    A Comparison of Domestic Violence Settlement from the Perspective of Islamic Law and Positive Law in Indonesia

    The numerous cases of household violence in Indonesia suggest that the state still has significant work to do in addressing it. Despite having its claim laws, it appears that their execution still has deficiencies. The purpose of this paper is to examine how Islamic Law and Positive Law in Indonesia compare to Domestic Violence. A qualitative method with a normative approach is employed in this research. The research results show that the sanctions prescribed in Islamic law are based on the application of takzir, qishash, and diat. Meanwhile, positive law provides criminal sanctions and fines. The primary objective in criminal acts of physical violence within the family is to deter or punish the perpetrator so that peace and the progression of community life are maintained. The state plays a role in enforcing amar ma'ruf nahi munkar, including in household matters. The state is obliged to provide protection, services, and recovery for victims

    Dispute Resolution in Consumer Protection in the Financial Services Sector Perspective Sadd al-Zari’ah

    The misuse of personal data by third parties on fintech lending platforms—without consent through a written statement—poses a serious threat to data security and consumer rights. This study aims to offer a conceptual framework for financial service providers and the public concerning the regulation of personal data usage. Employing the Sadd al-Zari’ah approach, this research highlights the importance of preventing actions that may lead to disputes in the financial services sector. The study adopts a normative legal research method with two approaches: the statutory approach and the conceptual approach. The primary legal reference is Financial Services Authority Regulation (POJK) Number 22 of 2023. Data were obtained through literature review and analyzed qualitatively using descriptive techniques. The findings show that consumer protection dispute resolution in the financial services sector can be pursued through both preventive and repressive efforts by applying the concept of Sadd al-Zari’ah.     Analysis of Mitraguna Financing for Civil Servants through Take Over Mechanism at Bank BSI

    Bank Syariah Indonesia (BSI), as an Islamic financial institution, provides takeover financing services to facilitate the transition of customers from conventional banks to Sharia-compliant banking. One of its flagship products, the Mitraguna facility, has attracted significant public interest in switching to the Islamic financial system. This study aims to analyze the legal compliance of Bank Syariah Indonesia in implementing Fatwa No. 31/DSN-MUI/VI/2002 on Debt Transfer, issued by the National Sharia Council of the Indonesian Ulema Council (Dewan Syariah Nasional Majelis Ulama Indonesia / DSN-MUI), particularly in the context of takeover financing through the Mitraguna facility for civil servants. Using a normative-empirical method with a descriptive-analytical approach, data were collected through interviews with BSI employees (Basuki Rahmat Branch, Palu City), BSI’s official website, and library research. The findings indicate that the implementation of takeover financing at BSI through the Mitraguna facility aligns with the provisions of the fatwa, specifically through the use of the musyarakah mutanaqisah (MMQ) contract, which corresponds to Alternative II outlined in the DSN-MUI fatwa. This research is expected to contribute to the development of Sharia economic law and serve as a reference for ensuring Sharia compliance in Islamic financial institutions.Keywords: Mitraguna; Civil Servants; Takeover Financing; Bank Syariah Indonesi

    Socio-Spiritual Dimensions and Principles of Islamic Economic Law in Guidance of Pilgrims of the Wadi Fatimah Hajj Guidance Group Cirebon

    This study aims to analyze the spiritual motives of pilgrims as a driver of innovation in hajj guidance, the transformation of the meaning of hajj through the internalization of Sharia socio-economic values, and the integration of a holistic community-based hajj guidance model in the Wadi Fatimah Cirebon Hajj Guidance Group. This study uses an interpretive qualitative approach to understand the social and spiritual experiences of pilgrims in the Wadi Fatimah Cirebon Hajj Guidance Group. Data were collected through observation, interviews, and documentation, then analyzed using the Miles and Huberman model to capture the meaning, patterns, and relationships between social, spiritual, and legal aspects in hajj practice. The study finds that: (1) the spiritual motives of pilgrims in Wadi Fatimah are driven by personal awareness rather than social pressure or status seeking, with the group playing a key role in integrating maqāṣid al-syarī‘ah and Islamic economics, supported by ethical governance and community empowerment; (2) The meaning of hajj has evolved from being a ritual to a social practice, with the group fostering both spiritual piety and socio-economic awareness through Sharia values and collaboration with state law; (3) The effectiveness of hajj guidance lies in its ability to build a holistic institutional model responsive to social dynamics.     Some students consider Arabic a frightening subject. The word 'difficult' is the main term used in their responses when asked about the reason. As a result, this leads to a lack of interest among students in learning Arabic. Therefore, a model is necessary that can attract students' interest during the learning process. This research aims to determine the use and effectiveness of the Teams Games Tournament learning model in the subject of present tense accusatives for eighth grade students at Al-Ulum Islamic Junior High School Integrated of Medan. The researcher employs a mixed-method approach, incorporating qualitative methods such as observation, interviews, and documentation, alongside quantitative data collected through a Likert scale questionnaire, which is analyzed using a percentage-based formula. The researcher found that this model has a significant positive impact on students desire to learn Arabic, especially in the subject of the factors causing the accusative case for the present tense verb, reaching a percentage of 81.6% in the category 'very effective'. These results were supported by the interview that students feel more enjoyable, motivated, and easier to understand this material and contribute to cooperation in the group and increase their concentration. This research is an alternative and a solution for teachers, especially Arabic language teachers, who face the issue of students lack of desire and low concentration when learning.Key words: Effectiveness, Teams Games Tournament, Present Tense Accusative

