The research is aimed at analyzing the ICSID (International Centre Settlement Investment Dispute) decision in solving a dispute between Churchill Mining PLC and the Government of the Republic of Indonesia. The case brought to the public attention, because mining license owned by PT. Ridlatama which acquired from Churchill Mining PLC had been revocated. Churchill Mining PLC holds 75% share of PT. Ridlatama and it suffered losses caused by the revocation of its mining license. Churchill Mining PLC filed the case to the local court but it failed. Churchill Mining PLC then sought ruling from International arbitration or ICSID. On December 6, 2016, ICSID issued a decision that clearly threw out Churchill Mining PLC claim. ICSID, the World Bank court, ordered the firm to pay a total of US$.9.446.528 in cost to the Government of the Republic of Indonesia. It is based on the evidences that the UK-Australia company did the fraud and had document forgery of coal mining permit in East Kutai, Indonesia. So the firm has violated the Bilateral Investment Treaties between Indonesia-UK and Indonesia-Australia

    Get PDF
Determination of alpha tocopherol in corn oil can be analyzed by using Reversed-Phase High Performance Liquid Chromatography (RP-HPLC). This research aimed to validate RP-HPLC method for determination of alpha tocopherol in corn oil. The method was based on linearity, precision, accuracy, limit detection (LOD) and limit quantization (LOQ). The Reversed Phase High Performance Liquid Chromatography (RP-HPLC) method includes the determination of the wavelength, the mobile phase composition and the flow rate of mobile phase, then validation of each of the above methods.  The maximum wavelength was found in 290 nm, composition of mobile phase was 100% methanol, flow rate of mobile phase was 1,5 mL/min and retention time was 9,67 min. The researched result indicated that the method of RP-HPLC had a linearity with the correlation coefficient of 0.999, a relative standard deviation (%RSD) for intra and inter-day precision was < 5%, accuracy/recovery was 95.69-100.99 %, detection limit was 0,43 mg/L,  quantization limit was 0,55 mg/L and  alpha tocopherol content  in corn oil was 40.06 ± 0.24 mg/L

Analysis of Microtremor Data Using Horizontal to Vertical Spectral Ratio (HVSR) Method of Makassar, South Sulawesi

    Get PDF
Makassar has experienced earthquakes indicating that the city is an area vulnerable to earthquake hazards.  The regional tectonic setting supports the hazard in which several major faults develop surrounding the area. Earthquake events in the Makassar Strait of 4.5 SR in December 2015 is one of the hazard in this area. However not all the area was shaking at the same magnitude. The assumption is the different rock formation composing Makassar. Data taken from microtremor measurement supported by coring suggest a dominant frequency distribution has a significant relationship with the rock formation. Low dominant frequency arose at the area with thin sediment deposit (dominantly Camba Volcanic rock) and a high dominant frequency value came up at the area with thick sediment deposits (alluvial).  High seismic susceptibility index is found in thick sediment deposit. The area consists of interlayering between sand and clay and has shallow ground water table. On the other hand low vulnerability index is found in thin sediment deposit. It consists dominantly of tuff of Camba Volcanic Rock and has deep groundwater tabl

URBANIZATION AND SUSTAINABLE FOOD PRODUCTION IN CHINA

    Get PDF
China is now facing urbanization and the migrants from rural area have increased significantly. The farmland was the core iuess of the new urbanization process. The contracted land management right, residence land use rights and collective construction land allocation right were the main contents of the property right of peasants. To establish a new mechanism to make peasants and the rural collective enjoy the reasonable land profit is important for the new round land reform in China. Based on that, this paper will explain how the rural land were transformed into urban poverty. This paper argued that replace rural retained land into urban property model was a new form of compensation for the rural land.  By this model, the migrant farmers can obtain the compensation as the economic base in city and improve the willingness of farmers moving to city and transfer their land to enlarge average arable land scale to develop food production. The paper concluded that the way to solve the shortage of arable land was to speed up the process of urbanization, promote the circulation of cultivated land to realize the expansion of rural per capita arable land to ensure food security. Therefore, it is needed to build a unified construction land market, realize the same price and same right between state-owned land and rural collective land, giving farmers more property rights

Nowadays, Indonesia is one of the countries with the highest internet user growth. In line with it, the local governments in Indonesia use their official website to report the government’s activities as an accountability form to the society. Thus, this study conducted for knowing the accountability characteristics and the factors that affect the level of internet accountability reports in the local government websites.Using content analysis based on Global Reporting Initiative (GRI) index in government agencies and OLS statistical approach on the 34 provinces’ official websites, this study finds, in general, the provinces’ websites have reported 63% of the total numbers that suggested by GRI. Furthermore, there are two main factors, i.e. the number of population and districts/cities, which positively affect the level of accountability reports in provinces’ website. However, no empirical evidence shows the press pressure affects the broad of website reporting in the Indonesia provinces context.Overall, this research indicates that the Indonesia local governments, in this case, provincial governments have focused on delivering their accountability to the society. Moreover, this is a good sign for the democracy growth in Indonesia. Furthermore, the Indonesia local governments may have to give more portions on their official website for answering the headline news from the mass media, specifically for the environmental and social themes. Therefore, it will further strengthen the governance-sustainability and democracy in Indonesia local government environment

    Get PDF
This research aims to form an effective supervision model of a standard clause to protect consumer’s rights and interests. This study answers the questions the effectiveness of a standard clause supervision carried out by Otoritas Jasa Keuangan [Financial Services Authority (OJK)] and Badan Penyelesaian Sengketa Konsumen [Consumer Dispute Settlement Agency (BPSK)]; effective supervision model of a standard clause which can protect the rights and interest of the consumer. The object of this study are OJK and BPSK as a supervision of a standard clause. The result of this research shows that the supervision of standard clause done by those institutions has not been effective yet, this caused by several factors to wit the weakness of implementing regulation in terms of supervision, unclear supervision mechanism, the weakness of socialization related to the rules of standard clause towards business actors, and other weakness and obstacles faced by both institutions. The effective supervision model of standard clause is being formed that based on five points, namely: (1) the needs of institution/agency reformation who authorize to do supervision of standard clause; (2) the needs to determine the scope of duty and authority of standard clause supervision institution; (3) the needs of determination of material range about standard clause subjected to supervision which comprises: the content, the form, the position and the expression; (4) the needs of precise mechanism of standard clause supervision conducted by supervision institution; (5) the needs of following up the supervision results, especially to the business actors who break the standard clause rules

Prevention of Human Trafficking in Ethiopia: Assessing The Legal Framework

    Get PDF
Recent findings have indicated that both in-country trafficking (trafficking of individuals from rural areas to relatively affluent towns and cities) and external trafficking (trafficking of individuals from a given country to foreign countries) are prevalent in Ethiopia. In 2012, the government acceded to the Protocol to Suppress and Punish Trafficking in Persons Especially Women and Children supplementing the United Nations Convention against Transnational Organized Crime (The UN Trafficking Protocol, here after). With a view to giving effect to the requirements of this instrument, the government passed in to law Proclamation No. 909/2015 (The Prevention and Suppression of Trafficking in Persons and Smuggling of Migrants Proclamation), which is the most comprehensive of all laws adopted in Ethiopia to deal with human trafficking. Taking in to account the fact that human trafficking is exacerbated by the absence of regulatory framework on the employment of Ethiopian nationals in foreign countries, the govern-ment has also brought in to practice Proclamation No. 923/2016 (Ethiopia’s Overseas Employment Proclamation). This article has examined whether the above-mentioned laws of Ethiopia comply with international standards in dealing with prevention strategies
