The Miserable Loss from Yemeni Conflict: Can International Law Provide Reparation for Mental Injury?

    Get PDF
As the home of the world’s worst humanitarian crisis, Yemen can be an example to reveal how horrifying the mental health issues in conflicting areas can be. Since 2014, the ongoing conflict in Yemen has been resulting not merely in physical losses and injuries, but also mental catastrophe as its inevitable consequence. This article is a legal research that aims to analyze how mental injuries or psychological damages are being acknowledged as a real impact of armed conflict, to further be considered as a precondition for the reparation at the end of the conflict. The article suggests that the acknowledgment of the mental impacts of armed conflict needs to be taken into concern and consideration, especially from the perspective of  hard laws related to the IHL. Besides, the approach of soft law can be applied in attribution with the ongoing conflict in Yemen

Since Kuhn proclaimed the new paradigm concept in 1962, the view of the research world, especially those related to the socio-cultural fields, has changed drastically. The problem is with the field of architecture whose development history is related to the Faculty of Engineering but whose activities are more related to art and cultural meanings. This article discusses the history of the architectural education development since before it entered the higher education system and the history of the qualitative research development from the time before the concept of paradigm to the present conditions. Research is carried out with a constructive paradigm. Data were collected and analyzed from empirical studies, interpretation of research documents, and in-depth interviews with participants

    No full text
The study explores the impacts of governance on financial development in West African countries.Data for the study were obtained from the World Bank Database covering the period from 2006-2017. The variables for governance comprises of the six world governance indicators while financial development was represented by ratio of bank deposit to GDP and domestic credit to private sector. The control variables included in the model are interest rate, inflation, GDP per capita and trade openness. The findings from the study revealed that political stability and absence of violence, and regulatory quality have significant effects on both proxies of financial development. Also, voice and accountability, trade openness and interest rate show significances on the ratio bank deposit to GDP while government effectiveness (negative), rule of law, and control of corruption show significances on domestic credit to private sector. Thus, improving the quality of governance through strengthening legal and institutional frameworks, enforcement of standards and empowering of supervisory agencies, introducing an efficient regulatory environment to facilitate financial inclusion will play significant roles in the pace of financial development in the West Africa region. Get PDF
The issue of social crowdfunding has been widely discussed in various countries. In Indonesia, social crowdfunding media platforms are frequently used for social activities such as the donation for the victims of natural disasters or donation for people who suffer from financial deficiency. However, empirical research on social crowdfunding is finite. Even though the platform has been extensively used by the society, the lack of interest towards study in social crowdfunding is evident due to the obscureness of government regulations regarding the fundraising media. Considering the enormous contribution of social crowdfunding media for the people in need, the enthusiasm of the society to participate in the donation activities thus need to be elevated. This study aims to determine the degree of one’s motivation in trying to try to donate through social crowdfunding media. The data of this research was collected using survey method with a total of 300 respondents

Genetic Modification of Plants: An Emerging Technology

    Get PDF
Genetically modified (GM) plants can be created by adding specific DNA sequences obtained from the same plant species or different species. Which aims to achieve higher yields, disease and pest resistance, herbicide tolerance, production of antibodies, and other pharmaceutical molecules by manipulating gene expression to alter the protein properties. Insect resistant plants reduce the damage caused by pests and diseases. Herbicide glyphosate or glufosinate-tolerant GM plants gave promising results in combating weed. The properties of plants such as metal uptake, transport, accumulation, and detoxification of organic pollutants can be enhanced by genetically manipulating the fast-grown and introducing the responsible gene from the hyper accumulative species. GM plants can be used to produce cost-efficient and manageable drugs, vaccine, and biopharmaceuticals, if certain limitations are to be considered such as quality of final products, techniques for extraction and processing of biopharmaceuticals, and biosafety. Despite all these benefits, its adverse effects on the environment and human health have always been a matter of concern. The main limitation includes a horizontal transfer of the transgene to other species which may code for the specific antibiotic and herbicide resistance. It might be the possible transmission of resistance from the food products to the whole human population via intestinal bacteria. To address this several methods, need to be adopted to either keep away or eliminate marker genes from the transformed plants before growing in the field. Many scientists have come up with strategies to generate marker-free transgenic plants to give us safe and reliable GM technology

Evaluation of the Regulation Changes on Environment and Forestry in Indonesia

    Get PDF
This article aims to examine the correlation between the concept of proper enforcement of the law as stipulated in Article 5 (2) of the 1945 Constitution of Indonesia and the establishment and implementation of government regulation on environment and forestry. This article is a normative legal research with statute, historical, and conceptual approaches. The result shows that proper legal enforcement means two things, namely, establishment and enactment of government regulation by the President and the content of the regulation that does not contradict the law. Failure to comply with the law means the President does not establish or enforce a government regulation as mandated or the content of the regulation is not in line with the law.  If the President does form or enforce the implementation of government regulation, this means that the President violates his oath and promise to uphold the Constitution and to serve the nation. If the content of the regulation contradicts with the law, it can be canceled. In this situation, the government needs to realign the content of existing regulations. The ministry involved in legal drafting is called to oversee the content and follow through with revisions. All party involves in the making of law and regulation, such as the People Representatives, the President, or the Minister, is reminded to carefully formulate a government regulation
