Pembagian Waris Anak Angkat dalam Hukum Adat Bali dan Implementasinya dalam Hukum Nasional (Putusan Pengadilan 204/K/Pdt/2021)
Terdapat beberapa aturan yang berlaku di Indonesia mengenai pengangkatan anak, diantaranya adalah hukum nasional Indonesia, hukum Islam, dan hukum adat. Pada hukum adat Bali, anak yang diangkat melalui upacara widi widana memiliki kedudukan yang sama dengan anak kandung, anak angkat tersebut berhak mendapatkan warisan. Penelitian ini menggunakan metode Hukum Empiris, metode Hukum Empris merupakan suatu metode penilitian hukum yang menggunakan fakta-fakta empiris yang diambil dari perilaku manusia, baik perilaku verbal yang didapat dari wawancara maupun perilaku nyata yang dilakukan melalui pengamatan langsung. Hasil penelitian ini menunjukan bahwa terdapat anak yang kehilangan haknya untuk mendapatkan warisan diantaranya adalah anak yang ninggal kedaton sehingga meninggalkan tanggung jawab karena kawin ke luar, diangkat anak, dianggap durhaka dan dipecat kedudukannya sebagai anak oleh orang tuanya (pegat mapianak), sengaja meninggalkan tanggung jawab keluarga dan masyarakat (ngutang kawitan) tanpa diketahui alamatnya (ngumbang), dan pindah agama
Law Enforcement of State Losses Through Civil Proceedings: Exploration of the Role and Analysis of Alternative Options in Corruption Cases
Corruption in Timor-Leste has become a chronic issue that harms the country\u27s finances and economy, as well as violates the social and economic rights of the people. Efforts to recover state financial losses due to corrupt practices through civil proceedings have not been optimal, with the focus being more on criminal prosecution, which has proven to be ineffective. This research aims to examine the concept of recovering state financial losses through civil processes in Timor-Leste, identify obstacles in filing civil lawsuits, and formulate an ideal model and specific regulations for civil lawsuits in the context of recovering the proceeds of corruption. The study uses a qualitative approach by examining relevant legal documents and analyzing the judicial process and financial management in Timor-Leste. The focus of this research is on the application of civil lawsuit rules in recovering the proceeds of corruption and the challenges faced. The results show that the use of civil forfeiture can be a solution to expedite the recovery of corrupt assets through civil proceedings. The research also found obstacles in civil lawsuits, such as the ineffectiveness of criminal prosecution in reducing corruption and the need for anti-corruption legal reforms to improve the mechanism for recovering corrupted state assets. The proposed ideal model includes strengthening the role of the administrative tax and accounts court in examining the management and financial responsibility of the state, as well as placing civil lawsuits as the primary legal effort in combating corruption. This research underscores the importance of legal reforms and the implementation of civil lawsuits as the main strategy in fighting corruption in Timor-Leste. The use of civil forfeiture and asset confiscation through administrative channels is necessary to expedite the recovery of corrupt assets and reduce state financial losses
Pengawasan Perdagangan Ilegal Terhadap Trenggiling oleh Balai Konservasi Sumber Daya Alam Sumatera Barat
The Natural Resources Conservation Agency (BKSDA) has one function, namely monitoring the illegal trade in wild animals, especially protected wild animals. The implementation of monitoring of illegal trade in protected wild animals by the West Sumatra BKSDA aims to protect protected wild animals from the danger of extinction and prevent trade in protected animals. However, the implementation of this function has not gone well, judging from temporary observation data showing that there is still a lot of trade in protected wild animals, especially pangolins. So, based on this, the author is interested in conducting research with the title Monitoring the Illegal Trade in Pangolins by the West Sumatra Natural Resources Conservation Agency (BKSDA)

In this modern era, the interest of Indonesian society, especially the younger generation, in music concerts is increasing. Many consumers prefer to purchase tickets online due to its convenience, but frequent concert ticket cancellations leave them disappointed and at a loss. The normative research method is used to analyze the relevant laws, with Article 1320 of the Indonesian Civil Code serving as a guide for online buying and selling agreements. Breach of contract often occurs in online concert ticket sales, leading to legal consequences under Article 1243 of the Indonesian Civil Code. Buyers have the right to demand contract fulfillment and compensation for losses due to the seller\u27s negligence
