PENOLAKAN TERHADAP PEMBATALAN PERKAWINAN AKIBAT SEPERSUSUAN DI PENGADILAN AGAMA KENDAL
Kasus pembatalan perkawinan akibat persusuan menjadi permasalahan yang cukup rumit dalam praktik penerapan hukum Islam, terutama dalam konteks pertimbangan hakim dalam mengambil keputusan. Penelitian ini bertujuan untuk mengkaji alasan hakim menolak pembatalan perkawinan akibat persusuan berdasarkan Putusan Nomor 136/Pdt.G/2022/PA.Kdl serta menganalisis putusan tersebut dengan tinjauan hukum Islam. Penelitian ini dilakukan dengan metode kualitatif melalui wawancara mendalam dan studi dokumen. Hasil penelitian mengungkapkan bahwa pasangan dalam kasus ini, berdasarkan pandangan madzhab Maliki dan madzhab Hanafi, telah memenuhi syarat radha’ah. Yang mana termohon 1 dan termohon 2 merupakan saudara sepersusuan. Namun, hakim memutuskan untuk menolak pembatalan perkawinan dengan mempertimbangkan aspek kemaslahatan dengan mencegah kemungkinan penyalahgunaan hukum, termasuk potensi adanya konspirasi antara pemohon dan termohon. Putusan ini mencerminkan upaya hakim untuk mencegah adanya penyelundupan hukum meskipun ditemukan kekurangan dalam proses pengujian saksi dan fakta. Keputusan hakim dianggap sesuai dengan administratif Pengadilan secara formal, khususnya dalam hal pembuktian. Namun, penelitian ini menekankan pentingnya penguatan aturan hukum terkait larangan menikah dengan saudara sepersusuan agar pelanggaran serupa tidak lagi terulang. Langkah ini juga bertujuan untuk meningkatkan akurasi dalam penyelesaian perkara yang melibatkan norma-norma syariah
Islamic Legal Policy on Ultra-Micro Enterprise Financing and Its Implementation from the Perspective of Maqāṣid al-Sharī‘a
Until the mid-19th century, the Dutch colonialism (the Western world) began to intervene in the indigenous legal systems of Indonesia. The current situation marks the beginning of a decline in the civilization of Muslims, particularly in Indonesia. This development raises concerns about the future of Indonesian society as a whole. This decline permeated various aspects of life, including the field of mu’āmala law, which began to adopt usury-based concepts. This research aims to reconstruct the Islamic legal policy on Ultra-Micro (UMi) Financing as practiced by the Indonesian government, which still contains elements of usury (ribā) in its implementation. This study employs a qualitative approach using empirical-socio-legal research methods involving an analysis of UMi Financing contracts, interviews with stakeholders, and direct observations in Surakarta. The analysis is grounded in the theory of maqāṣid al-sharī’a, including the principles of ribā as outlined in classical Islamic jurisprudence (turāth). The findings reveal a research gap that the current legal policy on Sharia ultra-micro financing implemented by the government had ribā, which is found in classical Islamic texts
Energy Waqf and the Environmental Crisis: Advancing Islamic Philanthropy for Sustainability
This study examines energy waqf as an innovative Islamic philanthropic approach to addressing the growing environmental crisis. Using a literature review methodology, the research explores how religious beliefs, cultural values, and institutional trust influence community acceptance and participation in energy waqf initiatives. The findings reveal that strong religious commitment and cultural norms significantly motivate individuals to engage in such projects, which are widely perceived as acts of environmental stewardship and community service. Additional drivers of participation include emotional and psychological factors, awareness of waqf benefits, and confidence in the credibility of managing institutions. The study highlights the importance of public education and transparent governance in strengthening community involvement and ensuring the sustainability of energy waqf programs. These insights offer valuable guidance for policymakers, religious leaders, and development practitioners aiming to promote climate action through Islamic social finance. Energy waqf emerges not only as a philanthropic tool rooted in Islamic principles but also as a viable strategy for advancing renewable energy adoption and fostering environmentally conscious communities
Local Culture and Gender Differences in Educational Participation: A Study in Kwala Besar Village, Langkat Regency, North Sumatra, Indonesia
Local culture has an impact on gender participation in education. This research examines how local cultural values affect gender gaps in education participation in Kwala Besar Village, Langkat Regency, North Sumatra. Information was gathered through observations and interviews with different informants (parents, students, teachers and community members). The results show a strong gender gap in attendance at school, with more girls than boys going to school at each level. This disparity reflects community values whereby local boys are encouraged to drop out of school early compared to girls encouraged to attend higher education. It is an unequal system that does not allow for balanced social development; boys are not participating effectively in future economic opportunities as a result of a lack of education, and girls are not placed in significant roles that allow them to contribute to the development of the community. The study demonstrates the strong impact of local cultural values upon the opportunities available to the younger generation, and will be of interest to researchers, policymakers, educators, and development practitioners looking to plan culturally sensitive interventions to advance gender equity in education and community development
