Permohonan Pemutusan Hubungan Kerja oleh Pekerja/Buruh Karena Dirumahkan Tanpa Upah Lebih dari Tiga Bulan (Analisis Putusan Nomor: 398/Pdt.Sus-PHI/2021/PN. JKT. PST): (Analysis Verdict Number : 398/Pdt.Sus-PHI/2021/PN. JKT. PST )
At the end of 2020, to be precise in November 2020, the government passed Law Number 11 of 2020 concerning Job Creation. Several months later, namely in February 2021, the government stipulated implementing regulations for Law Number 11 of 2020, namely Government Regulation Number 35 of 2020 concerning Specific Time Work Agreements, Outsourcing, Working Time and Rest Time, as well as Termination of Employment Relations. People infected by the COVID-19 outbreak continue to increase every day, and the number of deaths due to the COVID-19 outbreak continues to increase. The Central Government and Regional Governments have issued policies to prevent and overcome the spread of the COVID-19 outbreak, namely by implementing Large-Scale Social Restrictions (PSBB) and Implementing Community Activity Restrictions (PPKM). With the implementation of PSBB and PPKM by the government, several sectors, especially the accommodation provision sector, tourism businesses, food and beverage businesses, real estate, and construction experienced direct impacts as a result of the COVID-19 pandemic and the existence of PSBB and PPKM. The tourism sector, especially hotels, experienced a decline in income due to the lack of overnight guests, forcing entrepreneurs to lay off workers without providing wages to reduce expenses and save company finances. This thesis research analyzes the impact caused by laying off workers/laborers without being paid wages and legal considerations regarding the decision of the Industrial Relations Court at the Central Jakarta District Court with case number: 398/Pdt. Sus PHI/2021/PN. JKT. PST. The purpose of this decision analysis is to find out requests for termination of employment (PHK) by workers or employees due to being laid off for more than three months without wages based on Law Number 11 of 2020 concerning Job Creation.Pemerintah di penghujung tahun 2020 tepatnya pada bulan November 2020 mengesahkan Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja, beberapa bulan kemudian yaitu pada bulan Februari tahun 2021 Pemerintah menetapkan peraturan pelaksana dari Undang-Undang Nomor 11 Tahun 2020, yaitu Peraturan Pemerintah Nomor 35 Tahun 2021 tentang Perjanjian Kerja Waktu Tertentu, Pengalihdayaan, Waktu Kerja, dan Waktu Istirahat, serta Pemutusan Hubungan Kerja (Pemutusan Hubungan Kerja). Pada 11 Maret 2020, organisasi kesehatan dunia Organisasi Kesehatan Dunia (WHO) menyatakan COVID-
19 sebagai Pandemi Global, dan pada tanggal 13 April 2020, Pemerintah Indonesia menerbitkan Keputusan Presiden Republik Indonesia Nomor 12 Tahun 2020 tentang Penetapan Bencana Non alam Penyebaran Corona Virus Disease 2019 (COVID-19) sebagai Bencana Nasional. Orang yang terinfeksi wabah Covid-19 setiap harinya terus meningkat, serta jumlah kematian akibat wabah Covid-19 terus bertambah. Pemerintah Pusat dan Pemerintah Dareah mengeluarkan kebijakan untuk mencegah dan menanggulangi penyebaran wabah COVID-19, yaitu dengan menerapkan Pembatasan Sosial Berskala Besar (PSBB) dan Pemberlakuan Pembatasan Kegiatan Masyarakat (PPKM). Dengan adanya PSBB dan PPKM oleh Pemerintah, beberapa sektor terutama sektor penyediaan akomodasi, usaha pariwisata, usaha makanan dan minuman, real estate, dan konstruksi, mengalami dampak langsung sebagai dampak pandemi Covid-19 dan adanya PSBB dan PPKM. Sektor pariwisata khususnya hotel mengalami penurunan pendapatan akibat minimnya tamu yang menginap sehingga memaksa pengusaha untuk merumahkan pekerja/pekerjanya tanpa memberikan upah untuk mengurangi pengeluaran dan menghemat keuangan perusahaan. Penelitian tesis ini menganalisis dampak yang timbul akibat pekerja/buruh dirumahkan tanpa diberi upah dan pertimbangan hukum atas putusan Pengadilan Hubungan Industrial pada Pengadilan Negeri Jakarta Pusat dengan nomor perkara: 398/Pdt. Sus PHI/2021/PN. JKT. PST. Tujuan analisis keputusan ini adalah untuk mengetahui Permohonan Pemutusan Hubungan Kerja (PHK) oleh Pekerja/Pekerja karena dirumahkan lebih dari tiga bulan tanpa upah berdasarkan Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja
Penerapan Prinsip Non Diskriminasi dan Kesetaraan dalam Pengelolaan Perguruan Tinggi Swasta
Prinsip non diskriminasi wajib diterapkan oleh Perguruan Tinggi Swasta, tanpa memandang siapa pendiri atau pemiliknya atau agama, budaya dan/atau ras yang dianut atau dimiliki oleh pendiri Perguruan Tinggi Swasta itu. Penerapan prinsip non diskriminasi dan kesetaraan dalam pengelolaan Perguruan Tinggi Swasta dapat dilakukan melalui 2 (dua) hal, yakni kurikulum harus memuat pendidikan agama menurut keyakinan peserta didik, bukan keyakinan pendiri dan persyaratan seleksi, pemilihan dan pengangkatan pejabat di lingkungan Perguruan Tinggi Swasta tidak bersifat diskriminatif. Perguruan Tinggi Swasta yang tidak menerapkan prinsip non diskriminasi dan kesetaraan dapat mengakibatkan Perguruan Tinggi Swasta itu dikenakan sanksi administrasi dan perseorangan, organisasi dan penyelenggara Perguruan Tinggi Swasta dikenakan sanksi pidan
