    Allocation of specific grant for local authorities in Chonburi

    Thesis (D.P.A.)--National Institute of Development Administration, 2021This research aimed to study the policy on the allocation of specific grants to local government organizations (LGOs) from two major funding sources, which are government-specific grants and the grants from provincial administrative organizations (PAOs) in relation to the political changes. The study has two main objectives: 1) to study the government's specific grant allocation policies to LGOs since the beginning of decentralization from 2001-2018 that affect local fiscal independence and to analyze the fiscal disparity that occurred among municipalities and subdistrict administrative organizations (SAOs) of Chonburi Province during the years 2010-2017, which covered the periods of 3 governments, in comparison with other grants in the same structure, as well as collecting problems and policy proposals to improve the allocation of specific grants and promote fiscal independence based on the principle of fairness among lower-tier LGOs within the province; and 2) to study the grant allocation policies of Chonburi PAO and to analyze the fiscal disparity among the municipalities and SAOs in Chonburi Province by comparing Chonburi PAO, which had not changed its chief executive, with other two PAOs, which had changed their chief executives in the latest local elections, between 2009 and 2017, as well as collecting problems and policy proposals to improve the allocation of the grants and promote the fiscal independence based on the principle of fairness among supported local authorities in the province. This research utilized the mixed method research methodology. It applied qualitative research methodology to analyze the secondary data of the grant allocation by the government and PAOs. The population of the study in part of the government’s grant allocation included 7,848 LGOs across Thailand and 98 LGOs in Chonburi Province, which consists of 47 municipalities and 50 SAOs. Meanwhile, the population of the study in part of PAO grant allocation is the local authorities under 3 PAOs, namely Chonburi, Sukhothai and Songkhla, consisting of 98, 90 and 140 local authorities, respectively. The research conducted the qualitative research by interviewing 9 experts and local chief executives with the semi-structured interview methodology. The results of this study consisted of 2 parts as follows: Part 1: The allocation of government specific grants:  The research found that the grant allocation policies were fluctuated with political changes. Most governments preferred to maintain the authority-related general grants. On the contrary, the specific grants varied inversely with purposive general grants; there were switches of missions between the two grants as well. It reflected the degree of political role in governing grant allocation policies which affected Chonburi localities. There, wealthy municipalities received more money than the poor ones, whereas the situation of Subdistrict Administrative Organizations (SAOs) was on the opposite. Furthermore, the disparity from all types of grants among municipalities was higher than that of SAOs, especially, the disparity from the specific grants because many localities did not receive support. There were several problems in allocating specific grants, such as the lack of clear criteria, unpredictable grant approval, and inconsistency with local needs. The suggestion is to reduce the proportion of the specific grants, spend it when necessary, develop low-valued projects that can be widely distributed to localities, increase the share of authority-related general grants, and provide external budgets for government programs. Part 2: The allocation of Chonburi PAO grants:  The research found that the policies of grant allocations to other receiving grant supported units, which isare under the PAO chief executive's independent mandate, was were highly variable with the individual.fluctuated between the chief executives. The fiscal disparity of grant allocation to LGOs can occur in two levels: 1) the disparity among the three types of receiving grant unitsagencies receiving the support, namely the GLOsLGOs, government agencies and public benefit activities,enterprises, and 2) the disparity among lower-tier LGOs, which are municipalities and SAOs. Chonburi PAO had a very high proportion of grants to the annual expenditure budget. The proportion of fiscal disparity among the three types of supported units was close, while the disparity between lower-tier LGOs were remarkably high. From the comparison of the grant allocation between Chonburi, Sukhothai, and Songkhla