Get PDFWorld War I had a profound impact on the French countryside. The mass mobilization of men forced women to take full responsibility for running the farms, agricultural work, and family responsibilities. Despite this, their role has long been underestimated in historiography, which has focused mainly on the experiences of soldiers. The aim of this article is to analyse the literary representation of rural women in Ernest Pérochon’s novel Les Gardiennes, published in 1924 and one of the few books devoted to this subject. Drawing on historical works on World War I and on the situation of peasants in the early twentieth century, the article examines how literary fiction contributes to the formation of collective memory. It also shows that Pérochon’s novel, by offering a rare and multi-dimensional account of the everyday lives of French peasant women during the war, contributes to their better recognition in the history of the conflict.I wojna światowa wywarła głęboki wpływ na francuską wieś. Masowa mobilizacja mężczyzn zmusiła kobiety do przejęcia pełnej odpowiedzialności za prowadzenie gospodarstw, pracę w rolnictwie oraz obowiązki rodzinne. Mimo to ich rola przez długi czas pozostawała niedoceniana w historiografii, która koncentrowała się głównie na doświadczeniach żołnierzy. Celem niniejszego artykułu jest analiza literackiego obrazu kobiet wiejskich w powieści Les Gardiennes Ernesta Pérochona, wydanej w 1924 r. i będącej jedną z nielicznych książek poświęconych temu zagadnieniu. W oparciu o prace historyczne dotyczące I wojny światowej oraz sytuacji chłopów na początku XX w. artykuł bada, w jaki sposób fikcja literacka przyczynia się do kształtowania pamięci zbiorowej. Ukazuje również, że powieść Pérochona, oferując rzadkie i wielowymiarowe świadectwo codziennego życia francuskich chłopek w czasie wojny, przyczynia się do ich lepszego uwzględnienia w historii konfliktu

No full textIntroduction: Contemporary education operates in a complex socio-cultural, technological, and migratory reality that challenges previous models of knowledge transmission and classroom relationships. In response to these challenges, concepts that facilitate inclusive, dialogical, and critical approaches to education are being increasingly adopted. One such proposal is the theory of the Third Space by Bhabha (1994).Research Aim: This article aims to analyse the potential and demonstrate applicability of the Third Space concept in various areas of education, including intercultural, migration, language, inclusion, community, and teacher education. The author intends to identify the conditions under which the Third Space becomes an arena for educational and social transformation.Evidence-based Facts: The results of the research on the application of the Third Space theory to educational practices show its potential to break down hegemonic structures and to build an educational community in different domains: integrating students' school academic knowledge with their home knowledge for the development of differentiated competences, negotiating cultural identities and bridging linguistic and institutional barriers, or using one's own experiences as an educational resource. Its application in teacher education fosters democratisation of relationships by dispersing hierarchies and holding workshops simultaneously in universities and schools.Summary: Bhabha's (1994) concept of the Third Space is an analytical and practical tool that offers significant possibilities for transforming specific educational practices and the quality of their participants' relationships. It also makes it possible to redefine student and teacher roles, supports development of intercultural, communicative, and critical competences, and creates conditions for inclusive, emancipatory, and transformative education. The article presents a theoretical framework and practical solutions for designing dialogical learning environments in contemporary schools, without rejecting previous solutions, but rather enriching and developing them to create new qualities relevant to current needs.Wprowadzenie: Współczesna edukacja funkcjonuje w realiach złożonych przemian społeczno-kulturowych, technologicznych i migracyjnych, które podważają dotychczasowe modele przekazu wiedzy i relacji w klasie. W odpowiedzi na te wyzwania coraz częściej sięga się po koncepcje umożliwiające inkluzyjne, dialogiczne i krytyczne podejścia do edukacji. Jedną z takich propozycji jest teoria Trzeciej Przestrzeni autorstwa Homi’ego K. Bhabhy (1994).Cel badań: Celem artykułu jest analiza potencjału i ukazanie aplikacyjnych możliwości koncepcji Trzeciej Przestrzeni w różnych obszarach edukacji: międzykulturowej, migracyjnej, językowej, inkluzyjnej, środowiskowej a także w kształceniu nauczycieli. Autorka zmierza do identyfikacji warunków, w jakich Trzecia Przestrzeń staje się areną