    Good Governance and Anti-Corruption: Responsibility to Protect Universal Health Care in Indonesia

    The establishment of universal health care marks a new momentum for the progressive realization of the right to health in Indonesia. The problem of corruption in health sector endangers the sustainability of effective and quality health care, therefore, Indonesia established an anti-fraud system to protect the universal health insurance fund. This research seeks to analyze the current anti-fraud system in universal health insurance through the lens of international law and principles of good governance. The sociolegal approach is chosen to study the relationship between the State party obligations to international law and the implementation of international law concerning universal health care and anti-corruption in the designated anti-fraud system. Good governance principles are essential in designing an effective anti-fraud system due to the correlation between human rights and anti-corruption that both areas emphasize good governance principles as guiding principles for the realization of human rights and the making of potent anti-corruption strategy

    Field Characteristic of Metamorphic-Hosted Gold Deposit in Sulawesi, Indonesia: An insight into Awak Mas Prospect, South Sulawesi

    Metamorphic-hosted gold deposit is found in Awak Mas, South Sulawesi. This area is characterized by mountainous topography in the western part and relatively flat area in the eastern part and consists of Pre-Tertiary, Tertiary and and Quaternary rocks. Some samples including host-rock, basement and quartz vein were collected and observed during 4 days field work. Mineralization is recognized by the occurrence of pyrite and irregular body of silicified breccia vein. Two main styles of mineralization consists of 1) broad and shallow-dipping zones of sheeted and stockwork quartz veining and associated alteration that conform to the shear fabric, especially within the dark, graphitic mudstones; 2) steeper dipping zones of quartz veining and breccias associated with high-angle faults cutting both the flyschoid cover sequence and basement metamorphic rocks. Gold mineralization is considered as mesothermal deposit which is characterized by albite-pyrite-silica-carbonate alteration overprinted the ductile fabric associated with deformation and metamorphism. The gold is commonly hosted within the flysch sequence and associated with abundant quartz veining and silica albite-pyrite alteration. However, the association of gold and quartz is not ubiquitous and some vein zones are locally barren of mineralization

    This paper studies the paradigmatic shift as the effect on the crossing organizational boundaries activities. Boundary crossing as part of specific function of organizations is common to organization theories. Nevertheless, the increasing and strong rate of occurrence of the crossing boundary activities is considered important today as the consequence of the technological revolution in information and communication technology coupled with the future technologies. Crossing boundaries influence the people involved and the institutional sets. The relationships within the boundaries are increasingly dynamic. Hence, this, in turn, may lead to paradigmatic shift. From the perspective of organization and innovation studies these processes are to a great extent attractive since they may create different conditions the existing literatures on organization as well as innovation, and consequently, on marketing.     The purpose of study was to explain the effect of entrepreneurship orientation and innovation in improving the performance and competitiveness of creative industries in Maros Regency. The primary data used in this study were collected by using questionnaires. The data is then processed in the form of descriptive statistics and inferential statistics. Based on the analysis, it is found that the orientation of entrepreneurship which is reflected by the activities of research and development activities, technological leadership, and innovation will be able to improve the performance and competitiveness of creative industry. Performance as measured by the company's ability to increase sales will be able to create competitiveness. The study also found an insignificant effect between innovation with competitiveness and performance with competitivenes

    Village Autonomy: The Main Road to Fulfill Right to Water

    Water resources are common resources that affect the livelihood of many people. Its management should be oriented towards the rights fulfillment to water for the community. However, the management of water resources still shows inconsistency. This results in uncertainty in the rights fulfillment to water for the community. Therefore, a reform in water resources management is needed. Village autonomy can be the foundation for a more community-oriented water rights management, since it contains independence and community initiatives. This research aimed at finding a precise and clear concept in the management of water resources based on village autonomy. This research was conducted using normative juridical, with legislative and doctrinal approaches. The results show that the concept of village autonomy-based water resources management is carried out by accommodating the community's rights on water resources. It aims at providing guidance in the implementation of management that is not only oriented to exploitation, but also consider the aspects of conservation and control of water resources. This conception is expected to be implemented in village communities (not customary village communities) so as to be able to fulfill the rights to water to village communities justly and democratically

    Indonesia’s Archipelagic Sea Lanes (ASLs) Designation: Rights Turning to Obligations?

    Indonesia is the first and only archipelagic state which has designated Archipelagic Sea Lanes (ASLs). However, such ASLs was only considered as a ‘Partial ASLs’ by the International Maritime Organization (IMO). This is due to the lack of the inclusion of all normal passage routes used for international navigation as required by Article 53 (4) of Law of the Sea Convention (LOSC). On the other hand, Indonesian national law stated that the rights of ASLP can only be exercised over the designated routes and this leave the undesignated routes under the innocent passage regimes, which is inconsistent with Article 53 (12) of LOSC. This article seeks to analyse Indonesia’s rights in designating ASLs and the implementation of Indonesia’s ‘Partial ASLs’. It is questionable whether Indonesia’s rights in designating ASLs has become an obligation by the ‘partial’ recognition of Indonesia’s ASLs by IMO. While none reported incident of navigational rights over Indonesia’s north-south ASLs, however some incidents did occur over the undesignated east/west ASLs. This paper begins with the analyses of the provisions of LOSC concerning archipelagic sea lines passage by looking at its travoux-preparatoir and then follows by the discussion of Indonesia’s implementation on its designated ASLPs. Reported incident occurred over the undesignated ASLs will also be discussed to gain clear understanding on the matter. It is argued that Indonesia should either designated the east/west ASLs or if not, adjusting its national law to be in conformity with LOSC

