LEGAL CERTAINTY OF COPYRIGHT AS FIDUCIARY GUARANTEE IN BANKING IN INDONESIA

    Get PDF
The Copyright Law and the Fiduciary Guarantee Law provide opportunities for copyright to be used as collateral. Implementation in the banking sector is still very limited, mainly due to the lack of adequate legal certainty regarding the mechanism for collateral. Using a normative juridical method and legislative and conceptual approaches, this study found that the existing legal framework does not provide clear standards regarding copyright valuation, the procedure for imposing a fiduciary charge on economic rights, and execution procedures when the debtor defaults. This condition leads to high legal risks for banks, thus reducing financial institutions\u27 interest in accepting copyrights as collateral. Therefore, regulatory harmonisation, technical assessment guidelines, and the strengthening of enforcement mechanisms are needed to achieve legal certainty and promote the optimisation of copyright as a financing instrument within the Indonesian banking system.

    Get PDF
In the context of increasing requirements for environmental protection, biosecurity, and sustainable development in agriculture, the implementation of green supply chain management has become an important strategic orientation for animal feed manufacturing enterprises. However, the extent to which green supply chain practices are adopted in this sector in Vietnam remains uneven and is influenced by various factors. This study aims to identify and analyze the factors affecting the implementation of green supply chain management among animal feed manufacturing enterprises located in Hanoi. Based on a review of previous studies and the theoretical framework of green supply chain management, the study proposes a research model comprising key groups of factors, including regulatory and environmental pressures, pressures from customers and supply chain partners, top management commitment, and firms’ internal capabilities. Research data were collected through a survey of 31 animal feed manufacturing enterprises operating in Hanoi and were analyzed using SPSS 26. The empirical results indicate that five factors have a positive impact on the implementation of green supply chain management. Based on these findings, the study proposes managerial and policy implications to promote the adoption of green supply chain management in the animal feed manufacturing industry toward sustainable development

HISTORICAL ASPECTS OF THE ECONOMIC FOUNDATIONS OF CONTEMPORARY ENVIRONMENTAL LAW

    Get PDF
Contemporary environmental law is deeply embedded in economic theory, particularly in the analysis of market failures, welfare optimization, and institutional design. This study examines the economic foundations of environmental law through a theoretical and analytical framework grounded in the law-and-economics tradition and institutional economics. Rather than relying on empirical data or econometric estimation, the paper adopts a conceptual approach that classifies environmental problems according to well-established categories of market failure, including negative externalities, public goods, common-pool resources, and non-market values. Building on this classification, the study evaluates the principal regulatory instruments of environmental law—command-and-control regulation, Pigouvian taxes, tradable permit systems, subsidies, and deposit-refund schemes—by examining their theoretical efficiency, incentive structures, distributional implications, and dynamic effects on innovation. Particular attention is devoted to the role of institutions and governance, emphasizing property-rights allocation, regulatory credibility, and policy stability as critical determinants of regulatory effectiveness. The analysis is complemented by conceptual visual frameworks that synthesize the alignment between economic problem structures and legal instruments. The research argues that environmental law is best understood as a hybrid system in which economic logic, legal normativity, and institutional constraints interact. Its contribution lies in offering a coherent conceptual framework that integrates economic reasoning into environmental legal analysis, thereby providing a foundation for future empirical research and policy evaluation

STRENGTHENING INSTITUTIONAL CAPACITY OF WOMEN’S MSMES FOR COMMUNITY WELFARE IN KONAWE REGENCY

    Get PDF
This study examines the institutional capacity development of women’s micro, small, and medium enterprises (MSMEs) in Konawe Regency, Indonesia, and their role in improving community welfare. Despite government initiatives, women’s MSMEs still face major challenges in rural areas. Using a descriptive qualitative approach, the study involved five informants—government officials and women entrepreneurs—through interviews, focus group discussions, observations, and document analysis. The findings indicate that institutional capacity is hindered by structural, socio-cultural, and economic barriers such as domestic role burdens, limited credit access, low business literacy, and poor digital infrastructure. Although some local initiatives exist, they are often unsustainable due to weak institutional support and a lack of stakeholder collaboration. The study proposes a community-based, collaborative model involving village-level women’s business groups, context-specific training, and gender-sensitive financial access. This model is expected to strengthen women’s institutional capacity, improve household welfare, and promote local economic resilience. The study contributes to gender-responsive institutional development discourse and offers practical recommendations for inclusive rural economic growth

