Emer de Vattel on the Society of Nations and the Political System of Europe
No full textThis chapter aims to explain why considering Vattel as a founding father of positivism rests on a misunderstanding. Despite the continuous attention Vattel received in the scholarly literature as well as in the diplomatic and juridical practice, especially in the United States, his legacy remained highly contested ever since his treatise The Law of Nations was first published in 1758. One reason is its indebtedness to the modern natural law tradition but also to Vattel’s originality, mainly due to the significance he attributed to the sovereign state as a free and independent member of the society of nations. Vattel established many dualisms to develop his very broad notion of the law of nations: he applied the law of nations to the ‘political system’ of Europe, which he considered a kind of republic instituted for maintaining order and liberty and founded on the scheme of the balance of power.</p

Konvergenz und regulative Funktion: Parfit über moralischen Fortschritt
Full text linkDieser Beitrag widmet sich der Hauptthese in Derek Parfits On What Matters, dass kantianische, konsequentialistische und kontraktualistische Theorien in der Moralphilosophie richtig verstanden zu gleichen Ergebnissen bei der Beurteilung moralischer Fragen gelangen. Anhand einer Diskussion von Parfits Reformulierung des kontraktualistischen Arguments wird gezeigt, dass die Akzeptanz dieser These entscheidend von einer Akzeptanz des Parfit’schen Gründebegriffs abhängt. Während es On What Matters nicht gelingen wird, diejenigen zu überzeugen, die Parfits objektiv-wertbasierte Gründetheorie nicht teilen, verweist selbst eine schwache Version der Konvergenzthese auf eine weitere wichtige Funktion des Moraldiskurses. Die von Parfit vorgestellte Objektivität und Einheit können dabei als notwendiges Element eines systematischen Moraldiskurses auftreten, der eine kontinuierliche Auseinandersetzung über universelle Normgehalte zum Inhalt hat

Von der historischen Begrifflichkeit der Organisationsgewalt bis hin zur heutigen Europäisierung des Verwaltungsrechts wird immer wieder die Frage zentral, welche substanziellen Aussagen dem Grundgesetz über die Verwaltungsorganisation zu entnehmen sind. David Roth-Isigkeit erarbeitet ein umfassendes Bild davon, welche Akteure im Verfassungsstaat über die Organisation der öffentlichen Verwaltung zu entscheiden haben und an welche verfassungsrechtlichen Maßstäbe sie dabei gebunden sind. Dabei zeigt sich die durchdringende Ordnungskraft des besonderen Verhältnisses von Demokratie und Rechtsstaat in der deutschen Verfassungsdogmatik

Going Beyond Counting First Authors in Author Co-citation Analysis
Full text linkThe present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed
Variations on the Author
Full text link“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
