Artistic practice as a reflection of social rality
Magistrska naloga se nanaša na lasten projekt Zavetje za brezdomce – NO more HOMELESS, ki izhaja iz analize odnosa med umetniškimi praksami in družbeno stvarnostjo. V uvodnem poglavju smo na kratko predstavili pojme, kot so družbena stvarnost, umetniške prakse 20. stoletja in medsebojni dinamični odnosi. Glede na literaturo smo predpostavili, da sodobne umetniške prakse z uporabo novih tehnologij, povezavo z znanostjo, vključevanjem participacije itd. reflektirajo sodobno družbeno stvarnost. V nadaljevanju našega raziskovanja smo naleteli na številne umetnike, ki se navezujejo na tematiko interpretiranja vloge in pomena participacije. Glede na avtorskoumetniški projekt magistrske naloge smo se osredotočili na tri umetniške prakse umetnikov iz Slovenije (Marko Peljhan – Makrolab, Marjetica Potrč in Ooze (Eva Pfannes in Sylvaino Hartenberg) – Of Soil and Water: King’s Cross Pond Club in KUD Obrat (Polonca Lovšin, Stefan Doepner, Urška Jurman in Apolonija Šušteršič) – Onkraj gradbišča) ter podrobneje raziskali to področje. Prišli smo do spoznanja, da se ob bok participativnosti večkrat postavi samoorganizacijsko načelo. Predpostavili smo, da sta participativnost in samoorganizacijsko načelo ključna relacijska dejavnika med umetniškimi praksami in družbeno stvarnostjo. Na podlagi analiz participativne umetnosti in samoorganizacijskega načela smo zasnovali konceptualno zasnovo lastnega dela Zavetje za brezdomce – NO more HOMELESS, ki predstavlja zavetje za brezdomce, narejeno iz odpadnih avtomobilskih predmetov ter naravnih materialov.The master\u27s thesis refers to the author\u27s art project called "Zavetje za brezdomce – no more homeless", which arises from the analysis of the relationship between artistic practices and social reality. In the introductory chapter, we briefly present concepts such as: social reality, artistic practices of the 20th century, as well as mutual dynamic relations. According to the literature, we assumed that contemporary art practices using new technologies, connection with science, inclusion of participation, etc. reflect contemporary social reality. In the continuation of our research, we came across a number of artists who relate to the theme and interpretation of the role and meaning of participation. According to the author\u27s art project of the master\u27s thesis, we focused on three artistic practices of artists from Slovenia (Marko Peljhan – Makrolab, Marjetica Potrč and Ooze (Eva Pfannes and Sylvaino Hartenberg) – Of Soil and Water: King’s Cross Pond Club and KUD Obrat (Polonca Lovšin, Stefan Doepner, Urška Jurman and Apolonija Šušteršič) – Onkraj gradbišča) and researched this field in more detail. We have come to the realization that the principle of self-organization is often placed alongside participation. We hypothesized that participatory and self-organizing principles are key relational factors between artistic practices and social reality. Based on the analysis of participatory art and the self-organization principle, we designed the conceptual design of our own work called "Zavetje za brezdomce – NO more HOMELESS", which is a shelter for the homeless, made of waste car objects and natural materials
Comparative analysis of selected Grimms' fairy tales in German editions and Slovenian translations
The thesis Comparative analysis of selected Grimms' fairy tales in German editions and Slovenian translations consists of two parts.Theoretical part presents life and work of brothers Grimm, with the emphasis on their most known work Children- and Household tales; life and work of Polonca (Magdalena) Kovač, slovenian children and youth author and first translator of complete Grimms' fairytales in slovene languge, including the authorized transcription of the interview with her; and translation theory, the features of youth literature translation and the history of Grimms' fairytales translation in slovene language.In the empirical part I discussed seven selected Grimms' fairytales: The Frog king or Iron Heinrich, The wolf and the seven young goats, Hansel and Gretel, Cinderella, Little red riding hood, The sleeping beauty and Snow white. The discussion proceeds in three ways: the analysis of the elements of literal text, the overview of the chandes in seven large german editions and the comparison between Fran Abreht (1954) and Polonca Kovač (1993) translations
Significance of and Comparative Trends in Procedural Regulation of Right to Information
