    Naturalized Epistemology and the Law of Evidence: A Reply to Pardo, Spellman, Muffato, and Enoch

    In «Naturalized Epistemology and the Law of Evidence Revisited», the original target article for the various refutations that I comment on here, I revisited through a slightly different lens the subject of the article that I coauthored with Brian Leiter close to twenty years ago. That article has prompted four responses from Professors Pardo, Spellman, Muffato, and Enoch. Professors Pardo and Spellman basically accept the implications of the original article and offer useful but friendly amendments. Prof. Muffato apparently does not want to dispute over my ground and so changes the subject, and in doing so offers a number of interesting points. Only the fourth, Prof. Enoch, has the same doubts about the utility of my original article as I do of the genre that gave rise to it. I can thus be quite brief in discussing professors Pardo, Spellman, and Muffato, but it will take bit more effort to lay out the limits of Prof. Enoch’s analysis

    In this article the author defends that using documents as evidence should demand analysis beyond the «paper», aiming at the evidential reasoning behind. Being so, in the first part the article presents the traditional premises about documents in civil law countries, criticizing them, after. In the second part, thinking on the phases of admission, production, and evaluation of evidence of documents used as evidence, the article presents criticisms and ideas for rethinking the form of working with documents in the civil law countries.En el presente artículo se defiende la necesidad de que los documentos sean analizados más allá del «papel», atendiendo al razonamiento probatorio que está por detrás. Así, en la primera parte se presentan y critican las premisas tradicionales. En la segunda, pensando en las fases de admisión, práctica y valoración de la prueba documental, se formulan críticas y propuestas para replantear la forma de trabajar con documentos en los países de civil law

    Audiovisuals for the social appropriation of science: extrinsic culture factors that influence its consumption

    Se presenta un estudio cuyo objetivo fue analizar algunos de los factores de cultura científica intrínseca en una población usuaria de redes sociales, con el fin de provocar reflexiones sobre el porqué se deberían considerar esos factores cuando se planifica la producción y distribución de audiovisuales de ciencia, especialmente en redes sociales. La muestra cualitativa estuvo compuesta por 182 personas mediante participación voluntaria, y las respuestas se recolectaron con un cuestionario digital en agosto y setiembre de 2021. Se estudiaron los hábitos de información, la actividad múltiple y uso de dispositivos, y los porcentajes de confianza en distintos emisores. Como resultados principales, aunque las personas declaran mucho interés en la ciencia, eso no se traduce en búsqueda activa de información y menos en participación en actividades. Un 91,5% del grupo entrevistado declaró actividad simultánea cuando consume audiovisuales de ciencia en redes sociales y la confianza premia a las universidades públicas y organismos internacionales y elude a líderes religiosos y a familiares.This study aimed to analyze some of the factors of intrinsic scientific culture in a population that uses social networks, in order to provoke reflections on why these factors should be considered when planning the production and distribution of science audiovisuals, especially in social networks. The qualitative sample consisted of 182 people through voluntary participation, and the responses were collected with a digital questionnaire in August and September 2021. The study variables were information habits, multiple activity and use of devices, and the percentages of trust in different sources. As main results, although people declare a lot of interest in science, this does not translate into an active search for information and less in participation in activities. 91.5% of the interviewed group declared simultaneous activity when they consume science audiovisuals on social networks and trust rewards public universities and international organizations and eludes religious leaders and family members

    Abstract - Apart from the considerations set out by jurists, moralists or sarcastic poets about cursing in the late Middle Ages, the main purpose of this article is to analyse the use of the insults («bad words, dishonest and offensive»), through the direct study of municipal sources and court proceedings, in the social and political life of a Catalan city within this period, focusing on the analysis of the insult’s variants, the situations where it was used, those targeted by it and some of its resulting consequences at every turn. Despite the frequent attempts to restrict or forbid its usage so as not to «stray away from good morals», blasphemy and derision became a rather common means of attack, predominantly in lawsuits and in convulsive contexts. Nevertheless, the sanctions imposed on offenders varied extensively, ranging from a simple request for pardon to fines, loss of rights, and even punishment by death.Keywords - Insults, Morality, Municipal Power, Tarragona, Late Middle Ages