PAOs, the research found that the latter two PAOs were alike: Their policies were extremely uncertain, and both places had high degree of fiscal disparity at the two levels of grant allocation. In addition, they paid attention to local authorities less than Chonburi PAO. The major problem was that in some years there was little financial support to no support at all to the LGOs. As a result, local authorities were not an important factor for PAO chief executives in considering whether to provide financial supports. In addition, the grant allocation policies did not correlate with the year before and after the local elections. To reduce this fiscal disparity, a framework of grant allocation among the three entities may need to be established by setting the minimum proportion the LGOs will receive as the guarantee of their revenue. The PAO thus should be careful in supporting any projects that are inconsistent with their legal missions, arranging the priority list of supported projects as needed, and thoroughly circulating its budget to all local authorities.     The model of success factors affecting consumer purchase intention by video advertising via online influencers

    Thesis (Ph.D. (Communication Arts and Innovation))--National Institute of Development Administration, 2021The study was mixed-method research of both qualitative and quantitative, aimed 1) to study the development of advertising using an online influencer from the past to the present, and 2) to test a structural equation model of success factors affecting consumers’ purchase intention by video advertising via online influencers. The research was conducted into two parts. Part 1: Qualitative research was conducted by descriptive research methodology, which was documentary research of information or articles on websites within 10 years from 2011 – at present (2021) and in-depth interview with three groups of experts in digital marketing: 1) marketers working on digital marketing using online influencers for no less than five years, 2) online-influencer platform administrators or managers with no less than 3-year experience, and 3) successful online influencers being awarded at the national level. Part 2: Quantitative research was conducted by the survey research method with 365 Gen-Y consumers, born between 1981-2000, who were exposed to online-influencer information and might or might not have bought products or services after viewing online-influencer advertisements. The collected data were applied for data analysis for developing a structural equation model (SEM). The findings showed that the development of online-influencer advertising from the past to the present can be divided into 6 periods. Period 1 was Before the Emergence of Online Influencers (approximately before 2012), Period 2 Organic Online Influencers (approximately 2013-2014), Period 3 Power of Online Influencer Turn to Marketing (approximately 2014-2015), Period 4 Widely Emerging Micro- and Nano Influencers (approximately 2016-2017), Period 5 Booming Influencer Marketing (approximately 2018-2019), and Period 6 Transparent Influencer Economy (approximately 2020-2021). On the other hand, the experts classified online influencers by 2 main methods, namely by the number of followers and types of influencers’ expertise. For the analysis of the structural equation model, it is found that the model of success factors affecting consumers’ purchase intention by video advertising via online influencers, developed by the researcher, is congruent with the empirical data since 10 indices or more than 3 indices pass the determined criteria, as follows: Chi-square/df = 1.244 ( 0.05), GFI = .970 (> .90), AGFI = .995 (> 0.90), CFI = .995 (> 0.90), NFI = .978 (> 0.90), IFI = .996 (> 0.90), RFI = .955 (> 0.90), RMR = .021 (< 0.05), and RMSEA = .026 (< .05) at a statistical significance level of 0.001. From analyzing the effect or causal relationship and path coefficients, it is found that Online Influencer Credibility has a positive direct effect on Attitude towards Advertising and Attitude towards Brand with the path coefficients = 0.964 and 0.762 respectively, Attitude towards Advertising has a positive direct effect on Purchase Intention with the path coefficients = 0.452 and Attitude towards Brand has a positive direct effect on Purchase Intention with the path coefficients = 0.413. The findings of all positive effects can explain the value of Purchase Intention from Squared Multiple Correlations (= 649)

    The elements of tourist satisfaction and loyalty with cultural/heritage sites: evidence from Ayutthaya

