CRIMINAL LIABILITY OF MINORS IN LITHUANIA
The basic principles of criminal law applicable to juveniles were formed more than a century ago, and this area of law is constantly changing in an attempt to strike a balance between the protection of the rights of the offender and the public interest. As minors are the most vulnerable and affected group of individuals, they must be punished differently from adults. Although the basic regulations applied to juvenile offenders are the same as those applied to majors, Lithuanian law nevertheless provides features that alleviate or otherwise mitigate the situation of the accused persons who have not reached the age of majority at the time of the offence. However, do the exceptionally applied rules on the imposition of penalties on minors ensure the purpose of the sentence and are those sentences effective
COMPLIANCE WITH THE PRINCIPLE OF EQUAL TREATMENT IN PUBLIC PROCUREMENTS
On 1 March 2007, the new Public Procurement Law entered into force, which aims to ensure free competition of economic operators, as well as equal and fair treatment thereof. However, the practice of Procurement Monitoring Bureau shows that one of the most common causes of complaints made to Procurement Monitoring Bureau is non-compliance with the principle of equal treatment by contracting authority both in the wording of tender regulations, namely, by inclusion of non-equal requirements in relation to different categories of tenderers, and in the assessment process of the tenders of the tenderers. This imposes unjustified restrictions on competition and serves as a basis for corruption
DEVELOPMENT OF THE TOURISM INDUSTRY IN LATVIA
The problem of the research is the security measures and restrictions introduced by the government, as well as the measures implemented by other countries have a negative impact on the development of the tourism industry. The aim of the research is to evaluate the development opportunities of the tourism industry in Latvia. From the beginning of 2020, when the Covid-19 restrictive measures were imposed, the situation in the tourism sector began to deteriorate. The most negative effects were felt in labour - intensive sectors - transport service, passenger transport, reservation services of travel agencies and tour operators, accommodation and food services. Latvia has developed a strategy to mitigate the consequences of the Covid-19 crisis with a set of measures that will allow overcoming the economic crisis caused by Covid-19 and its mitigation measures. The study analyses the statistical data on the impact of Covid-19 on the development of the tourism industry. Faced by the tourism industry when security measures and restrictions were put in place to mitigate the effects of the Covid-19 pandemic. The results of the study revealed that government restrictions and security measures are having a negative impact on tourism development, as economic performance has deteriorated significantly and it will take time for the tourism industry to recover from the crisis
SEXUAL HARASSMENT IN ACADEMICS: THE PARADIGM OF LEGAL EVALUATION IN LITHUANIA
The article focuses on the insights` analysis of the nowadays relevant social problems, related to sexual harassment in the academics, its legal evaluation in Lithuania. It is discussed, whether sexual harassment situations, that could be faced or happened in academics, could be seen as the ethic, moral violations or even more – criminal deeds. The authors go into deep and analyse the relationships between culprit and victim as they are not equal as such in the academic community. They have vertical relations, for instance, a lecturer and a student, etc. Then the principal question is raised – whether the guilty of the culprit should be proved / argued using presumption of innocence or there is a converse – the words and emotions of a victim take the prior place to incriminate a culprit. Another one question should be seen as the relevant one – does the legal situation change if there are enough assumptions to say “a culprit intended to have intimate relations with the victim”? It is also argued, that one of the biggest problems to uncover the situation’s real face is time of victim’s keeping silence as a victim, usually, is depending on culprit’s will (for instance, the lecturer and the student still have educational relations)
CONTACTLESS PAYMENTS FRAUD DETECTION METHODS AND IS SOCIETY PREPARED TO RESIST: A CASE STUDY
The ability to use contactless payment technologies, non-cash payments and credit card payments is becoming almost an essential requirement for consumers and merchants in today\u27s economic conditions. Different market sectors are rapidly adapting to these technologies and looking for the most convenient, secure, and fastest possible solutions that combine intelligent data processing, security, and business management functions. Millions of debit and credit card holders care about secure payments, the businesses that receive these payments are secure in terms of security, and the operators that process such incoming and outgoing payments are interested in innovative solutions that set them apart from the competition. Amid the COVID-19 pandemic, when e-commerce was growing exponentially, the global market for fraud detection and prevention, currently stands at USD 20.9 billion, and is expected to grow, until 2025 will rise to USD 38.2 billion by the end of the year; holds the market at 12.8 % annually. The US remains the dominant region in this market segment, but European countries are also increasingly investing in fraud prevention and detection solutions, which are growing in demand in Europe due to an increase in cybercrime as well as advanced bots and cyber-attack.
