    Posredovanje u sećanju preživelih prve i druge generacije: Magda Bošan Simin i Nevena Simin "Zašto su ćutale: majka i ćerka o istom ratu"

    The reasons for researching the works of Yugoslav author Magda Bošan Simin are several: (1) her novel "When the Sour Cherries Bloom" (1958) was probably the first literary representation of the Holocaust written by a woman author in Yugoslavia; (2) Bošan Simin represents the Holocaust in multiple formats (documentary prose, memoir, autobiographical novel); (3) the book "Why They Said Nothing: Mother and Daughter on One and the Same War" (2009, English edition 2015) is a narrative comprised of texts written by both Magda Bošan Simin as a Holocaust survivor and her daughter Nevena Simin as a second-generation Holocaust survivor. The research focuses on Holocaust survivors and their post-Holocaust children, issues of memory in Holocaust representation, types of memory, memory mediation, author’s intentionality, and gender and identity issues.Razloga za istraživanja dela jugoslovenske autorke Magde Bošan Simin je nekoliko: (1) njen roman "Kad cvetaju višnje" (1958.) verovatno prvi književni prikaz Holokausta koji je napisala žena autor u Jugoslaviji; (2) Bošan Simin predstavlja Holokaust u više formata (dokumentarna proza, memoari, autobiografski roman); (3) knjiga "Zašto su ćutale: majka i ćerka u istom ratu" (2009, Englesko izdanje 2015) je narativ koji se sastoji od tekstova koje su napisale obe - Magde Bošan Simin kao preživela Holokausta i njena ćerka Nevena Simin kao druga generacija preživele Holokaust.     Autor članka bavi se istraživanjem opusa arhitekta Nevena Šegvića. U trijadi njegova djela – arhitektonski rad, teorijski rad, pedagoški rad – tekst obrađuje problematiku samo prvog segmenta. Primjenom kronološkoga kriterija očitavanja kataloga autor sagledava vrijednost pojedinačnoga djela unutar duktusa cjelovitoga stvaralačkog opusa. Verifikacijom i valorizacijom radova te uspostavom stratifikacije elaborira se teza o postojanju pet problemsko- -razvojnih faza arhitektonskog opusa Nevena Šegvića.This article is a study of Neven Šegvić’s architecture focusing on his architectural achievements as one of the three main subject areas of his work (along with his theory and teaching). The author evaluates each work within the entire collection through a chronological study of catalogues. Through the analysis and assessment of Šegvić’s works and stratification, the author elaborates his thesis of five development stages in Šegvić’s architectural career

    Autor članka bavi se istraživanjem opusa arhitekta Nevena Šegvića. U trijadi njegova djela – teorijski rad, projektantski rad, pedagoški rad – tekst obrađuje problematiku prvog segmenta. Analizom evidentiranih bibliografskih jedinica autor sagledava vrijednost pojedinačnoga djela unutar duktusa cjelokupnoga znanstveno-publicističkog djela. Verifikacijom i valorizacijom izlučnih radova te uspostavom stratifikacije elaborira se teza o postojanju pet problemsko-razvojnih faza teorijskog opusa arhitekta Nevena Šegvića.Within his work on the oeuvre of the architect Neven Šegvić, the author focuses in this paper on Šegvić’s theoretical work, as one of the three main subject areas of his career, the others being architectural design and teaching. The analysis of Šegvić’s bibliography provides a basis for a critical evaluation of each particular work and its positioning within the entire theoretical oeuvre. The analysis is followed by a stratification in which the author identifies five discrete development phases in Neven Šegvić’s theoretical work

    MULTIPLICATION OF CHARACTERS–DUPLETS IN PETRE M. ANDREEVSKI’S NOVEL “TUNNEL”

