No full textPaper ini menjelaskan tentang efektifitas Undang-Undang nomor 16 Tahun 2019 tentang pembatasan usia pernikahan di Pulau Bawean dan paper ini bertujuan untuk mengetahui secara mendalam apakah Undang-Undang nomor 16 Tahun 2019 tentang pembatasan usia pernikahan sudah diterapkan dan berjalan dengan efektif pada masyarakat pulau Bawean. Jenis penelitian yang digunakan adalah kualitatif dengan pendekatan yuridis empiris. Hasil penelitian menunjukkan bahw Undang-Undang nomor 16 Tahun 2019 tentang pembatasan usia pernikahan belum efektif pada masyarakat bawean karena masih banyaknya angka pernikahan di bawah umur yang dilakukan di kalangan masyarakat. Kedua, KUA Sangkapura telah mensosialisasi kepada masyarakat tetapi masih banyak faktor-faktor yang menghambat upaya KUA untuk menjalankan UU Nomor 16 Tahun 2019 secara efekti

No full textThe term of jihad in recent years has become an interesting topic of conversation, especially after the term was used by radical groups to carry out acts of terror in the name of religion, and by using arguments from sacred texts, one of which is hadith. This paper aims to examine one of the hadiths which has an extreme meaning, "الجنة تحت ظلال السيوف", using the hermeneutic analysis knife offered by Hassan Hanafi. Historically, this hadith was used by the companions to encourage the mujahid during the war. However, if it is related to the present, interpreting the hadith as war is certainly not in accordance with the geographical conditions and the current time, especially if it is related to the Indonesian context. The war in the time of the Prophet was a sociological necessity that was carried out to defend against the attacks of the unbelievers. Meanwhile, in this era, the Indonesian people live on the principle of religious moderation, so that jihad which means war cannot be actualized. Thus Islam as rahmatan lil 'alamin will be realized. In this context, the hadith can be interpreted as all the efforts of a Muslim to be able to gain the pleasure of Allah

No full textBuying and selling is an economic transaction that cannot be separated from everyday human life. As social beings, humans need interaction with one another, including in fulfilling their daily needs. Buying and selling in Islam is not only seen as a medium of transactions between sellers and buyers who are not bound by rules. In Islam, every muamalah transaction that occurs between an individual and another or a group and community must be built on the principle of mutual benefit, and must avoid the existence of aggrieved parties, then the transaction must also be separated from the usury system. In fact, because of a pressing need, tactics are often carried out to avoid usury, especially qardh (debt) which is common and widespread among the people, among these tactics is to implement the 'inah contract. What is the description and law of the 'inah' contract, then what is the hilah law in this case, these two things will be discussed by comparing the opinions of the jurists along with the arguments of each party. To get and know about the law of 'inah' contract, the author uses the library research method. The research results show that the 'inah buying and selling contract as a solution to riba-free transactions is debated by the law among the jurists, some allow it with one note, but jumhur fuqaha is forbidden for several reasons
Konfigurasi Filantropi Islam Dalam Tradisi Maulid Nabi SAW Di Bawean
No full textAbstrakPenelitian ini mengkaji tentang konfigurasi filantropi Islam dalam tradisi Maulid Nabi SAW di Pulau Bawean. Penelitian ini adalah penelitian kualitatif deskriptif dengan menggunakan teori gift exchange yang dikembangkan oleh Marcell Mouss. Dari teori tersebut dapat disimpulkan bahwa tradisi maulid Nabi SAW di Bawean merupakan salah satu bentuk ekspresi kegembiraan masyarakat atas dilahirkannya Rasulullah SAW. Kegembiraan tersebut diinterpretasikan dalam bentuk social giving yang berupa pertukaran angka’an bherkat antar sesama warga. Di samping itu, masyarakat Bawean mengumpulkan dana filantropi Islam dalam bentuk bendera maulid untuk didistribusikan kepada Lembaga penyelenggara maulid, sehingga dana filantropi tersebut menjadi salah satu sumber pendapatan Lembaga untuk memenuhi kebutuhannya. Tradisi maulid Nabi SAW ini tidak hanya dilakukan satu kali saja, namun berulangkali. Setiap Lembaga atau komunitas mengadakan acara maulid. Hal ini menunjukkan bahwa Gerakan filantropi berbasis agama memiliki kekuatan yang lebih besar dibandingkan lainnya, sebab yang mereka harapkan tidak hanya sekedar materi, namun ada kekuatan iman, cinta, dan pahala yang menjadi harapan terbesar dari semua tindakanny
Analisis Praktik Pembiyaan Ijarah Multi Jasa Di KSPPS Bina Syariah Ummah
No full textAbstract: This research was conducted at KSPPS Bina Syariah Ummah Bawean Branch with the reason to know the mikanism and any problems that exist in the multi-service contract. Multi-service Ijarah is one of the financing products available at the Bawean Branch of Bina Syariah Ummah KSPPS for customers in obtaining benefits from a service. The purpose of this study is to determine the multi-service prosperity financing in the Bina Syariah Ummah Cooperative with questions. How is the mikanism of applying for a loan at the Bawean Branch of Bina Syariah Ummah Cooperative, and how to handle it if there is a bottleneck in the financing. This research uses descriptive qualitative, using primary data and secondary data. The data collection method used by us in this study is direct and indirect observation, both in terms of employee interviews at the Bina Syariah Ummah Bawean KSPPS, as well as documentation and online data search related to research conducted in the cooperative. Based on the results of this study, it can be seen that the mikanism of multi-service al Ijarah financing at the Bawean Branch of Bina Syariah Ummah KSPPS starts from the prospective members completing the application requirements for multi-service financing. After all the requirements are completed, the loan application will be typed by the cooperative teller in the form of a file submitted to the center via email. Then the completeness of the requirements will be documented at the place where the loan is submitted

No full text: Studying 'Ulum al-Diin (Religious Knowledge) is a must with the purpose of understanding about aspects relating to one's religion, while studying al-Fikr al-Islamiy (Islamic Thought) as the humanity of Islamic thinking which tends to use ratio, as well as applying in Dirasat Islamiyyah (Islamic Studies) armed with the paradigm of social science based on historical-empirical experience. While the position of al-'Ulum al-Ijtimaiyyah (Social Knowledge) as a real application in the social sphere of society. In the absence of real application as the application of al-'Ulum al-Ijtimaiyyah (Social Knowledge), the four components will not reach the point of contact with the Islamic scholarly link. The purpose of writing this scientific article aims to find answers from the coffers of rigidity between the relations of these four aspects so as to find common ground in answering the nature of Islamic scholarship in the face of globalization.
