    ABSTRAK IMPLEMENTASI DOKTRIN ULTIMUM REMEDIUM DALAM HUKUM PIDANA EKONOMI DI INDONESIA (Yoserwan, 1330112006, Program Doktor Ilmu Hukum, Fakultas Hukum Universitas Andalas 2018) Hukum pidana merupakan salah satu bentuk norma hukum yang mempunyai sanksi yang paling keras yakni berupa penderitaan atau nestapa. Oleh sebab itu, dalam hukum pidana terdapat dokrin yang mengajarkan bahwa hukum pidana harus difungsikan sebagai upaya yang terakhir untuk mengatasi berbagai pelanggaran hukum yang terjadi di tengah masyarakat setelah mekanisme keperdataan dan administratif tidak dapat dilaksanakan. Fungsi yang demikian disebut dengan ultimum remedium atau last resort atau ultimo ratio. Namun di pihak lain terlihat fenomena yang tidak lagi menempatkan hukum pidana sebagai upaya yang terakhir. Penelitian ini mengkaji bagaimana penerapan doktrin ultimum remedium dalam Hukum Pidana Ekonomi (HPE). Dipilihnya hukum pidana ekonomi, karena ekonomi merupakan salah satu faktor dalam kehidupan masyarakat yang mengalami perkembangan yang cepat dan membutuhkan pengaturan, termasuk melalui hukum pidana. Permasalahan yang dikaji adalah bagaimana implementasi doktrin ultimum remedium dalam formulasi HPE, bagaimana implementasi doktrin ultimum remedium oleh penegak hukum, serta mengapa doktrin ultimum remedium perlu diakomodasi dalam HPE. Metode yang digunakan dalam penelitian ini adalah penelitian hukum normatif dan empiris. Dalam penelitian normatif dilakukan invetarisasi hukum, penemuan asas hukum dan sinkronisasi hukum. Dalam penelitian empiris digunakan dalam menghimpun data primer dalam dari lembaga penegak hukum baik dalam tahapan penyidikan, penuntutan dan peradilan. Data dikumpulkan dengan metode studi dokumentasi dan wawancara. Data dianalisis secara juridis- kualitatif. Penelitian ini juga menggunakan studi kasus dan perbandingan hukum (comparative study). Hasil penelitian menunjukkan bahwa doktrin ultimum remedium belum sepenuhnya diakomodasi dalam pembentukan HPE pidana ekonomi. Hal itu ditunjukkan oleh semakin banyaknya undang-undang pidana ekonomi. Penegak hukum belum sepenuhnya mempunyai wewenang dan mengimplementasikan doktrin ultimum remedium dalam proses Sistem Peradilan Pidana. Doktrin ultimum remedium perlu diakomodasi dalam hukum pidana ekonomi karena adanya kecendurungan semakin meningkatnya kriminalisasi melalui pembentukan undang-undang pidana di bidang ekonomi. Hal ini berdampak kepada meningkatnya penalisiasi dan seterusnya berdampak kepada terjadinya kelebihan kapasitas (overcapacity) di lembaga pemasyarakatan. Banyaknya undang-undang pidana ekonomi berdampak kepada terjadinya ketidaksinkronan dan ketidakharmonisan dalam berbagai aturan HPE sehingga dapat menghambat penegakan hukumnya. Pembentukan hukum pidana ekonomi akan membutuhkan kelembagaan baru, sarana dan prasarana yang seterusnya akan berdampak kepada meningkatnya pembiayaan (cost) yang diperlukan dalam penegakan hukumnya. Untuk mengoptimalkan dontrin utimum remedium, perlu adanya penegasan ultimum remedium dalam peraturan perundang undang sebagai pertimbangan dalam kriminalisasi dan penegakan hukum. Perlu adanya penegasan dalam undang-undang yang memberi wewenang kepada penegak hukum padasetiap tahapan dalam Sistem Peradilan Pidana untuk menerapkan ultimum remedium guna terciptanya efisiensi dalam Sistem peradilan Pidana serta lebih mengoptimalkan pengenaan sanksi berupa uang (monetary sanction), sehingga dapat mengurangi beban anggaran serta mendatangkan pemasukan bagi negara. Dengan demikian Hukum Pidana Ekonomi tidak hanya mengedepankan penderitaan melainkan kemanfaatan untuk meningkatkan kesejahteraan masyarakat. Therefore, there is a doctrine in criminal law that criminal law must be lastly functioned after other mechanism such as civil and administrative processes cannot be performed. Such a function is usually called the doctrine of ultimum remedium or last resort or ultimo ratio. However, there are phenomena in society that the doctrine do not placed criminal law properly as the last remedy. This dissertation is studying the implementation of the doctrine of ultimum remedium in Economic Criminal Law of Indonesia. Economic criminal law is chosen is due the fact that economy is an important factor in society that develop fast and dynamically. Therefore it needs regulation, includes through criminal law. The problems should be answered here are: how is the doctrine of ultimo remedies is implemented in the formulation of economic criminal law, how is the doctrine implemented by law enforcement agencies in every stage of Criminal Justice System, and why such a doctrine should be accommodated in the formulation and enforcement of economic criminal law. This research applied both normative (doctrinal) and empirical (non-doctrinal) legal research. Doctrinal legal research is performed through laws inventory, legal principle finding, and studying law synchronization of economic criminal law. Empirical legal study is applied in searching the primary data in each law enforcement agencies in economic criminal law. The data are collected through interview and documentation study. This research also applied case study and comparative study. The result of the research shows that the doctrine of ultimum remedium is not fully implemented in the formulation of economic criminal law. It is proved form the fact that more and more economic criminal laws are enacted by legislative. Administrative or civil process is not always available in each law as alternative for criminal process. Law enforcement agencies do not fully have authority to implement the doctrine in performing its function in Criminal Justice System. The Law enforcement agencies have not also optimally implemented the doctrine of ultimum remedium in solving any violation of economic criminal law. There are some arguments why the doctrine should be accommodated in economic criminal law. The first, rampant criminalization will result in high penalization and in turn will cause overcapacity in the prisons. The second, many economic criminal laws will result in disharmony and asynchronous among existing economic criminal laws and in turn such a condition may inhibit their law enforcement. The creation of any new law needs new law institutions, facilities and sources. The effectis that a lot of budget should be allocated to make the law successfully enforced. In order to optimally utilize the doctrine of ultimum remedium in economic criminal law, the doctrine should become the primary consideration in formulating new economic criminal law. Every economic criminal law should clearly formulate the doctrine of ultimum remedium by providing civil and administrative procedure, as alternative to criminal procedure. Any economic criminal law should give priority to monetary sanction instead of other sanctions such as imprisonment. It is hoped that the implementation of ultimum remedium will result in efficiency and utility for public prosperity instead just for revenge and suffering.     Going Beyond Counting First Authors in Author Co-citation Analysis