    This article represents a detailed analysis of the characters’ traits in the novel “Tunnel” by Petre M. Andreevski, published for the first time in 2003 at the Publishing Center “Tri”-Skopje. Regarding the semiotic theory for the literary character, a quite solid determination of the notion of comprehending the characters- duplets (as for the characters- synonyms) was offered. In this interpretative paper the author’s attention precisely remains to character-duplets in the novel “Tunnel” considering quite complex semantic areas for the three characters in it: Igor, Goran Pakovski and Dejan Medarov. Following the narrative program of these three characters it can be noted that they actually are functioning as one actor in regard of the fact that their predicative functions gravitate towards one character which is the novel’s narrator (I-form for narrating) i.e. Nevena. Therefore for the author’s analysis the oppositions (characters- opposites) have core significance to all three characters in terms of the narrator (Igor vs Nevena; Goran Pakovski vs Nevena, Dejan Medarov vs Nevena). As a general conclusion from the characters-duplets analysis in “Tunnel” by Andreevski, the author applies the thesis that those characters in this Macedonian novel are key narrative elements, meaning the characters-duplets are actually the fundament of the narrative structure in the novel by Petre M. Andreevski

    The procedure of involuntary hospitalization of persons with mental disorder in light of the human rights protection standards

    This paper is aimed at analyzing the procedure of involuntary hospitalization of persons with mental disorder. Considering the fact that enforced hospitalization interferes with the fundamental human rights and individual freedoms, the rules of involuntary hospitalization procedure have to provide for the legality of decisions, prevent possible abuses and enable the exercise of legitimate rights and interests of persons with mental disorder confined to treatment in psychiatric institutions. Bearing in mind the significance of the involuntary hospitalization procedure, the author of this paper provides a critical analysis of the national regulation on involuntary hospitalization. The aim of this analysis is to observe whether the rules of involuntary hospitalization procedure comply with the generally recognized international and European standards on the human rights protection of persons with mental disorder, and to identify the shortcomings of the existing mechanism of involuntary hospitalization. Taking into consideration the results of this analysis, the author points to the necessity of reforming the involuntary hospitalization procedure and proposes possible directions for a further improvement of this legal institute

    U ovom radu, autorica se osvrće na Lefebvreovu knjigu Proizvodnja prostora, koja nudi zanimljiv pogled na tradiciju filozofskog ophođenja spram pojma prostora. Unutar ovakvoga prikaza, učenja dvojice istaknutih predstavnika filozofije njemačkog idealizma, Kanta i Hegela, imaju posebno mjesto. Lefebvre nudi dovoljno materijala za artikuliranje moderne povijesti filozofije kao epohalnog prijelaza s problematike vremenitosti na problematiku prostora. Autorica nastoji pokazati u kojem se smislu u ovom kontekstu ističe položaj spomenutih filozofa i to s obzirom na njihovo razumijevanje pojma prostora i njegovog odnosa sa shvaćanjem subjektivnosti. Taj odnos nije vezan isključivo za problem spoznaje, nego ujedno za tematizaciju djelovanja u smislu društvene prakse i političkog karaktera znanja unutar društvene zbilje.In this paper, the author analyses Lefebvre’s book The Production of Space, which gives an interesting perspective on the tradition of the philosophical treatment of the concept of space. Within this framework, two renowned philosophers of German Idealism, Kant and Hegel, occupy a distinguished place. Lefebvre does offer enough material needed for an articulation of modern history of philosophy regarding an epochal change from the problem of temporality towards the problem of space. The author intends to show in what manner is the role and place of those two philosophers distinguished, regarding their understanding of the notion of space and its relation to subjectivity. This relation is not exclusively an epistemological problem, but more importantly, it is tied to the thematising the agency in the sense of social practice and political character of knowledge within social reality

    Legal assumptions and the role of probation in the implementation of alternative sanctions and measures in the Republic of Croatia

