Reply to the Comments on Epistemic Ambitions of the Criminal Trial: Truth, Proof and Rights
This article sets out to reply to the comments by Antony Duff, Sabine Gless, John Jackson and Thomas Weigend on my article «Epistemic Ambitions of the Criminal Trial». It begins by examining the various positions of the commentators to the question of the aim(s) of the criminal trial before going on to consider the limits of instrumentalist and proceduralist approaches and to re-examine the right-based conception of trials. It concludes by considering the implications of this account of criminal trials
Judging Beyond Any Reasonable Doubt: A Logic and Epistemological Rule
The doubt is not related to innocence but only to guilt, the latter being the exclusive object of the process. The proof of guilt, being always of inductive nature, cannot accept the deductive method that connotes the relationship between premise (minor and major) and conclusion. From here arises the necessity that beyond reasonable doubt must respond to the postulates of logic and the motivation of judgments is an example. Research tends to show whether there is a valid theory to overcome the doubt of uncertainty about guilt-innocence. Can jurisprudence (mathematics-legal) as an exact science aid in the discovery of a perfect syllogism for a valid theory of reasonable doubt
DERECHO Y LITERATURA EN JOAQUÍN COSTA Y EDUARDO DE HINOJOSA
En el presente artículo nos proponemos examinar las relaciones entre Derecho y literatura a través de las obras de dos historiadores del Derecho coetáneos, que vivieron en la segunda mitad del siglo XIX y los primeros decenios del XX: el aragonés Joaquín Costa y Martínez (1846-1911) y el granadino Eduardo de Hinojosa y Naveros (1852-1919). Ambos fueron precursores en la tarea de investigar las normas e instituciones jurídicas en los textos literarios, y particularmente en la poesía épica, adoptando como objeto de estudio el Cantar de Mio Cid, el principal cantar de gesta castellano. Su interés por el diálogo entre Derecho y poesía derivó de la influencia de la Escuela Histórica del Derecho, y, en particular, de las aportaciones de Jakob Grimm
Sobre derecho y literatura
El presente artículo se propone abordar las notas centrales del denominado movimiento de derecho y literatura, promoviendo una revisión de sus contribuciones más importantes y del desarrollo que ha tenido en Argentina.
En ese marco, inicialmente, se analizarán las dos grandes corrientes que vinculan al derecho con la literatura: el derecho en la literatura y el derecho como literatura, a través de la mención a algunas obras significativas.
Luego, se hará hincapié en el lugar que ocupa este tipo de abordajes en Argentina y, sobre todo, en la importancia de atravesarlo desde una mirada decolonial.The present article aims to address the central notes of the so-called "law and literature" movement, promoting a review of its most important contributions and its development in Argentina.
In this context, initially, we will analyze the two major currents that link law with literature: law in literature and law as literature, through mentioning some significant works.
Afterwards, emphasis will be placed on the position that this type of approach holds in Argentina and, above all, on the importance of approaching it from a decolonial perspective
Lo desigual y lo prohibido en "Emma Zunz" de J.L. Borges
This paper proposes an analysis of Jorge Luis Borges' short story "Emma Zunz" based on the contributions of the so-called "law and literature" movement. In fact, the work will be approached, first and foremost, by identifying the legal elements in the construction of the fictional narrative, highlighting, above all, their significance in the time in which the events take place.
On the other hand, the study will focus on what Emma Zunz teaches the world of law, understanding teaching as showing, that is, the ways in which literature designates the unnamable, articulates desire, power, and the body, issues of fundamental importance for thinking about legal subjectivity.El presente trabajo propone un análisis del cuento “Emma Zunz” de Jorge Luis Borges, a partir de las contribuciones del denominado movimiento “derecho y literatura”. En efecto, se abordará la obra, en primer lugar, mediante la identificación de las presencias jurídicas en la construcción de la narrativa ficcional, destacando, sobre todo, la significación en la época en la que transcurren los hechos.
