    Determining ‘Uqūbāt for Sexual Harassment and Rape from the Perspective of Maqāṣid al-Sharīʿah: An Analysis of Mahkamah Syar’iyah Singkil Decision

    This study aims to analyze the selection of ‘uqubat ta’zir (discretionary punishments) in verdicts concerning jarimah (criminal acts) of sexual harassment and rape at the Mahkamah Syar’iyah Singkil during the period of 2021–2023, as well as to examine the judges' considerations through the lens of maqashid shariah (objectives of Islamic law). The study focuses on the implementation of the Supreme Court Circular (SEMA) and its alignment with maqashid shariah values in the determination of ‘uqubat ta’zir. This study uses a library research method to draw on primary data from Mahkamah Syar’iyah Singkil verdicts and interviews, alongside secondary data from regulations, qanun (regional Islamic laws), and relevant literature. The research adopts a normative juridical approach. The findings indicate that the panel of judges has implemented SEMA No. 10 of 2020 by imposing ‘uqubat ta’zir in the form of imprisonment. This implementation reflects a preventive effort against recidivism, a form of protection and recovery for victims, as well as a means of legal education (tadabbur) for society. Normatively, the judges' considerations align with the principles of maqashid shariah, particularly in the aspect of hifz al-nafs (protection of life). However, the application of hifz al-nasl (protection of lineage) and hifz al-mal (protection of property) has not been optimal, as no verdicts during the study period included restitution orders for the victims. Therefore, integrating restitution components into verdicts is crucial to strengthening the elements of public welfare (maslahah) and substantive justice within the jinayat judicial system

    The Extension of the Village Head’s Term of Office in Law Number 3 of 2024: A Review from the Perspective of Siyāsah Dustūriyyah

    The passage of Law Number 3 of 2024 concerning Villages extends the term of office of the Village Head to eight years, with a maximum of two terms. This is similar to the term limits during the New Order era. However, in practice, elections are often delayed, resulting in the regulations regarding the term of office not always being implemented on schedule. This research aims to analyze the changes in the Village Head’s term of office in Law Number 3 of 2024 from the perspective of siyāsah dustūriyyah. Using a normative-juridical approach, the study finds that the extension of the term to eight years reflects efforts to ensure the stability of village governance and promote public welfare. However, it also necessitates the establishment of effective oversight mechanisms to prevent abuse of power. The extended term is expected to provide sufficient time for Village Heads to optimize development and improve the quality of public services. Nevertheless, this change must be accompanied by strict supervision and evaluation mechanisms to safeguard against authoritarian tendencies. Philosophically, this amendment reflects the values of justice and popular sovereignty; sociologically, it promotes village empowerment; and juridically, it ensures legal certainty. In the framework of siyāsah dustūriyyah, the leadership of the Village Head is not merely administrative but also a moral and spiritual trust that must be exercised with justice and responsibility in accordance with Islamic principles. Leadership remains valid only as long as it is exercised fairly and rightly, and must be replaced if it deviates from these values. Ultimately, the change in the Village Head’s term of office aligns with the principles of democracy, Islamic values, and the need to establish effective and just village governance

    The purpose of this research is to analyze student gang communities, factors that influence student gang communities, the impact of gang communities on academic achievement, and the role of guidance and counseling on student gang communities. This study is of a qualitative type and was carried out using phenomenological techniques. This study was conducted at SMP Negeri 5 Lhokseumawe. Research shows that effective and efficient school policies need to be implemented to overcome the current problem of student gang community conflict. Being involved in a gang community will have a negative impact on students' academic achievement, but by implementing moral values ​​such as honesty, discipline and responsibility, students can be directed towards more positive behavior. The research is expected to be able to provide support and advice to students to continue to comply with school policies, so that schools can adopt relevant policies. This shows that the research not only reaches conclusions but also provides practical suggestions that can be used to develop policies and programs capable of eradicating student gang communities in schools

