    Legal Supervision of Islamic Banking in Indonesia: A Post-Law No. 21/2008 concerning Islamic Banking Analysis

    This study critically evaluates Indonesia\u27s supervisory framework for Islamic banking following the enactment of Law No. 21 of 2008. Utilizing a qualitative legal method, it explores how legal reforms institutionalized shariah compliance and distributed supervisory responsibilities among secular and religious authorities. The research analyzes doctrinal mandates, institutional behavior, and jurisprudential alignment, identifying both progress and challenges in regulatory coherence. While the law advanced legal certainty and structured oversight, issues such as jurisdictional ambiguity and capacity constraints persist. The findings offer a balanced assessment of the supervisory regime, aligning it with global standards and highlighting areas for reform. The study contributes original insights to legal theory, Islamic finance governance, and policy development

    Transformation of Islamic Economic Discourse: Academic Perspectives and Policy in Indonesia

    This article investigates the discursive evolution of Islamic economics in Indonesia, focusing on the intersection of academic narratives and public policy. Employing a qualitative narrative approach, the research examines how Islamic economic thought has transitioned from theological idealism to policy pragmatism. The study utilizes document analysis of academic publications, institutional records, and regulatory texts, interpreted through theoretical frameworks including maqāṣid al-sharī‘ah, discourse theory, and critical realism. Findings reveal a dynamic interplay wherein academic scholarship shapes and is shaped by policy developments. The establishment of Islamic financial institutions, curricular reforms in Islamic economics education, and the incorporation of zakāt and waqf into state policy illustrate this interaction. Ideologically, the field has diversified, accommodating multiple interpretations and promoting hybrid models that combine ethical fidelity with institutional functionality. The study contributes to the theoretical refinement of Islamic economics and offers practical insights for governance, pedagogy, and economic planning in Muslim-majority societies

    Legal Governance of Sharia Banking in Indonesia: Examining the Implementation of Law No. 21 of 2008 concerning Sharia Banking

    This study investigates the legal and institutional dimensions of Islamic banking regulation in Indonesia by analyzing the implementation of Law No. 21 of 2008 concerning Sharia Banking. It aims to understand how the law constructs the legal identity of Sharia banks, how regulatory bodies enforce compliance, and what challenges arise in aligning Islamic principles with the national legal system. Using doctrinal legal analysis supported by institutional and Islamic jurisprudence theories, the study draws upon statutory sources, regulatory documents, and scholarly literature published before 2009. The findings show that although the law formally legitimizes Sharia banking, its practical implementation is hindered by regulatory fragmentation, overlapping institutional jurisdictions, and the absence of codified Sharia governance mechanisms. The study also highlights the difficulty of harmonizing Islamic financial norms with secular legal principles in contract enforcement and regulatory interpretation. These issues limit the effectiveness and doctrinal integrity of Indonesia’s dual banking system. The research contributes to scholarly debates on legal pluralism and regulatory design, offering recommendations for institutional reform, Sharia standardization, and enhanced judicial capacity in Islamic finance. The findings are relevant for policymakers, legal scholars, and financial institutions aiming to build Indonesia\u27s coherent, enforceable, and ethically grounded Islamic banking sector

    Reorienting Indonesia’s Islamic Financial Policy: A Normative Review of State Sukuk

    This study investigates the normative orientation of Indonesia’s state sukuk policy within the framework of Islamic public finance. Drawing from sharia jurisprudence, legal theory, and fiscal policy, the research examines the degree of alignment between Indonesia’s sukuk issuance practices and Islamic ethical principles. Using a qualitative normative-juridical method, the study analyzes legal documents, policy instruments, and scholarly sources to assess the conformity of state sukuk to maqāṣid al-sharī‘ah. The findings reveal that while Indonesia’s sukuk framework shows technical adherence to Islamic finance standards, it lacks substantive ethical integration. Weaknesses include limited transparency, insufficient governance, and a focus on fiscal pragmatism over social justice. To resolve these issues, the study proposes a policy reorientation emphasizing maqāṣid-based planning, ethical oversight, and legal harmonization. These insights contribute to the discourse on Islamic financial reform, offering a model for integrating normative principles into national finance strategies in Muslim-majority countries

    Discourse on Indonesia’s Dual Banking System: A Thematic Literature Review

    Indonesia’s dual banking system, integrating conventional and sharia-compliant models, presents a unique case of institutional pluralism in the financial sector. This study offers a thematic literature review exploring the theoretical foundations, operational dynamics, and regulatory frameworks shaping the coexistence of these systems. Using Institutional Pluralism Theory, Financial Intermediation Theory, and Islamic Economic Principles, the review identifies how legal structures and ethical paradigms interact within Indonesia’s financial landscape. Findings highlight that while the system is legally robust and ethically justified, practical limitations such as regulatory fragmentation, consumer misperceptions, and product standardization remain. The study underscores the need for regulatory harmonization, consumer education, and adaptive jurisprudence to optimize the dual model for stability and social equity. Contributing to global discourses on financial pluralism, this review refines theoretical interpretations and offers practical recommendations for dual banking implementation in emerging economies