transformacji edukacyjnej i społecznej.Stan wiedzy: Wyniki badań aplikowania teorii Trzeciej Przestrzeni do praktyk edukacyjnych ukazują jej potencjał do przełamywania hegemonicznych struktur oraz budowania wspólnoty edukacyjnej w różnych obszarach: integrowania szkolnej wiedzy akademickiej uczniów z ich wiedzą domową dla rozwijania zróżnicowanych kompetencji, negocjowania tożsamości kulturowych i niwelowania barier językowych oraz instytucjonalnych, czy wykorzystywania własnych doświadczeń jako zasobów edukacyjnych. No full textDer Beitrag enthält das Abstract ausschließlich in englischer Sprache.Pepa San Martín's 2016 feature-length film debut Rara (Weird), is based on the true story of the Chilean Judge Karen Atala, who in 2004 lost custody of her three daughters because of her sexual orientation. Rather than centring its plot on the legal matters of the case, San Martín’s proposal concentrates on the worldview of one of the daughters, Sara, a 12-year-old girl who becomes tacitly aware of being different to the "norm" because of living with her mother and her partner. But the film’s title also alludes to the family formed by Sara’s father and his new wife, which is governed by a bourgeois and corseted order. Rara is a film about free women who are, however, unprotected by the law. This study focuses on the questioning of the normative family that the film poses and attempts to respond to this condition of "weirdness" experienced by Sara, whose particular view forms the central axis of the narrative.L'article contient uniquement le résumé en anglais

Get PDFThis article is based on a real case of intervention between a social educator and a child in second childhood. It focuses on developing professional helping relationships with children, thus, reflecting on the particularities of the request, the praxis, and the role of each actor. Since it is one of the possibilities of psychosocial intervention, the helping relationship is based on a relational experience in which the professional becomes a facilitator of the child’s development, in a close and safe friendly atmosphere. The relational meeting requires the professional to have qualities, such as authenticity, empathy, respect, and unconditional acceptance of the other, be it the child or his carers. This article aims to reflect on the implications of the practice of helping relationships in child interventions and contribute to a better understanding of the importance of these relationships throughout each child’s change and empowerment process.Artykuł opiera się na prawdziwym przypadku interwencji między pedagogiem społecznym a dzieckiem w drugim dzieciństwie. Koncentruje się na rozwoju profesjonalnych relacji pomocowych z dziećmi, odzwierciedlając w ten sposób specyfikę prośby, praktyki i roli każdego z aktorów. Ponieważ jest to jedna z możliwości interwencji psychospołecznej, relacja pomocowa opiera się na doświadczeniu relacyjnym, w którym profesjonalista staje się facylitatorem rozwoju dziecka, w bliskiej i bezpiecznej przyjaznej atmosferze. Spotkanie relacyjne wymaga od profesjonalisty posiadania takich cech, jak autentyczność, empatia, szacunek i bezwarunkowa akceptacja drugiej osoby, czy to dziecka, czy jego opiekunów. Get PDFThe amendment to the Election Code introduced before the start of the 2018–2024 local government term, which excluded the possibility of persons holding executive authority positions from seeking election for a third term in a given municipality, led to a heated discussion of both the advisability of its introduction and the constitutionality of the new regulation. It has been alleged by a wide range of people, primarily by constitutionalists and members of the local government, that the principle of two-term tenure of office for mayors and heads of municipalities deprives some citizens of the passive suffrage guaranteed by the Constitution of the Republic of Poland. The compliance of the new regulations with other fundamental principles of the state system, as well as with provisions stemming from major international documents, is equally questionable. The article, based on the necessary analysis of legal provisions, with the application of the functional method supported by the formal-dogmatic and historical method, attempts to answer the questions concerning both the constitutionality of the regulations on the two-term limit for heads of municipalities and the purposefulness of such a law in consideration of the premises of the administrative reform carried out in 1990. The author, as a result of the analysis, advocates the implementation of legislative changes aimed at ensuring the independence of local government from the political will of central legislative authorities, as well as the continuation of the civil society development.Wprowadzona przed rozpoczęciem kadencji samorządu 2018–2024 nowelizacja