Politik Hukum Pemerintah Indonesia Bidang Lingkungan Hidup Pasca Berlakunya Undang-Undang Nomor 6 Tahun 2023 Tentang Penetapan Peraturan Pemerintah Pengganti Undang-Undang Nomor 2 Tahun 2022 Tentang Cipta Kerja Menjadi Undang-Undang
The Indonesian government\u27s legal policy in the environmental sector has been regulated in Article 28H paragraph (1) and Article 33 paragraph (4) of the 1945 Constitution of the Republic of Indonesia, namely regarding the right to a good and healthy environment as a human right and the implementation of the national economy based on the principles of sustainable and environmentally sound development. To increase investment and make it easier to obtain environmental approval, the Government made changes to regulations regarding the environment which were previously regulated by Law Number 32 of 2009 concerning Environmental Protection and Management. The problems discussed in this study are how the shift in legal politics in the environmental sector after the enactment of Law Number 6 of 2023 concerning the Stipulation of Government Regulations in Lieu of Law Number 2 of 2022 concerning Job Creation into Law, how changes in environmental regulations after the enactment of Law Number 6 of 2023 concerning the Stipulation of Government Regulations in Lieu of Law Number 2 of 2022 concerning Job Creation into Law, how is the settlement of environmental disputes through filing an administrative lawsuit at the State Administrative Court after the enactment of Law Number 6 of 2023 concerning the Stipulation of Government Regulations in Lieu of Law Number 2 of 2022 concerning Job Creation into Law.
This research uses normative legal research methods by examining library materials and the type of research used in this research is an inventory of positive law. The results of this study indicate that the government\u27s legal politics in the environmental sector has shifted after the enactment of Law Number 6 of 2023 concerning the Stipulation of Government Regulation in Lieu of Law Number 2 of 2022 concerning Job Creation into Law because of the ease of obtaining environmental approval and increasing investment, not in accordance with the legal politics of environmental management and protection stipulated in Article 28 H paragraph (1) and Article 33 paragraph (4) of the 1945 Constitution of the Republic of Indonesia and the environmental development agenda which is a national priority agenda in the 2020-2024 National Medium-Term Development Plan.The ease of obtaining environmental approval can be seen from the loss of public participation in the AMDAL document, the change of environmental permits to environmental approval, the withdrawal of the authority of the Regional Government to the authority of the Central Government, the revocation of the provisions of the article regarding absolute liability without the need to prove the element of fault (stict liability), the revocation of the provisions of the article regarding the cancellation of environmental permits through court decisions, the revocation of the provisions of the article regarding the right to administrative lawsuits in environmental disputes in the State Administrative Court, and the change of articles regarding environmental crimes from formal crimes to material crimes. The settlement of environmental disputes through administrative lawsuits at the State Administrative Court after the enactment of Law Number 6 of 2023 concerning the Stipulation of Government Regulations in Lieu of Law Number 2 of 2022 concerning Job Creation into Law is Individuals, business entities incorporated or not incorporated, and / or Environmental Organizations whose interests have been and / or have the potential to be harmed by State Administrative Decisions and / or Government Administrative Actions can file a lawsuit at the State Administrative Court with the legal basis of the Supreme Court of the Republic of Indonesia Regulation Number 1 of 2023 concerning Guidelines for Adjudicating Environmental Cases.
