    Caveat Emptor’s Current Role in Louisiana and Islamic Law: Worlds Apart Yet Surprisingly Close

    Caveat emptor is one of the most well known maxims of the legal world. Interpreters from different countries have their own understanding of this doctrine. At first glance, Louisiana law and Islamic law have nothing in common. Louisiana, at least superficially, adheres to the great civil law tradition that the legislature is supreme. Its primary sources of law are legislation and custom. Islamic law is divine in origin, a direct manifestation of Allah’s will. Its primary sources of law are the Koran and the wisdom of the Prophet Muhammad. Yet, in practice, these two systems have developed surprisingly similar approaches toward duties of disclosure and the doctrine of caveat emptor. The similarities between the above mentioned legal systems’ approach to caveat emptor and duties of disclosure are uncanny. Regardless of whether the issue is dealt under the heading of mistake, misrepresentation, or error and fraud, there is a commonality of approach that cannot be missed. Despite this obvious diversity of methods, traditions and styles, it is possible to notice an element, or better, a tendency common to the examined regulations, that may be found more in operational rules than in principle statements

    During the late 1990s, Colorado's Taxpayer's Bill of Rights was praised widely for its effectiveness in restraining the growth of government and providing tax relief for the residents of the state. TABOR capped government revenue growth at population plus inflation and mandated immediate rebates of surplus revenues. Now TABOR is under attack by interest groups that want to increase government taxation faster than the cap will allow. They blame TABOR for the pressure the state budget has faced over the last four years. Yet that pressure is a direct result not of TABOR but of a recession, a drought, and a misguided educational-spending mandate that forced government to spend more money than it collected. Opponents of TABOR have endorsed Referendum C as a much-needed fix to TABOR. However, far from simply tinkering with TABOR, Referendum C puts government growth in overdrive. The referendum would in effect give Colorado state government a blank check for the next five years. It would also permanently change the way the TABOR cap is calculated and lock in for perpetuity more government spending. This paper sets the record straight on what really caused the budget problems in Colorado and what passage of Referendum C would mean to fiscal control in that state

    [Transcription begins] 50 North St. Meshanticut, R. I. December 10, 1942 Bryant Service Club; This past week I received a letter from my son, Samuel B. Tabor, from “somewhere in north west Africa”. He informs me that he has been advanced in rank and his address has been changed, so that his present address will be: Sgt. Samuel B. Tabor, 31070292 38th Evacuation Hosp. A.P.O. 302, c/o Postmaster New York, N. Y. In the paper, Providence Sunday Journal, of Nov. 15th there was a group picture and I am sure his picture was there. He tells me he is well, although they sleep in pup tents on straw mattresses; rise while the stars are still shining, and eat breakfast as the sun is coming up. They use their helmets to wash up in, wash clothes in, and as buckets in general. They usually work from dawn until dusk, and he was writing my letter by the light of a lantern.
