Negotiating Islamic Moderation: The Interplay of Sharia and Local Culture in Gorontalo, Minangkabau, and Banten
Muslim scholars and local communities have actively negotiated the Islamization process in Indonesia through complex engagements with Islamic law (sharia) and local cultural traditions. This study examines how such interactions have shaped distinct constructions of Islamic moderation in three culturally significant regions: Gorontalo, Minangkabau, and Banten. Employing a qualitative, field-based approach, the research utilizes in-depth interviews, participant observation, and document analysis to explore the integration of sharia and adat (customary law). The findings reveal three typological models of Islamic moderation: (1) an integrative model in Gorontalo, where royal diplomacy and political marriage internalized Islamic law within the framework of customary governance; (2) a negotiation model in Minangkabau, emerging from post-conflict reconciliation between ulama and customary leaders, institutionalized through the philosophy of Adat basandi syarak, syarak basandi Kitabullah; and (3) a hegemonic model in Banten, characterized by the dominance of Islamic law over local traditions, embedded within the centralized religious authority and state power. These findings suggest that Islamic moderation in Indonesia is not a singular concept but the product of historically and contextually embedded legal-cultural dynamics. The study concludes that Islamic moderation is a localized negotiation among legal norms, cultural practices, and power structures. Its academic contribution advances the understanding of legal pluralism in Muslim societies while offering policy-relevant insights for promoting religious tolerance and cultural inclusivity in Indonesia
HUKUM WARIS ADAT BOLAANG MONGONDOW DALAM PERSPEKTIF HUKUM KELUARGA ISLAM
Abstrak : Penelitian ini bertujuan untuk menganalisis pelaksanaan hukum waris adat masyarakat Bolaang Mongondow di Kotamobagu Selatan. Metode yang digunakan adalah penelitian lapangan dengan pendekatan kualitatif, berlokasi di Kecamatan Kotamobagu Selatan. Subjek penelitian mencakup tokoh adat, instansi hukum, tokoh agama, dan masyarakat terkait isu waris. Pengumpulan data dilakukan melalui wawancara dan dokumentasi, sedangkan analisis data meliputi reduksi, penyajian, dan penarikan kesimpulan (verifikasi). Teknik triangulasi digunakan untuk memeriksa keabsahan data. Hasil penelitian menunjukkan bahwa pembagian harta warisan di Kotamobagu Selatan masih banyak dipengaruhi oleh cara pewarisan adat Bolaang Mongondow. Dalam praktik ini, anak perempuan bungsu, anak perempuan satu-satunya biasanya berhak menerima rumah sebagai bagian dari warisan. Hal ini mencerminkan nilai-nilai budaya yang mendasari cara pewarisan di masyarakat. Dari perspektif hukum keluarga Islam, pelaksanaan pembagian waris adat Bolaang Mongondow dapat dikaitkan dengan konsep ‘urf, di mana praktik adat yang berlaku diakui selama tidak bertentangan dengan prinsip syariah.Abstract : Inheritance Law of Bolaang Mongondow in the Perspective of Islamic Family Law. This study aims to analyze the implementation of customary inheritance law among the Bolaang Mongondow community in Kotamobagu Selatan. The research employs a field study methodology with a qualitative approach, focusing on the location of Kotamobagu Selatan. The subjects of this research include customary leaders, legal institutions, religious leaders, and community members related to inheritance issues. Data collection is conducted through interviews and documentation, while data analysis involves data reduction, data presentation, and conclusion drawing (verification). To assess the validity of the data, triangulation techniques are used. The results indicate that the distribution of inheritance in Kotamobagu Selatan is still largely influenced by the customary inheritance practices of Bolaang Mongondow. In this practice, the youngest daughter, the only daughter, or the child designated as the heir in the care of a particular child is typically entitled to receive the house as part of the inheritance. This reflects the cultural values underlying inheritance practices in the community. From the perspective of Islamic family law, the implementation of the customary inheritance of Bolaang Mongondow can be associated with the concept of 'urf, where prevailing customary practices are recognized and respected as long as they do not contradict sharia principles.Kata Kunci : Hukum Keluarga Islam, hukum Waris, Bolaang Mongondow.