Por otro lado, el estudio se detendrá en aquello que Emma Zunz enseña al mundo del derecho, entendiendo enseñar como mostrar, es decir, las formas en que la literatura designa lo innombrable, articula el deseo, el poder y el cuerpo, asuntos de trascendencia fundamental para pensar la subjetividad jurídica

The Minga as a communicative Practice that Guides the Social Transformation of the Indigenous People of Chimborazo, Ecuador
Este artículo reflexiona la forma en la que la minga como práctica comunicativa permite la transformación de la realidad -en conjunto- de los habitantes de las parroquias Tixán y Totorillas, provincia de Chimborazo Ecuador. Es un estudio cualitativo que utiliza para la recogida de la información la etnografía y la observación. Entre los resultados obtenidos pudo concluirse que posibilita la acción comunitaria, la reflexión frente a una problemática, una eficiente toma de decisiones que permita intervenir colectivamente la realidad, y en especial, la interacción convertida en generadora de cambio social.This article reflects on the way in which the minga as a communicative practice allows the transformation of the reality -as a whole- of the inhabitants of the Tixán and Totorillas parishes, province of Chimborazo Ecuador. It is a qualitative study that uses ethnography and observation to collect information. Among the results obtained, it could be concluded that it enables community action, reflection on a problem, efficient decision-making that allows collective intervention in reality, and especially, the interaction that has become a generator of social change
La gaia ciència a Nàpols: l'«Illuminator» de Jaume Borbó (1453)
RESUM: L’article recull les notícies conegudes sobre Jaume Borbó (doc. 1439-1453), mestre de cant a la capella reial d’Alfons el Magnànim a Nàpols, i ressegueix l’estructura i les fonts del seu tractat Illuminator (1453), escrit en català i conservat en llatí, sobre gèneres poètics, vicis i algunes figures retòriques. L’examen de l’estructura i de les definicions revela que la font principal de l’obra és el Compendi de Joan de Castellnou (ca. 1341). L’article examina també les definicions dels gèneres francesos de forma fixa, que són la principal novetat del tractat.ABSTRACT: Jaume Borbó (doc. 1439-1453) was «master of the boys» at the Neapolitan royal chapel of Alfonso the Magnanimous, and the author of the Illuminator, a treatise on poetic genres, vices and rhetorical figures, written in Catalan in 1453 and preserved in a Latin version only. The article shows that its structure and contents, especially the definitions of rhetorical figures and troubadour genres, are based on Joan de Castellnou’s Compendi (ca. 1341). Borbó updated his treatise with the definition of some formes fixes of French origin, which are examined as well
«Famusi et caritativi hospitali»: Barcelona i la referencialitat del gran hospital urbà
RESUM: Durant la baixa edat mitjana, alguns centres hospitalaris van adquirir una certa fama o reputació de grandesa, bones pràctiques i exemplaritat. En aquest article, proposem que, davant de la diversitat d’orígens institucionals i models administratius, la fama és un dels elements aglutinadors més importants del fenomen del gran hospital baixmedieval. En aquest sentit, utilitzem la noció de referencialitat per avaluar el grau d’influència i la capacitat d’esdevenir model d’aquestes institucions. Aquestes dinàmiques es presenten tant en un marc regional ampli, la Corona d’Aragó o el món mediterrani, com en un espai local més específic a través de la interacció entre l’Hospital de la Santa Creu i l’Hospital d’en Pere Desvilar de Barcelona.
ABSTRACT: During the Late Middle Ages, some hospitals acquired a certain reputation of greatness and exemplarity. In this article, I propose that, given the diversity of institutional origins and administrative models, this reputation is one of the most important unifying elements of the great late medieval hospital. In this sense, I use the notion of referentiality to define how these hospitals influenced other institutions. These dynamics are presented both in a broad regional framework, such as central and northern Italy, the Crown of Aragon or the Mediterranean world, and in a more specific local space, through the interaction between the Hospital de la Santa Creu and the Hospital d’en Pere Desvilar in Barcelona
What’s so Special about the Criminal Trial? A Comment on Sarah Summers «Epistemic Ambitions of the Criminal Trial: Truth, Proof, and Rights»
This paper offers some further support to Sarah Summers’ argument, in «The Epistemic Ambitions of the Criminal Trial: Truth, Proof, and Rights», that we cannot separate process from outcome in the criminal trial—that the justification and legitimacy of the verdict (especially of a conviction) depends crucially on the procedure through which it was reached. Intuitive support for this view is found by considering the case of a guilty person who is convicted after a trial that denied him the opportunity or means for «effective participation»; further support is found in the provisions made for those who are «unfit to plead», those who lack the capacities necessary for effective participation in their trial. A firmer grounding for this view is then found in a theory of the criminal trial as a process through which alleged public wrongdoers are called to account—a process in which they should be active participants