    Syntactic Error Analysis in Writing Arabic Sentences at Tsanawiyah Level and Its Implications

    This study aims to identify writing errors in simple Arabic sentences made by students at the Tsanawiyah (Islamic junior high school) level. The research employs a qualitative approach using case study and content analysis methods. Data collection techniques include participatory observation, structured interviews, and document analysis. The data source consists of 45 sentences written by students in constructing jumlah ismiyah (nominal sentences). The findings show that out of the 45 collected simple sentences, 20 were identified to contain syntactic errors. Furthermore, based on the data and interview results, the causes of these errors were found to be both interlingual and intralingual. Interlingual errors occur when students mix rules from their native language with the target language, while intralingual errors result from confusion or lack of understanding of the target language itself. Students' difficulties in writing simple Arabic sentences, as revealed through interviews and error analysis, include a lack of awareness in selecting vocabulary that is perceived as correct but does not align with native speaker usage. In addition, challenges arise in choosing the correct gendered forms (masculine vs. feminine), number (singular, dual, plural), and determining the proper i'rab (grammatical case endings) and syntactic positions of words. This research may serve as a reference for understanding the level of difficulty students face in constructing simple Arabic sentences. It can also be used as a benchmark for evaluating teaching effectiveness and for enhancing the design of Arabic language learning strategies within educational institutions

    TAFSIR TEKS KEAGAMAAN OLEH PEMUDA MUSLIM DI DESA PLAJAN JEPARA UNTUK MODERASI BERAGAMA

    Moderate reasoning in religion cannot be separated from the understanding of religious texts by its adherents. Youth are a strategic part of society who are expected to continue and maintain the values and traditions of religious moderation. The residents of Plajan Jepara village adhere to four religions, namely Islam, Hinduism, Christianity and Buddhism.  This article aims to describe the form of religious tolerance in Plajan village and explain the youth's understanding of religious texts that support good practices of religious moderation in Plajan village. The research was carried out in the form of field research with a qualitative approach that explored data from 10 respondents from Muhammadiyah and Nahdhatul Ulama.  This article concludes that the good practice of religious moderation in Plajan village is based on a number of things, namely a history of peace, mutual cooperation, acceptance of other parties and based on local culture. This practice of religious moderation is supported by the government and local religious leaders. These values influence youth leaders who strive to maintain the  peace  theology and mutual cooperation between religious believers. Religious texts are understood by young people as the embodiment of divine values which provide freedom of religion (lakum dinukum wa liyadin), respect for neighbors and relatives and mutual love for each other. Thus, understanding religious texts is directed at supporting the function of religion as a unifier. Membentuk nalar moderat dalam beragama tidak dapat dilepaskan dari pemahaman teks keagamaan oleh para pemeluknya. Pemuda merupakan bagian masyarakat strategis yang diharapkan menjadi pelanjut dan perawat nilai dan tradisi moderasi beragama. Penduduk desa Plajan Jepara  memeluk empat agama yaitu Islam, Hindu, Kristen dan Budha.  Artikel ini bertujuan untuk mendeskripsikan wujud toleransi beragama di desa Plajan dan menjelaskan pemahaman para pemuda atas teks keagamaan yang mendukung praktik baik moderasi beragama di desa Plajan. Penelitian dilakukan berjenis field research dengan pendekatan kualitatif yang menggali data dari responden berjumlah 10 orang dari unsur Muhammadiyah dan Nahdhatul Ulama.  Artikel ini menyimpulkan praktik baik moderasi beragama di desa Plajan dilatarbelakangi oleh sejumlah hal yaitu sejarah damai,  kegotongroyongan,  peneriman atas pihak lain dan berbasis budaya lokal. Praktik moderasi beragama ini didukung oleh pemerintah dan pemuka agama setempat. Nilai-nilai ini mempengaruhi para tokoh pemuda yang berupaya merawat filosofi damai dan gotong rotong antar pemeluk agama. Teks keagamaan dipahami oleh para pemuda sebagai pengejawantahan nilai-nilai ke-Tuhanan yang memberikan kebebasan beragama (lakum dinukum wa liyadin), penghormatan kepada tetangga dan kerabat serta saling mengasihi sesama.     Analysis of Fraud in Transactions on Shopee: A Fiqh Muamalah Perspective Using the Fraud Triangle Theory