    General elections are an important mechanism in a modern democratic system that allows the people to participate in determining the country's leaders and policies. The main purpose of elections is to provide citizens with the opportunity to express their voices and elect leaders who will represent them in government so that Indonesian women are then able to take a role in politics in Indonesia. The inequality between men and women in politics has resulted in women's aspirations not being channeled through existing political channels, resulting in gender-based political discrimination which has continued for quite a long time.  This research uses normative legal research methods by conducting research studies of literature and statutory regulations related to the research object in order to find answers to the problems to be researched. The results of this research show that after the general election held in 2024, the people have expressed their aspirations through a democratic party held simultaneously throughout Indonesia. The current problem is the paradigm and belief that women's nature is only to take care of the family and women are not suitable to occupy leadership positions. This cannot happen in a democratic country because Article 27 paragraph 1 of the 1945 Constitution (UUD 1945) states that the principle of equal rights for all citizens is recognized without exception, this article as the basis of the State constitution has provided space for every citizen. participate in government without distinction of gender. It is further clarified in article 245 of Law No. 7 of 2017 concerning general elections which states "the list of prospective candidates as intended in article 243 contains at least 30% representation of women. Based on the results of the 2024 election, the number of women's representation only covers 21.9% in DPR RI seats, which means it is not in accordance with the implementation of existing regulations, this is due to the decline in the affirmation policy in the form of a 30% women's nomination quota in PKPU No. 10 of 2023 which carries out rounding down which has the impact of not meeting the minimum number of 30% of women in electoral districts allocated for seats: 4, 7, 8 and 11 which has the potential to reduce the number of women's representation.Pemilihan umum merupakan mekanisme penting dalam sistem demokrasi modern yang memungkinkan rakyat untuk berpartisipasi dalam menentukan pemimpin dan kebijakan negara. Tujuan utama pemilu adalah untuk memberikan kesempatan kepada warga negara dalam menyuarakan aspirasi mereka dan memilih pemimpin yang akan mewakili mereka dalam pemerintahan, sehingga perempuan Indonesia juga dapat mengambil peran dalam dunia politik di Indonesia. Ketimpangan antara laki-laki dan perempuan dalam politik telah menyebabkan aspirasi perempuan tidak tersalurkan melalui saluran politik yang ada, yang kemudian berujung pada diskriminasi politik berbasis gender yang berlangsung cukup lama. Penelitian ini menggunakan metode penelitian hukum normatif dengan melakukan studi kepustakaan dan kajian terhadap peraturan perundang-undangan yang berkaitan dengan objek penelitian guna menemukan jawaban atas permasalahan yang diteliti. Hasil penelitian ini menunjukkan bahwa setelah pemilu yang diselenggarakan pada tahun 2024, rakyat telah menyuarakan aspirasinya melalui pesta demokrasi yang diselenggarakan serentak di seluruh Indonesia. Permasalahan saat ini adalah paradigma dan keyakinan bahwa kodrat perempuan hanyalah mengurus keluarga dan tidak layak untuk menduduki posisi kepemimpinan. Hal ini tidak dapat dibenarkan dalam negara demokrasi, karena Pasal 27 ayat (1) UUD 1945 menyatakan bahwa asas persamaan hak bagi seluruh warga negara diakui tanpa pengecualian. Pasal ini sebagai dasar konstitusi negara telah memberikan ruang bagi setiap warga negara untuk berpartisipasi dalam pemerintahan tanpa membedakan jenis kelamin. Hal ini ditegaskan lebih lanjut dalam Pasal 245 Undang-Undang Nomor 7 Tahun 2017 tentang Pemilihan Umum yang menyatakan bahwa "daftar bakal calon sebagaimana dimaksud dalam Pasal 243 memuat paling sedikit 30% keterwakilan perempuan." Berdasarkan hasil Pemilu 2024, jumlah keterwakilan perempuan hanya mencapai 21,9% di kursi DPR RI, yang berarti belum sesuai dengan pelaksanaan regulasi yang berlaku. Hal ini disebabkan oleh menurunnya efektivitas kebijakan afirmasi berupa kuota pencalonan perempuan sebesar 30% dalam PKPU Nomor 10 Tahun 2023 yang menggunakan metode pembulatan ke bawah.     This research aims to describe the implementation and values ​​of Islamic education in the megengan tradition. This type of research uses a qualitative descriptive method with a phenomenological approach. This research took place in Langgenharjo village, Juwana subdistrict, Pati Regency. The data collection methods for this research are observation, interviews and documentation methods. The results obtained from this research are that the implementation of the Megengan tradition is carried out in the month of Sha'ban in the afternoon until dusk at the prayer room by bringing food in the form of blessed rice brought from home which will later be exchanged with other people. The implementation of the megengan tradition begins with an opening, mauidhoh hasanah, tahlil, prayer and closing. The implementation of this tradition is led by religious figures.     This study examines the impact of implementing the Contextual Teaching and Learning (CTL) model on improving students’ moral character in Islamic Religious Education (PAI) lessons in Aceh. The research was conducted in several public and private junior high schools in Aceh Barat, Aceh Selatan, Banda Aceh, Aceh Besar, Pidie, and Bireuen. This study aimed to evaluate the effectiveness of CTL in enhancing students’ understanding and application of moral values. The research employed a field study approach with a qualitative methodology. Data were collected through observations, in-depth interviews with PAI teachers and students, and an analysis of school documents. The findings indicate that the implementation of the Contextual Teaching and Learning (CTL) model has a significantly positive impact on improving students’ moral character, particularly in aspects of honesty, responsibility, and social care, while also helping students connect Islamic Religious Education (PAI) material with real-life situations. This provides practical contributions to the development of contextual-based learning in Islamic character education. The study concludes that the CTL model improves students’ moral character in PAI lessons. It is recommended that schools in Aceh consider adopting this model more broadly to achieve holistic educational goal

