Paleotemperature of Middle Eocene Tonasa Limestone based on Foraminifera at Palakka Area South Sulawesi
The research area is located in Palakka area, Barru Regency of South Sulawesi. The aim of this research is to interpret paleotemperature deposition of the Tonasa Limestone especially marl based on small bentonic foraminifera. The reseach method used in this study is measuring section at Palakka River and Pange River and identification and determination of foraminifera species under binoculer microscopic. The research area consists of interbedded mudstone and bioclastic limestone, and based on abundant of foraminifera the depositional environment was Inner Neritic to Middle Neritic of Middle Eocene (P11) and sea water temperature indicate warm water. Sea temperature changes may be affected by sea level change and other activities such as global climate changes, local tectonic, and oceanic current, which impact on the presence and abundance of foraminifera
Sediment Texture and Topography Features Control on Coastal Morphodynamics State
The characteristic of the change sediment texture and topography features are primary variable for coastal morphodynamics state, besides Ω is known as the dimension fall velocity, period and breaker wave height. Morphodynamic state as a coastal system is an important issue for a proper coastal management and planning. Study area is located at Parepare and Pinrang Regencies. The purpose of this study is to explain coastal morphodynamics. The study methods are field study and petrography analysis. To examine the coastal sediment and topography features along the beach is used Gradistat software. The results indicate that the lithology of the study area mainly consists of tuff and volcanic breccia which might has formed in Late Miocene. The Lapakaka beach is a tide-modified beach, has a steep slope, coarse grain sediments, cusped and reflective. Lumpue beach is also a tide-modified beach, however it has fine grain sediments, low gradient and often featureless; Tassiwalie beach is wave-dominated beaches of reflective states, has coarser grain sediments and consist of relatively steep beach slope (5-20o); Sibo beach is tide-dominated beaches, very low waves, low elevation, coarse-grained and irregular; Maroneng beach include in dissipative, fine sediment, low gradient swash (~1o) and containing bar. The all beaches type above shows different state in sediment texture and topography. The study needs to be continued in order to understand deeply the beach morphodynamics state in supporting an integrated coastal management
The Influence of Risk on The Performance Project of Framework Agreement Construction
The contract is an important aspect that is crucial in the implementation of construction projects. Framework agreement is one of the model contracts that are still limited implementation in the construction world in Indonesia. This study aims to assess the application of Framework agreement in the construction field, especially from the aspect of risk; it starts from identification to the risk allocation of the aspect of construction contracts. The research is done in the form of a survey by capturing the opinions or perceptions, experiences, and attitudes of respondents consisted of contracting, procurement, vendor, and the project owner. From the results of the study note that the most influential risk level is variable Fossil (X8), Testing (X9), Termination of employment (X16), Delay Testing (X18), handover of some of the work ((X20), Procedure variation (X28), the Right Contractor to Halt Work (X33), the risk of service users (X36), the consequences of the risk of service users (X37) and exemption from the obligation to force majeure (X44)
The Factors Influencing Fluid Fertilizer Use Intensity among Onion Farmers in Brebes District, Central Java, Indonesia
The behavior of the farmers to using the fertilizer could be influenced by some factors. The factors such as social environment, culture, agriculture differentiate the way of using intensity the fertilizer. That behavior can also be different to what fertilizer the farmers use. The study aims to identify and analyze the behavior of farmers in using intensity of the liquid fertilizer products. The research was conducted by using a survey approach through interviews and questions (questionnaire) to 100 respondents of onion farmers in Brebes District Central Java on April until May 2015. Factors affecting the using intensity were analyzed by using multiple linear regression analysis. As the result shows in this study show that the using intensity of the liquid fertilizer is influenced by the income, the experience in planting the onions, how large the land, the productivity of the onion, the cultivating season, the recommendations from other farmers, field trials, and recommendations from the fertilizer store. The implication of the study is the farmers behavior to using the fertilizer is not only influenced of rational factors but also influenced by psychosocial factors. Government efforts to educate farmers about the benefits and risks to using liquid fertilizer need involves both aspects
Religious Communal of Indigenous Peoples in Improving Economy Through Local Wisdom (A Juridical Study on Rural Credit Institution in Bali)
Rural Credit Institution is a financial institution that is specifically located in Pakraman (customary villages) in Bali. The presence of Rural Credit Institution in Bali adjoined to other bank financial institutions such as Commercial Banks and Rural Banks are widespread throughout the province of Bali. Rural Credit Institutions as a financial institution acquire legality under Article 58 of Act No. 7 of 1992 in conjunction with Act No. 10 of 1998 which provides status as Rural Banks. Local wisdom that owned by Rural Credit Institutions, has the scope of business activities, the types of activities and financial transactions are limited in Pakraman as the target area. Customers who save funds or require a loan to be registered as local residents aimed at empowering communities. It is a characteristic of religious communal of Bali’s people for business activities in the village. The uniqueness in the Rural Credit Institutions is the local wisdom of Bali’s people that can be maintained and not be crushed by globalization
Actualization of Islamic Rules in Sharia Banking: A Review of Contemporary Issues in Jayapura, Indonesia
This article aims to determine the applicable of Islamic rules in Sharia Banking of Jayapura. The study was conducted in Jayapura City, Papua, Indonesia with purposive sampling techniques which involving over 90 respondents from two Islamic banks, Bank Muamalah Indonesia (BMI) and Bank Syariah Mandiri (BSM). The research also involved some knowledgeable informants to give rich related information. The data were analysed by using the frequency table with the descriptive analysis. Results of the research revealed that the actualization is still facing a wide range of issues. Firstly, most of the customers have not clear or deep understanding of profit-and-loss sharing system. Secondly, they also do not know what advantages they would get if they do transactions in the BMI and BMS Jayapura. Besides that, it also indicated that most of the BMI and BSM customers decided to be member of the banks because of their fanatics to their religion and they are afraid of breaking the Islamic rules