(Economics and Management))--National Institute of Development Administration, 2021This study aims to analyze the factors of tourists’ motivation, expectations, and satisfaction by establishing a theoretical model to quantify their joint impact on the tourists’ loyalty. Collecting data from 400 participants of Chinese tourists who visited ‘Ayutthaya Province’ of Thailand, this research by employing both Structural Equation Modelling (SEM) and descriptive Analysis, finds that the elements of tourists’ expectations (e.g., accessibility, historic buildings) and motivation (e.g., to visit historical place/culture, religious places, income) have a significant positive impact on their overall level of satisfaction. Further analysis indicates that higher satisfaction leads to higher tourists’ loyalty to the destination. This research contributed to the literature on heritage marketing by keeping in view the cultural differences and analyzing various factors that can influence Chinese tourists’ perception of visiting cultural-oriented destinations. The research setting of this study allows us to better understand Chinese tourists' views on Thai heritage culture experiences, value creation, image building, behavioural intentions, and their overall level of satisfaction. The government of Thailand can develop important policies amid boosting heritage/cultural-oriented tourism to ensure its sustainability and economic performance of the sector.  Implications for management and directions for future research are provided

    วิทยานิพนธ์ (น.ด.)--สถาบันบัณฑิตพัฒนบริหารศาสตร์, 2564ดุษฎีนิพนธ์นี้ศึกษาวิจัยในเรื่องการนำหลักการกำกับดูแลกิจการที่ดีมาใช้ในการพัฒนากฎหมายบริษัทในประเทศไทย โดยมีวัตถุประสงค์เพื่อนำเสนอรูปแบบกฎหมายบริษัทเอกชนจำกัด ที่สอดรับกับหลักการกำกับดูแลกิจการที่ดีในระดับสากล เพราะระบบกฎหมายบริษัทในประเทศไทย ยังไม่เหมือนกฎหมายบริษัทต่างประเทศที่ได้รวมเอาบริษัททุกประเภทไว้ในกฎหมายเดียวกัน  อีกทั้งประมวลกฎหมายและพาณิชย์ ในส่วนบริษัทจำกัด ยังมีพัฒนาการที่แตกต่างจากกฎหมายบริษัทมหาชนจำกัดในประเด็นความสอดรับกับหลักการกำกับดูแลกิจการ ซึ่งหากได้มีการพัฒนากฎหมายบริษัทจำกัด จะทำให้เป็นเครื่องมือสำคัญของผู้ประกอบการเพื่อการแสวงหากำไรในระบบเศรษฐกิจแบบทุนนิยมที่มีความยั่งยืน การศึกษาวิจัยนี้ได้ใช้วิธีการศึกษาเชิงคุณภาพ โดยใช้วิธีการศึกษากฎหมายเปรียบเทียบ  พบว่า กฎหมายบริษัทจาก 3 ประเทศ คือ สหราชอาณาจักร สหรัฐอเมริกา ในระบบ Common Law และประเทศญี่ปุ่น ในระบบ Civil Law ซึ่งแนวคิดการพัฒนารูปแบบและเนื้อหากฎหมายบริษัท จากเดิมที่เป็นทฤษฎีผู้ถือหุ้นเป็นสำคัญ กลายมาสู่ทฤษฎีบริษัทรูปแบบผู้มีส่วนได้เสียซึ่งสอดคล้องกับหลักการกำกับดูแลกิจการที่ดีมากขึ้น โดยกฎหมายบริษัทของทั้งสามประเทศมีกำหนดหน้าที่และความรับผิดของกรรมการเพื่อสร้างการมีหลักการกำกับดูแลกิจการที่ดี และการให้ความสำคัญแก่ผู้มีส่วนได้เสียกลุ่มต่าง ๆ ขณะที่กฎหมายบริษัทจำกัดของไทย หลายมาตราที่สัมพันธ์กับหลักการกำกับดูแลกิจการที่ดี ยังคงได้รับอิทธิพลจากรูปแบบทฤษฎีบริษัทที่ให้ความสำคัญกับผู้ถือหุ้น มาตั้งแต่ปี พ.ศ. 2472 ดุษฎีนิพนธ์นี้ มีข้อเสนอแนะว่า ประเทศไทยควรมีการปฏิรูปกฎหมายบริษัทจำกัดของไทย โดยการนำหลักการกำกับดูแลกิจการที่ดี มาใช้ในการพัฒนากฎหมาย  เพื่อให้มีการบริหารจัดการบริษัทในมาตรฐานที่ไม่แตกต่างกันระหว่างบริษัทเอกชนจำกัดกับบริษัทมหาชนจำกัด ส่วนรูปแบบการแก้ไขปรับปรุงอาจเป็นการแก้ไขเพิ่มเติมในประมวลกฎหมายแพ่งและพาณิชย์เป็นรายมาตรา หรือ การยกร่างใหม่โดยรวมกฎหมายบริษัทจำกัดกับกฎหมายบริษัทมหาชนจำกัดเข้าไว้ด้วยกัน ในส่วนการพัฒนา Soft Law นั้น เสนอให้มีหลักการกำกับดูแลกิจการที่ดีสำหรับบริษัทที่ไม่ได้อยู่ในตลาดหลักทรัพย์ เป็นการเฉพาะ  เพื่อเป็นการเตรียมบริษัทเอกชนขนาดกลางและขนาดใหญ่ ให้พร้อมในการแปรสภาพเป็นบริษัทมหาชนเพื่อเข้าสู่ตลาดหลักทรัพย์ หากมีความประสงค์ สำหรับบริษัทเอกชนขนาดใหญ่ ที่ไม่ได้เข้าตลาดหลักทรัพย์  ควรมีการผลักดันให้เกิดบรรษัทภิบาลที่ดีในบริษัทเหล่านี้ โดยใช้กฎหมายบริษัทจำกัดของไทยเป็นเครื่องมือผลักดัน ดังเช่นกรณีกฎหมายบริษัทของต่างประเทศที่กำหนดให้คณะกรรมการมีหน้าที่ในการจัดทำรายงานแผนการดำเนินการของบริษัท ที่มีประเด็นเรื่องสังคมและสิ่งแวดล้อม  เพื่อให้ธุรกิจเกิดการพัฒนาที่ยั่งยืน เฉกเช่นบริษัทจดทะเบียนThis dissertation studied the application of good corporate governance to develop corporation law in Thailand. Its objective was to propose a model of law on private limited companies that accords with the principle of good governance at the international level. This is because corporation law in Thailand is not like in other countries where they combine all types of companies in one law. Further, the provision on private limited companies of the Civil and Commercial Code has been developed differently from that of the law on public limited companies regarding its consistency with corporate governance. If the law on private limited companies undergoes development, it will become a tool for entrepreneurs to sustainably seek profits in the capitalist economy. This research applied the qualitative approach using the comparative law analysis technique. The findings indicated that corporation