Any legal right is (more) efficiently pursued if sufficient procedural regulation supports its substantive setting. This article is dedicated to an analysis of procedural regulation of right to information (RTI) since its significance is increasing in terms of developing good governance and good administration within contemporary transparent, open and collaborative society. The comparative analysis of selected countries (USA, Ireland, Sweden, Austria, Germany, Slovenia, Croatia) included herein proves that selected procedural institutions, such as time limits and an appeal to an independent body or judicial review, contribute to a significantly higher level of implementation of the RTI in practice as also indicated by several international studies. In conclusion, the author recommends certain good practices, especially significance of RTI implementation in relation to different authorities in the context of administrative procedure guaranteeing constitutional and supranational transparency principles
Productions of Edward Albee's plays in Slovenia and the critics' response
The article focuses on Edward Albee's four plays belonging to the theatre of the absurd which have been performed in Slovene theatres so far. The author analyses Albee's The 'Zoo Story, which has been produced four times, his American Dream and A Delicate Balance, which have been performed only once, and Albee's most known work in Slovenia, Who's Afraid of Virginia Woolf?, which has been produced six times in Slovene theatres. The continuation of this article focuses on each of Albees above mentioned four plays including their production details, directors, actors, the comparison of critics' opinions and an estimation of how SIovene audiences accepted them according to the number of spectators and critics' responses
ADMINISTRATIVE SILENCE WITHIN THE THEORY AND PRACTICE IN SLOVENIA
U radu se kritičkom analizom izmjena regulacije i provedbe Zakona o općem upravnom postupku (ZUP) razmatraju teorijski i praktični aspekti instituta šutnje uprave u Republici Sloveniji. Prema većinskom modelu koji je na snazi u različitim zemljama, i u Sloveniji šutnja uprave predstavlja temelj za fikciju negativne odluke čime stranka napušta stanje pendencije te može ostvariti pravnu zaštitu kao da je njezin zahtjev odbijen. No pod utjecajem trendova u pogledu veće učinkovitosti u upravnim stvarima te kako bi se izbjeglo nerazumno dugo rješavanje, sve se češće uvodi fikcija pozitivne odluke. Uzimajući u obzir teorijsko - dogmatske aspekte uz istraživanje implementacije šutnje uprave u slovenskoj regulaciji te upravnoj i sudskoj praksi, autorica rada na temelju hipoteze da takva fikcija u općem zakonu zbog potrebe za meritornom zaštitom javnog interesa donosi više opasnosti nego koristi, prikazuje ograničenost zahvata takve vrste na upravnopravnom području.Critically analysing the regulations of the Law on General Administrative Disputes (LGAD) and its application in practice, the author in the article examines theoretical and practical aspects of the institute of administrative silence in the Republic of Slovenia. According to the majority model which has been in force in different countries, the administrative silence in Slovenia also presents a legal ground for a fictive, negative administrative act according to which a party is not in a pending state anymore and is entitled to legal protection as if the request has been denied. However, due to a strong influence of trends to increase efficiency in administrative matters as well as efforts to avoid unreasonably long proceedings until an administrative act is passed, a fiction that administration’s silence amounts to a positive decision is introduced more often. Having in mind the theoretical and dogmatic aspects of the research on implementation of administration’s silence in Slovenian regulations and administrative and court practice, the author of the article presents a hypothesis that the above mentioned fiction under the general law has stronger negative than positive consequences due to a need for meritorious protection of the public interest. She presents limitations correlated to legal actions of such kind within the legal administrative field
Posredovanje i nagodba u upravnim stvarima u Sloveniji
Unlike with court procedures, the kernel of the administra-
tive procedure is not to resolve a dispute among parties to
a procedure but to recognize a private party’s right while
protecting the public interest. Therefore it is questionable
– even with regard to constitutional law – whether mediati-
on and settlement between the public and private interests
