La necessitat d’anomenar vila un llogarret: motivacions en la fundació de San Vicente de la Barquera (1210)
ABSTRACT - This article proposes is to show a series of hypotheses about the reasons behind the founding of San Vicente de la Barquera by King Alfonso VIII of Castile. Like the rest of the inhabited centers in the Cantabrian coast, this town was a rural space: one of the so-called aldeas (small towns) or costas bravas (rough coasts). When the need to articulate, arbitrate, trade and dominate, led to the kings of several kingdoms to call them villas. This might be interpreted as a mere declaration of intent. However in this article we we point to other factors that were involved in the founding of this port town.KEYWORDS - Villa; Small Village; San Vicente de la Barquera; Founding
«Ki ore irat od Loovis»: La vocazione dei cavalieri francesi alla Crociata. Per una lettura di RS 1548
Abstract - The contribution is devoted to the anonymous song «Chevalier mult estes guariz» (RS 1548a), transcribed during the second half of the twelfth century on f. 88 of the composite codex Erfurt, Universitätsbibliothek, Dep. Erf. Codex Amplonianus 8° 32. The jointed transmission of text and music for a lyrical form with refrain and responsorial structure makes this crusading song — the earliest extant exemplar in Old French — an outstanding witness. The contribution highlights the leading role played by the musical execution, underlined by the rewriting of the refrain last line with an extra-neume entered above the text possibly serving the practical purposes of the reader-singer.Keywords - Old French Lyric, Crusades, Early Music Writing, Anglo-Norman Literature

This paper explores the French references in Francesc de la Via’s narrative poem "Procés de Corona d’aur". The French songs mentioned in the poem are close to some rondeaux that were probably sung at the court of King Martin I of Aragon
(Un-)Interpretability in Expert Evidence: An Inquiry into the Frontiers of Evidential Assessment
Evidence law regimes across several contemporary legal orders provide a host of doctrinal devices designed to probe various sorts and sources of information, especially with respect to their accuracy and reliability. These legal provisions, however, are vulnerable to or even tolerant towards uninterpretable evidence, that is evidence whose probative value cannot be assessed. This article critically examines and discusses the “littering paths” of uninterpretable evidence in legal proceedings. We point out the misinformative character and potentially misleading impact on criminal adjudication when using scientific evidence for purposes that, strictly speaking, the evidence cannot help with. We identify common causes and possible remedies and argue that to track uninterpretability, it is necessary to understand what exactly it means to say that a piece of evidence is probative in the procedural space of reasons, and how to draw the line between informative and non-informative items of evidence
Culture, strategy and growth: a model of people towards business acceleration
Introducción: La pandemia COVID-19 aceleró la presencia el futuro y visibilizó todos los cambios tecnológicos y estratégicos lo que complica aún mas la situación competitiva de las empresas de Ecuador. Metodología: A través de la revisión documental de los principales conceptos referentes a cultura organizacional, estrategia y creación de valor; además, de una investigación profunda realizada en Ecuador, se identifican elementos y elecciones que influyen en la baja competitividad del país y así establecer un modelo para el crecimiento para estas empresas.Resultados: Solamente el 42,4% de las organizaciones investigadas tienen una creencia profunda para la sostenibilidad; el 42,4% una propuesta de valor enfocada en la eficiencia y productividad; y, el 62,3% no cuentan con una metodología para el desarrollo de proyectos de innovación. Discusión: El modelo estratégico utilizado por estas empresas no tiene claridad en el diseño y está enfocado en la eficiencia, los planes operativos y el corto plazo.Conclusiones: El diseño de un modelo cultura – estrategia – crecimiento permite incorporar elementos fundamentales para mejorar el crecimiento y la competitividad de las organizaciones en Ecuador.Introduction: The COVID-19 pandemic acceleratedthe presence in the future and made all technologicaland strategic changes visible which further complicatesthe competitive situation of companies in Ecuador.Methodology: Through the documentary reviewof the main concepts referring to organizationalculture, strategy and value creation; in addition,to a deep investigation carried out in Ecuador,elements and elections that influence the lowcompetitiveness of the country are identifiedand thus establish a model for growth forthese companies. Results: Only 42.4% of theorganizations investigated have a deep belief insustainability; 42.4% a value proposition focusedon efficiency and productivity; and, 62.3% donot have a methodology for the development ofinnovation projects. Discussion: The strategicmodel used by these companies lacks clarity indesign and is focused on efficiency, operationalplans and the short term. ABSTRACT - This article analyses the poetic performance by Prince Peter of Aragon (at the time, count of Empúries) during the feast to celebrate his older brother Alfons’s coronation in 1328, as described in Ramon Muntaner’s chronicle. Both the context of the whole ceremony and the contemporary poetic trends provide indications to further the understanding of this scene. In Defense of Weird Hypotheticals
Professor Allen (this issue) critiques the value of using “weird” hypotheticals to mine intuitions about legal systems. I respond by supporting the value of “thin” hypotheticals for providing information about how people reason generally, rather than for revealing peoples’ specific answers. I note that because legal systems are the products of many minds thinking about how other minds operate, the object of inquiry is metacognition—that is, understanding how reasoning works
A privacidade digital posta à prova no processo penal
The Article 8 of the European Convention on Human Rights deals with the need of respect for privacy. The 4th Amendment to the US Constitution addresses the same issue. The criminal procedure ensures the protection of privacy, as far as possible, and the praxis must recognize that, for privacy reasons, there should be limits to the seizure of computer records and to its off-site analysis. Among the critical aspects of the off-site analysis of electronic data, the approach to be adopted by the law enforcement officers in the face of serendipity findings largely remains an unanswered question. The doctrine of the European Court of Human Rights is characterized by some ineffectiveness in the creation of remedies for the violation of privacy in criminal proceedings, namely with regard to the search of data contained on computers and its off-site analysis, mainly because it does not order the exclusion of computer-generated evidence that has been illegally gathered, which should be the case, in the light of the fair trial principle. The knowledge of the North American case law and guidelines could represent a valuable contribution to the improvement of Strasbourg jurisprudence, in its decision-making role and also in its nomophylactic function, as well as to the improvement of European national legal systems at the legislative level and at the level of decision-making processes.O artigo 8.º da Convenção Europeia dos Direitos Humanos trata do respeito pela privacidade. O Quarto Aditamento à Constituição dos EUA trata igualmente do respeito pela privacidade. O processo penal deve assegurar a proteção da privacidade, na medida do possível, e o direito em ação deve respeitar os limites da cópia de dados eletrónicos e as restrições impostas à análise externa do acervo recolhido. Entre os aspetos críticos da análise externa de dados eletrónicos, avulta a questão do procedimento a adotar pelo investigador criminal diante dos conhecimentos fortuitos, uma questão que é analisada detalhadamente neste artigo. A jurisprudência do Tribunal Europeu dos Direitos Humanos caracteriza-se por alguma ineficácia na criação de remédios para a violação da privacidade no processo penal, designadamente no tocante à cópia de dados eletrónicos e à análise externa do acervo recolhido, desde logo porque não comina a exclusão das evidências produzidas por computador que tenham sido obtidas ilicitamente, o que deveria ser o caso ser o caso, à luz do princípio do processo equitativo. O conhecimento das diretrizes e do direito jurisprudencial norte-americano representa um contributo valioso para o aprofundamento da jurisprudência de Estrasburgo, na sua dupla função decisória e nomofilácica, assim como para o aperfeiçoamento dos ordenamentos jurídicos nacionais europeus ao nível legislativo e ao nível da prática decisória e jurisprudencial
