    Aquest és el primer número de la nova etapa de la revista de la Facultat de Lletres Estudi General. Es tracta d’una capçalera històrica de les publicacions periòdiques generades des de la Universitat de Girona, juntament amb Scientia Gerundensis. En efecte, l’any 1981 naixia Estudi General per commemorar el desè aniversari del Col·legi Universitari de Girona (CUG), el precedent més immediat, recordem-ho, de l’actual UdG, creada el 1991

    Transphobic Discourses on Sociodigital Networks: An Analysis of Comments in Facebook Groups

    A través de etnografía una digital y un análisis multimodal del discurso se identificaron en grupos latinoamericanos de Facebook las formas en las que se expresan discursos transfóbicos en las modalidades verbales y no verbales de posts y memes en redes sociodigitales, que sirvan para dar cuenta de las tramas comunes presentes en el lenguaje peyorativo. Los datos mostraron la presencia de discursos transfóbicos en comentarios y memes los cuales se organizaron como estereotipos y prejuicios a partir de las posturas de los interlocutores. Los datos permitieron formular cinco registros que sirven para analizar la transfobia expresada en redes sociodigitales, los cuales organizaron el discurso como deshumanizante, biologicista, psicologista, cientificista y paternalista. Se concluyó que en comunidades virtuales existe un rechazo hacia las personas trans que se expresa por medio del uso de lenguaje peyorativo en sus modalidades verbal y no verbal, mismo que configura discursos de odio en diferentes niveles.Through digital ethnography and multimodal discourse analysis, we identified in Latin American Facebook groups the ways in which transphobic discourses are expressed in the verbal and non-verbal modalities of posts and memes in sociodigital networks, which serve to account for the common ways of presentation in pejorative language. The data showed the presence of transphobic discourse in comments and memes, which were organized as stereotypes and prejudices based on the positions of the interlocutors. The data allowed for the formulation of five registers to analyze transphobia expressed on sociodigital networks, organizing discourse as dehumanizing, biologistic, psychological, scientistic, and paternalistic. It was concluded that in virtual communities, there is a rejection towards trans individuals expressed through the use of pejorative language in both verbal and non-verbal modalities, shaping hate speech at different levels.&nbsp

    Implicit Biases, Explicit Injustice: Epistemic Effects on Unconscious Biases in Evidential Reasoning in Mexico

    En este artículo se realiza un análisis epistemológico del impacto de los sesgos implícitos en el razonamiento probatorio en el contexto del derecho procesal penal mexicano. Se argumenta que estos sesgos afectan la justificación de las creencias, además de causar daños a individuos y a la sociedad, dificultando el logro de metas epistémicas del proceso, tales como la búsqueda de la verdad o el esclarecimiento de los hechos. Se sostiene que las personas juzgadoras son epistémicamente responsables por sus creencias implícitamente sesgadas, incluso si i) no tienen control directo sobre ellas, ii) su influencia es inconsciente y iii) no tienen acceso al conocimiento científico sobre los sesgos. Como ejemplo, se analiza la influencia de dichos sesgos en la valoración de la prueba testimonial según la jurisprudencia mexicana. También se proponen dos soluciones procesales para mitigar su impacto epistémicamente negativo.This article provides an epistemological analysis of the impact of implicit biases on evidentiary reasoning within the context of Mexican criminal law. It argues that these biases affect the justification of beliefs, causing harm to individuals and society, and hindering the achievement of epistemic goals of the process, such as the pursuit of truth or fact-finding. It posits that judges are epistemically responsible for their implicitly biased beliefs, even if i) they do not have direct control over them, ii) their influence is unconscious, and iii) they lack access to scientific knowledge about biases. As an example, the influence of these biases on the evaluation of testimonial evidence according to Mexican jurisprudence is analyzed. Two procedural solutions are also proposed to mitigate their negative epistemic effects

    Understanding Epistemic Injustice as Contributory Injustice: A Comment on Picinali's Argument