Tanggung Jawab Notaris Atas Keabsahan Akta Otentik Yang Memakai Surrogate Sebagai Pengganti Tanda Tangan
Notary is a public official who has the authority to make authentic deeds and has responsibility for the deed, an authentic deed made by and before a notary after being read out is then signed by the faces, witnesses, and notary. The problem arises when the confronter is unable to affix his signature due to either physical limitations, the confronter cannot read or write, or also the confronter has a signature that changes. For this problem, for those who cannot affix their signatures, the signatures can be replaced where at the end of the deed the notary provides a statement called a surrogate. This writing uses normative juridical research methods by conducting library research to obtain various legal materials and applicable laws and regulations. This writing aims to obtain the fact that notaries must be able to be responsible for the authentic deeds they make, whether it is affixed with signatures by the confronters or those who use surrogates as a substitute for signatures. It is hoped that through the use of surrogates in the deed, the confrontants will not experience differential treatment between one another so as to get the same sense of legal certainty and justice.Notaris adalah pejabat umum yang memiliki wewenang membuat akta otentik dan memiliki tanggung jawab atas akta tersebut, akta otentik yang dibuat oleh dan dihadapan notaris sesudah dibacakan selanjutnya ditandatangani oleh para penghadap, para saksi, dan notaris. Timbul persoalan ketika penghadap tidak mampu membubuhkan tandatangannya yang diakibatkan baik oleh keterbatasan fisik, penghadap tidak bisa membaca maupun menulis, atau juga penghadap memiliki tanda tangan yang berubah-ubah. Atas permasalahan ini bagi penghadap yang tidak bisa membubuhkan tanda tangannya maka tanda tangan penghadap tersebut bisa digantikan dimana pada bagian akhir akta maka notaris memberikan keterangan yang disebut sebagai surrogate. Penulisan ini menggunakan metode penelitian yuridis normatif dengan melakukan penelitian kepustakaan guna memperoleh berbagai bahan hukum serta peraturan perundang-undangan yang berlaku. Penulisan ini bertujuan untuk memperoleh fakta bahwa notaris harus bisa bertanggung jawab atas akta otentik yang dibuatnya baik itu yang dibubuhi tanda tangan oleh para penghadap maupun yang memakai surrogate sebagai pengganti tanda tangan. Diharapkan melalui penggunaan surrogate pada akta maka para penghadap tidak mengalami pembedaan perlakuan antara yang satu dengan yang lainnya sehingga mendapatkan rasa kepastian dan keadilan hukum yang sama
Analisis Yuridis Terjadinya Peristiwa Konflik Bersenjata Ukraina dan Rusia Ditinjau dari Perspektif Hukum Humaniter Internasional
Over the past half century, almost every country has been involved in armed conflicts either domestically or with other nations. One example is the escalating armed conflict between Ukraine and Russia, resulting in many civilian casualties and damaging public infrastructure, which is considered a violation of the provisions of international humanitarian law. This research was conducted using normative juridical methods by examining legal materials obtained through literature study. The findings of this research indicate that the Russian Armed Forces have committed various violations contrary to the principles of humanitarian law, such as the principles of military necessity, humanity, and proportionality. Violations of these principles may include disproportionate attacks, targeting civilians, excessive use of force, and restrictions on humanitarian assistance. Resolving this conflict requires a comprehensive approach and the commitment of all parties involved, such as urging Russia and Ukraine to fulfill their obligations as UN members by respecting applicable international humanitarian law provisions under the principle of pacta sunt servanda, mediating through diplomatic channels, imposing sanctions by the UN against both countries for violations of international humanitarian law as accountability for the attacks committed, and urging the UN Security Council to issue a resolution to immediately cease the hostilities
Penyelesaian Perkara Penghinaan Kepada Suku Melayu Menurut Hukum Adat Melayu Riau Kota Dumai
In contrast to positive law, customary law does not recognize the distinction between criminal law and civil law. The settlement of cases in the community is carried out by means according to customary law. One of the cases resolved according to Riau Malay customary law was a case of insulting the Malay tribe in Dumai City. Using empirical juridical research methods, based on the results of the study, it was found that the settlement of cases of insults to the Malays was carried out by deliberation and sanctions ranging from light to severe sanctions, namely making yellow rice, slaughtering animals in the form of chickens, goats and buffaloes and disposing of the country which was divided into two, namely disposing of the country within a specified time and disposing of the country that was not determined
