La importancia de la abducción en la etapa de investigación criminal
No full textEl artículo tiene como objetivo mostrar la relevancia de las discusiones sobre la abducción, que juega un papel central en el razonamiento probatorio existente en las primeras etapas de la investigación de un delito. A partir de la explicación de la estructura abductiva, se tomará como ejemplo un caso de investigación criminal ocurrido en Brasil, en el que la toma de decisiones por la policía fue precipitada y sesgada, dando lugar a la condena de un inocente. Tomando lo anterior como base, se presentarán algunas herramientas de inteligencia artificial existentes y otras propuestas de políticas públicas que pueden ser implementadas para formar a los responsables de la investigación criminal en la generación de mejores hipotesis de trabajo.The article aims to show the importance of discussing abduction, a type of inference that plays a central role in the evidential reasoning presented in the early stages of criminal investigation. After explaining the inference structure, the use of abduction reasoning will be exemplified using a real case, in which the police officer’s decision-making process was premature and biased, resulting in a judicial error and the conviction of an innocent man. Although not exhaustive, at the end, will be presented some suggestions to improve the criminal investigation using the abduction reasoning, as the use of artificial intelligence tools and public policy proposals which could be implemented to train those responsible for criminal investigations, all in order to generate better hypotheses
Notes linguistiques sur le « Salut d’amor » occitano-catalan
Get PDFRÉSUMÉ: L’article propose une analyse linguistique du Salut d’amor, texte narratif qui a été transmis par le chansonnier catalan Fa (Paris, BnF, esp. 487). Ce poème en octosyllabes, qui s’inscrit dans la tradition des novas rimadas, est caractérisé par un mélange d’éléments stylistiques et littéraires issus de la tradition des troubadours occitans, et d’images récurrentes dans les oeuvres narratives catalanes et même françaises. À travers un examen de la scripta, nous tenterons de résumer les traits les plus caractéristiques de la koinè littéraire occitano-catalane à laquelle le texte appartient.ABSTRACT: The article proposes a linguistic analysis of the Salut d’amor, a narrative text transmitted by the Catalan chansonnier Fa (Paris, BnF, esp. 487). This octosyllabic poem, which belongs to the tradition of the novas rimadas, is distinguished by a mixture of stylistic and literary elements derived from the Occitan troubadour tradition and also by images that recur in Catalan and French narrative works. Through an analysis of the scripta, we will try to summarise the most distinctive features of the Occitan-Catalan literary koinè to which the text belongs
Feminist Perspectives in FADU Classrooms: Gender Policies and the Landscape of Textile Design in Argentina
No full textFrom the perspective of gender studies and the history of textiles, numerous examples have been examined that highlight the role of textiles as a vehicle and tool in the feminist struggle. This phenomenon has gained particular relevance in recent years, playing a fundamental role in Latin American movements, especially in Argentina, which has led the region in terms of the legalization of abortion.
In this context, this presentation focuses on analyzing the impact of these discourses on the textile design program at the University of Buenos Aires. This program is unique in its kind in Argentine territory and has therefore been a breeding ground for innovative projects with a socially progressive perspective. Therefore, the works developed in this academic field from 2015, the date of the first "Ni Una Menos" (Not One Less) march, will be examined. Attention will be paid to their material, functional, and discursive attributes with the purpose of identifying and documenting feminist approaches in their conception and development. The ultimate goal is to discover how future female designers have responded to the feminist political landscape and how they have integrated these perspectives into their projects.Desde el ámbito de los estudios de género y la historia de los textiles, se han examinado numerosos ejemplos que destacan el papel del textil como vehículo y herramienta en la lucha feminista. Este fenómeno ha cobrado particular relevancia en los últimos años, desempeñando un papel fundamental en los movimientos latinoamericanos, especialmente en Argentina, que ha liderado la región en lo que respecta a la legalización del aborto.
En este contexto, la presente ponencia se centra en analizar el impacto de estos discursos en el programa de diseño textil de la Universidad de Buenos Aires. Esta carrera es única en su tipo en el territorio argentino y, por ende, ha sido un semillero para la gestación de proyectos innovadores con una perspectiva socialmente avanzada. Por lo tanto, se examinarán los trabajos desarrollados en este ámbito académico a partir de 2015, fecha de la primera marcha Ni Una Menos. Se prestará atención a sus atributos materiales, funcionales y discursivos con el propósito de identificar y registrar estrategias de enfoque feminista en su concepción y desarrollo. El objetivo último es descubrir cómo las futuras diseñadoras han respondido al panorama político feminista y cómo han integrado estas perspectivas en sus proyecto
Overview of Spanish Universities’ Sustainability and Sustainability Communication Performance
No full textSustainability is not only essential for protecting environment; it is also important for equality, human rights, the fight against hunger, education, health services and social development. Sustainability communication is just as important as these efforts. Through communication efforts, it is possible to make these efforts known and raise awareness on the subject. Universities, which have the greatest role in the development of society, are responsible for raising informed and aware future generations and also lead other institutions in this. This research aims to holistically assess current sustainability and related communication practices particularly gender/equality to reveal the general framework of sustainability structures in universities and to examine communication practices surrounding sustainability in Spanish universities, which perform well in this regard, especially in gender equality. A survey was conducted with 12 Spanish universities which are scored in THE and QS World University Rankings according to their SDG performances.AbstractSustainability is not only essential for protecting the environment; it is also important for equality, human rights, the fight against hunger, education, health services and social development. Consum de drogues, malestar psicològic i necessitat de suport relacionat amb successos vitals estressants en estudiants universitaris.
