The right of compensation to the HIV victim in Malaysia: an analysis from the case of Abd Rahim bin Abd Rahman v public prosecutor
Get PDFIn a criminal trial, the stature of the victim is only limited to being a witness or purveyor of evidence. Issues concerning the victim of a crime normally concern the punishment of criminals. Inevitably, the victim’s interest as the aggrieved party has not been properly taken care of. For instance, the court in seeking justice would award the appropriate punishments or sentences to the accused whilst neglecting or overlooking the
aspect of ‘curing’ or ‘relieving’ the victim’s pain and suffering from the criminal act. In
relation to HIV transmission in sexual offences, one may suffer a lifetime ‘pain’ mentally,
physically and emotionally. In addition, economically one would further have to bear medical costs and expenses. Thus, the court in carrying out justice may both compensate the victim and punish the offender simultaneously. In line with the above scenario, this paper seeks to
analyse the case of Abd Rahim Bin Abd Rahaman v Public Prosecutor with regard to the Court’s effort in affirming the seriousness of the HIV transmission in sexual offences. The finding shows that section 426 of the Criminal Procedure Code allows the court to make an order for the payment of compensation to the victims subject to the application made by the Public Prosecutor. The case of Abd Rahim however did not discuss the issue of compensation in depth. As a concluding suggestion, the Public Prosecutor in assisting the Court to delivering justice should also address the issue of compensating the victim by invoking
section 426 of the Criminal Procedure Code (Act 593)

No full textAbdurrahim Reyhan, Erzincan'da yetişmiş, İstanbul'da bulunmuş ve orada vefat ettikten sonra Erzincan Terzi Baba Mezarlığına defnedilmiştir. Kendisi Nakşibendiyye Tarikatı Haldîyye Kolu'nun Teveccüh icazetine sahip önemli bir şahsiyettir. Çağdaş mutasavvıflardan olup tasavvufi anlayışını ortaya çıkmasına vesile olması için böyle bir çalışma hazırlanmıştır. Tezimiz, bir giriş, iki bölüm ve bir sonuçtan oluşmaktadır. Çalışmamıza temel kaynak olarak, Reyhan Efendi'nin başta olmak üzere kaleme alınmış dört ciltlik tasavvuf sohbetleri "Gülden Bülbüllere", "Teveccüh Sohbetleri" ve hayatı hakkında yapılan röportajlardan istifade edilmiştir. Girişte, Abdurrahim Reyhan'nın yaşadığı devrin siyasî, dinî ve tasavvufî ortamı hakkında özetle bir bilgi verildikten sonra kullanılan kaynaklar hakkında kısa bir değerlendirilme yapılmıştır. Birinci bölümde Abdurrahim Reyhan'nın nesebi, gençliği, şahsiyeti, çocukları, hocaları, silsilesi, halifeliği ve vefatı gibi hususlar konu edilmiştir. İkinci bölümde, Abdurrahim Reyhan'nın tasavvufî kavramlara yaklaşımı incelenmeye tahsis edilmiştir. Burada İbadetlere genel bir bakışı ardından seyr u sülûk'la ilgili kavramlardan cihad, sabır, bela, terk, şuğul, teslim, tevazu, takva, vuslat, râbıta, hizmet, cezbe, gaflet, irşat, ruh-nefs, kalp, kabz-bast, aşk, şeyh-mürşit-veli ve teveccüh başlıkları altında ayrı ayrı ele alınmıştır. Kavramların Kur'an ve Sünnette nasıl geçtiği izah edildikten sonra bazı mutasavvıfların bu kavramlara yaklaşımı ile Reyhan Efendi'nin görüşleri incelenerek verilmiştir. Sonuç kısmında ise Abdurrahim Reyhan'nın tasavvuf görüşleri hakkında genel bir değerlendirme yapılmıştır
Abd al-Rahim Reyhan, grew up in Erzincan, and also lived in Istanbul and was buried in Erzincan Terzi Baba Mezarlığı. He is an important figure in the Haldîyye school of the Naqshbandiyya Sect, with a permisson for "Teveccüh". This study has been prepared in order to reveal one of the modern sufists and his understanding of Sufism. This thesis consists of an introduction, two chapters and a conclusion. We benefited for our study as the main source, the four volumes of Reyhan Efendi's Sufi sohbets, wich were written by his students especially of, "Gülden Bülbüller", "Teveccüh Sohbetleri" and interviews about his life. At the introduction, after a summary information about the political, religious and mystical environment of the period where Abd al-Rahim Reyhan lived, there was also a brief evaluation made about the resources wich were used. In the first part were issues related to the subjects such as the purpose, youth, personality, children, teachers, caliphate and death of Abd al-Rahim Reyhan. In the second part, Abd al-Rahim Reyhan's approach to sufi concepts is devoted to analysis. Here, after a general view of his understanding of worshipping and the concepts related with seyr u sülûk are discussed separately. After explaining how the concepts passed in the Qur'an and Sunnah, the views of Reyhan Efendi were given by examining the approach of some other sufis to these subjects. And in the conclusion, a general evaluation has been made about the Sufi views of Abd al-Rahim Reyha