    This paper offers some further support to Federico Picinali’s argument, in «Evidential Reasoning, Testimonial Injustice and the Fairness of the Criminal Trial», that a trial is unfair when assessments of relevance and probative value includes an epistemic injustice, namely a testimonial injustice. It has been argued that there are barriers to establishing testimonial injustice in specific cases, such as the ones Picinali surveys. This paper argues that even if we accept that there are concerns about establishing the occurrence of a testimonial injustice in the cases Picinali identifies, we can reformulate the epistemic injustice that renders the trial unfair as a contributory injustice. Reformulating the epistemic injustice as a contributory injustice evades the concerns we might have with establishing testimonial injustice allowing Picinali’s broad argument that a trial is unfair when an assessment of evidence includes an epistemic injustice—contributory or testimonial—to remain intact. This reformulation also offers new propositions on how to combat epistemic injustice

    Consideraciones dogmáticas y probatorias sobre el dolo en el proceso penal

    El análisis del dolo supone dilucidar tres discusiones íntimamente relacionadas. La primera es la cuestión conceptual referida a la definición dogmática del dolo y supone revisar sus teorías y críticas a fin de precisar el contenido del dolo y determinar si es un hecho que puede ser probado o si es una categoría normativa de imputación penal. Ello es relevante para la cuestión epistemológica sobre cuál es el objeto de prueba en la atribución o imputación del dolo y consiste en precisar si en el proceso penal el thema probandum son ciertos estados mentales eventualmente relevantes para la imputación dolosa o los indicios susceptibles de subsumirse en un catálogo abierto y referencial de indicadores normativos. La tercera discusión se refiere a la cuestión epistemológica sobre el método mediante el cual se acreditan dichos estados mentales o indicios y presupone precisar si el enlace que conecta las pruebas con la hipótesis a probar puede sólo consistir sólo en una generalización epistémica o si, además, las presunciones y los conceptos (como el dolo) y sus teorías son especies de inferencias probatorias.   The analysis of mens rea involves elucidating three closely related discussions. The first is the conceptual issue refered to the dogmatic definition of mens rea and involves reviewing its theories and criticisms in order to specify the content of mens rea and determine if it is a fact that can be proven or if it is a normative category of criminal accusation. This is relevant to the epistemological question about what is to be prooved in the attribution or imputation of mens rea and consists in specifying whether in the criminal trial the thema probandum are certain state of mind that may be relevant to the mens rea imputation or the indications that can be subsumed in a open and referential catalog of regulatory indicators. The third discussion refers to the epistemological question involving the method by which state of minds or indications are prooved and presupposes specifying whether the link that connects the evidence with the hypothesis to be tested can only consist of an epistemic generalization or if, in addition, presumptions and concepts (such as mens rea) and their theories are types of evidentiary inferences

    The chemical expert report on the determination of gunshot residue: Minimum content, expert reasoning and due process

    This article aims to analyze an expert report produced by the legal chemistry area in the determination of gunshot residue. The purpose is to determine if it has the necessary information to evaluate the quality of the expert knowledge, considering the demands of due process. To achieve this purpose, first of all, the content of the report will be described in relation to procedural regulations and expert practice, focusing on its formal aspects. In the second part, emphasis will be placed on the substantial aspects, highlighting the content of the specialized knowledge present in the expert report, and evaluating the quality of the expert knowledge in the particular case, trying to understand the logic underlying the expert reasoning. Finally, in the third part, reflections and recommendations for improvement will be presented, related to the previous points, with the purpose of contributing to the quality of specialized knowledge, which is essential to guarantee an adequate legal process.Este artículo tiene como objetivo analizar un informe pericial producido por el área de química legal en la determinación de residuos de disparo. La finalidad es examinar si el mismo cuenta con la información necesaria para evaluar la calidad del conocimiento experto, considerando las exigencias del debido proceso. Para alcanzar este propósito, en primer lugar, se describirá el contenido del informe en relación con la normativa procesal y la práctica pericial, con un enfoque en los aspectos formales del mismo. En la segunda parte, se hará hincapié en los aspectos sustanciales, resaltando el contenido del conocimiento especializado y evaluando la calidad del conocimiento experto en el caso particular, tratando de comprender la lógica subyacente en el razonamiento pericial. Finalmente, en la tercera parte, se presentarán reflexiones y recomendaciones de mejora, relacionadas con los puntos anteriores, con el propósito de contribuir a la calidad del conocimiento especializado, esencial para garantizar un proceso legal adecuado