Strengthening Sharia Economics in Jayapura's Muslim Minority Communities through Fiqh al-Aqalliyyat
The Muslim community in Jayapura faces significant challenges in implementing Sharia-based economics, chiefly due to persistent social stigma surrounding halal products and limited public understanding of Islamic economic principles. This study explores how Fiqh al-Aqalliyyat a flexible jurisprudential framework can address these challenges within a multicultural society. Adopting a qualitative case study methodology, the research draws on interviews with 14 key local stakeholders, including government officials, religious leaders, and business owners. Data were gathered through purposive sampling and analyzed thematically to identify key barriers and viable solutions. The findings indicate that social stigma and inadequate infrastructure impede halal product promotion. Nevertheless, significant opportunities exist, including a growing demand for halal goods, government support for Sharia-compliant capital markets, and the active engagement of religious institutions. The novelty of this research lies in its integration of Fiqh al-Aqalliyyat and Maqasid al-Sharia as analytical frameworks to address the specific socio-economic realities of a Muslim minority in Jayapura, offering practical insights applicable to similar contexts elsewhere.The Muslim community in Jayapura faces significant challenges in implementing Sharia-based economics, chiefly due to persistent social stigma surrounding halal products and limited public understanding of Islamic economic principles. Towards Discursive Justice: An Integrative Foucault-Islam Framework for Critical Media Discourse Analysis in Justice Issues
This research aims to analyze the construction of online media discourse in the "Vina Cirebon" case through the integration of Foucauldian discourse analysis and Islamic legal perspectives to understand the dynamics of power, knowledge, and justice in media narratives. Using a qualitative approach with case study design, this research analyzes six Kompas.com news articles from January-June 2024 selected purposively. The analytical method includes critical discourse analysis based on Foucault's model examining knowledge systems, power-knowledge relations, regimes of truth, and subject construction, which is then evaluated using Islamic legal perspectives on principles of justice (al-’adl), transparency (al-wuduh), and protection of human dignity (karamah al-insan). Research findings reveal that media operates as a discursive apparatus legitimizing institutional dominance of the Indonesian National Police (POLRI) in controlling information production and distribution, where "truth" is constructed through discursive practices that marginalize alternative perspectives. Islamic legal evaluation shows misalignment between media practices and Islamic justice principles, particularly in transparency and protection of individual dignity. This research produces the innovative concept of "discursive justice" that demands media practices to be not only procedurally fair but also substantively protective of human rights. The findings indicate the need for transformation of the media ecosystem towards more responsible and ethical practices in the context of justice
Negotiated Gender Equality in Multireligious Families: Muslim Minority Households in Tana Toraja
This study examines the strategies employed by Muslim minority families in Tana Toraja to foster harmony and gender-balanced relationships within multireligious household settings. Using a qualitative phenomenological design, the research draws on extended interviews and close observations of five families formed through religious conversion. The analysis shows that everyday family life is shaped less by rigid patriarchal expectations than by negotiated understandings of roles and responsibilities, allowing men and women to construct a shared moral framework that remains sensitive to their differing religious commitments. Women, in particular, often act as stabilizing figures who sustain kinship networks through social participation, educational involvement, and economic activities, while simultaneously upholding clear boundaries in matters of worship and creed. Interpreted through Maqāsid al-Sharīʿah and contemporary approaches to Islamic pedagogy (Tarbiyah), these patterns reveal an egalitarian ethos that reinforces the protection of faith and lineage by fostering an atmosphere that is both tolerant of pluralism and grounded in religious integrity. The study contributes to current debates in Islamic family law and the sociology of religion by demonstrating how negotiated gender equality becomes a practical strategy for preserving familial cohesion in multireligious contexts
