Adaptation of Islamic Law in the Dutch Colonial Era: Fiqh al-aqalliyyāt, Maqasid Al-Shariah, and Its Legacy for Modern Indonesian Islamic Legal Institutions

    No full text
This study examines the dynamics of Islamic jurisprudence (Fiqh al-aqalliyyāt) during the Dutch colonial period in Indonesia, with a focus on the role of Maqasid al-Shariah (Islamic principles) in guiding the adaptation of Islamic law amidst the dominance of colonial law. In a situation where Muslims were in a minority position politically and in power, Islamic law underwent a process of negotiation and adjustment, both through religious court institutions and social-religious practices in society. This study employs a historical-comparative approach to examine the interaction between Islamic law and colonial law, and to investigate its long-term implications for the structure and functioning of contemporary Islamic legal institutions in Indonesia. The results show that the adaptation of Islamic law in the colonial era was driven not only by the need to maintain the identity and continuity of sharia but also by considerations of benefit in line with the principles of Maqasid al-Shariah. This historical legacy has had a profound influence on the modern Islamic legal framework, both in its institutional aspects and in the legal substance that remains applicable to this day

Reception of Islamic Legal Rituals Among Indigenous Indonesian Communities with Comparative Findings from Wetu Telu and Masade

    No full text
This article examines the Reception of Islamic legal rituals among indigenous Indonesian communities through a law-centered comparative design. This study understands reception as the selection, reinterpretation, and substantive integration of Islamic ritual norms into local practice. The framework juxtaposes doctrinal analysis of fiqh (Islamic jurisprudence) categories, namely ibādāt taʿabbudī/tawqīfī (worship rituals strictly bound to canonical pillars and conditions) and muʿāmalāt/ahwāl al-shakhṣiyyah (social transactions and personal status), with ethnographic and historical materials. The analysis assesses four equivalent domains: core obligations of worship, calendrical ordering, sacred space and authority, and life-cycle rites. Findings indicate that the Wetu Telu (Sasak "three times" tradition) community in Lombok exhibits primarily substantive Reception, in which ritual form and legal intent converge and are institutionally embedded. By contrast, the Masade (Sangihe "Old Islam" community) exhibits a more selective and symbolic reception, maintaining Islamic identifiers while limiting ritual obligations and temporal coordination within a localized sacred order. These patterns clarify how ʿurf (customary practice) can sustain or reframe Fiqh in indigenous settings without reducing analysis to a simple binary of "orthodox" versus "syncretic." The article contributes a scalable matrix for assessing ritual reception across communities and highlights implications for legal pluralism and the living law of Islam in Indonesia

Strategic Development of the Brick Industry based on Islamic Economics: a Case Study in Bangko Bakti Village

    No full text
This study aims to develop a strategic model for brick enterprise by integrating the SOAR framework with Islamic economic principles to enhance sustainability, ethical integrity, and long-term growth in small-scale industries. The research applies a qualitative descriptive method conducted in Bangko Bakti Village, Rokan Hilir Regency, Riau Province. Data were collected through in-depth interviews with the business owner, workers, and local stakeholders, complemented by field observations and secondary sources. Triangulation was used to ensure data reliability and validity, while the IFE–EFE matrices and SOAR analysis were applied sequentially to determine strategic positioning and formulate development strategies. Islamic values such as adl (justice), ihsan (excellence), amanah (trustworthiness), and maslahah (public welfare) were embedded in each analytical stage to guide ethical decision-making and ensure fairness in the business operations. The results show that the enterprise holds strong internal capabilities (IFE score 3.15) and favorable external opportunities (EFE score 3.00), positioning it in the “Grow and Build” quadrant of the IE matrix. Practical strategies derived from this integration include implementing digital marketing, improving production efficiency, ensuring quality control, and promoting fair wage distribution. The study demonstrates that incorporating Islamic ethics within the SOAR model can strengthen managerial accountability, social welfare, and stakeholder trust, offering a replicable approach for other SMEs seeking value-driven and sustainable growth