law of 3 countries including the United Kingdom, the United States under the common law system, and Japan under the civil law system changed the model and content related to their corporation law based on the old theory whereby shareholders were key to the one that involved stakeholders. This is more consistent with the principle of good corporate governance. The law in these countries imposes duties and responsibilities of members to create the principle of good corporate governance and focus on stakeholders of various groups. While several sections of the law on private limited companies in Thailand go well with the principle of good corporate governance, they have been influenced by the theory that focuses on the shareholders since 1923. This dissertation puts forward a recommendation that Thailand should reform its law on private limited companies by applying the principle of good corporate governance to develop the law. The goal is to manage companies under the same standard between private limited companies and public limited companies. Amendments may be in a form of additional amendments against sections of the Civil and Commercial Code. Alternatively, a new law may be drafted by combining the law on private limited companies and public limited companies together. In terms of soft law development, there should be a principle of good corporate governance for companies not listed under the stock exchange. This is to prepare medium and large-sized private companies to be ready for their transformation to public limited companies for the stock exchange if they wish. For large private limited companies that do not enter the stock exchange, there should be a push for corporate governance among them. The law on private limited companies may be used as a tool like corporation law in other countries that impose duties and responsibilities of members to prepare a company operation report containing social and environmental issues so that a company may develop sustainably like in a case of a registered company

    Model of electronic waste management for eastern economic corridor

    Thesis (Ph.D (Environmental Management))--National Institute of Development Administration, 2021This research aimed to evaluate the household electronic waste (e-waste) management in Eastern Economic Corridor (EEC) in Chachoengsao, Chonburi, and Rayong provinces, and recommend the appropriate model of household e-waste management for EEC, notably at the policy level. This research was qualitative research by analyzing situations, problems, and impacts from household e-waste management in the three provinces between 2016-2019, with the concept of Pressure-State-Response (PSR). After that, evaluate the household e-waste management in the three provinces with the CIPP-I Model, documentary research, request information, non-participant observation, and in-depth interview by semi-structured interview with 27 key informants by purposive sampling. They were executives, policymakers, e-waste experts, state enterprises in electrical and electronic manufacturing companies, and e-waste sorting or recycling plants in industrial estates. Data analysis used the content and grouping analysis. The evaluation results were used for SWOT Analysis and TOW Matrix to acquire the factors impacting the management and guidelines of household e-waste in the three provinces and use them to develop the model of household e-waste management for EEC. The evaluation form conducted the draft model testing with 55 assessors covering the former interviewees and residents in EEC. The findings revealed that only Rayong provincial administrative organization collected household e-waste from local administrative organizations (LAOs) at the Rayong Integrated Solid Waste Management Center and sent e-waste to the private disposal site outside the EEC areas. People thought that the e-waste sorting was the responsibility of LAOs. LAOs motivated people to realize the importance of sorting e-waste by collaborating with the relevant local government agencies and the private sector in the collection process, namely installing drop-off points in private establishments. The drop-off points were installed in all communities. However, e-waste was discarded and mixed with general solid waste, contamination of heavy metals in soil, surface water, and groundwater, foul smell from sorting and recycling factories operating with improper methods, causing dizziness to the people living near the factories. Some could not bear the smell and had to move out, especially in Chachoengsao and Chonburi. Natural Resources and Environmental Protection Volunteers (NEV) were established. Employment and income were generated