Maqaṣid Al-Syariah In Fatwa Yusuf Al-Qardhawi About Misyar Marriage
The existence of misyar marriage does not aim to build sakinah, mawaddah and rahmah households. Meanwhile, according to Yusuf al-Qardhawi in his fatwa, it is permissible as long as it is in an urgent condition. So the author looks at it from the point of view of his Maqasid al-Shariah. Research Methods In this study using a qualitative descriptive approach. Protection of the Soul/Body (Hifz al-Nafs). Scholars who allow misyar marriage are of the opinion that when viewed from the realization of the great goals of a marriage, it is true that misyar marriage is not an ideal form of marriage. Property Protection (Hifz al-mal). With misyar marriage, a rich wife can help her husband's economy which may be weak. This is in line with the concept of maqaṣid al-shariah in the realm of al-nafs at the tahsiniyat level. Apart from that, with a misyar marriage, the wife is lucky because she has someone who can protect herself and her property from damage and interference from other parties. Protection of the Intellect (Hifz al-Aqli). Forms of human care for the mind and thoughts by living a healthy way and continuing to develop their natural talents. Protection of Offspring (Hifz al-Nasl). The initial purpose of marriage is so that husband and wife can live together forever, day and night in order to achieve a life that is sakinah, mawaddah, wa rahmah
ANALISIS RISIKO CURAH HUJAN TINGGI TERHADAP KELANGSUNGAN KEGIATAN BELAJAR DAN MENGAJAR DI MTS HUDATUL FALAH
Heavy rainfall can have a significant impact on the smoothness of teaching and learning activities in schools. The research findings indicate that high rainfall disrupts the punctuality of students and teachers in attending school due to poor weather conditions. Student and teacher lateness and absences affect the smoothness of the learning process at MTs Hudatul Falah. Additionally, certain parts of the school building have also been damaged due high rainfall, such as roofs, walls and stairs. The school has taken measures to address the impact of high rainfall, including improving the maintenance and repair of the school building, as allowing tolerance for lateness and providing flexibility in the class schedule. Evaluations of the school's readiness and the empowerment of teachers and students in dealing with emergencies related to high rainfall have also been conducted. This research provides insights into the importance of addressing the impact of extreme weather conditions in the educational context. The impact of high rainfall, particularly student and teacher lateness, requires greater attention to improving the condition of school buildings and increasing readiness to face the risks of extreme weather. These steps will help ensure the continuity of teaching and learning activities in the future.Curah hujan tinggi dapat memiliki dampak yang signifikan terhadap kelancaran kegiatan belajar dan mengajar di sekolah. Hasil penelitian menunjukkan bahwa curah hujan tinggi mengganggu ketepatan siswa dan pengajar untuk datang ke sekolah dengan kondisi cuaca yang buruk. Keterlambatan dan absensi siswa dan pengajar mempengaruhi kelancaran proses pembelajaran di MTs Hudatul Falah. Selain itu, beberapa bagian bangunan sekolah juga mengalami kerusakan akibat curah hujan tinggi, seperti atap, dinding dan tangga. Sekolah telah mengambil langkah-langkah untuk mengatasi dampak curah hujan tinggi, termasuk peningkatan perbaikan dan pemeliharaan bangunan sekolah, serta memberikan toleransi keterlambatan dan fleksibilitas jadwal pembelajaran. Evaluasi kesiapan sekolah dan pemberdayaan staf pengajar dan siswa dalam menghadapi situasi darurat terkait curah hujan tinggi juga dilakukan. Penelitian ini memberikan wawasan tentang pentingnya menghadapi dampak cuaca ekstrem dalam konteks pendidikan. Dampak curah hujan tinggi, khususnya keterlambatan siswa dan pengajar, memerlukan perhatian yang lebih besar terhadap perbaikan kondisi bangunan sekolah serta peningkatan kesiapan dalam menghadapi risiko cuaca ekstrem. Langkah-langkah ini akan membantu memastikan kelancaran kegiatan belajar dan mengajar yang berkelanjutan di masa depan.

