The author argues that in current international development co-operation, there is a need for deeper understanding of the complex, context-relevant social and political power structures and processes that prevent gender programming from enhancing gender justice. As an empirical case study the article discusses the challenges that the implementation of the UNSCR 1325 has been facing in Kenya.</p

No full textTämä maisterin opinnäytetyö on taiteellinen tutkimus retkeilystä ja luontosuhteesta. Se on saanut alkunsa perinteisesssä ja sosiaalisessa mediassa näkyvien retkeilyaiheisten kuvien ja tekijän omien retkeilykokemusten välisestä ristiriidasta. Opinnäytetyössään tekijä kokoaa erilaiset retkeilykuvat retkeilykuvasto-käsitteen alle ja tutkii retkeilykokemusten ja retkeilykuvien suhdetta käyttämällä omia retkeilykokemuksiaan taiteellisen työskentelyn materiaalina.
Viime vuosien aikana retkeilyn ja ulkoilmaharrastusten suosio on kasvanut huomattavasti. Lisääntynyt retkeily aiheuttaa ympäristölle epäsuotuisia lieveilmiöitä, joiden vaikutukset kohdistuvat aineelliseeen ympäristöön, retkeilykulttuuriin ja muihin retkeilykokemuksen synnyttäviin tekijöihin. Tekijä esittää retkeilykuvaston osaltaan vaikuttavan retkeilykulttuurin muotoutumiseen. Retkeilykuvat liittyvät erilaisiin luontosuhteisiin, jotka ilmenevät retkeilyssä ja jokapäiväisessä toiminnassa. Luontosuhdetta ja retkeilyä käsitelltiin opinnäytetyössä ympäristötieteilijöiden Risto Willamon ja Yrjö Hailan ajatuksiin tukeutuen.
Opinnäytetyön menetelmänä on tekijän oma taiteellinen praktiikka. Tekijä maalasi puolen vuoden aikana noin 50 teosta samalla kirjoittaen työskentelystään ja siihen liittyvästä ajattelustaan. Opinnäytetyön tutkimusosuus on taiteellisen työskentelyn lopuksi laadittu kuvien ja kaunokirjallisen tekstin muodostama narratiivi taiteellisesta prosessista, jossa tekijä tutki ensisijaisesti omaa ajatteluaan ja luontosuhdettaan kuvallisen työskentelyn avulla. Taiteellisen työskentelyn keskiössä olivat tekijän omat retkeilykokemukset, joita hän prosessin aikana tarkasteli keholllisina ja aistisina kokemuksina sekä suhteuttaen visuaalista ajatteluaan aiempaan retkeilykuvastoon ja retkeilyn visuaaliseen kulttuuriin.
Taiteellisen työskentelyn tulokset painottuvat ensisijaisesti ajatteluun ja tekijän taiteellisten käytäntöjen kehittämiseen, ja ne esitellään opinnäytetyössä ilman teoksista järjestettyä näyttelyä. Tutkielman tuloksena syntyi pohdintaa erityisesti kliseiden ja autenttisuuden sekä objektiivisen havainnon ja subjektiivisen tulkinnan suhteista kuvallisessa ilmaisussa. Opinnäytteessä pohditaan tekijän praktiikan ja opinnäytetyön tuottaman ajattelun pedagogisia mahdollisuuksia taiteen perusopetuksessa.This Master’s thesis is an artistic research on nature, camping and human-nature relationships. It has been motivated by the dissonance between the outdoor-themed images in traditional and social media and the author’s personal experiences of outdoor activities. The author defines a concept of outdoor imagery that covers the different kinds of outdoor-themed images and he studies the relationships between outdoor experiences and the outdoor imagery using his personal experiences of hiking, camping and nature excursions as the material for artistic work.
Over the last years the popularity of hiking and other outdoor activities has increased noticeably. The increase in outdoor activities has caused unwanted side effects in the environment, the cultures of outdoor activities and the other factors of outdoor experiences. The author suggests that the outdoor imagery in part shapes the cultures of outdoor activities. The outdoor-themed images are linked to different kinds of human-nature relationships that manifest in the outdoor activities and the everyday life. In the thesis the human-nature relationships and the outdoor activities were discussed supported by the ideas of the environmental scientists Risto Willamo and Yrjö Haila.
The methodology of the thesis was built on the artistic praxis of the author. The author painted about 50 paintings over a half-year period while also writing about the artistic process and the artistic thinking involved in it. The research section of the thesis is a narrative consisting of literal and visual elements where the author studies primarily his thinking and his relationship with nature through his artistic work. The artistic work focused on the author’s personal outdoor experiences by representing them as corporeal and sensual experiences and by studying his visual thinking in relation to the existing outdoor imagery and the visual cultures of outdoor activities.
