Gender Equity in Muslim Family Law: Modern and Contemporary ‘Ulamā’s View

    Get PDF
The concept of equality has been a rhetoric of increasing importance globally today. This concept teaches that men and women are equal in all aspects without distinction. The Islamic teaching totally reject this concept. Therefore, the main feminist movement claims that Islam is a anti-religion to equality. The equality concept of Islam is quite different from the Western perspective. Hence, this study focuses on the ‘ulamā’s view on some important aspects related to equity, especially the nature of different gender and different responsibilities, divorce rights, polygamy, testimony, and inheritable rights based on narrative review. It employs a qualitative approach, where the relevant document is based on primary and secondary sources such as books, journals and website articles and videos. The data collected in this regard were analyzed using the content analyzing method. The findings show that the modern and contemporary ‘ulamā’s opinion aligns with Islam’s principle of equity, emphasizing the reality and justice behind the concept of equity. Through the understanding and practice of Islamic doctrine can establish a fair equality in the world

Spin-Off as a Strategy to Accelerate Islamic Banking Growth in Indonesia: Assessing the Readiness of Sharia Business Units

    Get PDF
Islamic banking in Indonesia has grown significantly in recent years, supported by legal mandates encouraging structural separation between conventional and Sharia banking. This study aims to assess the readiness of Sharia Business Units (UUS) to implement the 2023 spin-off policy. A qualitative research approach was employed, with data collected through documentation and literature review. The study examined 20 Sharia Business Units, including one unit from a State-Owned Enterprise (Bank Tabungan Negara), 13 units under Regionally-Owned Enterprises (BUMD), and six units affiliated with private banks. The findings show that 50% of the assessed Sharia Business Units are not prepared to separate from their parent banks, particularly in terms of asset size, capital adequacy, and overall institutional health. Most UUS lack sufficient capital readiness, infrastructure, and qualified human resources to operate independently. When viewed holistically—across financial, operational, and HR dimensions—the majority of UUS included in this study were not ready for the 2023 spin-off. These findings provide valuable insights for regulators and stakeholders in the Islamic banking industry, particularly in shaping future policies and support mechanisms for Sharia Business Units transitioning toward independence

Urgency of Legal Personal Data Protection in E-Commerce Transactions Involving Artificial Intelligence

    Get PDF
The protection of personal data has become increasingly critical in the digital era, particularly in e-commerce transactions involving the use of Artificial Intelligence (AI). A significant legal gap persists because, although Indonesia has enacted Law No. 27 of 2022 on Personal Data Protection, there are still no implementing regulations specifically addressing the use of AI in personal data collection and processing. Consequently, legal protection for consumers remains inadequate and vulnerable to misuse by digital businesses and cybercriminals. This study aims to analyze the effectiveness of legal protection for consumers’ personal data in Indonesia and to assess the urgency of regulating AI use in e-commerce activities. The research employs a normative legal method, utilizing legislative and conceptual approaches. The findings reveal that AI can enhance the detection and prevention of personal data breaches more effectively. However, without implementing regulations and an independent supervisory authority, AI may also pose significant privacy risks. Moreover, the lack of clear legal standards governing the accountability of electronic system operators for data security further weakens personal data protection. This study recommends formulating detailed implementing regulations governing AI use in personal data management and establishing an independent supervisory body with the authority to monitor, evaluate, and enforce compliance with personal data protection laws. Keywords: Artificial Intelligence; E-commerce; Legal Protection; Personal Dat

    Get PDF
This research aims to analyze the challenges and opportunities faced by MSMEs in Indonesia in simultaneously utilizing the halal industry, digital economy, and creative economy. The method used is qualitative, with case studies involving in-depth interviews, observation, and analysis of related documents. The focus of this research is to identify the main obstacles, such as halal certification bureaucracy, low digital literacy, and limited global market access, as well as opportunities that arise from the integration of these three sectors. The research results show that digitalization facilitates MSMEs in increasing market access and operational efficiency through sharia e-commerce and fintech platforms. Meanwhile, the creative economy encourages innovation in halal products that add value and are relevant to modern consumer trends. However, MSMEs still need help in technology adoption and innovative financing. This research underscores the need for cross-sector collaboration and government policy support to create an inclusive and sustainable business ecosystem. With an adaptive strategy, MSMEs in Indonesia can take advantage of the synergy between the halal industry, digital economy, and creative economy to compete in the global market and contribute to national economic growt

Evaluating the Feasibility of Yanbu’ul Qur’an Observatory in Menawan Kudus for Lunar Crescent Observation

    Get PDF
The Yanbu’ul Qur’an Observatory in Menawan Kudus, Indonesia, functions as a site for crescent moon (rukyat al-hilāl) observations and Islamic astronomy education. Despite conducting various observation activities, successful hilāl sighting has only occurred during Zulhijjah 1443 H, primarily due to light pollution, limited horizon clarity, and low contrast between the moon and the horizon. This field study analyzes primary data on observatory infrastructure, horizon conditions, sky brightness, and climatological factors, along with secondary data from observation records (2022–2023). The findings indicate two key points: (1) the observatory significantly supports astronomy education at the Yanbu’ul Qur’an Islamic Boarding School, and (2) it is moderately feasible for hilāl observation based on parameters from the Indonesian Agency for Meteorology, Climatology, and Geophysics (BMKG), including favorable westward orientation, minimal obstructions, elevated location, low light pollution, and reliable electricity and internet access

Evaluating a Psychoanalytically-Informed Training Program for Personality Development among University Staff in Iraq: A Freudian Framework

    Get PDF
In modern organizational settings, unresolved psychological conflicts and dysfunctional personality traits among employees often hinder productivity, workplace harmony, and overall institutional performance. This study addresses the critical need for deeper psychological interventions by exploring the effectiveness of a training program based on Freudian psychoanalysis in developing personality traits among university employees. The research aimed to design and evaluate a psychoanalytically-informed training intervention targeting core aspects of personality such as self-awareness, emotional regulation, defense mechanisms, and interpersonal functioning. Employing an experimental one-group pre-test/post-test design, the study involved 16 purposively selected employees from the University of Zakho. Participants underwent a four-week training program consisting of 12 intensive sessions. A validated Personality Traits Development Scale (PTDS) was used to assess personality changes before and after the intervention. Statistical analysis revealed significant improvements in post-test scores compared to pre-test scores, with a very large effect size (Cohen's d = 2.32), indicating the program's substantial impact. These findings highlight the power of psychoanalytic interventions in organizational development by fostering meaningful personality transformation rather than superficial behavioral adjustments. The study contributes novel empirical evidence to the field of workplace psychology, advocating for the integration of depth psychology into team member development initiatives across diverse cultural and institutional context