    The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed.     Variations on the Author

    “Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship

    Appropriate Similarity Measures for Author Cocitation Analysis

    We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature.     Dispelling the Myths Behind First-author Citation Counts

    We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases. It is argued that increasingly available digital full text research papers make it possible for citation analysis studies to go beyond what the ISI databases have directly supported and to employ more sophisticated methods

    We have done our best to complete the author checklist relating to the use of animals in the hut study. Note that the objective for the hut study was to evaluate the IRS treatment applications for residual efficacy against Anopheles mosquitoes, including the local An. coluzzii mosquito population. Cows were only used to attract mosquitoes into the huts and no tests were carried out directly on the cows. The author checklist is intended for use with studies where experiments are carried out on animals, which is why we have had such difficulty in completing this for the hut study, as many of the questions do not relate to how the cows were used

    In the consideration of Law No. 23 of 2003 regarding Child Protection, it is stipulated that a child is bud, potential and young generation who will become the successor for aspiration of nation struggling and hold strategic value in securing the existence of this nation in the future. That why this law obligates the state and government to provide special protection for child in any condition. In Law No. 11 of 2012 regarding Juvenile Criminal Justice System, the protection is given by establishing special court for children who are committing a crime, which is separated from adult court. This law also mandates as a mandatory that the law enforcement agencies in each stage of criminal justice should apply diversion in solving any child crime or child in conflicting with law. For the police, which stand in the first row of criminal justice system, diversion process is actually can be applied by some procedures available. Those procedures are through the implementation of police discretion, penal mediation, and restorative justice or by solving trough adat law process. The implementation of those procedures in one hand will provide strong protection for child’s rights and on the other hand will secure the best interest of child
