Legal Relations of Contemporary Islamic Family: A Study of The Existence of Local Culture in Sambas, West Kalimantan
This research investigates marriage laws in Islam, aiming to explore the scientific knowledge of Islamic family law related to the local Sambas culture in marriage practices. The people of Sambas deeply intertwine their regional loyalties with local customary culture, particularly in the context of Muslim weddings. This study addresses whether Islamic marriage laws conflict with local cultural traditions, especially within Indonesia's framework of Islamic family law. The focus of this research examines how the implementation of Islamic marriage laws interacts with or conflicts with the local Sambas culture. The research employs a qualitative methodology that combines fieldwork and literature review. The empirical normative approach is designed to describe data related to contemporary Islamic family law legislation in the context of the local cultural axiology of Sambas, West Kalimantan. This approach systematically examines and explains the facts and characteristics of the subject in detail and depth. The researcher closely ties the research methods to the procedures, techniques, tools, and designs used throughout the study. The primary finding of this research underscores that culture is fundamentally a product of human intellect, comprising patterns, ways of thinking, emotions, and reactions shaped by and expressed through symbols created collectively by the Sambas community. The study identifies significant issues in the current legislative framework, where policymakers often prioritize intellectual subjectivity over human objectivity. As a result, emerging policies fail to address societal needs adequately. In response, the researcher catalogs various forms of local wisdom within Islamic communities in Sambas, proposing these as relevant methodologies for establishing laws that align with local culture

KAMPUNG JAWA TONDANO DALAM PERSPEKTIF ARKEOLOGI RUANG
Abstract : The interaction between humans and the environment creates a cultural landscape which is a concrete manifestation of human adaptation to the environment. This research discusses Kampung Jawa Tondano in the scope of spatial archeology. Kampung Jawa Tondano is a famous historical settlement in Minahasa Regency, North Sulawesi. This village was founded by Kiai Mojo and his followers when they were exiled in Tondano. This research aims to look at the spatial dynamics and cultural continuity of Kampung Jawa Tondano from a spatial archaeological perspective. Most villages in Indonesia are created from cultural patterns. The character of a village based on Muslim residents and becoming a center for spreading religion is called an Islamic Village or Kauman. Kauman is not applied in the Kampung Jawa Tondano, the term kauman does not appear in the spatial expression in this village. The condition of exile status of minority community groups in Kampung Jawa Tondano is certainly a reason for not emphasizing religious aspects compared to tribal identity. Other components of the settlement in Kampung Jawa Tondano that have a relationship with Islamic and Javanese culture are the Al-Falah Mosque building and the Kiai Mojo Complex Tomb. The mosque building adopts the concept of a traditional Javanese mosque building. The placement of the Kiai Mojo Complex Tomb on a hill is evidence of the continuity of Javanese culture. The phenomenon of mosque fundraising on highways represents an established social practice in Indonesian society, particularly in Bangkalan Regency. This practice creates a unique dynamic between religious legitimacy and social norms that warrants comprehensive examination. This study aims to analyze the practice of mosque fundraising on Bangkalan Regency highways from the perspective of Islamic legal sociology, focusing on the interaction between religious and social norms that shape this practice. Employing a qualitative approach with field research methods, data were collected through in-depth interviews, observation, and documentation. The findings indicate that mosque fundraising practices on highways receive support from local religious leaders despite contradicting the Indonesian Ulema Council (MUI) fatwa. This support creates strong social acceptance, making it an integral part of local tradition that is difficult to modify. However, this practice raises challenges related to road user safety and trustworthy fund management. It can be concluded that the practice of mosque fundraising on Bangkalan Regency highways is formed through complex interactions between religious and social norms that mutually legitimize each other. RELIGIOUS MODERATION IN SLOGANS, PRACTICES, AND MADRASAH REFLECTION
ABSTRACTThe lack of understanding of madrasah students about the concept of religious moderation and the lack of encounters between religions in society is the main basis for this research literature study. Religious moderation is a discourse as well as a practice needed in a multicultural society such as in North Sulawesi. This means that where there is diversity, that is where the value of moderation must be present and become the lifeblood of the link between members of the community. The results of the study indicate that there are solutions that can be implemented in strengthening religious moderation, including creating or using existing mottos in society as a basis for instilling religious moderation values, such as the mottos of torang samua basudara and torang samua created by God in North Sulawesi. Building houses of worship side by side, of course, can open meeting spaces and increase the intensity of encounters between religions as the main capital in strengthening religious moderation. In madrasas, madrasas can make madrasah moderation days and hold interfaith student exchanges so that religious moderation is familiar among madrasah students who are part of the millennial generation. Then, you can also make a religious moderation accompanying diploma as a sign of the maturity of student religious moderation which is oriented towards attitudes and moderation schools as an alternative to strengthening community religious moderation, especially the millennial generation. Keywords: Religious moderation and Madrasa