Relevansi Bilangan Ganjil dan Tradisi Tikrār dalam Proses Pemeliharaan Hadis di Era Nabi
Keanekaragaman pola sabda Nabi Muhammad saw dalam menyampaikan pesan tentu membawa makna tersendiri. Tradisi tikrār dalam proses pembelajaran seakan erat kaitannya dengan bilangan ganjil yang menyimpan berbagai keistimewaan. Validitas dan otentitas dari hadis yang tersebar sampai saat ini merupakan buah upaya keberhatian para sahabat dalam menjaga hafalan. Untuk membuktikan keberadaan dan peran tradisi tikrār beserta pengulangan berjumlah ganjil dalam proses pemeliharaan hadis, maka orbit utama dalam penelitian ini memerlukan penggalian makna mendalam sehingga relevansi antar keduanya akan terungkap secara spesifik. Penelitian kualitatif dengan basis kepustakaan ini menerapkan teknik dokumentasi dalam menghimpun keseleruhan data, baik kategori primer maupun sekunder. Cakupan data yang diperoleh akan melewati proses analisis menggunakan teori semantik. Penerapan tradisi tikrār dengan ketepatan pengulangan berjumlah ganjil secara signifikan berimplikasi pada akurasi pemahaman dan daya tangkap para periwayat dikalangan sahabat. Dengan demikian, proses pemeliharaan hadis mempengaruhi validitas dan otensitas hadis yang tersebar pada saat ini
Penyelesaian Pembiayaan Bermasalah di KSPPS Bina Syariah Ummah Cabang Bawean
Abstract: This research was conducted to answer several questions: What are the causes of problematic financing at KSPPS Bina Syariah Ummah Bawean Branch?, what steps have been taken to deal with this problem?, and what steps have been prepared to minimize the potential for problematic financing to arise in the future ?. This research uses a type of normative-empirical legal research with a conceptual approach, a statutory approach, and a case study approach to legal events. The data used are primary data and secondary data. Primary data sources were obtained from interviews with the KSPPS Bina Syari'ah Ummah Bawean Branch. Secondary data sources were obtained from literature studies and document studies. Data collection techniques were carried out by document studies and interviews. The results of this study concluded that the factors causing problematic financing at KSPPS Bina Syariah Ummah Bawean Branch consisted of 2 aspects: internal and external. Internal aspects (cooperatives) in the form of not implementing the precautionary principle properly. While external factors (partners) are dishonesty and indiscipline, non-permanent income, business failures and disasters that befall their businesses. There are two settlement procedures used: rescheduling and collateral execution (selling collateral). While preventive measures are carried out by actually implementing the Management Operational Standards in a preventive (prevention) and curative (resolving efforts) way.Keywords: problem financing, KSPPS, Bina Syariah Ummah, Bawean Branch
Abstrak: Penelitian ini dilakukan guna menjawab beberapa pertanyaan: Apa penyebab pembiayaan bermasalah di KSPPS Bina Syariah Ummah Cabang Bawean ?, langkah apa saja yang telah dilakukan guna menangani masalah ini ?, dan langkah apa saja yang dipersiapkan untuk meminimalisir potensi timbulnya pembiayaan bermasalah di masa mendatang ?. Penelitian ini menggunakan jenis penelitian hukum normatif-empiris dengan pendekatan konseptual, pendekatan perundang-undangan, dan pendekatan studi kasus pada peristiwa hukum. Data yang digunakan berupa data primer dan data sekunder. Sumber data primer didapat dari wawancara kepada pihak KSPPS Bina Syari’ah Ummah Cabang Bawean. Sumber data sekunder diperoleh dari studi kepustakaan dan studi dokumen. Teknik pengumpulan data dilakukan dengan studi dokumen dan wawancara. Hasil penelitian ini menyimpulkan bahwa faktor penyebab terjadinya pembiayaan bermasalah di KSPPS Bina Syariah Ummah Cabang Bawean terdiri dari 2 aspek: internal dan eksternal. Aspek internal (koperasi) berupa tidak dijalankannya prinsip kehati-hatian dengan benar. Sementara faktor eksternal (mitra) berupa ketidakjujuran dan ketidakdisiplinan, penghasilan bukan dari pekerjaan tetap, kegagalan usaha dan musibah yang menimpa usahanya. Prosedur penyelesaian yang digunakan ada dua: rescheduling (penjadwalan kembali) dan eksekusi jaminan (menjual jaminan). Sementara langkah pencegahan dilakukan dengan benar-benar melaksanakan Standar Operasional Manajemen dengan cara preventif (pencegahan) dan kuratif (upaya penyelesaian).Kata kunci: pembiayaan bermasalah, KSPPS, Bina Syariah Ummah, Cabang Bawea