When Clerical Errors Become Court Cases: Administrative Justice and the Judicialization of Marriage Registration in Indonesia

    No full text
This article analyzes the juridical and socio-legal implications of the judicialization of marriage biodata correction under the Regulation of the Minister of Religious Affairs (PMA) Number 30 of 2024 in Indonesia. The regulation requires that all amendments to marital biodata be resolved through judicial determination, shifting corrective authority from the Office of Religious Affairs (KUA) to the Religious Courts. This policy change raises concerns regarding administrative justice, public service efficiency, and access to justice in family law administration. Using a combined normative juridical and socio-legal approach, the study examines the evolution of marriage registration regulations from PMA No. 11 of 2007 to PMA No. 30 of 2024. It analyzes empirical data from biodata amendment cases adjudicated by the Religious Court of Suwawa between January and October 2025. The findings reveal a non-linear regulatory trajectory marked by alternating phases of administrative flexibility and judicial centralization, as well as persistent ambiguity in distinguishing clerical corrections from substantive amendments. Empirically, most court applications involve minor typographical errors previously resolvable administratively. The article argues that this condition reflects over-judicialization of administrative corrections. It concludes that technically non-substantive biodata corrections should be reintegrated into the administrative authority of the KUA through a structured and accountable administrative self-correction mechanism to promote proportionality, efficiency, and public service justice

    No full text
The integration of Artificial Intelligence (AI) into English language instruction has created new opportunities for enhancing learner engagement and communication skills, particularly in English for Specific Purposes (ESP) contexts. In Business English courses, students must master professional speaking tasks that require fluency, accuracy, and confidence. However, few studies have explored how AI tools can be combined with project-based learning (PBL) to support these outcomes. This study examines the use of AI-supported video projects to enhance speaking performance and improve learner perceptions in a Business English classroom. Using a mixed-methods design, quantitative data from pre- and post-tests and qualitative reflections were analyzed. Results showed significant gains in speaking performance and increased learner autonomy, confidence, and engagement. Students also encountered several challenges, including technical difficulties in using AI applications and initial anxiety about video recording, which required patience and self-regulation to overcome. Despite these challenges, students viewed the AI tools as beneficial. These findings suggest that integrating AI into PBL tasks can serve as a transformative approach for ESP instruction in higher education. Keywords: Artificial Intelligence in Education; Business English Speaking Skills; English forSpecific Purposes (ESP); Project-Based Learning; Technology-Enhanced LanguageLearnin

Sociocultural Interactions and Community Education: An Anthropological Study in Indramayu, West Java

    No full text
This study examines the impact of sociocultural interactions in rural Indramayu on education perspectives, highlighting challenges and opportunities in accessing culturally relevant education. A qualitative descriptive approach was employed in three sub-districts: Kandanghaur, Gabus Wetan, and Bongas, where the majority of residents are farmers and fishermen. Findings suggest that local values, such as cooperation and harmony, influence perceptions of education as a means to enhance livelihoods beyond agriculture and fisheries. However, economic priorities often prevent children from pursuing higher education. Opportunities arise through local wisdom-based education, integrating practical skills and sustainable resource management. Globalization enhances access to knowledge and technology, but it also poses a threat to cultural preservation. This study highlights the importance of striking a balance between technological advancements and the preservation of local cultural values to foster sustainable rural development

    No full text
The rapid digital transformation in education has brought significant challenges and opportunities, particularly in integrating technology to improve learning outcomes. This study aims to analyze the effectiveness of Learning Management Systems (LMS) in enhancing student learning outcomes, focusing on the Education Management course. Using a quasi-experimental design, the research involved 18 students who underwent pre-test and post-test assessments. The results showed a significant improvement in learning outcomes, with the average post-test score (80.67) significantly higher than the pre-test score (54.89), supported by statistical analysis (sig. 0.000). The findings align with Al-Fraihat et al. (2020) and Sun et al. (2008), emphasizing the importance of LMS usability, content quality, and integration with active learning strategies. However, challenges such as the digital divide and lack of face-to-face interaction need addressing through equitable access to technology and hybrid learning models. The study concludes that LMS is an effective tool for digital learning transformation, recommending continuous content development, training, and periodic evaluation to maximize its potential