Politik hukum pemerintah Indonesia bidang lingkungan hidup telah diatur dalam Pasal 28H ayat (1) dan Pasal 33 ayat (4) UUD NRI Tahun 1945 yaitu mengenai hak atas lingkungan hidup yang baik dan sehat sebagai hak asasi manusia serta penyelenggaraan perekonomian nasional berdasarkan atas prinsip pembangunan berkelanjutan dan berwawasan lingkungan hidup. Namun dalam rangka meningkatkan investasi dan memberikan kemudahan untuk memperoleh persetujuan lingkungan, Pemerintah melakukan perubahan regulasi mengenai lingkungan hidup yang sebelumnya diatur oleh Undang-Undang Nomor 32 Tahun 2009 Tentang Perlindungan dan Pengelolaan Lingkungan Hidup. Permasalahan yang dibahas dalam penelitian ini adalah bagaimana pergeseran politik hukum bidang lingkungan hidup pasca berlakunya Undang-Undang Nomor 6 Tahun 2023 Tentang Penetapan Peraturan Pemerintah Pengganti Undang-Undang Nomor 2 Tahun 2022 Tentang Cipta Kerja Menjadi Undang-Undang,Bagaimana perubahan regulasi mengenai lingkungan hidup pasca berlakunya Undang-Undang Nomor 6 Tahun 2023 Tentang Penetapan Peraturan Pemerintah Pengganti Undang-Undang Nomor 2 Tahun 2022 Tentang Cipta Kerja Menjadi Undang-Undang, Bagaimana penyelesaian sengketa lingkungan hidup melalui pengajuan gugatan administratif di Pengadilan Tata Usaha Negara pasca berlakunya Undang-Undang Nomor 6 Tahun 2023 Tentang Penetapan Peraturan Pemerintah Pengganti Undang-Undang Nomor 2 Tahun 2022 Tentang Cipta Kerja Menjadi Undang-Undang?.
Penelitian ini menggunakan metode penelitian hukum hukum normatif dengan cara meneliti bahan pustaka dan tipe penelitian yang dipakai dalam penelitian ini adalah inventarisasi hukum positif. Hasil penelitian ini menunjukkan bahwa politik hukum pemerintah bidang lingkungan hidup mengalami pergeseran pasca berlakunya Undang-Undang Nomor 6 Tahun 2023 Tentang Penetapan Peraturan Pemerintah Pengganti Undang-Undang Nomor 2 Tahun 2022 Tentang Cipta Kerja menjadi Undang-Undang karena kemudahan untuk memperoleh persetujuan lingkungan dan meningkatkan investasi,tidak sesuai dengan politik hukum pengelolaan dan perlindungan lingkungan yang diatur dalam Pasal 28 H ayat (1) dan Pasal 33 ayat (4) UUD NRI Tahun 1945 serta agenda pembangunan lingkungan hidup yang menjadi agenda prioritas nasional dalam Rencana Pembangunan Jangka Menengah Nasional 2020-2024.Kemudahan untuk memperoleh persetujuan lingkungan terlihat dari hilangnya partisipasi publik dalam dokumen AMDAL, perubahan izin lingkungan menjadi persetujuan lingkungan, penarikan kewenangan Pemerintah Daerah menjadi kewenangan Pemerintah Pusat, dicabutnya ketentuan pasal mengenai pertanggungjawaban mutlak tanpa perlu pembuktian unsur kesalahan (stict liability),dicabutnya ketentuan pasal mengenai pembatalan izin lingkungan melalui keputusan pengadilan, dicabutnya ketentuan pasal mengenai hak gugat administratif sengketa lingkungan hidup di Pengadilan Tata Usaha Negara, serta perubahan pasal mengenai tindak pidana lingkungan hidup dari tindak pidana formil menjadi pidana materiil.Penyelesaian sengketa lingkungan hidup melalui gugatan administratif di Pengadilan Tata Usaha Negara pasca berlakunya Undang-Undang Nomor 6 Tahun 2023 Tentang Penetapan Peraturan Pemerintah Pengganti Undang-Undang Nomor 2 Tahun 2022 Tentang Cipta Kerja Menjadi Undang-Undang adalah Orang perseorangan, badan usaha yang berbadan hukum maupun yang tidak berbadan hukum, dan/ atau Organisasi Lingkungan Hidup yang kepentingannya telah dan/ atau berpotensi dirugikan oleh Keputusan Tata Usaha Negara dan/atau Tindakan Administrasi Pemerintahan dapat mengajukan gugatan di Pengadilan Tata Usaha Negara dengan dasar hukum Peraturan Mahkamah Agung Republik Indonesia Nomor 1 Tahun 2023 Tentang Pedoman Mengadili Perkara Lingkungan Hidup
Pengaruh Disiplin Kerja dan Pengawasan Terhadap Kinerja Pegawai di Kantor Badan Kepegawaian dan Pengembangan Sumber Daya Manusia Kabupaten Ngada, Provinsi Nusa Tenggara Timur