This paper discusses the analysis of the procedure for finding law in the perspective of positive law and Islamic law, with the main subject of study being how the method or method of finding law in positive law and Islamic law. Utilizing a literature study, of course, primary data comes from books and journals related to the problem being studied. This paper finds that the method of exploring legal discovery in Indonesia can be done both in formal law and material law. Legal discovery in the field of formal law is aimed at overcoming all juridical and technical obstacles and hurdles in order to achieve a simple, fast and low-cost trial without reducing legal protection and fair service for the litigants (Article 59 UU-PA). Legal discovery in the field of material law is aimed at the realization of justice in every case faced. Legal discovery is always related to legal protection and justice services to justice seekers. Legal discovery is always quantitative, realistic, pragmatic and executable. In the realm of Islamic law, the method of finding law is not too different from the method of positive law. Muslim experts have developed the structure of legal discovery (istinbath) as explained by Prof. Syamsul Anwar in his writings such as through linguistic/literal implementation, ta'lili or causation and synchronization or alignment. Coupled with an offer built by Louay Safi with an integrated method of legal discovery. Wanita Karir Perspektif Mubadalah Ky Fakih Dan Kedudukannya Dalam Hukum Islam
Abstract: Career women generally experience difficulties in balancing their role in the household and their role in the career. If this condition occurs for a long time, it will lead to family and work conflicts which will eventually result in disharmony in the household. Career women have roles and burdens that are not light, both as career women with all their responsibilities, and as wives who must obey and obey their husbands and carry out their obligations as wives, as well as mothers for their sons and daughters who need balanced thoughts and attention. From the problems above, the researcher took the formulation of the problem as follows: 1). How are Career Women according to the Concept of Mub is Ky Fakih and 2). What is the Position of Career Women in Islam. This study uses a qualitative research method with literature review in which researchers analyze career women using two concepts, namely Mubadallah and Islam. From the results of this analysis, it explains that career women according to the concept of mubadallah Ky Fakih, namely that women are allowed to become career women because in Islam Allah SWT created humans with male and female sexes, they are not differentiated in terms of worship, only their biological factors are differentiate. Meanwhile, career women, according to Islam, women have the freedom to work, do not leave their responsibilities and are the mothers of their children and can maintain their nature as well as their religion
Strategi Kepemimpinan Kepala Raudlatul Athfal Sabilurrosyad Untuk Meningkatkan Kompetensi Keagamaan Peserta Didik
