Alasan Yang Meringankan Penjatuhan Pidana dan Dampaknya Bagi Masyarakat: Contoh Putusan Mahkamah Agung Nomor 239 K/Pid.Sus/2020
Di negara hukum seperti Indonesia, menaati aturan dalam bertindak di masyarakat adalah sebuah kewajiban. Namun tindakan yang tidak sesuai seringkali dilakukan oleh pihak-pihak yang tidak bertanggung jawab, terutama dalam konteks penyalahgunaan narkoba. Teknologi yang semakin canggih juga memperbesar peluang terjadinya kejahatan tersebut. Untuk mengatasi hal tersebut, Indonesia telah membentuk sistem peradilan pidana dengan memberikan sanksi kepada pelaku tindak pidana. Namun proses peradilan tidak selalu menghasilkan penjatuhan pidana yang sebanding dengan perbuatan yang dilakukan. Penelitian ini menggunakan metode penelitian hukum normatif untuk menganalisis alasan-alasan meringankan hukuman pidana dan dampaknya terhadap masyarakat. Diuraikan kasus tindak pidana narkotika, di mana tersangka mendapat pengurangan hukuman dari 10 tahun menjadi 8 tahun setelah melalui proses banding dan kasasi. Alasan meringankan pidana antara lain pertimbangan hakim terhadap berbagai faktor, seperti upaya terdakwa untuk mengurangi berat ringannya perbuatannya atau keadaan pribadi tertentu, meskipun hal ini diharapkan dapat menciptakan keadilan, namun tidak dapat dipungkiri bahwa hal tersebut mempunyai dampak. efek negatif. Konsekuensi ini mencakup peningkatan kejahatan, ketidakadilan dalam sistem peradilan, berkurangnya efektivitas rehabilitasi, potensi ancaman terhadap keselamatan masyarakat, dan berkurangnya pencegahan kejahatan. In the practice of land acquisition for development in the public interest, affected land owners must be given appropriate compensation and fulfill the principles of justice. In the end, often providing compensation for these losses is not appropriate and fair. This research aims to reveal justice in providing compensation to land owners due to land acquisition for development in the public interest. This study is a normative legal study which has descriptive characteristics. Secondary data which includes primary, secondary and tertiary legal material was obtained through library study. After the data is collected, it is then studied using qualitative analysis techniques based on a statutory approach. The findings of this research show that providing compensation to land owners due to land acquisition for development in the public interest is often because justice is not met
Jaminan Terhadap Penyandang Disabilitas dalam Memperoleh Pekerjaan
Every Indonesian citizen has the right to work and live a life worthy of humanity. This includes persons with disabilities. However, in reality, there are still many people with disabilities who experience difficulties and even discrimination in obtaining employment. This research aims to determine guarantees for persons with disabilities in obtaining employment. The research method used is the descriptive normative legal research method. The data type used is secondary data sourced from primary legal materials, secondary legal materials, and tertiary legal materials. The secondary data is collected through a literature study. The data is analyzed using qualitative analysis techniques. The results of this research show that the Law on Persons with Disabilities is sufficient to regulate guarantees for persons with disabilities in obtaining employment, and various government regulations have even been issued which also regulate guarantees for persons with disabilities in obtaining employment as implementing regulations
Implementasi dan Efektivitas Pelaksanaan Undang-Undang Pengampunan Pajak Dan Program Pengungkapan Sukarela
The principle of taxation must fulfill the element of justice for all taxpayers including in the tax amnesty program. The elimination of taxes that should be owed and tax sanctions for taxpayers who participate in the tax amnesty program and the Voluntary Disclosure Program (PPS) is done by paying ransom. However, the small amount of ransom payment is allegedly not fulfilling the element of legal justice. The purpose of this study is to determine the implementation and effectiveness of the Tax Amnesty Law and PPS. The method used in this research is the normative juridical law study method, using a statutory approach in studying, examining and exploring the problems in this study. The conclusion is that the elimination of taxes that should be payable does not fulfill the principle of justice, while the exemption of tax sanctions has fulfilled the principle of justice. The implementation of the tax amnesty program is ineffective due to the insignificant tax revenue and compliance of tax return submission after tax amnesty and PPS, as well as the increase in tax ratio which tends to stagnate and even still below neighboring countries in ASEAN.
 
Analisis Yuridis Atas Jual Beli Buku Bajakan pada Marketplace
Dewasa ini dengan mudahnya akses pembelian buku bagi masyarakat selaku konsumen pada marketplace, banyak dimanfaatkan pihak tidak bertangungjawab untuk mencari keuntungan secara finansial dengan menjual buku-buku bajakan. Kegiatan pembajakan merupakan penggandaan ciptaan dan atau produk hak terkait secara tidak sah dan pendistribusian barang hasil penggandaan dimaksud secara luas untuk memperoleh keuntungan ekonomi. Masyarakat sebagai konsumen wajib menerapkan prinsip kehati-hatian, mengingat maraknya praktik jual beli buku bajakan pada sebuah marketplace. Diharapkan pula marketplace sebagai perantara antara penjual dan pembeli melaksanakan upaya preventif dan represif guna mengatasi praktek jual beli buku bajakan. Upaya nyata dari masyarakat selaku konsumen dan merketplace sebagai perantara penjual dan pembeli tersebut, merupakan perwujudan dan penghargaan atas karya intelektualitas terkait hak moral dan hak ekonomi bagi pencipta atau pemegang hak cipta.

Sistem Pemidanaan Tindak Pidana Narkotika dalam Perspektif Hukum Pidana Nasional
This research uses normative legal research methods with a focus on analyzing legal norms. This research aims to reveal the basic aspects of the formation of certain laws, by analyzing related laws using a statute approach. The sentencing system in Law Number 1 Year 2023 on the Criminal Code (National Criminal Code) presents significant changes, especially in special criminal offenses such as narcotics. The sentencing guidelines introduced in the National Criminal Code allow for broader considerations in imposing punishment, taking into account aspects of justice and humanity. The death penalty is regulated with leniency, giving judges a lot of consideration before making a decision. For drug offenders, the National Criminal Code provides rehabilitation sanctions, showing a more humane approach. Drug sentencing under the National Criminal Code reflects an integrative sentencing theory, which combines the principle of retribution with considerations of crime prevention and offender rehabilitation. This marks a change in the Indonesian criminal law system that prioritizes justice and humanity
Upaya Perlindungan Anak oleh Lembaga Perlindungan Anak Indonesia Terhadap Korban Pelecehan Seksual
This research analyzes the efforts of child protection agencies in Indonesia to protect victims of sexual abuse. By employing qualitative analysis methods on relevant data, the main conclusion of this study is that child protection agencies face several constraints that limit their effectiveness in providing adequate protection to victims of sexual abuse. These constraints include limited resources, lack of coordination among agencies, low public awareness, limited access to protection services, and inconsistent law enforcement. Close collaboration between the government, civil society organizations, and all elements of society is needed to address these constraints and enhance child protection in Indonesia, particularly in the context of sexual abuse victims

Purposes of the Research : This research aims to determine and analyze the legality of the inauguration of the Head of the State Government based on Ambon City Regional Regulation Number 10 of 2017 concerning the Appointment, Election, Inauguration and Dismissal of the Head of the State Government Methods of the Research : This writing uses normative research methods, with the problem approach used being the statutory approach, conceptual approach, historical approach and case approach. The sources of legal materials in this writing are primary, secondary and tertiary legal materials. The technique for collecting legal materials uses library research which is then analyzed qualitatively to answer the problems being studied.
