    No full text
This study investigates the mediating role of fraud prevention in the relationship between human capital, village financial planning, and moslem community welfare. Focusing on 260 villages in South Aceh, a sample of 120 respondents from 40 randomly selected village fund recipients was surveyed, comprising village financial staff, development planning staff, and members of the Village Council (Tuha Peut). The study employs the Structural Equation Modeling–Partial Least Squares (SEM–PLS) approach, with bootstrapping techniques used to assess mediation effects. The findings indicate that the quality of human resources directly influences both community welfare and fraud prevention. However, fraud prevention does not significantly mediate the relationship between human resource quality and community welfare. Conversely, it plays a significant mediating role in the relationship between village financial planning and community welfare. These results underscore the strategic importance of implementing robust fraud prevention mechanisms within financial planning processes to enhance moslem community welfare. The study recommends prioritizing fraud prevention initiatives alongside human capital development to maximize the impact of village fund programs on moslem welfare outcomes.========================================================================================================ABSTRAK - Tata Kelola Dana Desa: Peran Mediasi Pencegahan Kecurangan terhadap Kesejahteraan Masyarakat Muslim.

A Model of Zakah-Waqf Integration for MSMEs Empowerment in Islamic Social Finance

    No full text
Micro, small, and medium enterprises (MSMEs) in Indonesia face persistent challenges in accessing capital, as reported in the 2023 Micro and Small Industry (IMK) survey. As instruments of Islamic social finance, zakah and waqf offer promising alternative funding sources for MSME empowerment. Currently, zakah and waqf institutions operate productive MSME programs independently, despite their complementary characteristics. This study aims to develop an integrated model of productive zakah and cash waqf to enhance the empowerment of MSMEs, while also identifying the key issues, solutions, and strategies required for implementation. A qualitative approach was employed through in-depth expert interviews to design the model, followed by the Delphi-Analytic Network Process (ANP) method to assess stakeholder consensus on challenges, responses, and policy strategies. The findings reveal a dual-scheme model: the first scheme utilizes productive zakah and returns from cash waqf (mauquf alaih) to support newly established MSMEs, while the second scheme allocates cash waqf funds (mauquf bih) to more established MSMEs under a mudharabah contract. Delphi-ANP analysis indicates that human resource capacity is the top priority for successful integration, followed by regulatory alignment, public awareness, and technological readiness. The study concludes that harmonizing zakah and waqf management within single institutions should be prioritized before expanding to cross-institutional collaborations, offering a practical roadmap for enhancing Islamic social finance effectiveness in MSME development.

    No full text
The punishment for a child is a special sentence imposed by a judge, apart from imprisonment, in the verdict that the sentence does not need to be carried out due to certain conditions. In the judge's ruling on juvenile punishment, it is stated in Law No. 11 of 2012. This research examines how judges consider sentencing children in conflict with the law at the Takengon District Court in cases with the same circumstances but different verdicts. In this research writing, the researcher uses the normative legal research method, which is an approach based on primary legal materials by examining theories, concepts, legal principles, and regulations related to this research. This approach is also known as the library approach, where the researcher studies the judge's considerations in criminal decisions against children in the same case. The result of this research is that the legal basis for conditional sentences and imprisonment for children has been regulated in the Child Criminal Justice System Law No. 11 of 2012, which states all procedures for handling juvenile criminal cases from the investigation stage, guidance, until the completion of the sentence. As for the legal reasons behind the judge's decision, conditional sentences and prison sentences must be reviewed from several aspects, such as social and economic factors that can influence the judge's considerations, including supporting facilities

Critical discourse analysis of misogyny and sexism in South Korea: Media sources studies

    No full text
Misogyny and sexism have become prominent issues in society, particularly in the workplace and daily life. Examining the role of media narratives in shaping public perception and framing events to serve specific agendas or ideologies can offer diverse perspectives. This study conducts of discourse analysis of two media sources: the BBC World Service video "Women fight back as South Korea tries to abolish its Gender Equality Ministry" and the interview video "What Koreans Think about Misogyny in Korea" by Asian Boss. By focusing on narrative structure, language, and representations of misogyny and sexism, this research aimed to reveal how these media platforms frame the issue. Using a qualitative approach, the study analyzed and interpreted the language in these sources. By using Van Dijk's discourse analysis theory with three analytical frameworks (textual analysis, social cognition and social context) as a research tool to explore this issue through the media. These findings indicated that BBC emphasizes structural and systemic issues from a global feminist perspective, focusing on formal cases, while Asian Boss highlights personal experiences and local opinions, focusing on community attitudes. The differences in framing not only underscore the varying emphases in how each media outlet addresses misogyny and sexism but also reveal the impact of media perspectives in shaping public understanding of these issues in South Korea. This analysis suggested broader implications for gender equality policies and the ongoing discourse surrounding women’s rights in the country

Descriptive analysis of the implementation of gender responsive policies for poverty alleviation in Aceh

    No full text
Women’s poverty in Aceh persists due to entrenched gender norms restricting their economic access and social welfare, despite the poverty alleviation efforts. Gender mainstreaming policies (GMP), initiated through Presidential Instruction No. 9/2000, remain ineffective due to weak institutional coordination, inadequate funding, and exclusion of women in planning. This qualitative study analyzes policy implementation via document reviews, observations, and interviews, revealing multidimensional challenges. Institutional fragmentation, short-term program focus, and financial constraints limit women’s empowerment. Women’s exclusion from policy planning further reduces program ownership and engagement. Field data underscore women’s undervalued economic roles in coastal and agricultural sectors. In fishing communities, women contribute to fish processing, while female coffee farmers in Bener Meriah manage harvesting and small businesses. However, restricted access to resources, credit, and decision-making stifles their potential. To address these gaps, the study advocates strengthening institutional collaboration, increasing gender-responsive budgets, and integrating women into planning and evaluation. Sustainable outcomes require prioritizing long-term strategies with robust monitoring. Enhancing resource access, financial support, and decision-making power for women is critical to reducing poverty and advancing gender equity. These reforms aim to transform policy frameworks into actionable, inclusive solutions, ensuring Aceh’s poverty alleviation efforts align with the needs and contributions of its women

The Urgency of the Second Amendment to ITE Law from the Standpoint of the Positive Law and Human Rights

    No full text
The ITE Law experienced modifications in 2016 with the enactment of Law No. 19 of 2016, which amends Law No. 11 of 2008 regarding ITE. In 2023, the ITE Law will see a reemergence of changes. This article seeks to delve deeper into the pressing nature of these changes through the lens of human rights. This research uses normative legal methods with a legislative approach with a human rights perspective. Data collection through literature reviews relevant to the research focus, including literature reviews, theoretical frameworks, and government regulatory documents. This article concludes that the existing findings show that the proposed amendments are already regulated in existing laws and regulations, thus indicating that there is no urgent need to revise the ITE Law. Out of the seven proposed changes, five hav been addressed in other laws and regulations. If the changes persist, there will be overlapping regulations that could undermine the positive legal framework in Indonesia. At the same time, two proposed changes regarding the consequences of criminal threats and sanctions have been incorporated into the Criminal Code, which was ratified and enacted at the end of 2022 and is set to take effect in 2026. The ITE Law, when viewed alongside regulations from other countries, has strayed from its initial purpose as a protector of electronic activities and has instead become a means of legitimizing criminalization. This clearly indicates that the ITE Law is inconsistent with human rights