The religious competence of students must be sought as early as possible because the acceptance of knowledge and the transfer of values carried out at an early age is very easy, but as the main subject, the head of an educational institution has an important and strategic role in selecting the right strategy to improve the religious competence of students and realizing quality management. Who excels in his institution so that it becomes a necessity for a head of an educational institution especially at the educational level of Raudlatul Athfal to have a good leadership strategy to improve the religious competence of students. Type of Research This is a qualitative research with a case study approach. The location of the research was carried out at Raudlatul Athfal Sabilurrosyad Jolotundo Jetis Mojokerto, the data collection techniques were participant observation, in-depth interviews and documentation, while the data analysis techniques began with data reduction, data presentation, data verification, while data validity testing techniques were carried out by means of: credibility, transferability, dependability, confirmability. The results of the study indicate that the strategy of the head of Raudlatul Athfal Sabilurrosyad to improve the religious competence of students, namely: 1) Growing teacher awareness of the importance of religious competence for students, 2) Holding collaboration with student guardians, 3) Providing training for teachers, and 4) Supervise and assist. While the supporting and inhibiting factors for the implementation of the leadership strategy of the head of Raudlatul Athfal Sabilurrosyad to increase the religious competence of students are, 1) All elements of Raudlatul Athfal Sabilurrosyad fully support the policies of the head of the institution, 2) The obstacles faced in implementing his leadership strategy are that there are a few elements of Raudlatul Athfal Sabilurrosyad who still unable to consistently carry out an agreement to increase the religious competence of students but this has been able to be anticipated and given policies by the head of Raudlatul Athfal Sabilurrosyad.Kompetensi keagamaan peserta didik harus diupayakan sedini mungkin dikarenakan penerimaan pengetahuan dan transfer values yang dilakukan pada usia dini sangat lah mudah akan tetapi sebagai subjek utama kepala lembaga pendidikan memiliki peranan penting dan strategis untuk melakukan pemilihan strategi jitu guna meningkatkan kompetensi keagamaan peserta didiknya serta mewujudkan manajemen mutu yang unggul di lembaganya sehingga menjadi sebuah keniscayaan seorang kepala lembaga pendidikan terkhusus setingkat pendidikan Raudlatul Athfal memiliki strategi kepemimpinan yang baik untuk meningkatkan kompetensi keagamaan peserta didik. Jenis Penelitian Ini adalah penelitian kualitatif dengan pendekatannya Studi Kasus. Lokasi penelitian dilaksanakan di Raudlatul Athfal Sabilurrosyad Jolotundo Jetis Mojokerto, teknik pengumpulan datanya yakni observasi partisipan, wawancara mendalam dan dokumentasi, adapun teknik analisis data diawali dengan reduksi data, penyajian data, verifikasi data, sedangkan teknik uji keabsahan data dengan cara: kreadibilitas, transferabilitas,dependabilitas, konfirmabilitas. Adapun hasil penelitian menunjukkan bahwa strategi kepala Raudlatul Athfal Sabilurrosyad untuk meningkatkan kompetensi keagamaan peserta didik, Yaitu: 1) Menumbuhkan kesadaran guru pentingnya kompetensi keagamaan bagi peserta didik, 2) Mengadakan kerjasama dengan wali peserta didik, 3) Memberikan pelatihan bagi guru, dan 4) Melakukan pengawasan dan pendampingan. Sedangkan faktor pendukung dan penghambat keterlaksanaan strategi kepemimpinan kepala Raudlatul Athfal Sabilurrosyad untuk meningkatkan kompetensi keagamaan peserta didik ialah, 1) Semua elemen Raudlatul Athfal Sabilurrosyad mendukung penuh kebijakan kepala lembaga, 2) Kendala yang dihadapi dalam pelaksanaan strategi kepemimpinannya yaitu terdapat segelintir elemen Raudlatul Athfal Sabilurrosyad yang masih belum dapat konsisten menjalankan kesepatanan meningkatkan kompetensi keagamaan peserta didik namun hal tersebut kemudian telah mampu diantisipasi dan diberikan kebijakan oleh kepala Raudlatul Athfal Sabilurrosyad.