    Evaluation Study of Medical Solid Waste Management in Syekh Yusuf Gowa Hospital

    Syekh Yusuf Gowa Hospital is one of the hospitals which implemented medical waste management. This hospital is a public hospital and included in class B category according to PERMEN 340/MenKes/PER/III/2010. This category is based on quality, human resources, equipment, facilities and infrastructure, administration and management, and service capability of this hospital. Moreover, this hospital is adjacent with residential and office complex in Sungguminasa City. Therefore, the medical waste management in this hospital should be monitored and evaluated comparing with the government rules (Permenkes). The objectives of this research are to find out the quantity of medical solid waste generation and its characteristics, to ascertain the system of medical waste management, and to evaluate the system of medical solid waste management in Syekh Yusuf Gowa Hospital in accordance with the Indonesian Ministry of Health Regulation. The results of this research are: (1) The generation of medical solid waste in this hospital is 1,228 kg/month or 40.93 kg/day. There are five categories of medical solid waste generated in this hospital:  infectious, sharp, anatomical, chemical, and pharmaceutical waste. The most waste generated in this hospital is the infectious waste that is equal to 70%. While the least amount of waste generated is pharmaceutical waste that is equal to 2%; (2) Medical solid waste management system is conducted by sorting the waste which generated in each room/unit. Furthermore, these wastes are transported to the temporary dumpsite in hospital area. Then, these wastes are packaged and transported to the third party and/or processed in incinerator. The residual ash from incinerator was brought to temporary dumpsite of toxic and hazardous waste and third party; (3) The results of the evaluation of medical solid waste management system in Syekh Yusuf Gowa Hospital has been done well, in accordance with the Ministry of Health Regulation

    FOOD PRODUCTION AND CONSUMPTION PATTERN AT COASTAL AREA OF KARAMPUANG ISLAND

    Patterns of production and consumption of food communities in coastal regions are different from the people who live in mountainous areas or other areas (agricultural society). The fundamental difference between coastal communities and the agricultural society is due to the access to land. This study aimed to assess the patterns of food production and consumption in coastal areas. The method used is a case study to look deeply at the social reality of consumption and production pattern in coastal regions. Field data collection is done systematically through questionnaires, in-depth interviews, focus group discussions and field observation. The focus on research is the coastal community in Karampuang island. The target group is determined based on the knowledge of field conditions, and the initial information has been obtained from key informants. The most important results were obtained, namely: Patterns of food production of the island Karampuang characterized by the production of a limited form of cassava were only able to complement the food needs alone, and Society Consumption Pattern Karampuang Island is characterized by the intensity of the low consumption, low consumption type material variations

    The President’s Power and Anti-Corruption Policy: What Can Be Learned from New Order Experience

    The New Order government led by President Soeharto was supposed to be a regime that would ameliorate the abuse of power conducted by the previous government. One of the important agendas for the New Order government was overcoming the issues regarding the abuse of authority and corruption in the government sector. Several legislations, Presidential legal policies and institutions were formed to carry out such mission. However, the New Order government eventually failed and became a corrupt regime. This study concludes that notwithstanding Indonesia theoretically had an institutional framework to combat corruption under the New Order government, it failed to eradicate corruption. The failure of anti-corruption policies under the New Order era was caused by 3 forms of failure. Firstly, the failure to build a democratic and anti-corruption presidential power. Secondly, the failure to build a comprehensive anti-corruption policy. Thirdly, the failure to build an effective anti-corruption agency. The method employed in this study is a combination of several approaches between the statutory approach, historical approach and conceptual approach. The main data used in this study is the literature which are consists of previous research, legislation and Presidential policies

    Oebobo Station Performance on the Pattern of Public Transport Movement in Kupang City

    The development of Kupang City can be observed from the increase of activity or movement of society, so that city needs the existence of a system of transportation service and satisfied traffic. One of the facilities of urban transportation is a station that serves as a node point, can be considered as a tool to process loading and discharge passengers. Station has the complexity of the problem and affects the movement of public transport. The lack of public transportation operating at Oebobo Station is one of the phenomena in Kupang City. This research was conducted to examine the performance of the station to the movement pattern by reviewed at the location effectiveness, operational service, and transportation movement towards the pattern of public transportation movement in Kupang City. The purpose of research to see the effect of station performance on the pattern of movement and the influence of spatial structure on movement patterns by using quantitative approach. The data obtained through observation, survey and documentation are analyzed by using path analysis, and then tested simultaneously and partially. The results show that the performance of the station in supporting the movement of Kupang City is a sufficient. Location effectiveness, service operation, and transportation movement have significant effect simultaneously to movement pattern in Kupang City. Partially shows that the movement of transportation (destination, transportation route, and passenger safety) and the insufficiency of public transportation operating at Oebobo Station have an impact on the reduction of station performance grade