The Impact Of Islamic Banking On Financial Inclusion In Developing Countries: A Systematic Literature Review
Purpose - This literature review aims to systematically analyze and synthesize existing research on the impact of Islamic banking on financial inclusion in developing countries, with a specific focus on four Southeast Asian nations: Indonesia, Malaysia, Brunei Darussalam, and Singapore. The study seeks to identify key patterns, challenges, and opportunities in the relationship between Islamic banking development and financial inclusion outcomes.
Method - The review employs a systematic literature review methodology, analyzing peer-reviewed articles, policy documents, and institutional reports published between 2013 and 2024. The analysis focuses on four key dimensions: regulatory frameworks, technological innovation, market penetration, and socio-economic impact. A structured content analysis approach was used to synthesize findings from 87 selected publications.
Result - The review reveals a significant positive correlation between Islamic banking development and financial inclusion metrics across the studied countries. Malaysia demonstrates the most advanced integration of Islamic banking with financial inclusion initiatives, supported by comprehensive regulatory frameworks and technological innovation. Indonesia shows rapid growth potential but faces infrastructure challenges, while Brunei Darussalam exhibits high market penetration within a smaller market. Singapore's unique position as a regional Islamic finance hub contributes differently to financial inclusion through sophisticated product development and cross-border services.
Implication - The findings suggest that successful integration of Islamic banking with financial inclusion objectives requires a holistic approach encompassing regulatory reform, technological advancement, and market development strategies. The review identifies best practices and lessons learned that can inform policy development in other developing nations seeking to leverage Islamic banking for financial inclusion.
Originality - This review provides the first comprehensive cross-country analysis of Islamic banking's impact on financial inclusion in Southeast Asia, synthesizing recent empirical evidence and theoretical frameworks. It contributes to the literature by identifying patterns of successful implementation and challenges across different market contexts, offering valuable insights for policymakers and practitioners
The Role of Public Law in Determining the Islamic Calendar in Indonesia
The debate over the determination of the beginning of the Islamic calendar in Indonesia is still a complex issue that has a vast impact on religious, social, and public policy aspects. This polemic arises due to differences in ḥisāb (astronomical calculation) and rukyat (hilāl observation) methods adopted by various Islamic organizations, such as Nahdlatul Ulama (NU) and Muhammadiyah. This study used a qualitative approach with descriptive-normative analysis to explore the urgency of legal formalization and the supremacy of public law in determining the beginning of the Islamic calendar. The findings show that the absence of a binding legal authority is the main factor fuelling disagreement. Government-organised isbat sessions are often not universally accepted, so a more assertive legal policy based on national consensus is needed. By considering the principle of benefit, this study recommends the integration of sharia, astronomical technology, and positive law to improve accuracy, legitimacy, and uniformity in determining the beginning of the Islamic calendar
Examining the Role of Religion in Increasing the Quality of Life of Women in the Muslim World in the Tanggulangin, Sidoarjo
This research aims to investigate the interplay between Islam and women's empowerment, specifically examining how Islamic teachings and interpretations shape the social, economic, and political roles of women in Muslim societies. The primary objective of this study is to determine whether Islam functions as a barrier or a catalyst for women's empowerment in contemporary contexts. By analyzing classical Islamic texts and modern interpretations, the research seeks to uncover how religious discourse aligns with or contradicts principles of gender equality and women's rights. Employing a qualitative methodology, the study utilizes a diverse array of scholarly sources, case studies, and empirical data to explore the complex relationship between Islamic principles and the evolving roles of women. The findings reveal that, although certain traditional interpretations of Islam have been employed to justify gender-based restrictions, there is substantial evidence that progressive contextualized interpretations of Islamic teachings can serve as a powerful advocacy tool for women's empowerment. This study contributes to the larger discourse on religion and gender by presenting a nuanced perspective that neither glorifies nor condemns Islam but instead highlights the significance of interpretation, context, and socio-cultural dynamics in shaping gender roles. Ultimately, the research emphasizes the necessity for inclusive and reformative approaches to Islamic thought that advocate for justice and equality for women
