    Subjects' Relevance Within an AI-included Creative Process

    Speaking of the works created by or using artificial intelligence (AI) either in form of specialized software (as the portrait of Edmond Belamy) or an interactive platform (as the DeepArt’s or Humtap’s outcomes), there is an indisputable role of humans. Within such an AI-included creative process, we can find a lot of subjects interacting with an AI, either as (i) the author of an AI per se, (ii) the authors of all the datasets used for creating a basic framework, which serves as an environment for creating the works, or (iii) the users of an AI providing input data for it to create the works. All these subjects have potential IP rights to the resulting works, even if there is no strict answer to who is the real author of the work.     Umělá inteligence je fenoménem prosazujícím se postupně čím dál více v právních vztazích. Ve většinovém chápání je umělá inteligence softwarem s nejrůznějšími schopnostmi, tedy objektem právního vztahu. Sílí však debaty nad tím, zda by umělá inteligence nemohla být subjektem právního vztahu. Poukazuje se na to, že umělá inteligence je schopna autonomně tvořit, učit se, řídit vozidla, ale je též je schopna získat trvalé bydliště, státní občanství, a dokonce sama sebe reprodukovat. Nicméně k tomu, aby umělá inteligence mohla být subjektem právního vztahu, je třeba jí přiznat právní osobnost jako základní právní status. Jen tak může být obdobně jako právnická osoba coby autonomní výtvor práva pasivním nositelem práv a může se s ní operovat v dalších fázích zkoumání při přiznávání autorství či trestní odpovědnosti. Příspěvek si proto klade za cíl analyzovat podmínky přiznání právní osobnosti umělé inteligenci včetně důsledků z toho plynoucích. V úvodu příspěvku autor vymezí dosavadní vývoj na poli tvůrčí umělé inteligence s důrazem na kritickou revizi jejího místa na poli subjektu právního vztahu. Ve druhé části se autor zaměří na analytický rozbor samotného institutu právní osobnosti, jejího historického opodstatnění, podob, včetně nutných aplikačních kritérií pro její přiznání fyzickým a právnickým osobám. Třetí část příspěvku bude věnována relevantní a stěžejní tuzemské a zahraniční judikatuře na téma právní osobnosti, na což naváže část čtvrtá v podobě úvahy nad použitím případných alternativních modelů v případě umělé inteligence, jako je elektronická osoba, svěřenský fond apod. Generally speaking, the artificial intelligence is a software with a variety of capabilities and it is an object of legal relations. But, there are debates over whether the artificial intelligence could be a subject of such relations. It is argued that the artificial intelligence is able to autonomously create, learn, drive,but also to obtain a permanent residence, citizenship and even reproduce itself. However, before the shift to the position of subject, a legal personality as a fundamental legal status must be granted to the artificial intelligence. That is the only way how the artificial intelligence could be (similarly to a legal entity as autonomous creation of law) a passive right-holder and could be analysed when granting an authorship or a criminal liability to it. The paper aims to analyse the conditions of granting the legal personality to the artificial intelligence, including the consequences thereof. At the beginning, author will describe the development in the field of creative artificial intelligence with an emphasis on a critical review of its place in the position of subject of legal relations. In the second part, author will focus on an analytical analysis of the legal personality per se, its historical justification and its forms, including necessary application criteria for its attribution to natural persons and legal entities. In the third part, relevant and fundamental national and foreign court decisions dealing with the legal personality will be described. It will be followed by the consideration of the use of possible alternative models such as electronic per-son or trust fund. The final part will contain application of previous conclusions with some possible consequences resulting from granting the legal personality to the artificial intelligence

