    A Study of Ogino Family Collection “Presumed Hirao Seki (Shimoda Utako)’s handwritten karuta cards” (1) ―Reprinting of karuta cards and Shimoda’s childhood as seen through the karuta―

    Karuta cards written in 1869 by Hirao Seki (Shimoda Utako’s name before her marriage) were discovered in Iwamura, Ena City, Gifu Prefecture. The karuta cards were placed in a wooden box containing three different types of karuta. Most were made from poetry selected from the Manyoshu, while the others were made from poetry in Ise Monogatari and poetry of unknown origin. This article reprints these karuta cards and discusses Shimoda’s childhood through the karuta. Shimoda wrote that karuta was very popular in Iwamura during her childhood. She also wrote that she selected famous waka and kanshi and made several types of homemade waka and kanshi karuta to play with. She also wrote that playing karuta helped her learn waka and kanshi. This study assumes that she learnt poetry using these karuta cards, confirming her reminiscence. The karuta cards found have the first and second verses of poetry written on them: the first verse is written in black ink, and the second verse is written at the edge of the cards in vermilion ink. This is intentional, and it can be inferred how Shimoda and her friends played karuta: the player takes the cards of the second verse after listening to the first verse read by the reader, which requires combinations of the first and the second verses to be memorized. Shimoda’s rich knowledge and culture were acquired from her father’s teachings, and reading and playing karuta.     特許法における内在的同一の問題に関しては新規性欠如とする立場と新規性具備とする立場の両方の見解が対立していた。本稿は、新規性具備という結論を導くための立論が、引用発明の認定について本件発明の出願日における当業者の認識可能性を要求し事後的証拠を排除する当業者認識要求説と、クレームに記載されていない何らかの思想の相違を理由とする思想同一要求説の二つのアプローチに整理できること、さらには両者の関係を示した。他方、本稿はいずれの見解に対しても否定的であり、内在的同一の場面においては一律に新規性欠如という結論を妥当とする。また、裁判例には内在的同一の場合に新規性具備の結論を導いたものが散見されるところ、いずれも例外的な場面であり、パブリックドメインの浸食は生じていないと説明し得ることを見出した。Regarding the issue of inherent disclosure in patent law, there have been two conflicting views: that such disclosure causes lack of novelty, and that novelty is maintained despite such disclosure. This article categorizes the arguments for reaching the conclusion that novelty is maintained into two approaches: the "awareness requirement theory," which demands the recognition of the cited invention by a person skilled in the art as of the filing date of the present invention and excludes ex post facto evidence, and the "identical idea requirement theory," which concludes the maintenance of novelty by reason of some differences in ideas not described in the claims. Furthermore, this article clarifies the relationship between these two theories. Furthermore, this article clarifies the relationship between these two theories. On the other hand, this article takes a negative stance towards both views and concludes that in cases of inherent disclosure, a conclusion of lack of novelty is uniformly appropriate.     A study of meals served in Japanese inns during the Edo period based on a book of menus provided by Honjin Iwanami House in Shimosuwa

    To clarify the food culture during the Edo period, we reprinted part of a book of menus provided by Honjin Iwanami House in Shimosuwa (now a town in Nagano Prefecture) and then reproduced some of the meals in the book: [Day 1, 24th (arrival), Zouni] and [Day 4, 27th (evening), Honzen]. After reprinting some of the menus in the book and checking their historical backgrounds, we discovered that they were prepared for 18 members of the seventh survey party, which was led by Tadataka Ino, for their meals from November 1 to 4, 1809 (September 24 to 27 of the sixth year of the Bunka era in the Japanese calendar). As these meals were prepared to express the inn’s appreciation for the efforts of the surveying party, they were more luxurious than the inn’s usual menu at that time. By reproducing meals from the book, we demonstrated that they were mostly made from local natural ingredients and included various types of seafood, poultry, and crops. The customs of the period for preparing meals are the starting point of the circular diet this research aims for, so the book of menus provided by the Iwanami family will be a valuable resource for future community activities to revitalize community lives.下諏訪宿本陣に遺る「献立書」について翻刻を試み、江戸時代の食文化について検証することを目的とし一部を再現した。「献立書」は、翻刻および時代考証の検証により「献立書」は伊能忠敬第七次測量隊 18 名に用意されたものであり、1809 年(文化 6 年)9 月 24 日~ 27 日(新暦 11 月 1 日から 4 日)と判明した。測量隊一行の食事はその当時の旅籠の献立よりは特別な献立であり、測量隊一行をねぎらう食事として用意されたものであった。再現を通して、「献立書」から当時の多様な魚介類、鳥類、農作物などを用い地域の自然を生かしてきた食であった。そして、このような食生活は私たちが目指す循環型食生活の原点であり、今後の地域活動において、岩波家に遺る「献立書」は地域活性化の貴重な資源となるものと思われた。departmental bulletin pape

    下田歌子は、1889(明治32)年に実践女学校・女子工芸学校を創設した。 その著書『女子の修養』を平成生まれの中学・高等学校生徒にも理解しやすいように音楽劇を創り、学祖教育の一環として音楽劇の教育的効果を確認する。Utako Shimoda, a pioneering Japanese educator, established Jissen Women’s School and Women’s Craft School in 1899. Drawing inspiration from her book, Women’s Cultivation, we developed a musical designed to resonate with middle and high school students of the Heisei era.
