Fundamentos para una ‘Carta por el Derecho a la Ciudad para el Partido de General Pueyrredón’ desde la accesibilidad al patrimonio como Derecho Humano
No full textEl patrimonio arquitectónico urbano, como parte del patrimonio cultural, puede entenderse como el testimonio de la vida de un pueblo, y de esa forma como una herramienta para conocer la historia, los cambios, la evolución de una sociedad y así, defenderla. A la vez, la ciudad y la arquitectura que le da forma a sus espacios físicos reflejan cómo las sociedades se piensan a sí mismas como totalidad y como conjunto de individualidades. El diseño de los espacios condiciona la forma en que las personas se desenvuelven y se vinculan entre sí, prefigura qué actividades se realizarán, dónde, cómo y quiénes podrán participar. Esto sucede tanto de forma consciente como inconsciente y, en ese marco, la ciudad puede convertirse en un factor de inclusión o de segregación (Coriat S. , 2008). Como sostiene Henri Lefebvre (1974), cada sociedad -lo que significa cada modo de producción- históricamente produce y posee su propio espacio. Es por ello que éste siempre es un espacio político, resultado de la lucha de clases, en el que se reproducen y perpetúan (hasta que perecen) las relaciones sociales de producción. En otras palabras, existe una lógica, materializada en el entorno construido, que establece las partes de la sociedad y de hacer visible o invisible a los distintos actores que la conforman, definiendo un orden y la convivencia entre cada una de las partes. Cuando algunos grupos son omitidos como participes activos de la vida urbana, cuando se detectan barreras, ya sean sociales, físicas, comunicacionales o sensoriales, para su desenvolvimiento autónomo y libre, se está vulnerando su derecho a la igualdad establecido en la Declaración Universal de los Derechos Humanos (ONU, 1948) y, puntualmente, su derecho a la ciudad. Este último, entendido como "como forma superior de los derechos: el derecho a la libertad, a la individualización en la socialización, al hábitat y al habitar. El derecho a la obra (a la actividad participante) y el derecho a la apropiación (muy diferente del derecho a la propiedad) están imbricados en el derecho a la ciudad" (Lefebvre, 1968). Como plantea Silvia Coriat (2002), es tanto un desafío como una responsabilidad incluir a todas las individualidades en la noción de persona usuaria del conjunto de espacios y edificios que se diseñan, asumiendo el rol de hacedores/as de un hábitat que acoja a la persona tal cual es, que sea su morada, y actuar en consecuencia. Para esto, la garantía de condiciones de accesibilidad es fundamental, entendiéndola como la condición que deben cumplir los entornos, procesos, bienes, productos y servicios, así como los objetos o instrumentos, herramientas y dispositivos, para ser comprensibles, utilizables y practicables por todas las personas en condiciones de seguridad y comodidad, de la forma más autónoma y natural posible . Mientras esto no sucede ¿para quiénes se piensa y construye la ciudad? ¿a quiénes se excluye? ¿qué representa la falta de accesibilidad al patrimonio arquitectónico en el marco del derecho a la ciudad? ¿cuál es la situación de la ciudad de Mar del Plata? A continuación, se apunta a dar respuesta a los interrogantes planteados, con el fin de fundamentar la necesidad de generar una "Carta por el Derecho a la Ciudad del Partido de General Pueyrredón" como instrumento de lucha y transformación, haciendo énfasis en los aspectos relativos al derecho a la accesibilidad al patrimonio arquitectónico como componente ineludible.Fil: Slavin, Estefanía. Appropriations of Irish drama by modern Korean nationalist theatre : a focus on the influence of Sean O’Casey in a colonial context
No full textMy thesis explores how a translated author on the periphery of the host culture’s
translated repertoire can be at once subversive and innovative on the colonial scene,
using as an example the case of Sean O’Casey in colonial Korea. It explores the
importation of Irish drama in modern Korean theatre during the colonial period and
examines the appropriations of O’Casey’s plays by a central Korean playwright, Yu
Chi-jin, in creating his own plays. Under Japanese colonial rule in the early twentieth
century, intellectuals perceived the supreme task for the Korean people to be the
recovery of national sovereignty and independence. The modern Korean theatre
movement which rose among Korean intellectuals and dramatists during the colonial
period was to play a major part in this task. The ultimate goal of this movement was
to establish a modern national theatre promoting Korean culture and educating the