for local junk shops. The appropriate model of household e-waste management in the three provinces of EEC for LAOs and relevant agencies according to the CIPP-I framework consisted of Context: submit the comprehensive plan on household e-waste management in EEC to the Eastern Economic Corridor Office of Thailand (EECO), set up a center for services and repair learning of household electrical and electric equipment. Input: provide services to collect large-sized e-waste at people’s homes, prepare the list of e-waste disposal companies in EEC, and provide enough personnel and budget for household e-waste management in each LAO. Process: the construct of community model, improve public relations to attract interest for people. Product: add the appropriate drop-off points with a sign at all areas, send collected household e-waste for disposal plants in EEC at priority. Impact: promote new e-waste disposal plants in industrial estates in EEC, support the local networks to monitor e-waste management situations, such as NEV-Net or Local Environmental Volunteer Network (LEV-Net), and support junk shops to receive a permit for health-hazardous operation

    Comparative study of legal measure to prevent cyberbullying children

    วิทยานิพนธ์ (น.ม.)--สถาบันบัณฑิตพัฒนบริหารศาสตร์, 2564ในปัจจุบันประเทศไทยยังไม่มีการกำหนดคำนิยามในเรื่องการกลั่นแกล้งรังแกออนไลน์และไม่ได้กำหนดมาตรการในการป้องกันการกระทำความผิดที่เป็นการกลั่นแกล้งรังแกออนไลน์ในเด็ก ทั้งในเชิงนโยบายและมาตรการบังคับ อีกทั้งยังไม่มีหน่วยงานที่มีหน้าที่รับผิดชอบในเรื่องดังกล่าวโดยตรง ทำให้ประเทศไทยไม่สามารถแก้ไขปัญหาการกลั่นแกล้งรังแกออนไลน์ในเด็กได้อย่างมีประสิทธิภาพ โดยงานวิจัยนี้ ผู้เขียนนี้มุ่งศึกษาถึงปัญหาการกลั่นแกล้งรังแกออนไลน์ในเด็ก (Cyber Bullying) โดยทำการศึกษาในเรื่องคำนิยามของการกลั่นแกล้งรังแกออนไลน์ การกำหนดมาตรการป้องกันทางกฎหมาย และอำนาจหน้าที่ของหน่วยงานที่รับผิดชอบของไทยและต่างประเทศโดยวิธีการศึกษาเปรียบเทียบกฎหมายไทยกับกฎหมายต่างประเทศ จากผลการศึกษาวิเคราะห์เปรียบเทียบกับประเทศญี่ปุ่นและประเทศแคนาดา พบว่าประเทศญี่ปุ่นมีกฎหมายป้องกันการกลั่นแกล้งรังแกออนไลน์ โดยมีการให้คำนิยามของการกระทำความผิด รวมถึงมีการกำหนดมาตรการป้องกันการกลั่นแกล้งรังแกในสถานศึกษาและการกำหนดบทบาทและอำนาจหน้าที่กับองค์กรที่เกี่ยวข้องในการควบคุมปัญหาการกลั่นแกล้งรังแกออนไลน์เป็นกฎหมายเฉพาะเพื่อเป็นกำหนดมาตรการป้องกันการกลั่นแกล้งออนไลน์ในเด็กที่เกิดขึ้นในสถานศึกษา และในประเทศแคนาดา รัฐ Manitoba จากการศึกษาพบว่าได้มีการบัญญัติกฎหมายเฉพาะในเรื่องการกลั่นแกล้งรังแกออนไลน์ มีการกำหนดคำนิยามของการกลั่นแกล้งรังแกออนไลน์ในเด็ก และกำหนดมาตรการลงโทษในเชิงป้องกันการกระทำความผิดซ้ำเพื่อป้องกันความเสียหายต่อจิตใจที่อาจเกิดขึ้น โดยกำหนดให้ศาลยุติธรรมเป็นองค์กรที่รับผิดชอบในเรื่องดังกล่าว จากการศึกษาวิเคราะห์ปัญหาการกลั่นแกล้งรังแกออนไลน์ที่เกิดขึ้นในเด็ก ผู้ศึกษามีความเห็นว่ามาตรการของประเทศญี่ปุ่น และประเทศแคนาดา มีการกำหนดมาตรการในเชิงป้องกันปัญหาการกลั่นแกล้งรังแกออนไลน์ในเด็ก โดยมีมาตรการที่แตกต่างกันเนื่องจากสภาพปัญหาและคดีที่เกิดขึ้นมีลักษณะเฉพาะแตกต่างกันตามสภาพสังคมในแต่ละประเทศ ดังนั้น งานวิจัยนี้จึงเสนอให้ประเทศไทยสมควรที่จะนำแนวทางการแก้ไขปัญหาการกลั่นแกล้งรังแกออนไลน์ของต่างประเทศมาปรับใช้ โดยสมควรกำหนดให้มีกฎหมายเฉพาะในเรื่องการกลั่นแกล้งรังแกออนไลน์ในเด็ก โดยบทบัญญัติดังกล่าวจะต้องมีการกำหนดคำนิยามของการกลั่นแกล้งรังแกออนไลน์ การกำหนดมาตรการป้องกันการกลั่นแกล้งรังแกออนไลน์ รวมถึงกำหนดอำนาจหน้าที่เฉพาะสำหรับหน่วยงานที่เกี่ยวข้องในการกำกับดูแลปัญหาการกลั่นแกล้งรังแกออนไลน์ในเด็กเพื่อให้เกิดประสิทธิภาพในการแก้ไขปัญหาการกลั่นแกล้งรังแกออนไลน์Currently, Thailand does not have a definition of online bullying, nor measurement set up to prevent it among children.  In terms of policy and enforcement, there are no any direct agencies to take a response for such matter. As a result, Thailand is unable to effectively solve the situation. In this research, the author focus on the problem when children face a cyberbullying by studying the definition, law enforcement implementation, and power also duties of accountable agencies in domestic and aboard through a comparative study on both Thai and foreign laws. From the results of a comparative analysis from Japan and Canada. The first one has a specific law to prevent online bullying by defining the meaning once it commit including criteria to prevent it in educational institutions also the determination of roles and duties from concerned organizations. For the second one, “In the state of Manitoba”, studies have shown that definite laws have been enacted on this issue likewise. The setting of definition and stipulates preventive measures against recidivism to obviated possible mental damage by liable it to the Court of Justice. From the study to analyze problem of cyberbullying in children. Author has an opinion that determination in both Japan and Canada have established measures to proactively prevent it. By the way, they have a different set up as the problems and cases that arise have particular characteristics according to the social conditions in each country. Therefore, this research suggests that Thailand should adopt these foreign countries solution with appropriate specific laws. By the provisions, there must have a definition of online bullying, establishing measures to prevent, and setting a specific authorized agencies to oversee and solve it effectively