    Islamic Financial Innovation in Literature: Reviewing Market-Based Narratives

    This article explores how Islamic financial product innovation is framed within academic literature prior to 2009. Drawing from institutional theory and discourse analysis, the study investigates the role of narratives in shaping perceptions of legitimacy and market adaptation in Islamic finance. It identifies three dominant themes in the literature: theological justification, functional market discourse, and socio-cultural contextualization. Through critical analysis of books, journal articles, and institutional reports, the paper reveals how scholarly narratives act as discursive tools for innovation legitimation. These narratives are not only reflective of religious doctrines but also responsive to economic and political realities, leading to diverse interpretations and implementations of Islamic financial principles. The study contributes a novel typology of innovation narratives and highlights the contextual factors influencing financial product design and adoption. The findings offer theoretical and practical implications for future research, policy formulation, and institutional strategy in Islamic financial markets

    Bridging the Human Capital Gap in Indonesia’s Islamic Finance Sector

    This article examines the persistent human resource challenges within Indonesia’s Islamic finance sector. Despite the sector\u27s growth, a significant gap exists between labor market needs and the competencies of available professionals. Drawing on human capital theory, stakeholder theory, and competency-based education models, the study analyzes structural, institutional, and strategic obstacles through qualitative document analysis. Findings reveal fragmented curricula, regulatory disconnects, and limited academic-industry alignment as core constraints. The study identifies opportunities for systemic reform, including the adoption of national competency frameworks, centralized certification, and digital finance integration. By proposing an ecosystem-based model for talent development, this research contributes to a more cohesive and forward-looking strategy for enhancing professional capacity in Islamic finance. The findings carry practical implications for universities, regulators, and financial institutions aiming to create a skilled, sharia-compliant workforce that aligns with Indonesia’s economic goals

    IMAN DAN AMAL SALEH DALAM ALQURAN (STUDI KAJIAN SEMANTIK)

    Iman dan amal saleh, suatu term penting dalam Alquran, karena iman dan amal salalu disebutkan, terkadang iman dan amal saleh bersandingan, yang tentunya  mengisyaratkan pesan penting untuk diteliti. Tujuan dari penelitian ini ialah untuk mengetahui bagaimana iman dan amal saleh dalam Alquran dengan pendekatan semantik T.Izutsu.Metode yang digunakan ialah deskriptif-analisis, yaitu mengambarkan secara umum mengenai objek serta menganalisis dengan jenis penelitian kepustakaan (library research).Hasil penelitian ini menunjukan iman dan amal saleh  dalam Alquran menunjukan saling berkaitan antara  satu dengan yang lainnya, jika  amal saleh disebutkan tanpa iman maka tidak akan berguna, walaupun perbuatannya baik, tidak akan mendapatkan sesuatu. Sebaliknya, jika perbuatan itu kecil tetapi dengan iman maka akan mendapatkan pahala. Selain itu, term amal saleh dalam Alquran menunjukan makna yang luas baik kepada Allah, manusia, dan makhluk-Nya

    APLIKASI QAT’IY DAN ZANNIY PADA SUMBER DALIL

    Penelitian ini bertujuan untuk mengkaji konsep qaṭ’iy dan ẓanniy pada beberapa sumber dalil, baik yang berkaitan dengan qaṭ’iy al-thubÅ«t/al-wurÅ«d/al-naql dan qaṭ’iy al-dalÄlah, maupun yang berkaitan dengan ẓanniy al-thubÅ«t/al-wurÅ«d/al-naql dan ẓanniy al-dalÄlah. Dalam penelitian kualitatif ini dilakukan studi deskriptif-analitis dengan metode penelitian pustaka (library research). Hasil temuan mengungkapkan bahwa para ulama uṣūl  dan sebagian mufasir sepakat bahwa ketentuan qaṭ’iy al-thubÅ«t/al-wurÅ«d/al-naql  teraplikasi pada nÄs Alquran dan Sunah mutawa>tirah. Ketentuan qaṭ’iy al-dalÄlah teraplikasi pada nÄs Alquran dan Sunah yang memenuhi al-iḥtimÄlÄt al-‘ashrah, ijmÄ’ á¹£arīḥ, qiyÄs mujma’ ‘alayh (konsensus bersama para mujtahid), dan uṣūl al-fiqh. Adapun ketentuan ẓanniy al-thubÅ«t/al-wurÅ«d/al-naql  teraplikasi pada sunah ghayr mutawÄtirah. Sedangkan ketentuan ẓanniy al-dalÄlah teraplikasi pada nÄs Alquran, sunah, ijmÄ’ sukÅ«tÄ«, dan qiyÄs fardiy atau  qiyÄs ghayr mujma’ ‘alayh
