The vanishing author in computer-generated works: a critical analysis of recent Australian case law
Abstract
The use of software is ubiquitous in the creation of many copyright works, yet the requirement in copyright law that every work have a human author who engages in independent intellectual effort means that its use may prevent copyright subsistence. Several recent Australian cases have refocused attention on authorship as an essential criterion of copyright subsistence, and these cases suggest that much computer-produced output may be authorless and thus lack copyright protection. This article, the first in a two-part series, analyses how each case deals with the question of authorship of computer-produced works and why the use of software diminishes copyright protection for a significant number of computer-generated works. The article critiques the application of conventional notions of human authorship developed in the pre-computer age to modern productions and suggests alternative approaches to authorship that satisfy both the major objectives of copyright policy and the need to adapt to the computer age. The article argues that, without a broader judicial approach to authorship of computer-generated works, Parliament must remedy the lacuna in protection for these ‘authorless’ works. Possible solutions for reform are suggested. In a forthcoming article, the author comprehensively examines those reform proposals

Programa de Pós-graduação em Engenharia QuímicaUm estudo detalhado dos possíveis caminhos da reação do íon cianeto com cloreto de etila em solução de DMSO foi realizado através de cálculos ab initio. A barreira de energia livre encontrada para a formação da nitrila foi de 24,1 kcal/mol, a qual está em excelente concordância com o valor experimental de 22,6 kcal/mol. A formação da isonitrila é menos favorável por 4,7 kcal/mol e o mecanismo E2 é menos favorável por 10 kcal/mol. Como consequência, tanto a formação da isonitrila como a reação E2 não são competitivas com a formação de nitrila. Em um segundo estudo, foi investigada teoricamente a reação SN2 do íon cianeto com um cloreto secundário (isopropila) a fim compreender a diminuição do rendimento da nitrila encontrada experimentalmente quando comparada com de cloretos primários. A barreira de 28,0 kcal/mol encontrada mostra que este processo é cineticamente muito lento, e que a formação da isonitrila em relação à nitrila se torna mais favorável com uma diferença de energia livre de 3,3 kcal/mol. Estes resultados sugerem que tanto a barreira mais elevada quanto a maior competição com formação de isonitrila são os responsáveis pelo menor rendimento neste caso. Na última parte do trabalho, investigamos a ação do primeiro organocatalisador geral de reações SN2, o 1,4-benzenodimetanol (BDM), sobre os sistemas apresentados acima. A atividade catalítica é baseada na formação de duas ligação de hidrogênio entre o catalisador e o estado de transição. O catalisador aumenta a velocidade das reações por um fator de 102. O efeito catalítico sobre a formação da isonitrila é menor em relação à formação de nitrila, de forma que o presente organocatalisador pode ser útil para aumentar a proporção de nitrilas em reações de cloretos secundários

The lived experience of parenting a child with a life-limiting condition: A focus on the mental health realm
Objective: As medical technology has improved, there has been a marked increase in the numbers of children with life-limiting conditions being managed in the community. Few studies have evaluated the life worlds of the parents of these children. However, there have been studies that have reported feelings of isolation and depression among mothers. This article reports a study that highlights the mental health implications of the lived experience of parenting a child with a life-limiting condition.
Method: Semistructured interviews were conducted with 10 parents of children with life-limiting conditions and analyzed using a phenomenological method.
Results: The essential meaning of the phenomenon “the lived experience of parenting a child with a life limiting condition” is understood as a full-time emotional struggle involving six continuous constituents: inner drive, feeling responsible, psychological effects, threatened self image, social withdrawal, and a fear of reaching the bottom line.
Significance of results: Very little clinical attention is focused upon the wider issues that affect parents dealing with caring for a child with a life-limiting condition
Ab initio pair potentials at metal-ceramic interfaces
A systematic approach is proposed to obtain the interfacial interatomic potentials. By inverting ab initio adhesive energy curves for the metal-MgO ceramic interfaces, We derive interfacial potentials between Ag and O2-, Ag and Mg2+, Al and O2-, Al and Mg2+. The interfacial potentials, obtained from this method, demonstrate general features of bondings between metal atoms and ceramic ions