Kodeksu wyborczego, która wyłączyła możliwość ubiegania się osób pełniących funkcje organów wykonawczych w gminach o wybór na trzecią kadencję w danej gminie, pociągnęła za sobą ożywioną dyskusję zarówno w przedmiocie celowości jej wprowadzenia, jak i zgodności nowej regulacji z Konstytucją RP. Szerokie grono przede wszystkim konstytucjonalistów i samorządowców podnosi, że dwukadencyjność wójtów, burmistrzów i prezydentów miast odbiera części obywateli zagwarantowane Konstytucją bierne prawo wyborcze. Wątpliwości budzi również zgodność nowych przepisów z innymi naczelnymi zasadami ustroju państwa, a także z regulacjami wynikającymi z najważniejszych dokumentów międzynarodowych. W artykule, opierając się na koniecznej w tym wypadku analizie przepisów prawa przy zastosowaniu metody funkcjonalnej wspartej metodą dogmatyczną i historyczną, podjęto próbę odpowiedzi na pytania zarówno o zgodność przepisów regulujących dwukadencyjność wójtów z Konstytucją, jak i o celowość takiej regulacji z uwagi na założenia reformy administracyjnej przeprowadzonej w 1990 r. Get PDF The extraction of heat energy through ground source heat pumps (GPCs), powered by natural energy, is an environmentally friendly alternative to traditional energy sources and provides an effi cient source of sustainable heating, cooling and seasonal thermal energy storage and recovery. This study attempts to analyse the problems of legal qualifi cation of geothermal equipment. Bearing in mind the investment process and the subsequent use of geothermal energy sources, such as heat and cooling storage, energy foundations or reservoirs (near-surface and subsurface), it becomes extremely important to answer the question of the legal nature of the indicated devices. In particular, to clarify whether they fall within the concept of real estate expressed in Article 46 § 1 of the Act of 23 April 1964. – Civil Code, or whether they are construction objects within the meaning of Article 3(1) of the Act of 7 July 1994 – Construction Law. It should be emphasised that whether a given device will be qualifi ed as real estate, a construction object, or whether it will not have such a legal status, will determine both the decision as to the implementation of the investment (the issue of permits, investment costs, the time needed for the implementation of the investment) and the subsequent use of the device (the issue of tax charges on both the device itself and the energy generated with it).Pozyskiwanie energii cieplnej za pomocą gruntowych pomp ciepła (GPC), zasilanych energią naturalną, stanowi przyjazną dla środowiska alternatywę dla tradycyjnych źródeł energii i zapewnia wydajne źródło zrównoważonego ogrzewania, chłodzenia oraz sezonowego magazynowania i odzyskiwania energii cieplnej. Niniejsze opracowanie to próba analizy problemów kwalifi kacji prawnej urządzeń geotermalnych. Mając na uwadze proces inwestycyjny oraz późniejsze wykorzystanie źródeł energii geotermalnej, takich jak magazyny ciepła i chłodu, fundamenty energetyczne czy zbiorniki (przypowierzchniowe i podpowierzchniowe), niezwykle istotna staje się odpowiedź na pytanie o charakter prawny wskazanych urządzeń. W szczególności wyjaśnienie, czy mieszczą się one w pojęciu nieruchomości wyrażonym w art. 46 § 1 ustawy z dnia 23 kwietnia 1964 roku – Kodeks cywilny, czy też są obiektami budowlanymi w rozumieniu art. 3 pkt 1 ustawy z dnia 7 lipca 1994 roku Prawo budowlane. Należy podkreślić, że to, czy dane urządzenie zostanie zakwalifi kowane jako nieruchomość, obiekt budowlany, czy też nie będzie miało takiego statusu prawnego, będzie determinowało zarówno decyzję co do realizacji inwestycji (kwestia pozwoleń, kosztów inwestycji, czasu potrzebnego na realizację inwestycji), jak i późniejszego korzystania z urządzenia (kwestia obciążeń podatkowych zarówno od samego urządzenia, jak i wytworzonej za jego pomocą energii)

No full textThe commented order raises an issue of the court fees, which is important from the perspective of the work methodology of an administrative judge. The Supreme Administrative Court, despite its refusal to adopt an abstract resolution, held that the Ombudsman for Small and Medium-Sized Entrepreneurs is obliged to pay court fees. The author of the order does not share this view. He argues that the SAC had no grounds for refusing to adopt a resolution since the conditions for its issuance had been met. Furthermore, the author indicates that the position of the Court is mistakenly, because its ignore the systemic and other types of arguments.Niniejsza glosa dotyka istotnej z perspektywy metodyki pracy sędziego administracyjnego problematyki kosztów sądowych. W glosowanym postanowieniu Naczelny Sąd Administracyjny mimo odmowy podjęcia uchwały abstrakcyjnej uznał, że na Rzeczniku Małych i Średnich Przedsiębiorców spoczywa obowiązek ponoszenia kosztów sądowych. Autor glosy nie podziela tego stanowiska. Wywodzi, że NSA nie miał podstaw do odmowy podjęcia uchwały, ponieważ zostały spełnione warunki umożliwiające jej wydanie. W glosie krytycznej ocenie podlega również stanowisko NSA, który odmawiając podjęcia uchwały abstrakcyjnej, uznał, że na Rzeczniku spoczywa obowiązek ponoszenia kosztów sądowych. Zdaniem autora glosy stanowisko to jest błędne, bowiem opiera się jedynie na zastosowaniu reguł wykładni językowej, całkowicie pomijając argumenty systemowe i celowościowe