are possible in administrative matters. However, elements
of settlement are being introduced into the administration
with the development of partnerships. A distinction must
be made here between the administrative process involving
adoption of general administrative acts, and determination
of particular administrative cases under the General Ad-
ministrative Procedure Act. The author finds that incor-
poration of the institutes of mediation and settlement into
this Act following the example of the civil procedure would
result in more hazards than benefits. Therefore the current
system, with partial supplements, suffices. A greater potential for a contractual determination of public law relations
is identified in sector-specific administrative law.Za razliku od sudskih postupaka, bit upravnoga postupka nije rješavanje spora među strankama u postupku, već priznavanje prava stranke u postupku uz istovremenu zaštitu javnog interesa. Stoga je upitno – uzevši u obzir čak i ustavno pravo – je li moguće posredovanje i nagodba između privatnih interesa i javnog interesa u upravnim stvarima. S druge strane, elementi nagodbe uvode se u javnu
upravu kroz razvoj partnerstva. Potrebno je razlikovati postupak donošenja provedbenih propisa od upravnog postupka prema Zakonu o općem upravnom postupku. Autorica smatra da bi uključivanje instituta posredovanja i nagodbe u taj zakon, onako kako se to čini u građanskom postupku, donijelo više štete nego koristi, te da je važeći sustav koji ih dopušta u posebnim područjima dovoljan. Smatra da ugovorno rješavanje javnopravnih odnosa ima znatno veću
potencijalnu primjenu u posebnim upravnim područjima
Participacija in informiranje v upravnem postopku – trendi v Sloveniji in Evropski uniji
The concept of good administration in national and other forms of administrative authorities requires efficient, yet democratic conduct in relations with parties (citizens, business, NGOs etc.). The participation of citizens and users of public services is a key building block of modern society. Namely, understanding the legitimacy and accountability of authority – limited by law – is expressed through
acknowledgment of parties as subjects and their proactive involvement in public co-decision making. On the parties’ side, participation leads to consistent compliance with administrative decision, hence development and trust into the state governed by law. This contribution aims to emphasize the significance of participation and its legal aspects in contemporary public administration – primarily based on a longitudinal analysis of the functions of administrative procedure. The concept of participation is expressed in different activities of all authority holders. However, it is more evident at issuing obligatory general and individual acts on of the parties’ rights and duties. Consequently, the right to information
and the right to be heard represent particular grounds for defence against misuse of power and are a necessary element of good governance. Information and inclusion of parties through dialogue led by so-called cooperative administration and its clients is, therefore, the key function of up-to-date administrative procedure. The author explores the development and implementation of rights to be informed and heard in key European and Slovenian legal acts (such as the Council of Europe, the Charter of the EU on Fundamental Rights and the Slovenian Constitution), theory and case law. In conclusion, one can establish transformation from once rather instrumental role of administrative procedure (purely to implement the individual right and public interest) to connective one. Administrative procedure thus gains function per se, i. e. coordination of societally and legally acknowledged interests and realization of constitutional and international guarantees and principles as fundamental human rights.Participacija ljudi v razmerjih do oblasti pomeni izraz demokratičnosti in priznavanja strank kot subjektov in soodločevalcev v javnih zadevah, ne le objektov monopolističnega upravnega odločanja. Zato zlasti pravici do informacij in izjaviti se oziroma biti slišan, posebej v konkretnih upravnih postopkih glede na posamični pravni interes
upravičencev, pomenita temelj obrambe pred prekomerno oblastjo in nujen element sodobnega dobrega upravljanja (good governance). V prispevku se na temelju funkcij upravnega postopka kot orodja obrambe pred in dialoga strank z oblastnimi upravnimi organi analizira razumevanje teh dveh pravic v ključnih evropskih in slovenskih pravnih aktih, teoriji in judikaturi.