    Enhancing Vocabulary Acquisition: A Study on the Impact of Crossword Puzzle Learning Media in an EFL Context

    Vocabulary mastery is essential in English language learning. The lack of English words in students’ memory will hinder them in communication. This research aims to determine the effect of crossword puzzle media on improving the vocabulary skills to the eighth-grade students of a junior high school in Aceh Tengah. The study was conducted by using experimental research, and carried out on two groups: the experimental and the control. A population of 120 eight-grade students were selected, and the sample were class VIII-1 and class VIII-2 consisting 32 students in each functioning as the control group and experimental group respectively. The results indicated that the average score of the experimental class exceeded that of the control class. This showed that the experimental class performed better than the control class. The results of the t-test revealed that the calculated t-value was greater than the table t-value (2.13 > 1.99). With a significance level of 5% and 38 degrees of freedom, this means that the null hypothesis (H0) is rejected and the alternative hypothesis (Ha) is accepted. In other words, this learning media has a positive effect during English language learning

    The Evolution of Education in Indonesia: A Study of the 2013 Curriculum, the Independent Curriculum, and Inclusive Education in the Digital Era

    Education plays a crucial role in shaping a competitive and competent generation. Indonesia has undergone several curriculum reforms to align with global and societal needs, with the 2013 Curriculum (K-13) and the Independent Curriculum (Merdeka Curriculum) being the most relevant in the past decade. This study explores the implementation of the Merdeka Curriculum at SMK Negeri 3 Aceh Barat through a qualitative approach, employing semi-structured interviews with a Bahasa Indonesia teacher to analyze its application, challenges, and effectiveness. Findings reveal that while the Merdeka Curriculum offers greater autonomy in learning design and differentiation in instruction, its implementation faces significant obstacles, particularly regarding technological infrastructure. The lack of access to digital tools and internet connectivity hinders the optimal use of technology-based learning, especially in rural areas. Additionally, teachers require continuous professional development to effectively integrate digital resources into inclusive education. Despite these challenges, differentiation in the Merdeka Curriculum enables a more personalized learning experience, allowing students to engage with content suited to their interests and career aspirations, particularly in vocational high schools

    Degradasi karakter peduli sosial pada siswa kerap terjadi di masa sekarang. Generasi muda lebih disibukkan dengan aktivitas masing-masing tanpa adanya interaksi. Oleh karena itu, diperlukan wadah sebagai pembentukan karakter peduli sosial. Tujuan penelitian ini untuk mengetahui integrasi nilai-nilai Islam dengan kegiatan pramuka dalam membentuk karakter peduli sosial di MI Jamiyatul Qurro. Penelitian ini menggunakan metode penelitian kualitatif deskriptif dengan sumber data primer yaitu pembina pramuka. Teknik pengumpulan data menggunakan teknik wawancara, observasi dan dokumentasi. Untuk memperoleh data, teknik analisis data menggunakan triangulasi. Hasil penelitian ini menunjukkan bahwa kegiatan pramuka dapat membentuk karakter peduli sosial siswa. Hal ini terjadi karena, kegiatan pramuka terdapat berbagai macam kegiatan yang dapat membentuk sikap kepedulian sosial siswa. Seperti kegiatan upacara, baris-berbaris, tali-temali, hiking dan kemah. Serta pembiasaan-pembiasaan dilakukan untuk meningkatkan karakter peduli sosial ialah pembiasaan membaca doa sebelum maupun sesudah kegiatan pramuka, pembiasaan melafalkan surat Al-Fatihah dan surat-surat pendek, pembiasaan dalam kegiatan bakti sosial, pembiasaan sikap tolong menolong, pembiasaan menjenguk anggota pramuka yang sedang sakit dan pembiasaan untuk saling menghargai. Kegiatan pramuka memiliki integrasi dengan nilai-nilai Islam di antaranya Q.S Al-Maun;1-3, Q.S Ali-Imran:102, Q.S Maryam:96, Q.S Al-Maidah ayat 2, Q.S An-Nisa:8, dan Q.S Al-Hujurat:13