The artistic work produced results in the thinking and the development of artistic praxis of the author. The results are presented in the thesis without a presenting the artworks created over the research process in an exhibition. The research process generated discussion concerning the relationships between cliches and authenticity as well as between the objective observation and the subjective interpretation in visual expression. The pedagogical applications of the artistic praxis of the author and the thinking produced by the research process are discussed in the thesis

The focus has to be on the building of an impartial state, with a clear national agenda and strong ethnically and politically neutral institutions and processes
Valokuvasäveltäminen : musiikin ja kuvan yhteys
No full textTämä opinnäytetyö on taiteellinen tutkimus musiikin ja valokuvan yhteydestä. Työssä tutkittiin, miten valokuva vaikuttaa sävellystyöhön, sekä pohdittiin, miten musiikki ja kuva tukevat toisiaan ja mitä uutta se antaa sävellyksiin.
Opinnäytetyöhön kuului blogi, jota pidettiin kuuden viikon ajan. Viikon aluksi julkaistiin valokuva ja kuvan pohjalta sävellettiin laulu. Blogissa seurattiin viikon aikana tapahtu- vaa työskentelyä. Valmis sävellys julkaistiin viikon lopuksi.
Tekijä vertaili omia sävellysmetodejaan muiden säveltäjien metodeihin. Työssä tarkas- teltiin, mitkä tekijät vaikuttivat projektissa syntyneiden sävellysten sisältöön. Työ antoi tekijälle paljon uusia lähestymistapoja ja työkaluja säveltää.
Tavoitteena oli, että valokuvasäveltämisestä jäisi tekijälle uusi sävellysmetodi. Opinnäy- tetyö kannustaa myös muita muusikoita käyttämään tätä metodia hyväksi.This thesis is an artistic research on the connection between music and photographs. The study focuses on analyzing the use of photographs as an inspiration for musical composition.
The project was carried out with the help of a blog, which was written for six weeks. On a weekly basis a photograph was taken and published on the blog. The photograph was then used to compose a piece of music during the week and the process was docu- mented publicly on the blog.
The author of this thesis compared her own composing methods to the methods of oth- er composers. The thesis also focuses on studying all the factors that affected the con- tent of the compositions created during the project.
The project gave the author several new ways of approaching the composing process and a new set of tools for composing new music. The goal was to maintain composing from photographs in the future as well and encourage other musicians in doing so
Sisämarkkinasääntelystä EU-työoikeuteen
No full textThe dissertation comprises four articles which have as a leading theme the relationship between the economic and social factors in EU labour law. The first one, headed On Social and Economic Factors in the Developing European Labour Law discusses EU directives on collective redundancies and transfer of undertakings. The author also criticizes the theory of converse pyramids, according to which the social factors would be generally subordinated to economic factors in EU law.
The second article, On the Social Dimension in Posting of Workers , discusses the Posted Workers Directive (96/71) and highlights how it applies within the legal framework set up by the EC Treaty, which also means that a proportionality assessment is applicable to the workers rights under the directive. In the context of the Laval case the author concludes that the ILO obligations of the EU Member States form a valid legal basis for such action in EU law, too, which is based on a combined effect of Article 307(1) EC and general international law.
The third article, On the Social Dimension in the Context of EC Competition Law , deals with the interpretation of the relationship between collective labour agreements and competition rules on the basis of the Albany judgment. The immunity of collective labour agreements set up in that judgment is fundamental. The author concludes regarding Article 86(2) EC that it may also cover particular social tasks of general interest. At social security systems this may mean that, as the AOK Bundeskassen judgment shows, certain competition elements included in such systems do not necessarily lead to the application of competition rules. Accordingly, in the Finnish Earnings-Relates Pension Scheme TEL certain inherent restrictions of competition should be regarded as justified under Article 86(2) EC.
In the fourth article, From Internal Market Regulation to ordre communautaire social , the author develops a proposal for a new collective labour law paradigm in the EU. It would comprise the leading premises and principles of EU and international labour law: labour is not a commodity (the ILO Constitution), improvement of working conditions (Article 136 EC), respect for EU and international fundamental rights, respect for the European social model (prominent role of collective agreements) and non-discrimination of grounds of nationality. An employer acting against these principles should not enjoy legal protection in EU law. As to the development of collective labour law in the EU, the author adheres to the thesis that in the long run Europeanisation of economy leads to the emergence of a European framework. However, at present it seems to develop essentially through case-law (the Laval and Viking cases).Väitöskirja koostuu neljästä artikkelista. Kantavana teemana on toisaalta taloudellisten ja toisaalta sosiaalisten tai työoikeudellisten näkökohtien suhteen kuvaaminen. Ensimmäinen artikkeli käsittelee työoikeuden kehitystä Euroopan yhteisön syntyvaiheissa ja varsinkin sisämarkkinaperustein 1970-luvulla säädettyjä joukkovähentämisdirektiiviä ja liikkeenluovutusdirektiiviä. Artikkelissa myös kritisoidaan ns. käännettyjen pyramidien teoriaa, jonka mukaan työelämän sääntely yhteisössä olisi ennalta määrätysti alisteista taloudellisille näkökohdille.