Reconstructing Takaful Participation in Makassar: Integrating Maqāṣid Al-Sharī‘ah, Cultural Embeddedness, and Sociological-Juridical Perspectives

    No full text
Takaful participation in Makassar remains low despite its role as a regional center for Islamic finance, indicating a gap between institutional development and societal acceptance. Existing studies have not fully explained how maqāṣid al-sharī‘ah values intersect with local socio-cultural structures or how social, cognitive, and legal factors shape participation. This study addresses these gaps by examining these dynamics and proposing a culturally grounded reconstruction model. Using a qualitative sociological-juridical approach, data were collected from 22 informants, including takaful agents, religious scholars, regulators, and policyholders, through semi-structured interviews, observation, and document analysis. Analysis followed the Miles Huberman Saldaña interactive model with triangulation to ensure validity. We employed a maqāṣid-based hermeneutical lens to interpret values such as ḥifẓ al-māl and ḥifẓ al-nafs, as well as taʿāwun, alongside the local cultural ethos of siri’ na pacce. Findings indicate that low participation is not due to resistance to Islamic principles, but rather to a misalignment between formal takaful mechanisms and community-based solidarity norms. The study introduces the Maqāṣid Cultural Embeddedness Model, integrating value reframing, institutional collaboration with religious leaders, and community-oriented micro-takaful design. This model provides conceptual and practical guidance for aligning takaful systems with maqāṣid objectives and the socio-cultural realities of Makassar

Enhancing Political Literacy Among Generation-Z Through Social Media: Evidence from Indonesia's Electoral Commission Instagram Account

    No full text
The digitalization of political communication has significantly transformed how citizens engage with political information, particularly among younger generations. Generation Z (Gen Z), born between 1997 and 2012, represents a cohort of digital natives with high technological literacy but relatively limited political awareness. In Indonesia, where Gen Z constitutes a substantial share of the electorate, electoral institutions face challenges in delivering effective political education through conventional channels. This study examines the effectiveness of political education content disseminated via the @KPU_KALSEL Instagram account in enhancing political literacy among Gen Z students. Using a qualitative descriptive approach, the study conducted semi-structured interviews with five undergraduate students from the Faculty of Social and Political Sciences at UNISKA (born in 2002), supported by content analysis and systematic observation carried out in November 2024. The findings indicate that Instagram-based political content contributes positively to increasing political awareness and understanding among Gen Z audiences. Factors influencing effectiveness include content accessibility, visual clarity, concise messaging, and topical relevance. Posts related to the Peaceful Campaign Declaration and information on the Quiet Period were perceived as particularly impactful. Participants demonstrated improved comprehension of electoral procedures, regulations, and democratic values. This study concludes that social media platforms, when strategically utilized, can serve as effective tools for political education and voter engagement among digitally native generations

ANALYSIS OF ISLAMIC LAW ON THE IMPACT OF PARENTAL INTERVENTION IN MARITAL LIFE

    No full text
Abatract: This research aims to analyze the boundaries of parental intervention in a child’s household and its impact from the perspective of Islamic law. The method employed is qualitative library research. Using a normative-juridical approach, this study examines the Qur'an, Hadith, the Marriage Law, and the opinions of scholars through descriptive-analytical analysis with deductive reasoning. The results indicate that Islamic law prohibits parental intervention that undermines the sovereignty of the child's household, particularly when it leads to efforts to destroy the relationship between husband and wife. Juridically, household independence is the absolute right of the married couple. Parental involvement is only permitted in the capacity of providing advice or acting as a mediator when conflicts arise that cannot be resolved independently. This research concludes that household harmony can be achieved through a balance between the obligation of filial piety (birrul walidain) and the respect for the child’s right to domestic autonomy. Keywords: Islamic Law, Parental Intervention, Marriage, Household Independence.
