The Concept of Childfree Perspective of Law Number 1 Year 1974 on Marriage and Compilation of Islamic Laws

    Get PDF
Modernization in the current era has brought significant changes to various aspects of life, including the institution of Marriage. One emerging phenomenon is childfree, which refers to a couple's decision not to have children, either through natural birth or adoption. In Indonesian society, the presence of children is often seen as a blessing and a sign of trust in God. Still, the decision to live without children poses unique psychological and economic challenges for some individuals. This study aims to examine the principles of legal regulation related to the concept of childfree based on Law Number 1 of 1974 concerning Marriage and the Compilation of Islamic Law. The study uses a qualitative method with a normative-descriptive approach, namely normative legal research that relies on literature studies and juridical analysis of legislation and relevant scientific works. Content analysis was used to interpret the data obtained. The results of the study indicate that although legislation emphasizes the importance of offspring in Marriage, there are no explicit provisions prohibiting couples from choosing to live without children. Legally, the child-free practice does not conflict with the marriage regulations in force in Indonesia. However, this decision remains a controversial issue in a society that strongly upholds family values

    Get PDF
The implementation of Sharia compliance in the management of zakat, infaq, and sadaqah (ZIS) funds is essential to ensure public trust and institutional accountability. This study aims to examine the extent to which BSI Maslahat, the official amil zakat institution affiliated with Bank Syariah Indonesia (BSI), complies with Sharia principles in distributing ZIS funds, particularly in terms of transparency and accountability. This research uses a qualitative method with a literature and documentary study approach. The data were sourced from BSI Maslahat’s annual reports from 2017 to 2023 and relevant fatwas issued by the National Sharia Council–Indonesian Ulema Council (DSN-MUI). Content analysis was applied to assess the alignment of ZIS distribution with Sharia principles, particularly DSN-MUI Fatwa No. 23/2020 and No. 71/2023. The findings indicate that ZIS distribution during the observed period did not fully comply with Fatwa No. 23/2020, as the riqab category was not included. However, improvements in transparency and reporting were evident in accordance with Fatwa No. 71/2023. These results are analyzed through Monzer Kahf’s Islamic Contract Theory, which emphasizes justice, transparency, and Sharia adherence. This study contributes to Islamic economic discourse by offering strategic recommendations to enhance ZIS fund management and compliance. It also serves as a reference for regulators and Islamic financial practitioners to improve institutional governance and public confidence in Islamic philanthropy. Keywords: BSI Maslahat; Sharia Compliance; ZIS Distribution; DSN-MUI; Islamic Contract Theor

Transformation Of The University Curriculum: An Evaluation Study Of The Islamic Religious Education Curriculum With The Provus Discrepancies Model

    Get PDF
This study evaluates the curriculum of the Islamic Education (PAI) Program at UIN Syarif Hidayatullah Jakarta using the Provus Discrepancy Model to identify gaps between curriculum design and implementation. The evaluation focuses on three components: needs analysis, curriculum design, and implementation. Data were collected through document analysis, observations, and in-depth interviews with stakeholders, and analyzed qualitatively. Findings reveal significant discrepancies. While the graduate profile includes prospective Islamic education teachers, researchers, and counselors, tracer studies show that 86% of graduates become teachers, with limited outcomes in the other roles. Curriculum revision is irregular and not aligned with the standard five-year cycle, leading to misalignment with job market demands. Excessive learning outcomes (CPLs) complicate assessment, and credit loads often exceed regulatory limits. In implementation, teaching remains predominantly teacher-centered, with limited use of Student-Centered Learning (SCL) and minimal emphasis on project-based or socio-emotional assessment. The study recommends regular, stakeholder-driven curriculum updates, reinforcement of research and counseling competencies, adoption of Outcome-Based Education (OBE), and greater integration of technology. A balanced application of cognitive, affective, and psychomotor assessments through SCL methods is essential to achieve a holistic graduate profile. Keywords: Curriculum Evaluation, Islamic Religious Education, Provus Discretionary Model,

    Get PDF
Purpose – This study aims to critique the Indonesian translation of Ibrāhīm Al-Kōnī’s short story Tair an-Nahs az-zahabi. It highlights the importance of preserving cultural and aesthetic integrity in literary translation, and evaluates the application of various translation techniques in transferring meaning from Arabic to Indonesian. Design/methods/approach –This research employs a qualitative descriptive method, focusing on comparative textual analysis between the source text and its Indonesian translation. The analysis centers on identifying and assessing translation techniques such as borrowing, calque, literal translation, transposition, modulation, amplification, reduction, adaptation, variation, discursive creation, clarification, and combinations thereof. Findings –The results show that techniques like borrowing and literal translation effectively retain core meanings, while methods such as modulation and amplification enhance clarity and emotional depth in the target text. However, certain techniques occasionally lead to slight shifts in meaning. Overall, the translation succeeds in conveying the symbolic, mythical, and cultural essence of the original story, albeit with some contextual reinterpretations. Research implications – The study underscores the need for a balanced use of translation strategies to maintain both literal and cultural fidelity in literary works. It suggests that a translator’s deep understanding of the source and target languages—along with their socio-cultural contexts—is essential for producing accurate and culturally resonant literary translations. These insights are valuable for translators and researchers seeking to improve the quality and sensitivity of Arabic–Indonesian literary translation