    Autorica u radu nastoji dati kratki pregled razvoja probacijskog sustava u Republici Hrvatskoj te uloge probacijske službe u izvršavanju alternativnih sankcija i mjera. Cilj je ovoga rada kroz prikaz pravnog okvira i dosadašnje prakse izricanja i provođenja suvremenih alternativa kaznama, ukazati na njihovu korisnost i pragmatičnost kao najadekvatnijih mjera za određene kategorije kaznenih djela, odnosno određene kategorije počinitelja. Autorica elaborira o pojmovnom određenju alternativnih sankcija i probacije te iznosi njihova diferencijalna poimanja i temeljne postavke. U pogledu regulacije i uređenja alternativnih sankcija i mjera doneseni su brojni dokumenti na međunarodnoj i regionalnoj razini, a koji su poticajno djelovali na zakonodavca u pogledu reforme našeg kaznenopravnog sustava. Prizma organizacijske strukture probacijske službe u RH te probacijskih poslova po pojedinima fazama kaznenog postupka nedvojbeno ukazuje na to da se RH opredijelila za rehabilitacijski pristup u načinu izvršenja sankcija s naglaskom na humanizaciju u pristupu kažnjavanja. Autorica razmatra vrste alternativnih sankcija (u širem smislu) u Republici Hrvatskoj. Rad za opće dobro nametnuo se kao najzastupljeniji od svih probacijskih poslova i zbog toga mu je u radu posvećeno najviše pozornosti. Trend porasta izrade izvješća probacijskih ureda, po zahtjevu suca izvršenja upućuje na rastuće povjerenje sudova u probacijsku službu što je samo jedan od aspekta pokazatelja uspješnosti prakse izricanja i provođenja alternativnih sankcija i mjera. U konačnici autorica daje svoja promišljanja o probacijskom sustavu de lege lata i de lege ferenda. Istraživanje izricanja i provođenja alternativnih sankcija i mjera utemeljeno je na podacima Državnog zavoda za statistiku, Izvješća Državnog odvjetništva RH, Izvješća Glavnog državnog odvjetnika RH te Izvješća o radu probacijske službe.The author tries to give a brief overview of the development of the probation system in the Republic of Croatia and the role of the probation service in the execution of alternative sanctions and measures. This paper aims to outline, through the presentation of legal frameworks and the practice of imposing and implementing alternative sanctions so far, the usefulness and pragmatism of alternative sanctions and measures as the most appropriate measures for certain categories of criminal offences, i.e. specific categories of perpetrators. The author elaborates on the conceptual determination of alternative sanctions and probation and presents their differential notions and basic assumptions. Regarding the regulation and arrangement of alternative sanctions and measures, several documents have been adopted at the international and regional level and had a stimulating effect on the legislator regarding the reform of our criminal justice system. The prism of the organisational structure of the probation service in the Republic of Croatia, as well as the probation work in individual stages of criminal proceedings, undoubtedly indicates that the Republic of Croatia has opted for a rehabilitation approach to the enforcement of sanctions with an emphasis on humanisation in the punishment approach. The author discusses the types of alternative sanctions (in a broader sense) in the Republic of Croatia. Community service has become one of the most represented of all probation works, for which reason, in this paper, the most attention has been given to it. The increasing trend of making probation office reports, at the request of the enforcement judge, indicates the growing confidence of courts in the probation service, which is only one aspect of the success indicators of imposing and implementing alternative sanctions and measures. Ultimately, the author gives its reflections on the probation system de lege lata and de lege ferenda. The study on the imposition and enforcement of alternative sanctions and measures is based on data from the Central Bureau of Statistics, the State Attorney’s Office Report, the Attorney General’s Report, and the Probation Service Performance Report

    LEGAL CAPACITY OF THE CHILD IN SERBIAN LEGISLATION

    In this paper the author provides a critical analysis of the statutory solutions of the the Serbian Family Law 2005 and the Preliminary Draft of the Civil Code regarding the legal capacity of the child. The first part of the paper is devoted to the Childhood and the concept of the evolving capacities of the child in lights of the UN Convention on the Rights of the Child. In the second part of the paper the author critically analyzed the regulations which define the limits of the legal capacity of the child in Serbian legislation in the context of modern trends in the field of the rights of the child.