Väitöskirjan toinen artikkeli käsittelee yhteisön direktiiviä, joka koskee työvoiman lähettämistä toiseen jäsenvaltioon työhön. Tällöin heihin on sovellettava vähintään työntekovaltiossa voimassa olevia palkkamääräyksiä, jotka rakennusalalla määräytyvät yleissitovissa työehtosopimuksissa. Yhteisön tuomioistuimen käsittelyssä olevan Laval tapauksen pohjalta tekijä erittelee työtaisteluoikeuden asemaa EU-oikeudessa ja päätyy siihen, että Kansainvälisen Työjärjestön ILOn piirissä määriteltyä työtaisteluoikeutta tulee kunnioittaa myös Euroopan yhteisön sisämarkkinavapauksia (tavaroiden, työvoiman, palvelujen ja pääoman vapaa liikkuvuus) sovellettaessa.
Väitöskirjan kolmas artikkeli käsittelee sosiaalisia näkökohtia yhteisön kilpailusääntöjen soveltamisessa. Tekijä tarkastelee työehtosopimusten ja kilpailusääntöjen suhdetta varsinkin hollantilaisen Albany tapauksen valossa. Tämän ohella tekijä analysoi yhteisön perustamissopimuksen sisältämää ns. varaventtiilisäännöstä, jonka nojalla yleishyödylliset palvelut voidaan vapauttaa kilpailusäännöistä. Tekijän johtopäätös on, että oikeuskäytännön mukaan vapautusperusteeksi kelpaa myös palvelujen sosiaalinen luonne. Kansalliseen oikeuteen sovellettu johtopäätös on, että työeläkejärjestelmän (TEL) eräät kilpailua rajoittavat osatekijät (yhteinen laskuperustekorko ja työeläkemaksu) tulisi katsoa yhteisöoikeudellisesti hyväksytyiksi.
Yhteenvetoartikkelissaan tekijä esittää yhteisön sisämarkkinasäännösten ja työelämän kollektiivisten oikeuksien suhteen määrittelylle uudentyyppistä lähtökohtaa ( yhteisön työoikeudellinen järjestys ). Sen mukaan myös Euroopan neuvostossa ja Kansainvälisessä Työjärjestössä omaksutut periaatteet ja perusoikeudet, yhdessä yhteisöoikeudellisen työehtojen parantamisen ja syrjimättömyyden periaatteen sekä yhteisössä vahvistettujen perusoikeuksien kanssa, ovat yhteisössä myös oikeudellista sitovuutta omaavassa asemassa. Tämän mukaisesti yhteisössä tulee myös työtaisteluoikeutta suojata perusoikeutena, mikä on keskeinen ratkaisun kohde käynnissä olevassa kahdessa oikeustapauksessa, joista toisessa on kyse suomalaisen varustamon aluksen ulosliputtamisesta Viroon sekä siihen liittyvästä uuden miehistön palkkauksesta.ei saavutettav

We demonstrate algorithms for efficiently enforcing domain consistency for these constraints, and show empirically that achieving this strongest possible level of consistency is not only of theoretical interest, but also has substantial value in practical applications. Assessment of diabetic foot ulcers based on pictorial material: an interobserver study
No full textObjective: The frequent change in clinicians, and the emerging use of photographic documentation in wound management, could require a more diverse treatment of patients due to poor interobserver agreement. The aim of this study was to assess the interobserver agreement of a commonly used classification system for diabetic foot ulcers (DFUs), the Meggitt-Wagner classification, and to compare the agreement on classification with the agreement in treatment recommendations.Method: An interobserver study was conducted based on a questionnaire linked to 30 photographs of DFUs. Different groups of observers were tested to investigate whether there was a difference between professions or level of education: experienced orthopaedic wound care doctors (n=7); nurses specialised in wound care (n=8) and untrained nurses assigned to a diabetic wound care training course (n=23). Krippendorff's alpha was used to calculate interobserver agreement, and an agreement of >0.67 was defined as substantial.Results: The Krippendorff's alpha value for interobserver agreement on the Meggitt-Wagner classification was 0.52 for the doctors group, 0.67 for the specialised nurses and 0.61 for the untrained nurses. The corresponding values regarding agreement on recommendation of surgical revision of the wound were 0.35, 0.22 and 0.15, respectively. The choice of dressing type or antibiotic treatment had even lower interobserver agreement.Conclusions: The interobserver agreement on the Meggitt-Wagner classification was substantial in the specialised nurse group, but the evaluation and treatment of DFUs should not be exclusively based on pictorial materials.</p