    El trabajo se propone realizar un análisis del concepto subyacente al término «máximas de experiencia». En primer lugar, se intenta establecer el estado actual de la comprensión del término por parte de la doctrina. A partir de ello, se da cuenta de la diversidad de conceptos que se manejan y se propone evaluar la estructura lógica de los enunciados a los que se suele catalogar como máximas de experiencia y el rol que cumplen en la valoración de la prueba. A continuación, el texto busca explorar el reemplazo del término por el concepto de generalizaciones y escoge una clasificación de estas. Finalmente, se advierte acerca de algunos peligros en su utilización y se proponen ciertos criterios para su empleo en los razonamientos sobre hechos.This study aims to analyze the concept beyond the term «maxims of experience». First, it attempts to settle how the term is currently understood by legal scholars. Secondly, it finds that a wide variety of concepts are being used and, consequently, examines the logical structure of the statements that are usually classified as maxims of experience and the role in evidence assessment. Afterwards, the essay seeks to explore if the term could be replaced by the concept of generalizations and choose a classification of these. Finally, the work warns about some risks in their use and some criteria are proposed for their application to legal fact reasoning

    Pérdida de oportunidades para la comunicación científica en las universidades españolas

    Cada vez es más reconocido que comunicar la ciencia al público en general es parte del papel de un científico. Sin embargo, muchos investigadores aún no consideran la comunicación como una tarea prioritaria en su agenda y la mayoría de ellos no tiene formación en comunicación científica. Además, la mayoría de los investigadores no tienen formación en comunicación científica o formación para llegar a audiencias no científicas. Por este motivo, los estudiantes de ciencias ingresan en la actualidad en un entorno profesional que requiere habilidades comunicativas que no se les suelen enseñar durante los estudios de grado. Ignorar el problema fomenta aún más la desconfianza y aliena aún más al público en general de la investigación científica. Este artículo investiga las diferentes percepciones que tienen los estudiantes de biomedicina de la Universidad  de Barcelona sobre la comunicación científica. El objetivo del estudio fue determinar si los futuros investigadores biomédicos consideran importante la comunicación de la ciencia, si tienen algún plan para considerarla como una carrera y si reciben suficiente información y formación en la universidad para poder desarrollar dicha carrera. Un hallazgo clave del estudio es que los estudiantes conocen la importancia de la comunicación científica, pero falta motivación, información y formación a nivel universitario. Esto sugeriría una pérdida percibida de oportunidades para fomentar la comunicación científica eficaz en las universidades.It is increasingly recognized that communicating science to the general public is part of a scientist’s role. However, many researchers still do not consider communication as a priority task in their agenda and most of them have no training in science communication. Moreover, most scientific researchers have no training in science communication or training in outreach to non-scientific audiences. These graduates thus currently enter a professional environment that requires communication skills that are not usually taught them during undergraduate studies. Ignoring the issue further fosters mistrust and further alienates the general public from scientific research. This article investigates the different perceptions that biomedical undergraduates at the University of Barcelona have about science communication. The aim of the study was to  determine whether future biomedical researchers consider science communication to be important, whether they have any plans to consider it as a career and whether they receive sufficient information and training at university to be able to develop such a career. A key finding of the study is that students know the importance of science communication, but motivation, information and training at university level is lacking. This would suggest a perceived loss of opportunities to foster effective science communication in universities

    El Cançoner trobadoresc de Sant Joan de les Abadesses: estat de la qüestió, història arxivística i context de producció

    Abstract - In 1917, Josep Masdeu, the monastery archivist of Sant Joan de les Abadesses, identified four songs written down in some blank spaces of a paper-based notarial book of the village. In 1935, Higini Anglès, a musicologist of recognized prestige, made them public and since then, they comprise the songbook of Sant Joan de les Abadesses, the unique troubadour catalogue in Catalonia including both the text of the songs and their equivalent musical notation to be performed. From that moment on, the manuscript has been studied in many occasions from a linguistic and musical point of view. The manuscript, currently preserved at the National Library of Catalonia, includes some other text passages of legal topics which we analyse in depth because they delimit the exact chronological period of the song writings. Our study, therefore, has been focused on three main purposes. In the first place, we revise the contributions made so far regarding the description of the document. Next, we build up the archivistic history of the manuscript, from the moment it was discovered until it was deposited in the library mentioned above.