In organizing personnel services at the Office of the Ngada Regency Personnel and Human Resources Development Agency (BKPSDM), the main obstacle faced is the lack of application of work discipline and supervision within the Ngada Regency BKPSDM Office. The objectives of this writing include: to determine how much influence work discipline has on the performance of employees of the Ngada Regency BKPSDM office, to determine how much influence supervision has on the performance of employees of the Ngada Regency BKPSDM office, and to determine how much influence work discipline and supervision have on the performance of employees of the Ngada Regency BKPSDM office. This research was conducted at the Office of the Ngada Regency Personnel and Human Resources Development Agency (BKPSDM), with a population of 36 people using the census method, namely all the population was sampled. The independent variables in this study are work discipline and supervision while the dependent variable is employee performance. Measurement of variables in this study using a Likert scale and SKP BKPSDM Kab. Ngada employees. Data processing with a statistical approach of multiple regression analysis using SPSS 22. From the standard estimated for the variables of Work Discipline (X1), Supervision (X2), Employee Performance (Y), the structural equation can be made as follows Y = 368.232 + 0.544 + 2.224. the results of data analysis show that work discipline has a significant effect on employee performance within the BKPSDM of Ngada Regency with a coefficient of determination of 31.2%, Supervision has an effect of 37.1% on performance, and Work discipline and Supervision have an effect of 39% on performance and the rest is influenced by other factors not examined

The legal framework Election in Indonesia regulates the methods and campaign periods allowed for electoral participants. The election campaigns are supposed to end at the start of election campaign’s quiet period. However, due to the evolution of campaign methods, particularly through the internet, there are still instances where advertisements and social media content related to electoral participants, whether by the participants themselves or others, continue to be circulated. Therefore, standards for conducting election campaigns must be fairly regulated. This article discusses the intersection between freedom of expression and elction crime during the quiet period, examining the stipulations of the Indonesia Election Law. Research reveals that the current regulations are ambiguous, leading to ongoing debates in election law enforcement. Campaign activities during the quiet period contradict electoral laws and may result in penalties ranging from administrative to criminal sanctions
The Validity of Illegal Investments In The Digital Era On Positive Legal Arrangements In Indonesia
The rapid advancement of technology has transformed human behavior in numerous ways, including the widespread use of the internet, which has become an indispensable part of modern life. The internet has revolutionized various industries such as communication, trade, finance, education, and business, making it easier than ever for people to engage in online activities and even digital investments. Yet, unfortunately, many fraudulent investment opportunities have emerged, preying on unsuspecting victims and causing significant financial losses. As a result, the Indonesian government has taken measures to combat illegal investments and protect the public. Such practices are considered criminal offenses under the Criminal Code\u27s Article 378, which criminalizes deceitful and fraudulent schemes. Additionally, fundraising without proper authorization is punishable under Article 46 of Law Number 10 of 1998 jo. Law Number 7 of 1992 concerning Banking. Sharia-based investments without a business permit from Bank Indonesia can also face legal repercussions under Article 59 of Law No. 21 of 2008 concerning Sharia Banking. These regulations aim to safeguard individuals from illegal investment activities
Pelaksanaan Pendaftaran Tanah Barang Milik Daerah Pemerintah Kota Padang
Penelitian ini meneliti pendaftaran tanah sebagai barang milik daerah di Kota Padang, yang merupakan sumber pendapatan penting bagi pemerintah daerah. Pendaftaran ini didasarkan pada beberapa peraturan, termasuk Peraturan Pemerintah No. 6 Tahun 2006, Peraturan Menteri Dalam Negeri No. 17 Tahun 2007, dan Peraturan Wali Kota Padang No. 10 Tahun 2017. Penelitian ini bertujuan untuk mengetahui pengaturan, pelaksanaan, dan akibat hukum dari tidak dilakukannya pendaftaran tanah milik daerah di Kantor Pertanahan Kota Padang. Pendekatan yang digunakan adalah yuridis normatif dan empiris, dengan fokus pada hukum dan pelaksanaan di lapangan. Hasil penelitian menunjukkan bahwa pendaftaran tanah belum sepenuhnya dilakukan dan terdapat hambatan seperti masalah administrasi, kurangnya koordinasi, dan keterbatasan sumber daya manusia. Administrasi yang baik dan peningkatan kualitas sumber daya manusia diperlukan untuk menyelesaikan masalah ini