(การพัฒนาทรัพยากรมนุษย์และองค์การ))--สถาบันบัณฑิตพัฒนบริหารศาสตร์, 2564ในระบบ iThesis ผู้เขียนแจ้งเปลี่ยนชื่อ-ชื่อสกุล เป็น พลอยนภัส ปัณณธรพรเตชิตการวิจัยนี้มีวัตถุประสงค์เพื่อ 1) ศึกษาระดับของบรรยากาศการส่งเสริมนวัตกรรมในองค์การ ความหลงใหลในงานแบบกลมกลืนและพฤติกรรมเชิงนวัตกรรมในการทำงานของพนักงานธนาคารพาณิชย์ในประเทศไทย 2) เพื่อศึกษาความสัมพันธ์ระหว่างบรรยากาศการส่งเสริมนวัตกรรมในองค์การ ความหลงใหลในงานแบบกลมกลืนและพฤติกรรมเชิงนวัตกรรมในการทำงานของพนักงานธนาคารพาณิชย์ในประเทศไทย 3) เพื่อศึกษาบทบาทการเป็นตัวแปรสื่อของความหลงใหลในงานแบบกลมกลืนในความสัมพันธ์ระหว่างบรรยากาศการส่งเสริมนวัตกรรมในองค์การกับพฤติกรรมเชิงนวัตกรรมในการทำงานของพนักงานธนาคารพาณิชย์ในประเทศไทย การศึกษานี้เป็นการวิจัยเชิงปริมาณที่ศึกษาในกลุ่มพนักงานธนาคารพาณิชย์จดทะเบียนในประเทศไทยจำนวน 13 แห่ง และได้เก็บข้อมูลจากกลุ่มตัวอย่างจำนวน 457 คน ผลการศึกษาพบว่า 1) ระดับของบรรยากาศการส่งเสริมนวัตกรรมในองค์การ ความหลงใหลในงานแบบกลมกลืนและพฤติกรรมเชิงนวัตกรรมในการทำงานอยู่ในระดับสูง 2) บรรยากาศการส่งเสริมนวัตกรรมในองค์การมีความสัมพันธ์เชิงบวกกับพฤติกรรมเชิงนวัตกรรมในการทำงานอย่างมีนัยสำคัญ 3) บรรยากาศการส่งเสริมนวัตกรรมในองค์การมีความสัมพันธ์เชิงบวกกับความหลงใหลในงานแบบกลมกลืนอย่างมีนัยสำคัญ 4) ความหลงใหลในงานแบบกลมกลืนมีความสัมพันธ์เชิงบวกกับพฤติกรรมเชิงนวัตกรรมในการทำงานอย่างมีนัยสำคัญ และ 5) ความหลงใหลในงานแบบกลมกลืนมีบทบาทเป็นตัวแปรสื่อแบบบางส่วนในความสัมพันธ์ระหว่างบรรยากาศการส่งเสริมนวัตกรรมในองค์การกับพฤติกรรมเชิงนวัตกรรมในการทำงาน.This research aims to 1) study the level of organizational innovation climate, harmonious work passion and innovative work behavior 2) study the relationship between organizational innovation climate, harmonious work passion and innovative work behavior and 3) study the mediating role of harmonious work passion on the relationship between organizational innovation climate and innovative work behavior of Thai commercial bank employees. This quantitative research collected data from 457 employees of 13 Thai commercial banks. The results of this study show that 1) the level of organizational innovation climate, harmonious work passion and innovative work behavior are high 2) Organizational innovation climate is positively related with innovative work behavior 3) Organizational innovation climate is positively related with harmonious work passion 4) Harmonious work passion is positively related with innovative work behavior and 5) Harmonious work passion is partially mediates the relationship between organizational innovation climate and innovative work behavior.

    วิทยานิพนธ์ (น.ด.)--สถาบันบัณฑิตพัฒนบริหารศาสตร์, 2564ดุษฎีนิพนธ์นี้ เพื่อศึกษาปัญหาการบังคับใช้พระราชบัญญัติคณะสงฆ์ พ.ศ. 2505 ใน 3 ประเด็น คือ สถานะและผู้แทนของวัด ที่ดินวัด และข้อพิพาททางปกครองคณะสงฆ์ ผลที่ได้จากการศึกษามีดังต่อไปนี้ ประเด็นที่หนึ่ง สถานะของวัดที่ได้รับพระราชทานวิสุงคามสีมากับสำนักสงฆ์ ตามมาตรา 31 วรรคแรก  ถือเป็นนิติบุคคลทางกฎหมายมหาชน ตามมาตรา 31 วรรคสอง แห่งพระราชบัญญัติคณะสงฆ์ พ.ศ. 2505 ซึ่งเป็นไปตามเจตนารมณ์ของการบัญญัติกฎหมายตามที่ได้ปรากฏในรายงานการประชุมของคณะกรรมาธิการวิสามัญพิจารณาร่างพระราชบัญญัติคณะสงฆ์ พ.ศ. 2505 ทั้งยังเป็นไปตามแนวคิดทฤษฎีที่สมมติว่านิติบุคคลเป็นบุคคล  (Fiction Theory)  และทฤษฎีที่นิติบุคคลเกิดขึ้นได้เพราะอำนาจรัฐ  (Concession Theory)  ซึ่งมีความสอดคล้องกับวัดในเมียนมาร์ที่มีสถานะเป็นนิติบุคคลตามกฎหมายจารีตประเพณี และเยอรมนีที่กฎหมายได้กำหนดให้องค์การทางศาสนามีสถานะเป็นนิติบุคคลทางกฎหมายมหาชนเช่นกัน สำหรับผู้แทนของวัดมีเจ้าอาวาสเป็นผู้แทนของวัดในกิจการทั่วไป ตามมาตรา 31 วรรคสาม แห่งพระราชบัญญัติคณะสงฆ์ พ.ศ. 2505 และมีอำนาจแต่งตั้งผู้แทนของวัดเป็นลายลักษณ์อักษร โดยการมอบอำนาจไปสู่ตำแหน่งอื่นให้มีหน้าที่รับผิดชอบหรือลงไปถึงฝ่ายปฏิบัติการ ผู้ปฏิบัติงานโดยตรงและยังกำหนดให้มีการมอบอำนาจต่อได้ ทั้งที่เป็นคฤหัสถ์และพระภิกษุ ซึ่งสอดคล้องกับศรีลังกาและเมียนมาร์ที่ให้เจ้าอาวาสเป็นผู้แทนของวัดตามที่กฎหมายกำหนด ซึ่งในกรณีนี้ผู้แทนวัดหรือผู้ได้รับมอบหมายให้มีอำนาจหน้าที่ดำเนินการแทนวัด จะต้องรับผิดตามมาตรา 76 แห่งประมวลกฎหมายแพ่งและพาณิชย์ ประเด็นที่สอง ที่วัดตามมาตรา 33 แห่งพระราชบัญญัติคณะสงฆ์ พ.