Analisis Efektivitas Instrumen Hukum Lingkungan dalam Pembangunan Berkelanjutan di Indonesia

    Get PDF
Regulatory reforms in Indonesia including the Environmental Protection and Management Law, the risk-based licensing regime, and Government Regulation 22/2021create both opportunities and challenges for achieving sustainable development. This article analyzes the effectiveness of environmental law and maps its realization from upstream instruments (Strategic Environmental Assessment/SEA and Environmental Impact Assessment/EIA) to downstream mechanisms (monitoring and multi-track enforcement). The study employs a normative legal method with statutory, conceptual, and case approaches, complemented by a policy-evaluation lens that links process indicators (EIA quality, public participation, oversight, administrative sanctions) to outcome indicators (ambient quality, land-cover change, pollution events). Findings indicate that: (i) post-approval oversight and progressive administrative sanctions strengthen compliance; (ii) high-quality EIA and meaningful participation enhance decision legitimacy and reduce dispute costs; (iii) information transparency reinforces accountability and scientific proof; (iv) civil and criminal tracks remain necessary for severe violations, while the polluter-pays principle and strict liability are effective if supported by robust damage-valuation guidance; (v) SEA functions as an upstream policy guardrail; and (vi) anti-SLAPP and citizen-lawsuit avenues broaden access to justice. The article’s novelty lies in an integrated evaluation framework that connects participation, transparency, and enforcement to measurable biophysical outcomes. Policy implications emphasize risk-based compliance assurance, strengthened environmental forensic laboratories, the use of remote sensing, independent audits, and routine public performance reporting across jurisdictions to drive continuous improvemen

    Get PDF
This study aims to analyze Muhammad Abduh\u27s thoughts on Islamic educational reform and describe their relevance to the dynamics of contemporary Islamic education in Indonesia. Using a literature review method with descriptive-critical analysis of Abduh\u27s primary works and secondary literature, this study identified four main ideas of reform: Abduh\u27s rejection of blind imitation and his encouragement to develop a culture of critical thinking; criticism of tendentious books that paved the way for strengthening critical literacy and developing more objective teaching materials; reform of educational institutions that emphasized the integration of religious and modern sciences; and revitalization of the Islamic intellectual heritage (turats) through a contextual and interdisciplinary approach to reading. These findings show that Abduh\u27s thinking can provide philosophical and practical direction for the development of madrasah and pesantren curricula, the improvement of teacher competence, and the modernization of learning methods that are more dialogical, rational, and adaptive to the challenges of the 21st century. Thus, this study contributes to explaining how Abduh\u27s reformist ideas can be implemented to strengthen the quality and relevance of Islamic education in Indonesia

Mysticism, Sufism, and Neurotheology: Bridging Spirituality and Modern Science

    Get PDF
This article examines the integration of mysticism, spirituality, Sufism, and neurotheology as a means to bridge the spiritual and biological dimensions of human religious experience. Mysticism is interpreted as the pinnacle of transrational religious experience, while spirituality is viewed as a progressive development of ethical and inner consciousness. Sufism, as the mystical path of Islam, offers a structured and practical framework of spiritual ascent through concepts such as maqamat (stations), ahwal (states), dhikr (remembrance), and fana’ (ego dissolution). This study employs a qualitative approach, utilising a literature review and philosophical-interpretive content analysis, to examine classical Sufi texts and contemporary neuroscientific research. The findings suggest that Sufi practices are associated with specific neurological activities, including activation of the prefrontal cortex, increased theta waves, and decreased activity in the default mode network. The integration of Sufism and neurotheology supports the development of transdisciplinary models in spiritual education and psychological therapy, while maintaining epistemological boundaries and the depth of spiritual meaning. This article contributes to the interdisciplinary discourse of religious studies, opening up space for a constructive dialogue between revelation and science

    Get PDF
This study aims to examine the relevance of Weber\u27s theory of authority in relation to the phenomenon of the Promised Land claim and its impact on the legitimacy of the Israeli occupation. The results and discussion in this study show that the Zionist political movement successfully utilised Jewish theological themes as the basis for the establishment of the state of Israel, in this case, the Promised Land claim becomes a doctrine that functions as a political aspiration and is believed to be rooted in divine and religious authority, revealing that Weberian tripartite classification of authority have limitations in explaining the form of legitimacy that comes from theological claims. The conclusion of this study is that the the Promised Land claim effectively functions as theological legitimacy in the Israeli occupation, offering a new form of authority distinct from Weberian tripartite classification of authority (traditional, charismatic, rational-legal)

An Analysis of Spirituality from the Perspective of Transpersonal Psychology

    Get PDF
Spirituality is an essential dimension of human life, encompassing self-awareness, relationships with God, others, and nature, as well as the search for meaning in life. This study examines spirituality through the perspective of Transpersonal Psychology, a modern branch of psychology that emphasizes transcendental experiences, heightened consciousness, and the integration of psychological, emotional, and spiritual dimensions. Transpersonal psychology emerged as a response to the limitations of conventional psychological approaches that focus on behavior, mental processes, and clinical healing, thus underemphasizing the spiritual aspect of individual growth. This study used library research methods to analyze relevant literature, including books, articles, and scientific documents on transpersonal psychology and spiritual experiences. The findings suggest that transpersonal experiences, including peak experiences, self-transcendence, and mystical experiences, play a significant role in shaping self-awareness, psychological well-being, and the quality of social relationships. The integration of the spiritual dimension into psychology helps individuals face stress, conflict, and the challenges of everyday life with greater awareness. The research also emphasizes the importance of a holistic, subjective, and humanistic approach to understanding transformative experiences that are unique to each individual. Thus, Transpersonal Psychology not only expands scientific understanding of humankind but also provides a practical foundation for spirituality-based education, counselling, and psychological interventions. This study asserts that spirituality, through transpersonal experiences, is a fundamental element in self-development, character formation, and the attainment of a deeper meaning in life within the context of contemporary psychology