Penyelesaian Sengketa Tanah oleh Lembaga Adat di Lembang Kaero Kecamatan Sangalla
Persoalan mengenai sengketa masih terjadi sampai sekarang secara umum penyelesaian sengketa tanah dapat diselesaikan melalui dua cara yakni pertama melalui jalur litigasi atau melalui pengadilan. Sedangkan yang kedua yakni melalui jalur non litigasi atau tanpa melalui pengadilan yang mengedepankan asas musyawarah dan mufakat dalam penyelesaiannya. Dalam masyarakat adat Lembang Kaero Kecamatan Sangalla’ dikenal adanya lembaga adat yang dijalankan untuk menyelesaikan permasalahan sengketa tanah di lingkup masyarakat Lembang Kaero. Menjadi hal yang menarik ialah mengenai prosedur penyelesaikan sengketa tanah oleh Lembaga adat yang tentunya berbeda dengan prosedur penyelesaian sengketa tanah di Pengadilan. Tujuan penelitian ini adalah untuk untuk mengetahui proses penyelesaian sengketa tanah oleh lembaga adat di Lembang Kaero Kecamatan Sangalla’. Metode penelitian yang penulis gunakan dalam penelitian ini adalah penelitian empiris. Hasil penelitian menunjukkan Penyelesaian sengketa tanah oleh Lembaga Adat di Lembang Kaero Kecamatan Sangalla’ dimulai dengan pengajuan gugatan ke Lembang Kaero, untuk selanjutnya dilakukan sidang adat dengan memberikan kesempatan yang sama bagi kedua belah pihak untuk mengajukan bukti-buktinya masing-masing, penyampaian putusan selanjutnya disampaikan oleh Hakim Adat Pendamai apabila putusan tersebut diterima oleh kedua belah pihak maka sengeketa tanah tersebut dinggap selesai namun apabila ada pihak yang merasa tidak puas atau keberatan maka bisa mengajukan upaya hukum ke tingkat Kecamatan Sangalla
Implementasi Pelayanan Administrasi Terpadu Kecamatan (Paten) di Kecamatan Genuk Kota Semarang
Sub-district Integrated Administrative Services (PATEN) is the organization of public services in the sub-district from the application stage to the document issuance stage in one place, one of the sub-districts in Semarang City that implements the PATEN policy is Genuk Sub-district. The purpose of this study is to find out the implementation of PATEN and identify obstacles and efforts in the implementation of PATEN in Genuk Sub-district. The research method used is empirical juridical with the research specification used is descriptive analytical. The results show that the implementation of PATEN policy in Genuk Sub-district is in accordance with Article 5 of the Minister of Home Affairs Regulation Number 4 of 2010 concerning PATEN Guidelines regarding the requirements for organizing PATEN, namely substance, administration, and technical requirements. In addition, the implementation of PATEN policy in Genuk Sub-district is in accordance with the principles of PATEN implementation stated in Semarang Mayor Regulation Number 43 of 2012 on PATENT Standards in Semarang City, which includes simplicity, clarity and certainty, accuracy, security and convenience, and is supported by factors that influence the success of policy implementation which include: communication, resources, disposition and bureaucratic structure. The obstacles in the implementation of PATEN policy in Genuk Sub-district are internal constraints, namely the lack of human resources, namely employees/staff in the field of public services, while external constraints are the lack of public awareness in seeking information about filing, and the difficulty of road access to Genuk Sub-district due to frequent flooding. Efforts made to overcome obstacles are the existence of internship programs, socialization, and pumping floods with water pumps.Pelayanan Administrasi Terpadu Kecamatan (PATEN) adalah penyelenggaraan pelayanan publik di kecamatan dari tahap permohonan sampai tahap terbitnya dokumen dalam satu tempat, salah satu kecamatan yang ada di Kota Semarang yang menerapkan kebijakan PATEN adalah Kecamatan Genuk. Tujuan penelitian ini adalah untuk mengetahui implementasi PATEN dan mengidentifikasi kendala serta upaya dalam pelaksanaan PATEN di Kecamatan Genuk. Metode penelitian yang digunakan adalah yuridis empiris dengan spesifikasi penelelitian yang dipergunakan adalah deskriptif analitis. Hasil penelitian menunjukkan bahwa implementasi kebijakan PATEN di Kecamatan Genuk sudah sesuai dengan Pasal 5 Peraturan Menteri Dalam Negeri Nomor 4 Tahun 2010 tentang Pedoman PATEN mengenai persyaratan untuk meyelenggarakan PATEN yaitu syarat substansi, administrasi, dan teknis. Selain itu, implementasi kebijakan PATEN