Polemik Mahkamah Kontitusi Terhadap Pertimbangan Open Legal Policy dalam Putusan Perkara Perpanjangan Masa Jabatan Pimpinan Komisi Pemberantasan Korupsi (KPK)
The importance of the Constitutional Court giving birth to decisions that contain substantial justice to what the community needs, one of which is to examine the law against the 1945 Constitution (UUD 1945). The authority of the Constitutional Court is actually allowed to go beyond what is stated in the law, only if the law confines the Constitutional Court judges in upholding justice such as Positive Legislature. In Decision Number 112/PUU-XX/2022, the Constitutional Court granted a judicial review request against Law Number 19 of 2019. One of the Court\u27s decisions was to grant a change in the term of office of the KPK leadership, which was originally 4 years to 5 years in one term. This decision is actually the domain of lawmaking institutions, the Constitutional Court\u27s view on open legal policy is part of a policy whose domain is outside of its competence in several specific articles in the law. Open legal policy actually needs to be given a limit by reflecting on its practice and foundation in several countries. This research uses a doctrinal research method which is a library legal research conducted by examining library materials or secondary data which is then supported by comparative studies of various countries. The results showed that the Constitutional Court should have rejected this case because it is an open legal policy that should be returned to the authority of the legislature. The Constitutional Court\u27s decision on the extension of the KPK\u27s term of office is controversial because it violates the principle of division of powers in state institutions. Its consideration was also not based on the urgent interests of citizens. Therefore, the author compares the practice with other countries, such as the United States, which overcomes the open legal policy gap with the use of the political questions doctrine, which provides clear boundaries to see a moment when the judiciary must take action with the orientation of restoring citizens\u27 rights, and when it must refrain according to the concept of separation of powers. However, other countries such as Poland, Ukraine and Hungary have used open legal policy as a tool to reduce political attacks on the constitutional judiciary
Upaya Tokoh Masyarakat Untuk Mencegah Perkawinan Anak Sebagai Bentuk Pendidikan Hukum
This research aims: To analyze the efforts of community leaders in preventing child marriage as a form of legal education in society. This research uses a form of qualitative research with a case study approach. Data sources were obtained from informants, places and events and documents. The main informants in this research are community figures, namely 1 religious leader and 1 marriage registrar. Supporting informants are children who carry out child marriages and parents of children who carry out child marriages. Data collection techniques include interviews with children who have child marriages, parents of children who have child marriages, community leaders (religious leaders and marriage registration officers), observations and documents. For data validity, source triangulation and technique triangulation were used. Meanwhile, the data analysis technique uses an interactive analysis model (Miles & Huberman 1984) which consists of data collection, data reduction, data presentation, and drawing conclusions. Based on the results of the research, it can be concluded that the efforts of community leaders to prevent child marriage as a form of legal education include religious leaders providing education regarding the science of marriage at majlis ta\u27lim events and at marriage ceremonies, Marriage Registrar Officers only provide outreach to the community who will be carrying out the marriage. namely just before the contract takes place
Pengaruh Model Problem Based Learning dalam Meningkatkan Hasil Belajar Siswa SMP Negeri 33 Kota Makassar Kelas IX
This research aims to determine the effect of problem-based learning on improving learning outcomes. This research uses a quantitative approach with a quasi-experimental design to evaluate the impact of implementing a problem-based learning model on Social Sciences (IPS) learning outcomes at SMPN 33 class IX UPT SMP Negeri 33 Makassar City. The research sample consisted of two groups. The sample was determined using purposive sampling, 30 experimental and 30 control class samples. Data was collected using tests. The control group received conventional learning, while the experimental group received learning with a problem-based learning model. Data is collected through test results. The hypothesis test results show a significant difference in the ability of Social Sciences learning outcomes between the two research groups. Confirms that the application of the problem-based learning model has a positive effect in improving social studies learning outcomes at the junior high school level
Analisis Hukum Yayasan Pendidikan Tinggi Sebagai Wajib Pajak Penghasilan
