Get PDFEl objetivo del siguiente trabajo es brindar precisiones sobre la temática de los “grupos de contratos” que se encuentran vinculados por una finalidad idéntica y común a todos ellos la cual no puede ser satisfecha mediante un contrato individual, sino que requiere la confluencia de un número mayor de ellos. Para poder describir con certeza esta situación creemos pertinente enfocarnos en cuatro aspectos: la evolución histórica del fenómeno, sus virtualidades sobre el principio de eficacia relativa de los contratos para arribar, finalmente, a sus dos requisitos de procedencia: el elemento objetivo dado por la pluralidad de contratos independientes y el elemento subjetivo representado por la finalidad económica común.
The purpose of the following paper is to provide clarifications on the topic «groups of contracts» that are linked by an identical and common purpose to all of them, which cannot be satisfied by means of an individual contract but requires the confluence of a larger number of them and their reception as a category in the Argentine Civil and Commercial Code. In order to describe this situation accurately, we believe it is appropriate to focus first on two aspects, such as the historical evolution of the phenomenon and its incidence on the principle of relative effectiveness of contracts; to arrive, finally, at two requirements: the objective element, given by the plurality of independent contracts, and the subjective element, represented by the common economic purpose.Fil: Raschetti, Franco. Going Beyond Counting First Authors in Author Co-citation Analysis
Get PDFThe present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed
Variations on the Author
Get PDF“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
Appropriate Similarity Measures for Author Cocitation Analysis
Get PDFWe provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. juez dentro del marco de un proceso judicial de consumo resulta un elemento fundamental. Dicho rol judicial se nutre de determinados aspectos de la disciplina de defensa
del consumidor y del usuario que le imprimen a la tarea judicial un perfil activista,
comprometido y proactivo.
Tal exigencia se funda en el especial cariz que tienen los derechos individuales
o colectivos involucrados ya que éstos gozan de jerarquía constitucional. Asimismo, la
asimetría jurídica y negocial entre el consumidor y proveedor impone una especial valoración de las soluciones legales establecidas en clave de permitir un goce efectivo del
acceso a la justicia como así también la necesidad de reinterpretar reglas procesales ya
existentes o de sanear la insuficiencia o deficiencia de la regulación.Abstract:
In order to achieve efficiency in the protection of consumers and users, the role
of the judge within the framework of a consumer judicial process is a fundamental element. This judicial role is nurtured by certain aspects of the discipline of consumer and
user protection that give the judicial task an activist, committed and proactive profile.
This requirement is based on the special nature of the individual or collective
rights involved, since they enjoy constitutional hierarchy. Likewise, the legal and business
asymmetry between the consumer and the supplier imposes a special assessment of the
legal solutions established in order to allow an effective enjoyment of access to justice as
well as the need to reinterpret existing procedural rules or to remedy the insufficiency
or deficiency of the regulation
Dispelling the Myths Behind First-author Citation Counts
Get PDFWe conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued
use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation
counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases. No full textResumen: La propia estructura de la garantía conduce a considerarla como un contrato aleatorio ya que las partes contratantes no tienen certeza al momento del perfeccionamiento del contrato de la medida de sus ventajas o pérdidas toda vez que para la puesta en marcha de la fianza, y en base a la subsidiariedad de la misma, debe configurarse previamente el incumplimiento del derecho garantido por parte del deudor, extremo que, primero, no se conoce si sucederá o no; y, segundo en caso de acontecer, es imposible prever la entidad del mismo ya que puede ser de carácter total o parcial. Los efectos prácticos de esta calificación no son menores ya que institutos como la teoría de la imprevisión y la lesión reclaman para su aplicación en los contratos aleatorios que la configuración de los mismos impliquen una entidad mayor o extraña al alea contractual que las partes han asumido al vincularse jurídicamente. Creemos que dicha aleatoriedad no sólo sea medida para estos dos institutos, sino que también puede constituir una herramienta de interpretación e integración del contrato

No full textWe have done our best to complete the author checklist relating to the use of animals in the hut study. Note that the objective for the hut study was to evaluate the IRS treatment applications for residual efficacy against Anopheles mosquitoes, including the local An. coluzzii mosquito population. Cows were only used to attract mosquitoes into the huts and no tests were carried out directly on the cows. The author checklist is intended for use with studies where experiments are carried out on animals, which is why we have had such difficulty in completing this for the hut study, as many of the questions do not relate to how the cows were used
