    The Influence of Different Characteristic Demographics of Beef Cattle Farmers on Adoption of Concentrate and UMMB Technology

    This research aimed to find out the influence of different demographic characteristics of beef cattle farmers on adoption of concentrate and UMMB (Urea Mineral Molasses Block) technology. The method employed was a descriptive quantitative with survey technique conducted on beef cattle farmers. The sample was selected using convenience sampling method, with 65 beef cattle farmers as the sample. The primary data was obtained from questionnaire and interview with 65 beef cattle farmers. The secondary data was obtained from Karanganyar Regency’s Central Statistic Agency. The data analysis employed included descriptive analysis, validity, reliability, and Oneway ANOVA tests. The results showed that the different demographic characteristics of beef cattle farmers (age, education, main job, job duration, breeding business status and cattle number owned) influence the adoption of concentrate and UMMB technology. The conclusion of research was that the demographic characteristics of beef cattle farmers showed different effects on the adoption of concentrate and UMMB technology

    The Use of Hybrid Contract in the Innovation of Islamic Banking Product

    ASEAN Banking Integration Framework (ABIF) provides market access and operational flexibility for Quality ASEAN Banks (QAB) in ASEAN countries. Indonesian sharia banking is faced with various challenges in fulfilling QAB qualification within this ABIF framework, one of which is the need for product innovations that can meet the needs of community transactions. One of the innovation is through hybrid contract. This study aims to analyze the validity of the use of contract hybrid in the innovation of Sharia banking products in order to encounter ABIF including its legal consequences under the prevailing laws and regulations in Indonesia. This paper was a normative juridical research with analytical descriptive approach. The validity of the use of hybrid contract in the innovation of Islamic banking products in Indonesia in order to encounter ABIF is based on the provisions of the DSN-MUI Fatwa which regulates the covenants used in the innovation of Islamic banking products, so that sharia banking that will make product innovation in Indonesia must ask Fatwa on the terms of contract which will be used in product innovation. The legal consequences of hybrid contract in the innovation of sharia banking products in Indonesia in order to face ABIF are subject to the provisions of Financial Services Authority Regulation (POJK) of Products and Activities of Sharia Banks and Sharia Business Units, so banks are required to apply the Sharia Principles in issuing their product innovation supported by the National Sharia Council Fatwa of the Indonesian Ulama Council which become the basis for the issuance of product innovation and accompanied by the Sharia Supervisory Board's opinion on the Product's innovation

    The Scope of Discretion in Government Administration Law: Constitutional or Unconstitutional?

    Law No. 30 of 2014 on Government Administration (Government Administration Law) has set the scope of discretion in Indonesian legal system. But the form of discretion is limited in scope government decision (KTUN) and factual actions of the government. The restriction implicates circulars or others policy rule is not a form of discretion. In addition, the provisions concerning the terms of use discretion, procedures and legal effect of discretion in the Government Administration Law are not applicable to the use of policy rule. In fact, the substance of discretion in policy rule (e.g. circulars and instructions) has the potential of conflicting laws and regulations and/or General Principles of Good Administration. The legal issues in this study are the constitutionality of the scope of discretion in Article 1 point 9 and Article 23 paragraph (1) of the Government Administration Law. This analysis showed that limits the scope of discretion in Government Administration Law contrary to formal elements, substantive, and control mechanisms within the rule of law. This analysis also suggests the expansion of the scope of discretion in the Government Administration Law and setting policy rules as the object of the petition for judicial review so that there is a control mechanism by trial to discretion in the form of policy rule

    The reform of the Indonesian Penal Code (KUHP) is necessary to accommodate the noble values of Indonesian society. Therefore, Indonesian criminal law should reflect the basic principles, cultural values that live within the inner niches of Indonesian society as a living law. The inclusion of several forms of obscene acts that exist within the extended Draft Penal Code is a manifestation of the philosophical, sociological and juridical framework of the Indonesian society. The extension of the concept of obscenity in the Draft of Indonesian Penal Code is in accordance with the philosophy of the Indonesian nation that gives religious values a fundamental place Consequently, the expansion of the concept of obscenity in the Draft of Indonesia Penal Code can answer some of the problems faced by Indonesian citizens

    A Relationship Model between Accident Factors and the Traffic Accident Severity Using Logistic Regression Model

    The present paper purposes to develop the relationship model between the factors of accidents and severity level of traffic accidents by using multinomial logistic regression model approach, for a case study the traffic accident in Makassar City, Indonesia. In further, the study evaluates the traffic accident factors which significantly influence the traffic accident severity level. In this regard, the outcome variable is the severity level of the traffic accident which has three attributes, i.e., death, serious injury, and minor injury. The explanatory variables involve victim characteristics and traffic accident characteristics. The present study used the traffic accident database during 2012 – 2015 which recorded by the traffic police agency in the city. The model calibration results show that the relationship model has a good accuracy level. The victim position and the collision types significantly influence the severity accident level. The results provide basic information for efforts in reducing traffic accidents.Â

    Thermal Performance of Naturally Ventilated Classroom in the Faculty of Engineering Hasanuddin University, Gowa Campus