Understanding Orangutan Reproduction: Biological Aspects, Climate Change, and Contaminant Exposure
Orangutans are arboreal primates and the only great apes native to Asia. Reproduction is crucial for the survival and long-term viability of orangutan populations. This review explores orangutan reproductive biology, focusing on its key features and the potential influences of environmental change. Orangutan (Pongo spp.) reproduction is marked by delayed sexual maturation, long interbirth intervals, and intensive maternal care, reflecting a slow life history strategy. Male bimaturism produces flanged and unflanged forms, each with different mating strategies shaped by social context. Female strategies, such as mate selection and resistance to coercive mating, play a critical role in reproductive outcomes. Climate change, through shifts in rainfall and temperature, is expected to affect food availability, potentially disrupting reproductive timing and offspring survival. The increasing presence of nanoparticles is also considered an emerging threat, though data specific to primates remains limited. Conservation efforts have focused on habitat protection, conflict mitigation, and ex-situ management, including rehabilitation and management of captive individuals in zoos; however, cryopreservation remains largely unexplored
Project-Based Learning in Creating Edible Straws from Red Dragon Fruit Peel to Develop Science Process Skills
This study aimed to analyze the implementation of project-based worksheets utilizing red dragon fruit peel waste (Hylocereus polyrhizus) to develop students’ science process skills (SPS). The research employed a pre-experimental method with a one-shot case study design, conducted at a vocational high school in Cimahi City, involving 31 senior high school students from Class XI Industrial Chemistry-C. The research instruments consisted of student activity observation sheets, project-based worksheets, and SPS performance sheets. The results showed an average student activity score of 95%, a cognitive SPS score of 90%, and a psychomotor SPS score of 96%, all categorized as “excellent.” Hence, the project-based worksheet on producing edible straws from red dragon fruit peel waste was proven to be highly feasible and effective in developing students’ SPS
Ethnocentrism, Localization Success, and Cultural Intelligence: Mediating Role of Knowledge Sharing in Digital Marketing: Ethnocentric Behaviour in Digital Marketing
Ethnocentric behavior among employees is observed in multicultural work environments characterized by the presence of individuals from different origins. The presence of ethnocentrism in the workplace has been observed to have an impact on coworkers. However, despite the importance of the above-mentioned factors, there has been no relevant scientific study on how these aspects affect human resource localization. This study investigates the influence of ethnocentric behavior and localization success on cultural intelligence through the mediating role of knowledge sharing tendency in the context of digital marketing. Although prior research has examined ethnocentrism in consumer behavior and policy, there is limited understanding of how individual-level ethnocentric tendencies affect human resource localization and intercultural competence in multinational work environments. Addressing this gap, the study surveyed 107 employees in multinational companies in Indonesia using a non-probability snowball sampling method. The data were analyzed using Partial Least Squares Structural Equation Modeling (PLS-SEM) with SmartPLS 3.0. The findings show that ethnocentric behavior and localization success positively influence both knowledge sharing tendency and cultural intelligence. However, knowledge sharing tendency does not significantly mediate the relationship between either ethnocentric behavior or localization success and cultural intelligence. These results highlight the importance of direct cross-cultural dynamics in enhancing cultural intelligence. The study contributes to the theoretical development of international HR management and cultural adaptation models while offering practical implications for designing training programs and policies that enhance knowledge transfer and cultural intelligence in global digital marketing environments