This research focuses on the Legal Analysis of Higher Education Foundations as Income Tax Subjects. The research method employed is normative juridical with a conceptual, theoretical, legislative, and case approach. The data used consists of secondary data in the form of primary and secondary legal materials. The research results indicate that Higher Education Foundations now have legal certainty as Taxable Entity subjects, with obligations to Withhold, Deposit, and Report (3M) Article 21 Income Tax under Law No. 36/2008 for activities falling under Article 21 Income Tax, Article 4 paragraph (1), such as salaries/wages of teachers, allowances, honorariums paid to employees or participants, and other parties. Income received or obtained from business activities, work, or services, deduction of registration fees for new students, student tuition fees, etc.; Article 4 paragraph (2) gains from the utilization of foundation assets, etc.; Article 23 Income Tax on architectural services for the construction of foundation education buildings. These amounts are then deposited at the post office or bank designated by the Minister of Finance. Furthermore, Taxpayers, Tax Withholders, and Tax Reporters, if found in violation of tax regulations, will face sanctions, including Administrative Sanctions under Article 7 Paragraph 1 of Law No. 6 of 1983 concerning General Provisions and Taxation Procedures (Tax Law) for failure to report Tax Returns, Article 9 Paragraph 1 and 2a Tax Law for late payment or deposit of taxes to the state treasury; Article 13 Paragraph 1 Tax Law for underpayment of taxes for 5 consecutive years. Criminal Sanctions will be applied according to Article 39 Paragraph (1) Tax Law for negligence of tax withholders in providing withholding or collection proof

Formation of a non-judicial resolution team for past serious human rights violations based on Presidential Decree Number 17 of 2022 whose task is to carry out non-judicial tasks to reveal cases of serious human rights violations and recommend concrete and dignified remedies for victims of serious human rights violations. Then. The question is, does the Non-Judicial Resolution Team for Past Serious Human Rights Violations have non-judicial authority in disclosing cases of past gross human rights violations
Kedudukan Hukum Akta Pengakuan Hutang yang Dibuat Dihadapan Notaris (Studi Kasus Perkara Mahkamah Agung Nomor: 2956/K/Pdt/2013)
A deed of acknowledgment of debt made by a notary authentically will be followed by a deed of acknowledgment of debt also authentically made by a notary. If the debtor is in default in carrying out his obligations to the creditor, based on the debt acknowledgment deed a grosse deed can be issued, which is the first copy which has the same force as a court decision which has permanent legal force. In this research, the formulation of the problem related to the legal protection of Land Deed Drafting Officials (PPAT) against acts of falsification of data on sale and purchase deeds by applicants, namely: 1. What is the legal position of the Deed of Debt Acknowledgment made before a Notary in Supreme Court case Number 2956 K/Pdt/2013 ? 2. What is the judge\u27s consideration in Supreme Court case Number 2956.K/PDT/2013 in relation to the Deed of Debt Acknowledgment made to the Notary? 3. What are the legal consequences of the decision of Supreme Court case Number 2956.K/Pdt/2013 on the Deed of Debt Acknowledgment made before a Notary? This research uses a juridical-normative approach. The research results obtained are: normative legal research, namely research. The results of the discussion of the problems that arise in this research are that the legal strength of a debt acknowledgment deed made by a notary with an authentic deed is perfect evidence for parties in the event of prosecution in court. Apart from that, the deed of acknowledgment of debt made by the notary is authentically legally binding in accordance with the law for the parties who make it so that it must be adhered to, complied with and implemented as well as possible and in good faith to achieve the smooth implementation of the debt. The legal consequence of making a debt acknowledgment deed made by a notary against the parties in the event of a trial in court is that the parties are bound by a debt payment agreement which they have acknowledged using an authentic notarial deed in the form of a debt acknowledgment deed. The basis for the legal considerations of the panel of judges in deciding the case of a lawsuit for cancellation of a debt acknowledgment deed made by a notary with an authentic deed in Supreme Court Decision No. 2956.K/PDT/2013 is that the cassation filed by Defendant I HH and Defendant II DH does not have strong reasons or does not have a strong legal basis to be submitted to the Supreme Court. However, the clause of the debt acknowledgment deed made by the notary containing the provisions for interest/late fines of 8% (eight percent) per month was canceled by the panel of judges and changed to 2% (two percent) per month because the interest provision was 8% (eight percent). per month, the legal provisions in force in the banking law require that the interest rate on a loan must not exceed 2% (two percent) per month.
