    In 1974, Elmer A. Driedger writes about the modern principle of interpretation for the first time in The Construction of Statutes, in which he states: « Today there is only one principle or approach, namely, the words of an Act are to be read in their entire context, in their grammatical and ordinary sense harmoniously with the scheme of the Act, the object of the Act, and the intention of the Parliament ». The modern principle combines the three so-called traditional rules of interpretation in Canada, namely the Literal rule, the Golden rule and the Mischief rule in order to determine the legislator's intention. In 1984, the Supreme Court of Canada uses the modern principle of interpretation for the first time in Stubart. In 1998, this method becomes the privileged and fundamental interpretative principle of our highest court following Rizzo Shoes. Since then, the Supreme Court has consistently used the modern principle in its interpretative activity, to such an extent that it has become the most popular doctrinal reference in the history of the country. While the Supreme Court has fully adopted this principle of interpretation, the Canadian doctrine, on the other hand, has often been critical towards the statement of the modern principle and the intentionalist approach that underpins it. The author focuses on two major criticisms. According to the first criticism, the statement of the modern principle does not allow to take into account the legal norms and the consequences of an interpretation. The second criticism states that the method is unduly biased towards the discovery of the legislator's intention and consequently, that this bias casts a shadow on the role of the judge in the creation of law. For these reasons, a line of thinking in legal scholarship believes that the modern principle does not reflect the actual interpretative activity taken by the Supreme Court. The author questions both criticisms and determines if the modern principle of interpretation allows an accurate representation of the interpretative activity of the Supreme Court, and why. To this end, the legislator's intention, the principle of sovereignty of the legislator and the theory of separation of powers are key elements.En 1974, Elmer A. Cette méthode moderne conjugue les trois règles d'interprétation dites traditionnelles au Canada, à savoir la Litteral rule, la Golden Rule, et la Mischief Rule, dans le but de déterminer l'intention du législateur. En 1984, la Cour suprême du Canada emploi pour la première fois la méthode moderne d'interprétation dans l'arrêt Stubart. En 1998, elle devient le principe interprétatif privilégié et fondamental de notre plus haut tribunal suite à l'arrêt Rizzo Shoes. Depuis, la Cour suprême a de façon constante employé la méthode moderne dans son activité interprétative à un point tel qu'elle est devenue la référence doctrinale la plus populaire dans l'histoire du pays. Pourtant, la doctrine canadienne ne tarit pas de critiques à l'égard de l'énoncé de la méthode moderne ainsi que de l'approche intentionnaliste qu'elle sous-tend. L'auteur s'intéresse à deux critiques majeures. Selon la première critique, l'énoncé de la méthode moderne ne permet pas la prise en compte des normes juridiques et des conséquences d'une interprétation, tandis que la seconde critique reproche à la méthode de se polariser indûment sur la détermination de l'intention du législateur jetant ainsi l'ombre sur le rôle créateur de droit du juge. En raison de ces critiques, un courant doctrinal est d'avis que la méthode moderne ne rendrait pas compte de la démarche interprétative réellement entreprise par la Cour suprême. L'auteur remet en question ces deux critiques et répond aux questions suivantes : la méthode moderne d'interprétation permet-elle une représentation fidèle de l'activité interprétative de la Cour suprême, et pourquoi ? À cette fin, l'intention du législateur, le principe de la souveraineté du législateur, et le principe de la séparation des pouvoirs sont des éléments déterminants

    Going Beyond Counting First Authors in Author Co-citation Analysis

    The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed

    “Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship

    Appropriate Similarity Measures for Author Cocitation Analysis

    We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature.