Legal Policy of Legislation in the Field of Natural Resources in Indonesia
Given the urgency for the peoples’ interests, legislation in the field of natural resources should be treated more compared to other fields. The urgency of arrangement in the field of natural resources is not only the right of every citizen to gain access to natural resources that we have, but also provide a guarantee that Indonesia’ natural resources can still be maintained and sustained to future generations. Unfortunately, the legal policy of natural resources tends to move towards free market competition, which is on one side open domination space for both private and foreign sectors, and on the other side attempted to remove the State’s role in the control and management of natural resources. This was strengthened by some of legislation in the field of natural resources were canceled in part or in their entirety by the Constitutional Court. In consideration of the Constitutional Court decision, explicitly confirms that the legislation product in the field of natural resources does not comply to the conditionally constitutional, where the right to “the control of state†of natural resources as mandated in Article 33 of the 1945 Constitution, is an absolute and should not be omitted. A shift in the law-political direction that tends to be pro-market, influenced by several aspects: First, the market ideology that is not prevented due to lack of firmness of attitude, principle independence and sovereignty politically by the lawmakers. Second, the inconsistent application of the Indonesia law ideal that embodied in the Pancasila, the 1945 Constitution, in any formulation of laws related to the management of natural resources. Third, still neglecting the peoples’ participation, which in the process of making laws relating to the management of natural resources, they are closed to the demands of the people, so it tends to be very elitist and unresponsive to the aspirations of the Indonesian peoples
Comparative Study of Issuing Bank’s Obligations towards Beneficiary of the Letter of Credit under UCP and English Law
Process of international trade is complicated and risky. Risks will be more considerable when times come to deal with receiving/sending payments from/to unknown business partners in remote geographic areas. Employing documentary letters of credit (LC) is one of the ways to reduce payment risk in international business especially when partner’s financial standing is unknown to each other. By using the LC as method of payment, parties will shift payment obligation from buyer as a natural person to the guarantee of bank as a legal person. The process of using LC is complicated and involves different players and relations between them. Amongst all relations in process of LC transaction, relation between issuing bank and beneficiary is the most complicated and least clear from legal stand point. This article tries to shed light on vague aspects of relations between issuing bank and beneficiary by studying obligations of the issuing bank towards beneficiary under the law of documentary letters of credit while comparing provisions of UCP with English Common Law on subject matter. Main objective of paper is providing answer to the question of what is the role of issuing bank in the process of LC transaction and which liabilities does it have towards beneficiary? Article consists of five main parts. Part one will provide an introduction to function and relation among different parties in process of an international LC transaction. Further, it endeavours to tap on principle of autonomy and strict compliance as governing principles of documentary letters of credit. Part two and three will take a comprehensive look at legal basis of relations between issuing bank and beneficiary, as well as bank’s obligations under documentary credit law. Part four will discuss liabilities of issuing banks towards beneficiary and finally part five will touch upon situation in which bank will right to recourse against beneficiary
Implementation of the Death Penalty in the Perspective of Human Rights in Indonesia
The 1945 Constitution of Indonesia provides for rights to life and to remain free from torture that are fundamental human rights that shall not be curtailed under any circumstance. Since 1945, Indonesia does not regulate the protection of the right of life to the citizens. Until 1946, enacted Law No. 1 of 1946 concerning the Indonesian Criminal Code which in several provisions concerning the death penalty. Death sentences and executions in Indonesia is always debatable. However, it is still implemented and can not be avoided, unless the change of its legal provisions. This study was a normative research or doctrinal research. The results of the study shows that the provisions of death penalty in Indonesia is still enforced because have been regulated in the Criminal Code and several organic laws such as the law of terrorism, narcotics, corruption, and human rights justice. The death penalty is contrary to Article 28I of the 1945 Constitution. It has set the rights to life, so that no one may violate human rights, including the government and the country is not granted the right to revoke rights for every citizen. The Indonesian government should not impose the death penalty contained in the draft new Code, and abolish the death penalty in its organic law that had been imposed on the offenders. Preferably, the death penalty may be replaced by alternative punishment with life imprisonment, a prison within a specified time or according to the judge’s decision
Preparation of International Business Contracts in Facing the ASEAN Economic Community Era
This article reviews the preparation for composing and formulating the international business contracts in facing the ASEAN Economic Community era. The study used the normative approach by collecting the materials related to the international business contracts. The outcomes of the research indicate that constitutionally, the Indonesian government must provide protection and equitable legal certainty for Indonesian citizens who intend to conduct business transactions within the framework of AEC. Format and writing techniques of international business contracts is compulsory known by the business people and their legal consultants that they do not suffer losses due to errors in the preparing of contract that violates the rules and provisions of international business contract