    Příspěvek analyzuje kritérium originality jako pojmový znak autorského díla napříč právem Evropské unie, a to jak na poli legislativním, kde je ve směrnicové úpravě anglický pojem "original" definován různorodě, tak na poli judikatorním, kde je jeho výklad uchopen též dost nestabilně. Znak originality vyjadřuje míru duševní činnosti autora ve vztahu k výslednému výtvoru. Jako takový je tento znak odrazem předpokladu zachyceného již v Bernské úmluvě, která naznačuje neodmyslitelné spojení autora a jeho díla. Originalita pak krom jiného významově balancuje mezi původností a jedinečností coby dvěma základními leč mírou náročnosti požadavků na dílo odlišnými úrovněmi takového spojení. Příspěvek si proto klade za cíl objasnit v tomto směru unijní chápání originality.The paper analyzes "originality" as the conceptual feature of a copyrighted work under the law of the European Union, both in the legislature, where in the directives the English term "original" is defined variously, as in the jurisprudence, where the interpretation of this term is also very unstable. The feature of originality reflects the rate of author's intellectual activity in relation to the final creation. The feature is reflection of an assumption taken down in the Berne Convention, where the inherent connection of an author and his work is suggested. Moreover, the originality in sense of its meaning is balancing between originality stricto sensu and uniqueness as two basic but in the requirements of demand different levels of such connection. Therefore the paper aims to clarify the European meaning of "originality" in that sense

    Artificial intelligence (AI) may be understood in countless ways. However, it may be understood to be an entity sufficiently simulating the cognitive aspects of human thinking. As such, AI can make valuable outcomes which are able to meet the individual conceptual features of copyrighted works and to gain copyright protection. Based on that we could call AI an author of such works. Nevertheless, despite all the development around intellectual property, AI is not reflected enough. Copyright is still based on the ideas of previous centuries and persists on the criterion of a natural person as the author. Therefore, it is needed to analyse AI in this context, its creative options, place in the world of intellectual property law, and to shift the paradigm of copyright towards the modern age, the age of AI. The paper focuses on a rudimentary metanalysis of AI and copyright in mutual interactions. In the beginning, the author's research is introduced with outlining all the intended proposed phases of regulation of AI within the copyright law and the methodology suitable for such a move. In the second chapter, AI definition and outcomes for the further operating are presented as well as its creative options which are rudimental for the assessment of the conceptual features. The third chapter deals with the copyright aspects of an AI itself focusing on an analysis of the applicable law on the national, supranational and international level. The fourth chapter represents the critical analysis and demarcation of the main problematic friction surfaces of copyright and earlier defined AI. The paper is concluded by an overall assessment of the analysis.Umělá inteligence (AI) může být chápána mnohými způsoby. Jedním z nich je i nahlížení na AI jako entitu simulující kognitivní aspekty lidského myšlení. Jako taková pak umělá inteligence může tvořit cenné výstupy, které mohou potenciálně naplnit jednotlivé pojmové znaky autorského díla a získat autorskoprávní ochranu. Na základě toho bychom mohli o AI hovořit jako o autorovi takových děl. Nicméně, i přes veškerý vývoj na poli práva duševního vlastnictví není AI v této pozici dostatečně reflektována. Autorské právo stále setrvává na myšlenkách minulých století a trvá na kritériu fyzické osoby jako autora. Proto je třeba provést analýzu tvůrčích možností AI, jejího místa v systému práva duševního vlastnictví a posunout paradigma autorského práva směrem k moderní době, době AI. Článek se soustředí na základní metaanalýzu AI a autorského práva ve vzájemné interakci. Na začátku je představen výzkum autora se všemi zamýšlenými fázemi regulace AI v rámci autorského práva a nastíněna základní metodologie. Ve druhé kapitole je pak představena definice AI, jakož i jednotlivé výstupy, které je schopna tvořit a které jsou základní pro posuzování jednotlivých pojmových znaků. Třetí kapitola se věnuje autorskoprávním aspektům AI samotné při reflektování národní, nadnárodní a mezinárodní právní úpravy. Čtvrtá kapitola poté představuje kritickou analýzu a vymezení základních problémových třecích ploch autorského práva a dříve definované AI, na což navazuje závěr s celkovým zhodnocením prováděné analýzy.Artificial intelligence (AI) may be understood in countless ways.     Going Beyond Counting First Authors in Author Co-citation Analysis

    The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed

    “Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship

    Appropriate Similarity Measures for Author Cocitation Analysis

    We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature.     Dispelling the Myths Behind First-author Citation Counts

    We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases. It is argued that increasingly available digital full text research papers make it possible for citation analysis studies to go beyond what the ISI databases have directly supported and to employ more sophisticated methods
