Differences And Similarities Between The Unidroit Principles Of International Commercial Contracts 2010 And National Laws: The Turkish Perspective
This research deals with comparisons between the UNIDROIT Principles on International Commercial
Contracts, 2010 with the Turkish Code of Obligations (TCO), No. 6098 of 2011. The author examines several
legal concepts of the TCO in the light of UNIDROIT Principles 2010 and tries to analyze the similarities
and differences between the Principles and the national law. The research has been devoted to show that
Turkish law of obligations is in harmony with the UNIDROIT Principles. In this context “general principles
of the law of obligations (freedom of contract, party autonomy), conclusion and interpretation of
contract, agency, grounds for avoidance (mistake, fraud, threat, gross disparity), illegality (infringement
of mandatory rules), third party rights, conditions, performance and non-performance, hardship, right
to terminate the contract, set-off, assignment of rights and contract, transfer of obligations, plurality
of obligors and of obligees have been examined. The author is of the opinion that current TCO and the
Turkish Commercial Code are in comply with many UNIDROIT Principles, and the Turkish doctrine on Law
of Obligations inclines towards the solutions in the Principles. The amendments and additions to the
Principles 2016 have not been taken into account as the research was made in 2014
On the Spectrum of a Discrete Non-Hermitian Quantum System
In this paper, we develop spectral analysis of a discrete non-Hermitian quantum system that is a discrete counterpart of some continuous quantum systems on a complex contour. In particular, simple conditions for discreteness of the spectrum are established.This paper is a contribution to the Proceedings of the VIIth Workshop “Quantum Physics with NonHermitian Operators” (June 29 – July 11, 2008, Benasque, Spain). Understanding University Brand Loyalty: The Mediating Role of Attitudes towards the Department and University
AbstractFor today's competitive academic environment, brand management in higher education is becoming highly important. As students have many options available to them, there is a growing need to study factors that enable higher education institutions to attract and retain students. In literature, there are many factors that foster or challenge branding activities of universities. In this study, the mediating role of attitude on university performance variables and university brand loyalty relationship is investigated. A survey is used as a research instrument and applied to university students. Data is collected from 321university students studying at business administration department of a public university. Hierarchical multiple regression is used to test the hypotheses which revealed partial mediation of attitude between the relationship of university performance and university brand loyalty

Production of small-scale Alfvén waves by ionospheric depletion, nonlinear magnetosphere-ionosphere coupling and phase mixing

AJBR is grateful to the Royal Commission for the Exhibition of 1851 for present support and acknowledges an STFC studentship that funded part of this work.Rockets and satellites have previously observed small-scale Alfven waves inside large-scale downward field-aligned currents, and numerical simulations have associated their formation with self-consistent magnetosphere-ionosphere coupling. The origin of these waves was previously attributed to ionospheric feedback instability; however, we show that they arise in numerical experiments in which the instability is excluded. A new interpretation is proposed in which strong ionospheric depletion and associated current broadening (a nonlinear steepening/wave-breaking process) form magnetosphereionosphere waves inside a downward current region and these oscillations drive upgoing inertial Alfven waves in the overlying plasma. The resulting waves are governed by characteristic periods, which are a good match to previously observed periods for reasonable assumed conditions. Meanwhile, wavelengths perpendicular to the magnetic field initially map to an ionospheric scale comparable to the electron inertial length for the low-altitude magnetosphere, but become shorter with time due to frequency-based phase mixing of boundary waves (a new manifestation of phase mixing). Under suitable conditions, these could act as seeds for the ionospheric feedback instability.Peer reviewe
Solid Pseudopapillary Neoplasm of the Pancreas: A Good Prognostic Tumor of the Bad Lucky Organ
Introduction Solid pseudopapillary neoplasm (SPN) of the pancreas is a rare clinical entity with low malignant potential and good clinical prognosis. It was first defined by Frantz Virginia in 1959 and was renamed solid pseudopapillary tumor by the World Health Organization (WHO) in 2010. SPN is more common in young women with an average age of 28-32 years and a female: male ratio of 3-10:1 in different publications. Material & Method The data were retrospectively analyzed for 26 patients whose pathology was compatible with SPN and operated on between 2003 and 2019 in the General Surgery Clinic at XXX. Results Of the patients, 25 (96.2%) were female and 1 (3.8%) was male; the mean age at diagnosis was 37.1 (range: 18-69, eight patients <30 years); mean body mass index was 28.8 kg/m(2). The most common reason for referral was abdominal pain (n=13, 50%); three patients (11%) had nausea and vomiting, and one patient (3.8%) had jaundice with mass at the head of the pancreas. Ten patients (38%) were asymptomatic and were diagnosed incidentally during examinations performed for other reasons. The most frequent tumor localization was the head and neck part of the pancreas (n=10, 38%); eight patients (31%) had body, and eight patients (31%) had tail localization. Ten patients (38%) had Whipple procedure (pancreaticoduodenectomy), 15 patients (53%) had distal pancreatectomy, and one patient had intra-abdominal mass excision and segmental small bowel resection operation in addition to distal pancreatectomy. Six (37%) of the 16 patients who underwent distal pancreatectomy had splenectomy too. One of the patients had laparoscopic distal pancreatectomy and splenectomy. The mean tumor diameter was 7.2 cm (range: 2-23 cm). Conclusion SPN is a rare tumor, and even though it is diagnosed late and in large sizes, it has prolonged survival when appropriate surgical resection is applied. The ability to perform surgery even in cases with relapse or meta stasis during the SPN follow-up reveals the importance of accurate diagnosis