    UNA MIRADA A LA RECEPCIÓN DE LITERATURA JURÍDICA HISPANOAMERICANA EN LA ESPAÑA DE LA SEGUNDA MITAD DEL XIX: RESEÑAS, AUTORES Y OBRAS

    The survival (or introduction) of Spanish legal literature in Spanish-American classrooms and offices, starting in the 1820s (in which most of the processes that would lead to the political independence of Spain from the current American States were concluded), has been approached -either as an object of investigation-, or at the service of the analysis of other matters, which have sufficiently accredited it. This article tries to support a story in the opposite direction, about which we have not found abundant literature: is there evidence about the reception in 19th century Spain of Hispanic American legal literature? If so, the questions are multiple: What works received attention, and by whom? How intense was it? What judgment was issued about these works, and what news is given about their authors? Was attention paid to all kinds of publications, including magazines? In the following lines we try to outline an answer, using, as a primary source, the entire nineteenth-century collection of the most important periodical publication of a legal nature of that time: the Revista General de Legislación y Jurisprudencia.  La pervivencia (o introducción) de literatura jurídica española en las aulas y despachos de letrados hispanoamericanos, a partir de la década del 1820 (en la que se concluye la mayoría de los procesos que derivarían en la independencia política de España de los actuales Estados americanos), ha sido abordada -bien como objeto de investigación-, o bien al servicio del análisis de otros asuntos, que la han acreditado con suficiencia. El presente artículo propone un relato en el sentido opuesto, quizá menos evidenciado: ¿existen evidencias sobre la recepción en la España del XIX de literatura jurídica hispanoamericana? En caso de que así fuere, las interrogantes son múltiples: ¿Qué obras recibieron atención, y por parte de quién? ¿Con qué intensidad se dio? ¿Qué juicio se emitió sobre dichas obras, y qué noticias se da sobre sus autores? ¿Se prestó atención a toda clase de publicaciones, incluidas las revistas? En las líneas subsiguientes intentamos esbozar una respuesta, empleando, como fuente primaria, la íntegra colección decimonónica de la publicación periódica de carácter jurídico más importante de la época: Revista General de Legislación y Jurisprudencia

Aquest treball explica el mestratge que va exercir el savi català en els membres del que s’ha anomenat el Grup de Barranquilla al Carib colombià, com el mateix García Márquez, originant el premacondisme; però també va ser el mentor i guia intel·lectual d’altres autors de la importància d’Álvaro Cepeda Samudio i de Javier Auqué Lara, fill del soci de Vinyes amb qui va obrir la famosa llibreria Ramon Vinyes & Co. a Barranquilla

    Exploring the support needs of adults with intellectual and/or developmental disabilities in Chile.