Gender Justice in Tudang Sipulung: An Ecofeminist–Maqāṣid al-Sharīʿah Reading of Inheritance in Bugis Bone, Indonesia
This article examines Tudang Sipulung, a traditional deliberative forum within the Bugis community of Bone Regency, South Sulawesi, as a culturally embedded mechanism for the distribution of inheritance. Using an ecofeminist perspective alongside the framework of maqāṣid al-sharīʿah, the study employs an empirical legal approach combined with legal-anthropological analysis. Data were collected through semi-structured interviews with religious leaders, local government officials, and heirs, supported by field observations and an examination of religious court decisions and village archival records. The findings show that women actively participate in inheritance deliberations and play a significant role in maintaining both family harmony and environmental sustainability. Their involvement reflects a close relationship between women’s economic responsibilities, household livelihoods, and ecological awareness. The practice of Tudang Sipulung demonstrates the protection of wealth (ḥifẓ al-māl) through negotiated and equitable distribution; the protection of lineage (ḥifẓ al-nasl) by reducing intrafamily conflict; and the protection of life (ḥifẓ al-nafs) by discouraging excessive accumulation and social tension. Conceptually, this study contributes to Islamic legal scholarship by reading customary inheritance practices through the combined lenses of ecofeminism and maqāṣid al-sharīʿah. In practice, it offers a gender-sensitive, environmentally grounded mediation model that may inform the resolution of inheritance disputes in pluralistic social settings
Analisis Korelasional Sikap Peserta Didik dan Hasil Belajar Sejarah Peradaban Islam di MTsN 2 Kab. Gorontalo
Permasalahan dalam penelitian ini didasarkan pada kenyataan apakah sikap peserta didik memiliki korelasi yang signifikan dengan hasil belajar pada mata pelajaran SKI. Untuk itu penelitian ini bertujuan untuk mengetahui apakah terdapat korelasi yang signifikan antara sikap peserta didik dengan hasil belajar Sejarah Kebudayaan Islam. Penelitian ini dilakukan di MTs. N 2 Kabupaten Gorontalo pada semester ganjil tahun ajaran 2024/2025. Metode yang digunakan adalah survei korelasional dengan teknik pengumpulan data menggunakan instrumen kuesioner dan tes pada sampel 60 peserta didik MTs. N 2 Kab. Gorontalo. Data tersebut diolah dengan teknik analisa deskriftif dan inferensial, dengan menghasilkan koefisien korelasi ry.1 = 0,46 dalam pola persamaan regresi sederhana Ў = 15,69 + 0,26X1.. Hasil tersebut dapat diinterprestasi bahwa penelitian ini terdapat korelasi yang signifikan antara sikap peserta didik dengan hasil belajar Sejarah Kebudayaan Islam. Dengan demikian sikap peserta didik terhadap mata pelajaran Sejarah Kebudayaan Islam merupakan salah satu faktor psikologis yang berpengaruh dalam pencapaian hasil belajar
Dompet Dhuafa Waspada Strategy in Empowering the Mustahik Economy for Sustainable Economic Development
Productive zakat is a strategic instrument for reducing poverty and enhancing community welfare, yet its implementation often encounters managerial and contextual challenges. This study aims to analyze the strategy of Dompet Dhuafa Waspada in Medan’s in empowering mustahik through productive zakat programs, specifically those involving business capital grants, skills training, and continuous mentoring within the Menjahit Harapan Dhuafa programme, Livestock Center, and Rumah Tempe initiatives. Using a qualitative case study approach supported by the SOAR (Strengths, Opportunities, Aspirations, Results) framework, data were obtained through in-depth interviews, observations, questionnaires, and documentation. The findings show that Dompet Dhuafa Waspada in Medan possesses strong internal capacities (score 19.6) and clear strategic aspirations (score 19.4), positioning the institution in the SA quadrant, which emphasizes maximizing strengths to achieve long-term goals. The study reveals that the implementation of productive zakat includes structured business assistance, capital