Constitutional sociology and corporations: A conversation with Gunther Teubner

    No full text
Abstract The present work corresponds to a conversation held with the German sociologist Gunther Teubner. In it, the author addresses central aspects related to the sociology of constitutions and their contribution to the understanding of the negative effects of the dark side of functional differentiation. Gunther Teubner is professor emeritus of private law and sociology of law at the prestigious Goethe University. His work is widely known for his contributions to the field of the sociology of law, particularly for his theory of autopoietic law, the concept of reflexive law, and, currently, for his theory of societal constitutionalization

Combining the Best of Gunther and Sullivan

    No full text
In the field of casebooks, there are few classics, but Gerald Gunther\u27s Constitutional Law has long been viewed as one of them. More than twenty years ago it was heralded in the Harvard Law Review as the Hart and Wechsler of constitutional law. After decades of solo authorship, Gunther is joined on the 13th edition by Kathleen Sullivan, who was primarily responsible for revising (among other sections) the chapters on freedom of expression. This partnership has succeeded in improving what was already perhaps the strongest section of the book. This Review examines the organization of the free expression materials, considers the selection and editing of cases, and comments on the notes and questions. But this casebook is not merely a teaching tool; it is also a scholarly work bristling with ideas. At the end of thisRreview, the author will identify and engage an overarching view that finds expression in the notes and more subtly in the organization of the free speech material

Equal Work, Comparable Worth and Disparate Treatment: An Argument for Narrowly Construing \u3cem\u3eCounty of Washington v. Gunther\u3c/em\u3e

    No full text
The Supreme Court\u27s decision in County of Washington v. Gunther rendered the Equal Protection Act\u27s equal work requirement inapplicable to claims of gender discrimination in compensation brought under Title VII of the Civil Rights Act. It is possible that Gunther will be invoked as a basis for applying the controversial theory of comparable worth to such claims. The author argues, however, that the Supreme Court\u27s rationale in Gunther precludes a comparable worth theory. He then examines alternative possible means of establishing post-Gunther claims under Title VII in terms of that rationale

Distant(ly) reading Alexander Kluge's distant writing

    No full text
In this article, I investigate whether Alexander Kluge's works displays an increase in references to “real” places, people and locations and whether this helps us to arrive at an assessment of the typical “Kluge sound”. I do so by means of a novel methodological approach: I subject Kluge’s texts to a distant reading by means of tools borrowed from the budding field of Digital Humanities. It is not my aim to question existing non-quantitative approaches. But I will enumerate a number of reasons why an author like Alexander Kluge is specifically amenable to such an approach. By means of distant reading, we can better come to grips with an oeuvre running into the thousands of pages and notable for its sheer diversity. In addition, it is shown that Kluge’s writing can be termed ‘distant’ not only because of its documentary poetics but also because it covers a lot of distance, even within the marked brevity of its short stories

Signos da pandemia: multimodalidade, semiótica social e comunicação a partir do pensamento de Gunther Kress

    No full text
In this article, we reflect on some impacts of the pandemic on interactions and communication drawing from Gunther Kress' multimodal and sociosemiotic thinking. To do so, we relate examples with fundamental concepts of Social Semiotics, such as identity, power, motivated sign and interest. In addition, we propose a small tribute to this author who greatly influenced us. We trace a brief history of his academic career in which we highlight some of his main publications and discuss concepts and ideas developed by him throughout his career. Keywords: Social Semiotics. Portfolio of recorded performances and exegesis: Messiaen’s musical language for the jazz pianist - an exploration through performance.

    No full text
Moving beyond Gunther Schuller’s Third Stream amalgamation of classical and jazz, this study explores whether the musical language of Olivier Messiaen can make a valid contribution to jazz piano performance. Initially, my project sought to answer such questions as: What elements of the musical language of Messiaen already exist in the jazz vocabulary? Am I able to extend this further? What are the timbral structures and pianistic effects within Messiaen’s musical language? What will be the most effective application of Messiaen’s musical language to jazz piano performance? Endeavouring to answer the final question led me to consider such aspects as whether the project should be limited to quoting Messiaen motifs, arranging Messiaen melodies, replacing jazz harmonic structures on standards with examples from Messiaen’s musical language or whether it would be better to approach the research conceptually. The work of Hubert Nuss provided encouraging reassurance that this was not an impossible task. In order to articulate this conception, the initial challenge was to decide how the classical and jazz worlds might meet in a ‘Messiaen’ technique. The approach adopted was similar to that used for undergraduate jazz study, namely, immersion in the piano scores and recordings of Messiaen’s music as well as by live performances. This was followed by the development and assessment of a contrived approach when specific techniques, such as tonal colourings or harmonic structures, were developed through prepared exercises and consciously included in my performance. It was then compared with an intuitive approach when no such precise parameters were established. This submission consists of CD recordings of two public recitals and an exegesis. It documents the development of this Messiaen technique and discusses its application in my performances. It also demonstrates the ways that Messiaen’s musical language can be used within jazz piano performance to provide a colour that distinguishes jazz piano performance in a competitive field.Thesis (M.Mus.) -- University of Adelaide, Elder Conservatorium of Music, 201