Tinjauan Fiqh Siyasah Pada Pengisian Kekosongan Jabatan Kepala Daerah oleh Wakil Kepala Daerah
This research discusses the causes of vacancies in regional head positions by deputy regional heads in Indonesia and the urgency of filling them, especially if the remaining term of office is more than 18 months. Using descriptive qualitative methods and Law Number 10 of 2016 as primary legal material, the research found that legal uncertainty regarding the time limit for filling this position often hampers the replacement process. In regional government theory, the positions of regional heads and their deputies are very important and inseparable, considering their roles in regional management and leadership. From Dusturiyah\u27s siyasah review, the replacement of regional heads by their deputies is not only permitted but also mandatory, considering that both of them were elected together with the same vision and mission. The role of the deputy regional head is important for the benefit of the people, namely in providing considerations, input and carrying out the duties of the regional head, as well as the need to immediately fill this vacancy and emphasize the need for legal clarity to immediately fill the position.Penelitian ini membahas penyebab kekosongan jabatan kepala daerah oleh wakil kepala daerah di Indonesia dan urgensi pengisiannya, terutama jika sisa masa jabatan lebih dari 18 bulan. Menggunakan metode kualitatif deskriptif dan Undang-Undang Nomor 10 Tahun 2016 sebagai bahan hukum primer, penelitian menemukan bahwa ketidakjelasan hukum soal batas waktu pengisian jabatan ini sering menghambat proses penggantian. Dalam teori pemerintahan daerah, jabatan kepala daerah dan wakilnya sangat penting dan tidak terpisahkan, mengingat peran keduanya dalam pengelolaan dan kepemimpinan daerah. Dari Tinjauan siyasah Dusturiyah, penggantian kepala daerah oleh wakilnya tidak hanya diperbolehkan tapi juga diwajibkan, mengingat keduanya dipilih bersama dengan visi dan misi yang sema. Pentingnya peran wakil kepala daerah untuk kemaslahatan umat yaitu dalam memberi pertimbangan, masukan, dan menjalankan tugas dari kepala daerah, serta kebutuhan segera mengisi kekosongan jabatan ini dan menegaskan perlunya kejelasan hukum untuk segera pengisian jabatan
Implementasi Tindak Pidana Jual Beli Organ Ditinjau dari Frasa Kompensasi Donor yang Diperbolehkan Menurut Sistem Hukum di Indonesia
Organ transplantation is the transfer of all or part of an organ from one body to another, or from one part to another part of the same body. Organ donors can come from people who are still alive or have died. This research describes and examines the first problem, how the legal relationship between donors and recipients of donors in living organ transplants in providing compensation is allowed according to applicable law in Indonesia. This research is a descriptive doctrinal legal research. the sources used are primary legal materials consisting of legal products such as laws, and other relevant legal regulations related to organ transplants. The result of this research is that the legal relationship between the donor and the recipient of the donor is a natural engagement that occurs due to urgent needs in the process before the implementation of Organ Transplantation. The implementation of organ transplantation is carried out by prioritizing a sense of volunteerism in donating organs without asking for compensation so that the phrase from the word compensation in this case is the payment of handling costs during the donor\u27s treatment in the hospital both before, during and after surgery this is based on the Minister of Health Regulation Number 38 of 2009 concerning the Implementation of Organ Transplantation to complete and reaffirm organ transplantation is carried out voluntarily, within the scope of the hospital at all stage