people, thereby recovering national independence. As their modernised dramatic
polysystem was still "young", Korean intellectuals and dramatists who were
involved in the theatre movement had to borrow dramatic models from other
countries. One of the models they chose was Irish playwrights, especially those who
were involved in the Irish dramatic movement. They published or staged the works
of W.B. Yeats, Lord Dunsany [Edward John Moreton Drax Plunkett], Augusta
Gregory, J.M. Synge, St. J. Ervine, T.C. Murray and Sean O'Casey. Although
O'Casey was considered an important dramatist in the Irish dramatic movement, he
was a playwright on the periphery in the list of translated Irish dramatists in Korea
due to the colonisers’ censorship. However, he remained as a subversive and
innovative playwright on the colonial scene by virtue of being appropriated by Yu
Chi-jin who used O’Casey’s plays as models when creating his own works. In
discussing the subject matter of my thesis, I use Even Zohar’s polysystems theory as
a starting point in looking at ideological issues surrounding translation and extend
the discussion to offer a postcolonial perspective. While most translation in a
colonial context was considered as "an expression of the cultural power of the
colonisers," my thesis shifts the focus to translation as an expression of the cultural
power of the colonised. I explore how the colonised uses another colonised culture to
subvert the colonisers’ power

No full textLos avances de nuestra investigación nos muestran que en Argentina no se cuenta con reglamentación ni bibliografía que contemple el balance necesario para hacer accesible el patrimonio construido de forma apropiada y con la debida sensibilidad: permitiendo el uso y disfrute por todas las personas en igualdad de condiciones e incrementando la apreciación y el reconocimiento de los valores culturales, sociales, económicos y políticos.
Entendemos que para realizar intervenciones acertadas en el patrimonio que garanticen la accesibilidad, es imprescindible un balance entre los requisitos de conservación patrimonial y los lineamientos del diseño universal. Todo ello bajo el marco común de los DD.HH. y trabajando la accesibilidad al patrimonio como medio de inclusión social. La falta de una investigación específica en la Argentina sobre esta temática conduce a respuestas precarias que nada aportan a la conservación del patrimonio ni a la garantía de la accesibilidad.
Ante este panorama, consideramos imprescindible avanzar en la investigación sobre la materia tomando como objeto de estudio bienes valorados de uso público, no solo de escala monumental. Ya sean de propiedad pública o privada, interesan particularmente aquellos edificios que, por su jerarquía y cualidades, albergan funciones de mucha concurrencia en donde la garantía de la accesibilidad cobra gran importancia. Se apunta a hacer un aporte al conocimiento científico y al trabajo profesional desarrollando herramientas específicas que contribuyan a la labor de los especialistas

This paper discusses the fulfillment of hadhanah rights after divorce, which aims to find out how the provisions for children's rights are according to the compilation of Islamic law after divorce, how efforts are made to fulfill the hadhanah rights of minors after divorce according to the compilation of Islamic law and find out how the analysis of decision No. 2184/Pdt.G/2020/PA.Mdn. This type of thesis research uses normative legal research with a qualitative approach method, while the research method used is literature study.(library research)with data collection techniques using secondary data consisting of primary legal materials, secondary legal materials and tertiary legal materials. That the author found in the trial several factors that caused custody of the child to fall to the biological father. The results of this research consist of several factors, namely that the child's mother left her child more than 1 year ago, the mother is currently living with another man and already has a child with that man, while the child's mother has not divorced from the child's father, and all this time the child has been in his father's care. So the panel of judges considers that it is in the interests of the child that the child's education and morals will be better maintained if he remains with his father. Here the author agrees with the judge's decision which states that custody of the child falls to the father. To strengthen the quality and capacity as well as the integrity of families with children, the government is obliged to provide services and training for parents and children