ศ. 2505 ไม่ถือว่าเป็นทรัพย์สินของรัฐหรือสาธารณสมบัติของแผ่นดิน แต่มีสถานะเป็นสมบัติสำหรับพระศาสนาซึ่งสอดคล้องกับที่ดินวัดในศรีลังกาและเมียนมาร์ที่มีสถานะเป็นทรัพย์สินของพระพุทธศาสนาและที่ดินวัดตามมาตรา 33 ยังได้รับความคุ้มครองเป็นพิเศษที่ไม่สามารถนำหลักทั่วไปในประมวลกฎหมายแพ่งและพาณิชย์มาบังคับใช้ได้ เพราะเป็นกฎหมายพิเศษที่นำมาบังคับใช้เป็นการเฉพาะ ซึ่งมีเจตนารมณ์ห้ามมิให้โอนกรรมสิทธิ์เหมือนปกติทั่วไป ห้ามยกอายุความขึ้นต่อสู้ และไม่อยู่ในความรับผิดแห่งการบังคับคดี ตามมาตรา 34 และมาตรา 35  แห่งพระราชบัญญัติคณะสงฆ์ พ.ศ. 2505 นอกจากนี้ที่ดินอันเป็นทรัพย์สินของพระภิกษุที่ได้มาจากการบวชเท่านั้น จึงจะตกเป็นสมบัติของวัดที่สังกัดหากพระภิกษุรูปนั้นมรณภาพลงตามมาตรา 1623 แห่งประมวลกฎหมายแพ่งและพาณิชย์ และไม่ควรนำหลักเกณฑ์การได้กรรมสิทธิ์ที่ดินของบุคคลทั่วไปตามมาตรา 84​ มาบังคับใช้​กับการได้กรรมสิทธิ์ในที่ดินของวัด หรือการที่วัดต้องได้รับอนุญาตจากรัฐมนตรีเสียก่อนจึงจะได้รับกรรมสิทธิ์ในที่ดินนั้นซึ่งกรณีนี้ควรให้มหาเถรสมาคมพิจารณาร่วมกับการบังคับใช้กฎหมายตามมาตรา 84 แห่งประมวลกฎหมายที่ดินด้วย ประเด็นที่สาม การใช้อำนาจทางปกครองคณะสงฆ์มี  3 เขตแดน คือ (1) การใช้อำนาจตามพระธรรมวินัย ซึ่งมีแนวทางการแก้ไขปัญหาความเดือดร้อนไว้เป็นระบบแล้ว (2) การใช้อำนาจทางปกครองตาม พระราชบัญญัติคณะสงฆ์ พ.ศ. 2505 ของผู้ดำรงตำแหน่งทางปกครองคณะสงฆ์ถือเป็นเจ้าหน้าที่ของรัฐตามมาตรา 3 และอยู่ในขอบเขตอำนาจศาลปกครองตามมาตรา 9, มาตรา 42, มาตรา 72 แห่งพระราชบัญญัติจัดตั้งศาลปกครองและวิธีพิจารณาคดีปกครอง พ.ศ. 2542 อย่างไรก็ตามเพื่อเป็นการรักษาขนบธรรมเนียมและจารีตของคณะสงฆ์กับฝ่ายอาณาจักร อีกทั้งเพื่อเป็นการคุ้มครองสิทธิของประชาชนตามรัฐธรรมนูญ จึงควรให้มีคณะกรรมการอุทธรณ์ขึ้นมาแก้ไขปัญหาเป็นการเฉพาะ และ (3) การใช้อำนาจทางปกครองตามพระราชบัญญัติคณะสงฆ์ พ.ศ. 2505 ที่สัมพันธ์เกี่ยวข้องกับชุมชนหรือสังคม ถือเป็นข้อพิพาทคดีปกครองอยู่ในอำนาจของศาลปกครองให้สามารถรับไว้พิจารณาพิพากษาได้ตามพระราชบัญญัติจัดตั้งศาลปกครองและวิธีพิจารณาคดีปกครอง พ.ศ. 2542 เพื่อเป็นกลไกในการสร้างดุลยภาพระหว่างการคุ้มครองสิทธิเสรีภาพของประชาชนกับการปกครองคณะสงฆ์ และยังมีความสอดคล้องกับศรีลังกาเพราะข้อพิพาททางปกครองเกี่ยวกับการแต่งตั้งเจ้าอาวาสสามารถฟ้องร้องที่ศาลจังหวัดได้ สำหรับเยอรมนีหากมีกรณีข้อพิพาทคดีปกครองขององค์การทางศาสนาที่ไม่เกี่ยวกับเรื่องวินัยและคำสอนทางศาสนา หรือฝรั่งเศสหากมีข้อพิพาทที่เกี่ยวกับการใช้อำนาจของฝ่ายปกครอง (Police Administrative) ย่อมเป็นข้อพิพาททางปกครองที่อยู่ในเขตอำนาจหน้าที่ของศาลปกครองเช่นเดียวกันThis thesis aims to study the problems of the enforcement of Sangha Act, B.E. 2505 (1962). There are three issues of the problems including: the status and temple representatives; the temple land; and the disputes of Sangha administration.  The research revealed that: firstly, the Wisukhamsima temple (the temple having royal grant of land with consecrated boundaries) and the monastery without Wisukhamsima are the juristic person having legal status as a legal entity as noted by section 31 of the Sangha Act, B.E. 2505 (1962). This is consistent with the objectives of law noted in the meeting report of the ac-hoc committee of the Sangha Act drafting and the Fiction Theory together with the Concession Theory. The status of juristic person of the temples in Thailand is also similar to the temples in Myanmar and in Germany. The temple in Myanmar is a juristic person defined by the traditional law, while the temple in Germany is a juristic person as defined by the public law.  For the temple representative, the abbot is the representative of the temple for general affairs as noted by section 31 of the Sangha Act, B.E. 2505 (1962). Then, the abbot is empowered by law to appoint temple representatives for more specific administrative affairs. The representatives appointed by the abbot can be both the monks and those who are not monks (the householders) and the responsibility of the representatives of the temple are indicated by section 76 of the Civil and Commercial Code. This is similar to Sri Lanka and Myanmar where an abbot is the temple representatives as defined by law. Secondly, the temple land as noted by section 33 of the Sangha Act is not state land or public domain, but it is the property of the Buddhism. Likewise Sri Lanka and Myanmar, the temple land is also the property of the Buddhism.  The temple land as noted by section 33 of the Sangha Act is also exempted from the provision of the Civil and Commercial Code except its section 1623. As noted by section 34 and section 35 of the Sangha Act, the temple land is exempted from the prescription and is not liable for execution as defined by the Civil and Commercial Code. However, only section 1623 of the Civil and Commercial Code is applied stating that “any property acquired by a Buddhist monk during his monkhood shall become, upon his death, property of the monastery which is his domicile, unless he has disposed of it during his life or by will.” In addition, the provision of ownership for general cases according to section 84 of the Land Code is also not applicable to the temple land. Thirdly, administrative power for the monks covers three jurisdictions comprising: (1) the