Get PDFThe article presents the main results of a follow-up research on the administration and service provision system in the Porto Metropolitan Area. The research group conducted an empirical study in Porto just before the outbreak of the COVID-19 pandemic. The impact of the polycrisis, which started in 2020, is analysed in this paper. The regulatory and organisational framework has not been significantly transformed as the result of the multiple crises and shocks, but the practice, and especially the planning activities in the field of the services of general economic interest, have become more concentrated. The cooperation in the field of the services of general interests (human services) has remained relatively limited. Thus, the polycrisis is not just a temporary “excited state”, but it has permanent impact on these systems.W artykule przedstawiono główne wyniki kolejnych badań dotyczących administracji i systemu świadczenia usług w Obszarze Metropolitalnym Porto (AMP). Grupa badawcza przeprowadziła badania empiryczne w Porto tuż przed wybuchem pandemii COVID-19. Analizie poddano wpływ polikryzysu rozpoczętego w 2020 r. Ramy regulacyjne i organizacyjne nie zostały znacząco zmienione w wyniku wielu kryzysów i wstrząsów, ale praktyka, a zwłaszcza działania planistyczne w dziedzinie usług świadczonych w ogólnym interesie gospodarczym, stała się bardziej skoncentrowana. Współpraca w dziedzinie usług świadczonych w interesie ogólnym (usługi dla ludności) pozostała stosunkowo ograniczona. Polikryzys nie jest zatem tylko tymczasowym „stanem podwyższonego napięcia”, tylko ma trwały wpływ na te systemy
Perspectives of the Influence of the Listed Companies' Financial Indicators on a Share Price to Sales Revenues Ratio during the Wave III, V and VII of the SARS-CoV-2 Pandemic in Poland
Get PDFTheoretical background: Market indicators are considered to be one of the most important groups of financial metrics used by investors when valuing shares. Among the quotients describing the environment of the listed entities, a security's Price-to-Sales ratio deserves a special attention. Its pattern allows the company's price to be measured in relation to quarterly/annual revenues, not profits. Thus, the C/P ratio indicates the extent to which a given company is underestimated or overestimated by the market in comparison to sales achieved.Purpose of the article: This paper focuses on constructing a model of potential exogenous variables from financial analysis determining the dynamics of changes in the C/Ps of the public companies. Measuring enterprise's value was conducted on a sample of 172 entities listed at the Warsaw Stock Exchange during three phases of the SARS-CoV-2 pandemic, covering its financial statements as per the first quarter of 2021-2023.Research methods: In the example below statistical tools such as linear correlation matrices and multiple regression functions were applied within a given time horizon. Due to the failure to meet the assumptions for random components variances' homogeneity of the individual objects series a generalized least squares (GLS) method was used, comparing the obtained outcomes with its classical counterpart. The statistical significance of the parameters in each equation was verified by means of the Student's t-test at the significance level α = 0.05.Main findings: The study confirmed statistically significant relationships in fluctuations between the C/P ratios and selected financial indicators during waves III and V of the COVID-19 pandemic (the adjusted R2^ coefficients in the generalized regression formulae equalled to 0.92 and 0.89, respectively). In both cases, C/P fluctuations were positively influenced by changes in the debts level, in the sense of the Financial Sustainability Ratio (FSR). On the contrary, negative impacts of C/Ps in the area of profitability, i.e. on Operating Margin (OM) indices and ROS ratios were noticed. Alternatively, the dynamics of the company's value could be described to a limited extent by financial indicators during the wave VII of the COVID-19 diffusion (adjusted R2^ = 0.62), with its maximum traditionally recorded by ROS and FSR ratios. The transformation of the residuals matrices towards the generalized least squares method resulted in decreases in standard errors of coefficients building estimation intervals around the mean