    This study aims to identify the thermal performance of naturally ventilated classrooms of the new campus of Faculty of Engineering, Hasanuddin University in Gowa. The natural ventilation system has three main functions that are to provide healthy air for occupants, to provide thermal comfort to the occupants, and to cool the fabrics in the building interior. Thermal comfort perceived by the user is determined by many factors, including physical, psychological, etc. This research was conducted by using the experimental method with research analysis using CFD (Computational Fluid Dynamics) simulation method. The input parameters in the simulation were obtained through field measurement in the form of room dimension, ventilation open area, and microclimate parameter. The simulation is carried out at maximum open conditions in existing ventilation system with open and closed class door treatment. The simulation treatment of airflow input speeds were 0.25, 0.5, 0.75, and 1 m/s. The results showed that the existing ventilation system of Classroom at Faculty of Engineering (FoE) Hasanuddin University (Unhas) with an opening ratio of 16.59 to 22.76% of the floor area is good enough to flow and distribute comfortable air movement inside the classroom, especially at airflow speeds above 0.5 m/s

    LAND REFORMS IN AN INDIAN STATE: LESSONS FROM THE EXPERIENCES OF IMPLEMENTATION

    Until the shift of developmental policy in India in 1990s the state used to play an instrumental role India’s development. By the time India attained independence it was widely regarded that semi feudal landlordism was the main obstacle in the way of national economic regeneration. In this paper an attempt has been to capture the processes of land reforms in India’s West Bengal under the Left Front rule and to critically review impact of this programme on village society. This paper also seeks to identify reasons with the help of empirical studies why it has not been possible for the Left Front Government to achieve the declared objectives of the programme. Major transformations in economic, social and political fields during the first two decades of the Left Front rule characterized by the successful implementation of land reform programmes but failed to produce sustained benefits to the poor beneficiaries of land reforms. The panchayat institutions were unsuccessful in making the poor realize that the existing social situation was not conducive for meeting their basic needs. The concluding part of the paper tries to bring together the lessons that the other countries or states in a federal system can learn from the experiences of implementation of land reforms programme in West Bengal.Â

    THE COMPLEX DYNAMICS OF LAND IN MIGRANT LABOUR SOCIETIES: WHO NEEDS LAND FOR AGRICULTURE?

    The agricultural modernisation narrative has been a central assumption of rural development since the mid-twentieth century, and more recently, the land reforms currently underway in Southern Africa. The narrative emphasises the viable use of land, defined in this case through agricultural productivity and market oriented production. The main contention of this paper is that such a focus undermines the rural socio-economic structure inherent in certain rural societies, which emerge through negotiations and compromises as societies change. It draws on data from studies in Lesotho and rural Zimbabwe that shows that rural households do not only hold land for agricultural purposes, but would hold onto land for security beyond mere agriculture production. It particularly emphasises the complex relationship between households and land, complex land needs and landholding patterns. As way of conclusion, it cautions against enforcing a peasant path on rural society through agriculture-based interventions

    JAPANESE ENTERPRISES ROLE ON SMES DEVELOPMENT IN INDONESIA: INSIDE TOBIKO EXPORT AND IMPORT

    The behavior and the performance of firms, which are highlighted on small and medium-sized enterprise (SME) development, have been extensively discussed since few past decades among the scholars and researchers. Nonetheless, most of those studies only concentrate onto Western firms and less is known in South-East Asia firms, especially the firms located in Indonesia. Consistent with the lack of literature mentioned above, the most significant problem within the body of literature is there are also very little comprehensive findings of empirical research in examining the role of foreign enterprises which specialized in flying fish roe product, known as Tobiko or To Bio No Tamago in Japanese, on the development of Indonesian SMEs in general and the development of natives’ wealth and knowledge in particular. To this knowledge, this study thus aims to expound the role of Kanetoku Corporation and Kanematsu Corporation (formerly known as Kanematsu Gosho Ltd.) – as the representative of the foreign firms – on the development of Indonesian SMEs that are originated from South Sulawesi province, especially from Makassar, Takalar, and Mamuju region. Through the application of resource-based view (RBV) as the grounded theory and the emphasis on the underpinning concept of innovation and knowledge-transfer, this study is strongly expected come up with the result that innovation and knowledge transfer provided by Japanese firms intentionally or unintentionally have become the vital factors on the development of South Sulawesi SMEs that can be seen for example within (1) the successful internationalization of South Sulawesi SMEs and amusingly (2) the remarkable discovery of a new habitat of flying fish outside the South Sulawesi province by the South Sulawesi SMEs during the collaboration between Japanese firms

    Arrangement of Relationship between State Institutions through the Fifth Amendment of the 1945 Constitution in Indonesia

    The amendment of 1945 Constitution is deemed to have many weaknesses and shortcomings, especially related to the regulate institutional relationship between state institutions. There are some problem related to the obscurity of position of state institutions, the overlapping of duties, functions and authority which lead to the unrealized of checks and balances and the vulnerable for abuse of power. The direction of the arrangement of relationship between state institutions should be: First, to strengthen the implementation and purification of presidential system; Second, to clear up the position of the MPR as a joint session between DPD and DPR in an institutional relationship directed to create a strong bicameralism system; Third, the arrangement of judicial institutions should affirm the concept of MK as the court of law and MA as the court of justice. With the addition of constitutional complaint authority for MK and the authority of the previlegiatum forum for MA. While the arrangement of institutional relationship between MA and KY in supervising the judge should be developed based on the concept of share responsibility; Fourth, to make Attorney General as a constitutional organ that have the same constitutional authority and legal standing as other law enforcement agencies, namely National Police and the Courts (MA and MK). Fifth, the institutionalization of independent state commissions as constitutional organs based on the criteria of having the urgency and function of strengthening the constitutional democratic state and strengthening the mechanism of checks and balances
