Get PDFEsensi suatu penegakan dan keadilan hukum itu adalah terletak pada bagaimana penerapannya dalam praktek di lapangan khususnya dalam pemisahan pembagian tugas dan tanggung jawab dari para penegak hukum dalam suatu peradilan tidak terkecuali dalam sistim peradilan militer. Apabila terdapat fungsi rangkap dalam suatu peradilan maka akan sulit untuk mendapatkan independesi dan keprofesionalan dari aparat hukum tersebut bahkan akan timbul kontradiksi dalam menerapkan kewenangan mana yang lebih dominan dilaksanakan dari kewenangan yang lainnya. Untuk menjawab permasalahan diatas maka rumusan masalah yang diangkat dalam skripsi ini adalah bagaimana kewenangan Oditur Militer sesuai Pasal 64,65 dan pasal 69 sebagai penyidik dihadapkan dengan Pasal 57 dimana juga Oditur Militer sebagai penuntut berdasarkan Undang-Undang Nomor 31 Tahun 1997 tentang Peradilan Militer dan bagaimana proses penuntutan yang dilakukan oleh Oditur Militer terhadap Prajurit Tentara Nasional Indonesia yang melakukan tindak pidana.
Penelitian ini menggunakan metode hukum normatif dengan pendekatan kasus yang dikaji dan dianalisa melalui kajian kepustakaan. Sementara data yang digunakan terdiri dari data primer berupa Undang-Undang dan Peraturan perundang-undangan tentang TNI dan hukum peradilan militer serta hukum dan peraturan perundang-undangan lainnya, sedangkan data sekunder melalui referensi buku-buku yang relevan dengan data primer serta data tertier dilakukan melalui penggunaan kamus hukum dan kamus lainnya yang relevan.
Dari hasil penelitian ini dapat disimpulkan bahwa untuk terciptanya penegakan dan keadilan hukum bagi masyarakat dalam suatu sistim peradilan tidak terkecuali juga dalam sistim peradilan militer agar dilakukan pemisahan yang tegas antara tugas aparat penegak hukum dalam hal sebagai penyidik dan penuntut sehingga diperoleh profesionalisme dan kemandirian yang jelas dalam pelaksanaan tugas dan kewenangan yang dimiliki dari para penegak hukum itu sendiri. Maka tugas dan kewenangan oditur militer sebagai penyidik sekaligus juga sebagai penuntut yang ada dalam pasal 64,65 dan pasal 69 Undang-Undang Nomor 31 Tahun 1997 tentang Peradilan Militer perlu untuk ditinjau ulang atau dilakukan perubahan sehingga tidak terjadi kontradiksi kewenangan bagi oditur militer dalam suatu sistim peradilan militer / The essence of law enforcement and justice lies in how it is applied in practice in the field, especially in the separation of the division of tasks and responsibilities of law enforcers in a court, including in the military justice system. If there is a dual function in a court, it will be difficult to obtain independence and professionalism from the legal apparatus, and there will even be contradictions in implementing which authority is more dominant than the other. To answer the above problems, the formulation of the problem raised in this thesis is how the authority of the Military Auditor according to Articles 64, 65 and 69 as investigators is faced with Article 57 where the Military Auditor is also a prosecutor based on Law Number 31 of 1997 concerning Military Justice and how the prosecution process is carried out by the Military Auditor against Indonesian National Army Soldiers who commit crimes.
This study uses a normative legal method with a case approach that is studied and analyzed through a literature review. Meanwhile, the data used consists of primary data in the form of Laws and Regulations on the TNI and military justice law and other laws and regulations, while secondary data through references to books relevant to primary data and tertiary data is carried out through the use of legal dictionaries and other relevant dictionaries.
From the results of this study, it can be concluded that in order to create legal enforcement and justice for the community in a judicial system, including in the military justice system, a strict separation must be made between the duties of law enforcement officers in terms of investigators and prosecutors so that clear professionalism and independence are obtained in carrying out the duties and authorities of the law enforcers themselves. Therefore, the duties and authorities of the military prosecutor as an investigator as well as a prosecutor in articles 64, 65 and 69 of Law Number 31 of 1997 concerning Military Justice need to be reviewed or changed so that there is no contradiction in authority for the military prosecutor in a military justice system
Going Beyond Counting First Authors in Author Co-citation Analysis

counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed

Get PDF“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
Appropriate Similarity Measures for Author Cocitation Analysis

We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. Note that the objective for the hut study was to evaluate the IRS treatment applications for residual efficacy against Anopheles mosquitoes, including the local An. coluzzii mosquito population. Cows were only used to attract mosquitoes into the huts and no tests were carried out directly on the cows. The author checklist is intended for use with studies where experiments are carried out on animals, which is why we have had such difficulty in completing this for the hut study, as many of the questions do not relate to how the cows were used