distribution, skills development, and marketplace facilitation; however, the program also faces several challenges. These include limited capital scalability, variability in mustahik entrepreneurial readiness, dependence on external market dynamics, and constraints in long-term monitoring. Despite these obstacles, the program successfully increases mustahik income, improves business independence, and generates measurable socio-economic benefits when integrated with consistent mentoring and cross-sector collaboration. This research provides a balanced evaluation of both the achievements and limitations of productive zakat implementation in Medan and offers an empirical foundation for strengthening institutional strategies and public policies that support sustainable poverty alleviation aligned with the Sustainable Development Goals
Challenging the Claim of Ijma' on the Prohibition of Bank Interest: A Critical Review of Murabahah Practices in Islamic Banking
The global Islamic finance industry is growing rapidly, with its primary legitimacy resting on the claim of ijmāʿ (scholarly consensus) regarding the prohibition of bank interest. However, murabahah contracts, which dominate 76.95% of Indonesian Islamic banking financing, have received structural criticism similar to that of the interest system. This study analyzes the validity of the ijmāʿ claim regarding the prohibition of bank interest, according to uṣūl al-fiqh (principles of Islamic jurisprudence), and examines whether murabahah practices contain elements that lead to the interest system. Qualitative research with descriptive-analytical and critical-evaluative library research approach using data from classical uṣūl al-fiqh texts (Khallaf, al-Shāfiʿī) and 33 journal articles (2000-2025). Analysis was conducted through data reduction, comparative analysis, critical-methodological evaluation, and source triangulation. The ijmāʿ claim regarding the prohibition of bank interest does not meet the requirement of an agreement among all mujtahids (qualified scholars capable of independent reasoning) without exception, due to ongoing disagreements and methodological debates; thus, it is more appropriately categorized as a jumhūr (majority) opinion. Murabahah practices contain three elements leading to the interest system: the bank's role as a disguised financier with risk transfer to customers, mark-up systems influenced by market interest rates and varying based on time period (implicit recognition of time value of money), and structural-functional similarity with interest-bearing financing confirmed by empirical studies (12.87% margin approaching conventional rates). The double inconsistency between methodologically invalid ijmāʿ claims and murabahah practices resembling interest creates risks of a credibility crisis. Reconstruction is necessary through genuine ownership, a real economy-based margin setting, transparency, reorientation towards PLS (Profit and Loss Sharing), and strengthened shari'ah supervision
PERAN RASA SYUKUR TERHADAP KESEJAHTERAAN SUBJEKTIF PADA MAHASISWA DENGAN DUKUNGAN SOSIAL SEBAGAI MEDIATOR
ABSTRAKMemiliki hidup yang sejahtera merupakan impian semua manusia termasuk mahasiswa. Mahasiswa kerap mengalami tantangan seperti cemas, stres, mudah merasa bosan maupun tertekan dengan beban tugas yang tidak teratasi dapat berujung pada rendahnya kesejahteraan subjektif mahasiswa. Penelitian ini bertujuan untuk menguji peran rasa syukur terhadap kesejahteraan subjektif dengan dukungan sosial sebagai mediator. Penelitian melibatkan partisipan sebanyak 373 mahasiswa di kota Kendari. Penelitian ini menggunakan metode kuantitatif dengan menggunakan Skala Kesejahteraan Subjektif, The Multidimensional Scale of Perceived Social Support (MPSS) dan Skala Bersyukur Indonesia (SBI). Analisis mediasi menunjukkan bahwa rasa syukur berperan secara positif terhadap dukungan sosial (β=0,1901) dan kesejahteraan subjektif (β=0,6032), kemudian dukungan sosial berperan secara positif terhadap kesejahteraan subjektif (β=0,7750). Terakhir, dukungan sosial memediasi peran rasa syukur terhadap kesejahteraan subjektif (β=0,1473). Kesimpulannya yaitu dukungan sosial memediasi peran rasa syukur terhadap kesejahteraan subjektif. Tingginya rasa syukur akan meningkatkan dukungan sosial, kemudian dukungan sosial dapat meningkatkan kesejahteraan subjektif.Kata Kunci: dukungan sosial, kesejahteraan subjektif, mahasiswa, rasa syuku