    El paradigma de los apoyos ha venido a transformar las prácticas en el ámbito de las discapacidades intelectuales, esto en conjunto con el enfoque de derechos ha traído consigo la necesidad de transformar las prácticas de inclusión en este campo. Pero ¿cómo transformamos las prácticas y los espacios si no se conocen en detalle las necesidades de apoyo de las personas con discapacidad intelectual?. En Chile esta es una realidad que debe ser afrontada, si bien hay estudios que han abordado el tema aún queda mucho por hacer. En este sentido el presente trabajo pretende dar a conocer las principales necesidades de apoyo de un grupo de 93 personas adultas  con DID, para la investigación se utilizó un muestreo por conveniencia compuesto por 93 participantes con DI entre 18 y 39 años (ME=28.3, DE=5.6), usuarios de tres asociaciones de atención a la discapacidad en la Región Metropolitana y en la Región de Valparaíso (Chile). Para conformar la muestra de personas con DI se establecieron dos criterios de inclusión: (1) tener un diagnóstico de DI según los estándares del DSM-5; y (2) tener 18 años o más. El 75,3% de las personas con DI fueron hombres con un grado de DI severo (46,2%) y un nivel socioeconómico medio-bajo (86%). La información sobre las personas con DI fue facilitada por 26 informantes, de los cuales el 11,5% eran cuidadores, 34,6% educadores, 34,6% profesionales del área de la salud y 19,2% profesionales de apoyo en residencias. Los principales resultados no evidencian diferencias significativas respecto a grado de DI, género y Nivel Socioeconómico, sin embargo, es necesario avanzar en la necesidad reflexionar estrategias específicas específicamente con la población en su mayoría se encuentra en un nivel III de Necesidades de Apoyo, lo que se puede interpretar como un nivel alto de necesidades de apoyo.The paradigm of supports has come to transform practices in the field of intellectual disabilities, this in conjunction with the rights approach has brought with it the need to transform the practices of inclusion in this field. But how do we transform practices and spaces if we do not know in detail the support needs of people with intellectual disabilities? In Chile this is a reality that must be faced, although there are studies that have addressed the issue there is still much to be done. In this sense, the present work intends to show the main support needs of a group of 93 adults with IDD, for the research a convenience sampling was used, composed by 93 participants with ID between 18 and 39 years old (ME=28.3, SD=5.6), users of three associations of attention to disability in the Metropolitan Region and in the Valparaiso Region (Chile). To form the sample of people with ID, two inclusion criteria were established: (1) having a diagnosis of ID according to DSM-5 standards; and (2) being 18 years of age or older. Of the total sample, 46.2% had a severe degree of ID and the majority (86%) had a medium-low socioeconomic level. Information on people with ID was provided by 26 informants, of whom 11.5% were caregivers, 34.6% were educators, 34.6% were health professionals and 19.2% were nursing home support professionals. The main results do not show significant differences with respect to degree of ID, gender and socioeconomic level, however, it is necessary to advance in the need to reflect on specific strategies specifically with the population, most of which is at level III of Support Needs, which can be interpreted as a high level of support needs.El paradigma de los apoyos ha venido a transformar las prácticas en el ámbito de las discapacidades intelectuales, esto en conjunto con el enfoque de derechos ha traído consigo la necesidad de transformar las prácticas de inclusión en este campo.     Educación inclusiva para personas con discapacidad intelectual en el sector de la enseñanza superior: metodologías pedagógicas y prácticas de traducción de los derechos a la práctica

    El artículo 24 de la Convención sobre los Derechos de las Personas con Discapacidad (CDPD) constituye la piedra angular del derecho a la «educación inclusiva», y en su apartado 1 establece que los Estados «garantizarán un sistema educativo inclusivo a todos los niveles» (2006). El Comité sobre los Derechos de las Personas con Discapacidad afirma que la inclusión «supone un proceso de reforma sistémica que entraña cambios y modificaciones en el contenido, los métodos de enseñanza, los enfoques, las estructuras y las estrategias de la educación» (2016, [11]). Sin embargo, este derecho a la educación inclusiva no se ha hecho realidad de manera sistemática para los estudiantes con discapacidad intelectual en la Educación Superior (ES). Este artículo (1) explorará el derecho a la educación inclusiva para personas con discapacidad establecido en la CDPD (2) revisará la investigación existente sobre pedagogías y prácticas para la enseñanza de estudiantes con discapacidad intelectual en la ES en Irlanda, Canadá, EE.UU. y Australia, (3) describirá un programa inclusivo basado en los derechos para personas con discapacidad intelectual desarrollado en una universidad irlandesa (UCC), y (4) argumentará que la reflexión crítica, la documentación y el intercambio de pedagogías y prácticas de programas basados en los derechos en la ES es clave para el desarrollo y la difusión de ideas prácticas en este campo emergente de la educación.Article 24 of the Convention on the Rights of Persons with Disabilities (CRPD) forms the cornerstone of the right to “inclusive education”, outlining in subsection 1 that, States “shall ensure an inclusive education system at all levels” (2006).  The Committee on the Rights of Persons with Disabilities states that inclusion “involves a process of systemic reform embodying changes and modifications in content, teaching methods, approaches, structures and strategies in education” (2016, [11]). However, this right to inclusive education has not been realised in any systematic way for students with Intellectual Disabilities in Higher Education (HE).