Get PDFLa pandèmia per Covid-19 ha suposat un gran impacte per la població general i en major grau en població considerada vulnerable. Entre aquest grup de subjectes en situació de vulnerabilitat podem ubicar als joves estudiants. A més de la variable pandèmica, existeixen altres esdeveniments vitals estressants que interpel·len en el malestar psicològic del jovent. El fet de no disposar d’estratègies per afrontar i gestionar aquests successos pot esdevenir conductes de risc. Entre les seves expressions trobem el consum de drogues, el desencadenament de diferents trastorns i en el pitjor dels casos en ideació autolítica. L’objectiu d’aquest estudi pretén fer una avaluació dins del context de la pandèmia per Covid-19 amb relació a les variables del malestar psicològic, els esdeveniments vitals estressants, el consum de drogues i la ideació autolítica en els estudiants dels diferents cursos d’Educació Social de la Universitat de Girona. La mida de la mostra es va determinar en 155 participants. Es va procedir a la creació d’un qüestionari, incloent les escales adequades per l’obtenció de les dades objecte d’estudi. Es varen obtenir els resultats a partir d’un disseny d’estudi transversal, observacional i analític. Corax and Anticorax: to the Origins of Judicial Rhetoric Córax y anticórax: a los orígenes de la retórica judicial
No full textAbstract: This paper aims to contribute to the discussion on corax, the first judicial argument that tradition attributes to two rhetoricians, Tisias and Corax. First, the paper addresses the historiographical questions about the identity of Tisias and Corax, accepting the interpretation of the existence of only one rhetorician, Tisias, called Corax. Subsequently, the study focuses on the argument ‘corax’ that Tisias developed which is based on verisimilitude, within the context of the birth and development of rhetoric. Although, in the critical literature, only one example of corax has been found in Antiphon’s Tetralogy A, this article argues that the same tetralogy also contains the answer to corax. This response called ‘anticorax’ provides the argumentative model by which a speaker can attempt to counter a corax. Argument and counterargument are inserted in the antilogical construction on which judicial debates are developed. This study proposes to deepen the origin of rhetoric, adding to its history the formulation of the ‘anticorax.
Homicide, infidelity and dirt in hotel rooms: problems of probatory significance
No full textAs chamadas evidências não se podem considerar provas dos crimes antes que se lhes imponha um significado probatório, mas este significado é mais problemático do que os discursos acusatórios estão dispostos a admitir. Este artigo pretende discutir as diversas teorias do significado que se encontram na filosofia da linguagem em diálogo com a filosofia da mente, buscando responder o que podemos considerar significado probatório em contexto processual penal. Buscaremos enfatizar como a dimensão pragmática é especialmente relevante para alcançarmos um significado qualquer, sobretudo em questão probatória penal. Ao final, esperamos tornar evidente que o significado probatório depende de muitos elementos ideológicos que contribuem para uma conclusão acerca do que é prova de um crime.The so-called evidence cannot be considered proof of crimes before a probatory meaning is imposed on them, but this meaning is more problematic than accusatory speeches are willing to admit. This article intends to discuss the different theories of meaning found in the philosophy of language in dialogue with the philosophy of mind, seeking to answer what we can consider probatory meaning in a criminal procedural context. We will seek to emphasize how the pragmatic dimension is especially relevant to achieve any meaning, especially in matters of criminal proof. In the end, we hope to make evident that the probatory meaning depends on many ideological elements that contribute to a conclusion about what is proof of a crime
Erro judiciário e reconhecimento de pessoas: lições extraídas da experiência brasileira
No full textO presente trabalho pretende extrair, a partir da trajetória do reconhecimento de pessoas no processo penal brasileiro, lições que possam contribuir para a evitação do erro judiciário. Para tanto, analisar-se-á a evolução jurisprudencial sobre o tema do reconhecimento e o discurso acerca do respeito às formalidades do art. 226 do código de processo penal brasileiro. Em seguida, com base em revisão bibliográfica de trabalhos sobre processo penal, prova judicial e psicologia do testemunho, buscar-se-á extrair algumas lições oferecidas por esta experiência, sobretudo no que diz respeito ao equívoco em apostar na superioridade moral e cognitiva dos juízes como remédio para as ilegalidades no âmbito da prova e à importância de se levar a ciência a sério, seja no desenho legislativo sobre os meios de prova, seja na atividade judicial de valoração probatória.The present work intends to elicit, from the trajectory of the eyewitness identification in the Brazilian criminal procedure, lessons that can contribute to the avoidance of judicial error. In order to do so, the work will analyze the jurisprudential evolution on the issue of eyewitness identification and the discourse on respect for the formalities of rule 226 of the Brazilian Criminal Procedure Code. Then, based on a bibliographic review of works on criminal procedure, legal evidence, and psychology of testimony, we will seek to extract some lessons offered by this experience, specially with regard to the mistake in relying on the moral and cognitive superiority of judges as a remedy for evidentiary illegalities and the importance of taking science seriously, whether in the legislative design on the means of proof, or in the judicial activity of probative valuation