Nikah Misyᾱr, : Perspektif Fatwa Ulama’, Gender Dan Hukum Keluarga Islam Di Indonesia
Abstract : The phenomenon of misyᾱr marriage raises debate among contemporary scholars. Contemporary scholars issue fatwas that are contradictory to one another by looking at different points of view. From the fatwas that have been issued by contemporary ulemas about misyᾱr marriages, the issue of protection and rights of women (wives) and the goals of shari'ah (maqᾱṣid al-sharī'ah) in misyᾱr marriages are the main reasons that are being debated among contemporary ulema'. This research uses a qualitative approach with a type of library research. The collection of legal material is carried out by examining documents, namely the fatwa of each ulema. Legal material analysis techniques include content analysis and critical analysis of the fatwa in terms of gender and maqᾱṣid al-sharī'ah perspectives. The results of the study show that: (1) There are two groups of contemporary 'ulama', namely 'ulama' who allow misyᾱr marriage, namely Yūsuf al-Qardhᾱwi and Wahbah Zuhailī and 'ulama' who prohibit misyᾱr marriage, namely 'Abd al-'Aziz bin al-Bᾱz and 'Abd al-'Aziz bin al-Bᾱz and ' Umar Sulaimᾱn al-Aṣqar. This difference is due to: First, differences in manhaj in establishing law. Second, the difference in determining the criteria for the validity of the marriage. Third, differences in understanding whether or not socialization is mandatory in a marriage. (2) Between the contemporary ulama' fatwa which allows and prohibits misyᾱr marriage when viewed from a gender perspective, the ulama' fatwa which prohibits it is more in accordance with the concept of gender on the basis of protecting women's rights more

The purpose of this article is to identify more about educational leadership. This description uses the Descriptive Literature and Qualitative Study approach method with data collection in the form of interviews. Based on the activities that have been carried out that educational leadership is a process of influencing, mobilizing and coordinating individuals in educational organizations / institutions to achieve these educational goals.leadership is important to do and there are certain factors that affect the success of leadership that comes from the leader himself including: knowledge and expertise which is the educational background of a leader, institution or the type of work in which the leader performs the duties of his office, the attitude and personality of the leader, and the personality attitudes of followers. There are seven challenges and obstacles commonly faced by education leaders in general, namely the complexity of leadership tasks, uncertainty and rapid change, complex performance appraisals, community and stakeholder demands, limited resources, cultural and ethnic differences, and time pressures. And educational leadership itself has a very important role to improve the quality of education, create a positive school culture, lead successful educational change, and manage conflict in the school environment.Tujuan penuisan artikel ini ialah untuk mengidentifikasi lebih lanjut tentang kepemimpinan pendidikan. Pada uraian ini menggunakan metode pendekatan Studi Pustaka dan Kualitatif Deskriptif dengan pengumpulan data berupa wawancara. Berdasarkan kegiatan yang telah dilakukan bahwa Kepemimpinan pendidikan melibatkan langkah-langkah untuk mempengaruhi, memotivasi, dan mengatur individu-individu di dalam suatu organisasi atau lembaga pendidikan agar dapat mencapai tujuan pendidikan yang telah ditetapkan.. kepemimpinan penting untuk dilakukan dan terdapat faktor-faktor tertentu yang mempengaruhi keberhasilan kepemimpinan yang berasal dari pemimpin itu sendiri diantaranya yaitu: pengetahuan dan keahlian yang merupakan latar belakang pendidikan seorang pemimpin, lembaga atau jenis pekerjaan tempat pemimpin itu melaksanakan tugas jabatannya, sikap dan kepribadian pemimpin, dan sikap-sikap kepribadian pengikut. Terdapat tujuh tantangan dan hambatan yang biasa dihadapi oleh pemimpin pendidikan pada umumnya yaitu kompleksitas tugas kepemimpinan, ketidakpastian dan perubahan yang cepat, penilaian kinerja yang kompleks, tuntutan masyarakat dan pemangku kepentingan, keterbatasan sumber daya, perbedaan budaya dan etnis, serta tekanan waktu. Dan didalam kepemimpinan pendidikan itu sendiri memiliki peran yang sangat penting untuk meningkatkan kualitas pendidikan, menciptakan budaya sekolah yang positif, memimpin perubahan pendidikan yang sukses, dan mengelola konflik di lingkungan sekolah