power as defined by the code of monastic discipline aiming to systematically peace building; (2) the administrative power exercised under Sangha Act B.E. 2505 (1962) is defined as the state officials and under the jurisdiction of the Administrative Court as noted by section 3, section 9, section 42, and section 72 of the Act on the Establishment of Administrative Courts and Administrative Court Procedure B.E. 2542 (1999). However, to remain tradition and custom between the clergy and the people and also to secure public rights, the Appeals Committee should be appointed and (3) an exercising of power according to the Sangha Act and related to community and society is the disputes under the jurisdiction of the administrative court according to the Act on the Establishment of Administrative Courts and Administrative Court Procedure B.E. 2542. This is to remain the balance between protection of public rights and liberty and the administration of the clergy. This case of Thailand is also complied with the case of Sri Lanka, France, and Germany, for example, the administrative dispute regarding abbot appointment is under the jurisdiction of administrative court in Sri Lanka and also in France and Germany. 

    Guidelines for responsible tourism development based on creating shared value towards society in active beach tourism cluster, Thailand

    Thesis (Ph.D. (Integrated Tourism and Hospitality Management))--National Institute of Development Administration, 2021The objectives of this research are to 1) To explore the hotel industry perspectives on responsible tourism, 2) To study the causal factors of the hotel industry in adapting the responsible tourism concept to the idea of creating value for society, and 3) To propose the guidelines for responsible tourism development based on creating shared value towards society in Active Beach Tourism Cluster, Thailand The research design was a mixed methodology combining the quantitative and qualitative research. For the quantitative method, the data was collected from online questionnaires 197 hotels with 580 respondents in the target provinces: Chonburi, Rayong, Trat and Chanthaburi. The respondents were staff in to 5- and 4-star hotel establishments. The exploratory factor analysis (EFA) with 6 dimensions including 1) Extrinsic Motivation (9 Indicators), 2) Business Value (8 Indicators). 3) Intrinsic Motivation (7 Indicators), 4) Perceived Benefits of CSV (9 Indicators), 5) Social Responsibilities (10 Indicators), 6) Intention to Create CSV (9 Indicators). And after performing confirmatory factor analysis (CFA) on the indicators, the overall construct reliability for all constructs reveals have acceptable scores within an acceptable range of factor loading (0.3 and above). The model fit indices present, including Chi-square (465.207), df (209), CFI (0.992), TLI (0.975), RMSEA (0.046), SRMR (0.049). The scope of this qualitative research is studying the perspectives of hoteliers (working for four- to five-star hotels) and community leaders in the Active Beach tourism cluster, through documents, research articles, academic journals, and field data collected from key informants. A total of 13 individuals were interviewed, including 5 hoteliers and 8 community leaders. The fieldwork was conducted in Active Beach Tourism Cluster during October – December 2020. The study was carried out via survey research, where data were collected from in-depth, semi-structured interviews, subjected to qualitative content analysis and online questionnaires. To answer research questions 1) What are the hotel industry perspectives on responsible tourism?  The study findings demonstrated that hotel operators have a responsible view on tourism. This view is based on positively good deeds that start with the self and are enhanced by the efforts of stakeholders. 2) What are the causal factors of the hotel industry in adapting the responsible tourism concept to the idea of creating value for society? The study findings demonstrated the causal factors are extrinsic motivation, business value, intrinsic motivation, perceived benefits of CSV, social responsibilities, and intention to create CSV. 3) How should the guidelines for responsible tourism development based on creating shared value towards society in Active Beach Tourism Cluster, Thailand be? The following issues are addressed: strategies to strengthen the Eastern region tourism network, strategies to promote responsible tourism based on CSV for society in the Eastern region, strategies for promoting the standards of products and services in tourism and hospitality, and strategies for developing potential human capital in the tourism and hospitality industry
