ABSTRAK
Mengingat bahwa akibat tindak pidana korupsi telah menimbulkan kerugian pada keuangan
negara, maka dalam Undang-Undang Pemberantasan Tindak Pidana Korupsi, kepada
koruptor dapat diancam pidana penjara dan denda serta pembayaran pidana uang pengganti
sebagai upaya pengembalian kerugian keuangan negara. Oleh karena itu, penelitian
mengenai Penerapan Pidana Pembayaran Uang Pengganti Dalam Tindak Pidana Korupsi Di
Wilayah Hukum Pengadilan Tipikor Padang bertujuan untuk mendeskripsikan serta
menganalisis lebih dalam mengenai penerapan uang pengganti pada pelaku tindak pidana
korupsi di pengadilan Tipikor Padang, termasuk di dalamnya untuk mengetahui dasar
pertimbangan hakim dalam menetapkan besarnya uang pengganti pada pelaku tindak pidana
korupsi di Pengadilan Tipikor Padang. Selain itu, penelitian ini juga bertujuan untuk
mengetahui mengenai pelaksanaan pembayaran uang pengganti dan akibat hukumnya apabila
terpidana tidak membayar uang pengganti yang telah diputuskan oleh majelis hakim. Metode
yang digunakan dalam penelitian ini adalah penelitian hukum yuridis empiris dengan sifat
penelitian deskriptif yang menggunakan sumber data primer dan sekunder dengan teknik
studi dokumen dan wawancara serta sumber bacaan yang berkaitan dengan masalah yang
ada. Adapun keseluruhan data yang telah didapat, dianalisis secara kualitatif atau lebih
dikenal dengan istilah analisis deskriptif kualitatif. Berdasarkan penelitian yang telah
dilakukan, maka dapat diketahui bahwa penerapan pidana tambahan berupa pembayaran
pidana pengganti telah diterapkan pada Pengadilan Tipikor Padang dan dasar pertimbangan
menjatuhkan pidana pengganti yaitu berdasarkan pertimbangan yuridis dan non yuridis,
termasuk pembuktian dipersidangan siapa yang menikmati hasil tindak pidana tersebut.
Mengingat uang pengganti memiliki kedudukan penting dalam pengembalian kerugian
keuangan negara akibat perbuatan korupsi, maka 1 (satu) bulan setelah putusan pengadilan
yang telah mempunyai kekuatan hukum tetap, maka jaksa selaku eksekutor melakukan
eksekusi pembayaran uang pengganti. Jika terpidana tidak melunasi pembayaran uang
pengganti, jaksa wajib melakukan penyitaan terhadap harta benda yang dimiliki terpidana.
Jika setelah dilakukan penyitaan terpidana tetap tidak melunasi pembayaran uang pengganti,
Jaksa wajib melelang harta benda tersebut. Dalam hal terpidana tidak memiliki harta benda
yang cukup guna membayar uang pengganti, terpidana dipidana dengan pidana penjara yang
sudah ditentukan dalam putusan pengadilan.

The application of the additional penalty of Substitute Money for Corruption in the Territory
of the Corruption Court of Padang

Abstract
Considering that the consequences of corruption have caused a loss to the state finance, in
Corruption Prevention Act, corruptors can be punished with imprisonment and payment of
fine and also impose additional penalties, that is substitute money as an effort to restore the
state financial loss. Therefore, research on the application of the additional penalty of
Substitute Money for Corruption in the Territory of the Corruption Court of Padang aims to
describe and analyze more deeply about the application of replacement money to the
corruptor in Corruption Court of Padang, including to know the judge's consideration In
determining the amount of replacement money to the corruptor in Corruption Court of
Padang Court. In addition, this study also aims to know about the implementation of
replacement payments and the legal consequences if the convict doesn’t pay the replacement
money that has been decided by the judges. Empirical legal research is applied in terms of
discussing the research questions and the type of this research is a descriptive one. the
source of the data are from primary and secondary data, which was obtained by interviewing
the respondents and by documentation study. Base on the research conducted, it can be
conclude as follows: Additional penalty in the form of replacement criminal payments has
been applied to the Corruption Court of Padang. The judge’s consideration to impose a
substitute criminal based on juridical and non juridical considerations, including evidence in
court who enjoys the proceeds of the offense. Considering that replacement money has an
important position in returning the state financial loss due to corruption, then 1 (one) month
after the court’s decision has had permanent legal force, the prosecutor shall execute the
payment of the replacement money. If the convicted person does not pay the replacement
payment, the prosecutor is obliged to seize the property owned by the convicted person. If
after the convicted convict still doesn’t pay off the replacement money, the Prosecutor must
auction off the property. In the event that the defendant doesn’t have sufficient property to
pay the surrogate, the convict is sentenced to a prison sentence determined in the court's
decision.

Going Beyond Counting First Authors in Author Co-citation Analysis
Get PDFThe present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed

Get PDF“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
Appropriate Similarity Measures for Author Cocitation Analysis
Get PDFWe provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. Dispelling the Myths Behind First-author Citation Counts

Note that the objective for the hut study was to evaluate the IRS treatment applications for residual efficacy against Anopheles mosquitoes, including the local An. coluzzii mosquito population. Cows were only used to attract mosquitoes into the huts and no tests were carried out directly on the cows. The author checklist is intended for use with studies where experiments are carried out on animals, which is why we have had such difficulty in completing this for the hut study, as many of the questions do not relate to how the cows were used