    Teucrium skorpilii Velenovský (1889: 39) ≡ Teucrium montanum var. skorpilii (Velen.) Diklić (1974: 356) Lectotype (designated here):— BULGARIA. Sliven, mountain Balkan, Tvrdica [m. Tvrdica Balkan], rocky grounds [in saxosis], 1888, Škorpil s.n. (PRC451944!, scan seen; image of the lectotype available at http://herbarium-prc.natur.cuni.cz/jacq-viewer/viewer.html?rft_id=prc_451944&identifiers=prc_451944). Notes:— The name Teucrium skorpilii was proposed by Velenovský (1890) to describe specimens collected by Škorpil in August 1888 on the rocks of Mount Tvrdica (“ Tvrdica-Balkan ”) in Bulgaria. Velenovský (1890) described T. skorpilii as a perennial plant completely covered with dense, more or less long, white-grey, protruding hairs, with toothed calyxes of which three teeth are larger and broadly triangular with abruptly setaceous narrowed tips, and with leaves that are revolute almost to the central vein. The species is close to T. montanum and should not be confused with T. pannonicum and T. parnassicum. The original material is preserved at the herbarium PRC (451944), and it fits with the description provided in the protologue. The label on this specimen is not the original written by Škorpil, the handwriting is of Velenovský. Škorpil sent the herbarium material to Velenovský in the autumn a year before he published the new name (Velenovský 1889), their collaboration and joint field trips in Bulgaria are well documented (Křivka & Holubec 2010). On this specimen there is a revision label by J. Soják stating that the specimen is typus for the name Velenovský published. An additional red label with “ HOLOTYPUS ” was added by a curator of the PRC based on Soják’s note (P. Mraz pers. comm.). According to Art. 9.1. Note 1, if the author used only one specimen or illustration (cited or uncited), when preparing the description of the new taxon, it must be accepted as the holotype. However, the possibility that the author used additional, uncited specimens or illustrations (which may have been lost or destroyed) must always be considered.     Who Would Even Want to Be a Living Karnavol? Tonči Kukoč Bager as the Carrier of the Local Carnivalesquesness

    Pitanje koji su kriteriji odabira nositelja karnevalskoga predstavljanja autorica nastoji rasvijetliti kroz lik Tončija Kukoča Bagera i kroz njegov položaj unutar bolske lokalne zajednice. Pritom o Bageru ne raspravlja kao o osobi izraženih predstavljačkih vještina; govori o liku Bagera, onakvom kakvim ga određuju odnosi unutar zajednice i grupna potreba za figurom koja će grotesknim prerušavanjem kritički preispitati uvriježene svakidašnje norme.An insight into ethnographic and folklore material on Croatian carnival customs leads to the conclusion that attention was seldom paid to the criteria for choosing carriers of transgressive disguising and performance. The author attempts to illuminate this issue in a case study conducted in Bol on the island of Brač, where the leading character is Tonči Kukoč Bager, a man perceived by his fellow townsmen as a person with exceptional inclination for ludicrous performances. In so doing, she does not analyze the personality of Bager as someone owing great presentational skills; she discusses the figure of Bager, as it is determined by relationships within the community and by the group’s necessity for a figure which would occasionally question the border between social order and disorder using grotesque disguise. In the well known narratives about Bager’s “otherness” the author recognizes the means of his exotization within the local community. She analyses the moments which Bager chooses for his performances, and concludes that Bager’s carnivalesque transgressions are not carried out only in the frame of Carnival customs; the comic events in Bol gain their legitimacy by Bager’s performative presence, which sometimes also turns serious segments into parody. Furthermore, the author presents most common Bager’s roles and ways of transformation, with a special emphasis on the gender reversal roles. She shows the construction of Bager into a trademark of Bol, as it is presented in the media discourse. Finally, the author concludes that Bager is needed in the community as much as he needs its members to be his audience; for the people of Bol his performances are a welcome periodical break from the everyday life, a whit of disorder placed within the local “normality”