A CRITICAL DISCURSIVE APPRAISAL OF ENVIRONMENTAL LAWS IN NIGERIA AND THE REALITY OF OIL SPILLAGE IN OGONILAND

The Nige Delta issue has been examined from diverse dimensions ranging from ecolinguistics, stylistics, discourse analysis, semantics and economic implications of vandalism and environmental despoliation in the region. As a result of the outcry emanating from government abandonment of the region, several environmental laws have been enacted to safeguard not just the Niger Delta region of Nigeria but also the entire Nigerian landscape. Since the discovery of oil in Oloibiri, the present Bayelsa state in 1956; oil exploration and production in the Niger Delta began in the late 1950s, operations were suspended in Ogoniland in the early 1990s due to disruptions from local public unrest. The oilfields and installations have since largely remained dormant. However, major oil pipelines still cross through Ogoniland and oil spills continue to affect the region, due to a lack of maintenance and vandalism to oil infrastructure and facilities. The policies guiding the Nigerian environment, and oil and gas production is enormous. Nigeria is a signatory to innumerable international agreements and conventions related to environmental sustainability, climate change, the health and safety of its citizens, and the protection of marine waters, fish, and livelihood structures. The regulations aim to reduce the dangers emanating from industrial activities and safeguard the surroundings and well-being. This article sets out to review , appraise and critically examine the existing laws guiding environmental despoliation in the Niger Delta region viz-a-viz the literature that exists on the reality of environmental degradation in Nigeria

SUBSTANTIVE JUSTICE IN COASTAL SPATIAL LICENSING: A RAWLSIAN PERSPECTIVE ON INDONESIA’S ONE SPATIAL PLANNING POLICY

    Get PDF
Inequality in coastal space utilization permits is a structural issue that directly impacts social justice and the sustainability of coastal area management. Although Indonesia has promoted the integration of land and sea spatial planning through the One Spatial Plan policy, coastal spatial licensing practices still show the dominance of well-capitalized actors and limited access for coastal communities, particularly traditional fishermen. This article aims to analyze the extent to which licensing policies for coastal space utilization reflect substantive justice using John Rawls\u27 Theory of Justice approach. This research employs a normative juridical method with a legislative, conceptual, and policy analysis approach. The study results indicate that the coastal space permitting system in Indonesia tends to meet procedural justice but has not fully achieved substantive justice as intended by Rawls\u27 principles of justice, particularly the difference principle and fair equality of opportunity. This article asserts that the One Spatial Plan policy has normative potential to address disparities in coastal spatial permits but requires policy design reform and legal affirmation favoring the most vulnerable groups to achieve substantive justice in coastal spatial management.

SILICON SOURCE FROM CALCIUM SLILICATE OF STEEL MAKING SLAG APPLICATION RATE ON GROWTH AND YIELD QUALITY IN SUGARCANE

    Get PDF
Calcium silicate is widely recognized as an important silicon source for crop production however, its agronomic benefits remain controversial, particularly under tropical conditions in Thailand. This study evaluated the effects of calcium silicate on growth, yield, and yield quality of sugarcane (Saccharum officinarum L.) cultivar Khon Kaen 3 grown in Kamphaeng Saen soil. Two experiments were conducted. The first experiment assessed the effects of calcium silicate soaking on bud germination and early growth of sugarcane setts using a completely randomized design with four soaking concentrations (0, 100, 200, and 400 g L⁻¹) and ten replications. The results demonstrated that soaking in calcium silicate at 400 g L⁻¹ significantly accelerated bud germination and enhanced early plant growth. The second experiment was a field trial arranged in a randomized complete block design with four fertilization rates (0, 125, 250, and 500 kg ha⁻¹) and four replications to examine the effects of calcium silicate fertilization on plant growth, yield, and yield quality. Although calcium silicate fertilization showed no statistically significant effects on vegetative growth, the highest yield and stalk number were obtained at 500 kg ha⁻¹. In contrast, the optimal yield quality, expressed as commercial cane sugar percentage, was achieved at 250 kg ha⁻¹. These findings suggest that calcium silicate management can improve sugarcane productivity and quality, with application rate influencing yield and sugar accumulation differently

This study investigates the relationship between organizational commitment and sustained productivity among micro and small business owners. Using a descriptive–correlational research design, data were collected from 152 respondents representing diverse entrepreneurial backgrounds. Descriptive statistics revealed a balanced gender distribution with a slight male majority, while most respondents were young to middle-aged adults managing enterprises less than ten years old. The majority were college-educated and primarily engaged in service and food-related businesses, reflecting contemporary entrepreneurial trends in developing economies. Findings showed high levels of affective commitment, as indicated by mean scores above 3.0 on indicators of pride, loyalty, and emotional attachment, suggesting that respondents remain engaged due to genuine identification with their businesses. Continuance commitment also registered a relatively high overall mean, reflecting a pragmatic “need to stay” influenced by perceived personal costs and limited alternatives. Perceived productivity and quality management practices yielded consistently high mean scores, highlighting strong confidence in resource efficiency, ethical leadership, staff management, and operational quality. Correlational analysis revealed a moderately positive and statistically significant relationship between overall organizational commitment and sustained productivity, indicating that higher commitment is associated with improved long-term performance. The findings contribute to organizational commitment theory by demonstrating the complementary roles of affective and continuance commitment in entrepreneurial settings. Practically, the results underscore the importance of fostering emotional engagement alongside structured quality management systems to enhance productivity, resilience, and competitiveness among small enterprises. This study investigates the relationship between organizational commitment and sustained productivity among micro and small business owners.