    This study analyzes fraud in Shopee transactions using the fraud triangle theory and the perspective of fiqh muamalah. Fraudulent activities in the Shopee marketplace, such as scams and deceitful seller practices, contradict Islamic principles, resulting in material and non-material losses. Fiqh muamalah, as a foundational framework for Islamic trade, strictly prohibits fraudulent practices that cause harm or injustice. The study employs a qualitative approach, utilizing content analysis of case studies on Shopee fraud. The findings reveal that fraud on Shopee arises due to economic pressure as a trigger for fraudulent behavior, opportunities created by weak regulatory frameworks, and the rationalization of fraud stemming from a lack of public awareness about online transaction rules. From the perspective of fiqh muamalah, these factors result in injustice and violate fundamental principles such as honesty (sidq), trustworthiness (amanah), and the prevention of harm (la darara wa la dirar).     Transforming Textile Waste into Educational Play Tools for Early Childhood: A Mentorship Program in Aceh Tengah

    Through play activities, children demonstrate their stages of growth and development. However, Early Childhood Education often encounters challenges, such as funding issues. The high cost of educational play tools and the lack of knowledge among educators in designing and creating educational tools using available materials from the environment are significant obstacles. The goals of this research are to analyze the initial capabilities of ECE educators in Bebesen Subdistrict, Central Aceh, in understanding the basic concepts of making educational play tools before mentoring; to design convection waste-based educational tools for classroom units in Bebesen Subdistrict; and to describe the mentoring process in making educational play tools from convection waste. This activity involves ECE educators in Bebesen using a qualitative descriptive approach with data collection techniques including interviews, focus group discussions (FGD), and documentation. The outcome of the research includes educational play tools made from convection waste that can be used in learning activities. ECE educators successfully developed skills to create various types of educational tools from convection waste. Utilizing garment industry waste reduces environmental waste and lowers the cost of making educational tools, making the program environmentally friendly and sustainable

    Penerapan Permainan Engklek dalam Meningkatkan Perkembangan Sosial Emosional Anak Usia 5-6 Tahun

    Penelitian ini bertujuan untuk meningkatkan perkembangan sosial emosional anak usia 5-6 tahun melalui penerapan permainan engklek. Latar belakang penelitian ini didasarkan pada rendahnya kemampuan sosial emosional yang terlihat dari hasil pra-siklus anak, di mana rata-rata capaian hanya mencapai 32% dengan kategori Mulai Berkembang (MB). Penelitian ini menggunakan metode Penelitian Tindakan Kelas (PTK) dengan subjek 15 orang anak kelompok B3 di TK IT Darul Istiqomah Palangka Raya. Penelitian dilaksanakan dalam dua siklus yang meliputi tahap perencanaan, pelaksanaan, pengamatan, dan refleksi. Teknik pengumpulan data menggunakan observasi, wawancara, dan dokumentasi, yang dianalisis secara deskriptif dengan persentase. Hasil penelitian menunjukan adanya peningkatan signifikan pada perkembangan sosial emosional anak. Pada siklus I, rata-rata capaian meningkat menjadi 52% (Berkembang Sesuai Harapan/BSH), namun belum memenuhi kriteria keberhasilan 76% (Berkembang Sangat Baik/BSB). Setelah dilakukan perbaikan pada siklus II, seperti penyederhanaan aturan permainan, demonstrasi langsung, dan pemberian penghargaan, rata-rata capaian meningkat menjadi 88%, yang memenuhi kriteria keberhasilan. Temuan ini menunjukkan bahwa penerapan permainan engklek efektif dalam meningkatkan perkembangan sosial emosional anak usia dini