AGRARIAN REFORM AND CHANGES IN THE CULTURAL HERITAGE LANDSCAPE OF RURAL LATGALE IN 1920S AND 1930S
In the 20th century, Latvia underwent several rapid rearrangements of social and economic system. One of them were the Latvian Agrarian Reform (1920–1937) due to the implementation of which also the Latgalian rural cultural heritage landscape changed. In Latgale, there were established farmsteads instead of compactly inhabited locations (villages, in Latvian – sādžas). The rural landscape of Latgale became similar to rural landscape in other regions of Latvia. The aim of the article is, studying the economic and social aspects of life in Latgalian villages, to find out the outcomes of dividing villages into farmsteads during the Latvian Agrarian Reform, their influence on changes in the Latgalian rural cultural heritage landscape
PECULIARITIES OF EDUCATION OF GIFTED STUDENTS IN GYMNASIUM: VIEWS OF LITHUANIAN AND UKRAINIAN TEACHERS
Identifying gifted children and teenagers and their educational needs is one of the most relevant psychological and pedagogical problems, which is currently of great interest worldwide. Recognizing person\u27s talents in education does not create added value by itself, the design of the educational process and the progress of the person\u27s maturity related to diagnostics is much more valuable. The article analyzes how to educate gifted children, how different trends in the education of gifted children are developed, and what means are used to achieve affordable, high quality, modern education that meets the needs of a free civil society. The aim of the qualitative research was to reveal the views of Lithuanian and Ukrainian teachers about the peculiarities of the education of gifted students in gymnasiums. The data obtained during the research in identifying gifted students, the peculiarities of the education of these students and the effectiveness of educational tools revealed the educational difficulties faced by teachers and the opportunities for improving the education of gifted students in gymnasium. A qualitative study of teachers\u27 views revealed that the identification of gifted students in the gymnasiums of both countries takes place when teachers pay attention to such student traits as creativity, critical thinking, etc.; teachers of both countries apply additional and individualized teaching methods when working with gifted students. The findings of the study revealed teachers\u27 views about the effectiveness of educational methods of gifted students, the difficulties of educating gifted students, and provided practice-based suggestions for pedagogues who educate gifted students.
PROBLEMATIC ASPECTS OF HEALTH-PRESERVING COMPETENCE DEVELOPMENT IN PRESCHOOL TEACHERS
The article substantiates the problem of health-preserving competence development in teachers of preschool education: as an important task of the modern world, as a priority personal characteristic, as a component of professional training. The essence of the phenomenon of “health-preserving competence” is revealed, the following structural components are distinguished: emotional and motivational, cognitive and activity-centered. The goal of the research is to determine the conceptual foundations of the development of health-preserving competence in teachers of preschool education; data collection and processing of information to clarify problematic aspects of the phenomenon being under consideration. In the course of empirical research, the authors used the method of anonymous thematic survey (questionnaire) and its analysis. The research group consisted of: students of the 4th year of dual mode of study (who work on specialty) – 38 participants (group A); students of the 4th year of part-time mode of study who work on specialty (in preschool educational institutions) – 45 participants (group B) and students of advanced training courses – 53 participants (group C). The total number is 136 respondents. The conducted research proved that the respondents are aware of the main categories of health; are motivated and aware of the importance of health-preserving behavior, but are not sufficiently aware of modern health-preserving technologies. Therefore, the activity-centered component requires to be strengthened for the development of health-preserving competence in teachers of preschool educational institutions. Prospects for further scientific work will consist in the implementation to the system of higher education and advanced training courses for preschool teachers of the elective course “Formation of health-preserving competence in the subjects of the educational process” and determining the effectiveness of its implementation
MODELS AND ALGORITHMS FOR OPTIMIZING LEGAL INFORMATION RETRIEVAL IN THE CORPORATE NETWORK OF ACADEMIC LIBRARIES
With the rapid growth of information in the global network, the challenges of finding information quickly and easily in a narrow range of fields of study and specialization are increasing. People are constantly looking for information in some form throughout their lives. This is the result of the constant striving of human beings for innovation, efforts to improve personal and professional competencies. One of the main objectives of libraries is to meet people’s needs for information. In short, this process can be called the type of informational support. The main purpose of this research is to develop models and algorithms to optimize the effective search of information about health information in corporate networks. Electronic libraries in the field of jurisprudence serve not only to train personnel in the field of jurisprudence, but also to increase legal literacy in society, to make citizens aware of their rights and obligations, and to prevent them from becoming victims of various frauds. For organizations, it serves as the most important repository of knowledge for their employees to constantly update their legal knowledge, to draw up normative-legal documents, contracts and agreements within the framework of legal requirements. Despite the fact that the field of jurisprudence is one of the most important areas of activity, the provision of scientific information to this field is not sufficiently systematized. Different organizations and institutions store their existing legal literature in the way they choose, and there is no single mechanism for making it available to users, digitizing, classifying, and searching for it. Most library users rate the efficiency of the library by the availability of the necessary literature. A survey of law students and professors was conducted to examine the interest of library users in legal electronic literature and their use. More than 50% of respondents use the electronic library daily, 93% are looking for legal literature, and 50% of participants said it is difficult to find legal literature. Also, all respondents (100%) approved the need to create a single corporate network by pooling electronic resources of higher education institutions providing legal training