di Kecamatan Genuk sudah sesuai dengan prinsip-prinsip penyelenggaraan PATEN yang tercantum dalam Peraturan Walikota Semarang Nomor 43 Tahun 2012 tentang Standar PATEN di Kota Semarang yaitu meliputi kesederhanaan, kejelasan dan kepastian, akurasi, keamanan dan kenyamanan, serta di dukung dengan faktor-faktor yang mempengaruhi keberhasilan implementasi kebijakan yang meliputi: komunikasi, sumber daya, disposisi dan struktur birokrasi. Kendala dalam implementasi kebijakan PATEN di Kecamatan Genuk yaitu Kendala internal adalah kurangnya sumber daya manusia yaitu pegawai/staff di bidang pelayanan publik, sedangkan kendala eksternal adalah kurangnya kesadaran masyarakat dalam mencari informasi mengenai pemberkasan, dan susahnya akses jalan ke Kecamatan Genuk dikarenakan seringnya terjadinya banjir. Upaya yang dilakukan untuk mengatasi kendala adalah dengan adanya program magang, sosialisasi, dan memompa banjir dengan pompa air

Government Regulation Number 42 of 2007 concerning Franchising (PP 42/2007), requires that the Franchisor must register the Franchise prospectus which is followed up with the registration of the Franchise Agreement by the Franchisee. Failure to register the Franchise Agreement results in the agreement being null and void because the Franchise Agreement is included in the form of a Formal Agreement. Void and void means returning the parties to their original state when the agreement had not yet been formed. However, if the Franchisee suffers a loss, he can sue the Franchisor for compensation on the basis of an Unlawful Act. The Franchisee will not experience such losses if the Franchisor registers its franchise prospectus. This study uses a normative legal research method with a qualitative approach
Membangun Transportasi Udara Era 5.0 di Indonesia: Perspektif Hukum dan Kebijakan
Society 5.0 was initiated by Japan, and inaugurated on January 21, 2019, made as a resolution to the Industrial Revolution 4.0, using modern-based science (Artificial Intelligence, Robots, Internet of Things) for human needs with the aim that humans can live comfortably, including in air transportation, initially focusing on human factors (pilots) began to shift the emphasis to the development of aviation technology. Therefore, it is interesting and necessary to examine how the readiness of laws and policies to build air transportation in the 5.0 era in Indonesia. This research is normative legal research using a statute approach, conceptual approach, and comparative approach and uses secondary data obtained from primary and secondary legal sources related to laws and policies to build air transportation in the 5.0 era in Indonesia. The results show that the existing laws and policies for building air transportation in the 5.0 era in Indonesia are not ready. It is necessary to harmonize and synchronize laws and regulations and policies to build air transportation in the 5.0 era in Indonesia with global regulations and policies in the form of international agreements related to air transportation development in the 5.0 era in the world
Tanggung Jawab Notaris Atas Keterangan Palsu Dalam Akta Rapat Umum Pemegang Saham Luar Biasa
The authority of a notary is to make authentic deeds regarding all acts, agreements, and stipulations required by statutory regulations and/or desired by those interested to be stated in an authentic deed. A notary is obliged to guarantee the truth of the deeds they make; therefore, a notary must act honestly, fairly, and transparently in making an authentic deed. However, notaries often act carelessly and are not thorough in carrying out their duties and positions, which can lead to legal problems in both the legal and criminal realms. The issues discussed below concern the responsibilities of a notary who includes false information in making a deed for an extraordinary general meeting of shareholders and the legal consequences of a notarial deed that includes false information. The type of research used to address this problem is normative legal research, descriptive in nature. The data used is secondary data analyzed qualitatively, and the method of drawing conclusions uses deductive logic. Based on the research results, a notarial deed containing elements of a criminal act can render the notary criminally liable under Article 55 and Article 56 of the Criminal Code due to negligence in falsifying documents. This can result in the notarial deed being annulled or nullified by law.