Pertimbangan Hukum Hakim Mengenai Kompetensi Absolut Peradilan Tata Usaha Negara Dalam Menyelesaikan Permohonan Fiktif Positif Pada Putusan No. 3/P/FP/2020/PTUN.MKS
This research analyzes the Makassar State Administrative Court Decision No. 3/P/FP/2020/PTUN.MKS which will discuss the object of the petition regarding the positive fictitious decision of the Respondent who did not respond to the Petitioner\u27s letter regarding IUPSWA. This application was registered on December 16, 2020 and decided on January 25, 2021 after the enactment of Law No. 11 of 2020 on Job Creation. Although the Law came into force on November 2, 2020, the decision did not consider the provisions of Article 175 Number 6 of Law No. 11 of 2020. In this case, the Panel of Judges relied more on Article 53 of Law No. 30 of 2014 on Government Administration, without taking into account the changes brought about by Article 175 Point 6 of Law No. 11 of 2020. The petitioner succeeded in filing the petition in its entirety, as the Panel of Judges was of the opinion that the Administrative Court was still authorized to handle cases of positive fictitious petitions. The reference basis for the absolute competence of the PTUN used by the Panel of Judges in adjudicating the application is based on the provisions of Article 53 of Law No. 30 of 2014 to Obtain a Decision on the Receipt of an Application to obtain a Decision and/or Action of a Government Agency or Official
Tanggung Jawab Notaris Akan Perjanjian (Akta) Pinjam Nama (Nominee) Warga Negara Asing Dalam Kepemilikan Tanah Dan Bangunan
A nominee agreement made by a notary is actually a form of legal smuggling, which is used for the benefit of a foreign party. Basically, a nominee agreement provides all authority that may arise in relation to national land law which cannot be owned by foreign parties, which is then given to native residents as recipients of power of attorney. There are problems that arise, namely the applicable legal provisions relating to the making of a deed of borrowing a notary\u27s name, the responsibility of a notary in making a Nominee deed for a land rights agreement between local residents and foreign nationals. This research uses a type of normative legal research and is analytical descriptive, where this research uses premier data as complementary data using data collection techniques carried out by means of literature study, as well as qualitative data analysis. Deeds of borrowing names or nominees are legally permissible, especially in shareholder agreements, however, unlike land ownership in the country, making deeds of borrowing names by a notary is an act of smuggling agrarian law and is prohibited by law. Based on Article 21 paragraph (1), Article 26 paragraph (2) of Law Number 5 of 1960 concerning Basic Agrarian Regulations, it is stated that a nominee agreement is an invalid agreement because it does not comply with statutory provisions. As a Notary there are three types of responsibility, namely civil legal responsibility, criminal legal responsibility and responsibility through the notary\u27s code of ethics. Telaah Terhadap Alasan Memperingan Sanksi Pidana Dalam Putusan Mahkamah Agung Nomor 813/K/PID/2023
Considering Indonesia is a nation of laws, as stated in Article 1 paragraph (3) of the Constitution of 1945, the rule of law, not man, should govern the state. But when we examine this issue, we find that an authority figure who is meant to lead by example and safeguard the public is still negligent and has an insufficient comprehension of the law. A senior police officer can nevertheless be included in the "Whoever" part of Article 340 of the Criminal Code when it comes to organized murder proceedings because he acknowledges that the person being assaulted is a human being with legal status. This paper aims to examine the legal importance of prohibiting high-ranking police personnel from committing intentional murder as a type of official crime. This paper applies a normative legal research methodology that involves a statutory approach and a literature review. After the data is gathered, it is processed and given a descriptive explanation to allow for a factual explanation of the correlation between the data. The outcomes of the research lead to the conclusion that office crimes are covered by Article 52 of the Criminal Code and that offenders who hold senior police positions may face sanctions to discourage their actions and punish them for their accountability
