Lombardo Radice’s serene school as his link to idealism
The contribution intends to illustrate Lombardo Radice’s ties with idealism and specifically with the Gentile heritage, starting from the reflection on didactics carried out by the Sicilian educationist. In this way, the 1923 reform isn’t a simple legislative update, but takes on the dimension of a broader educational project and at the same time certifies a considerable depth of thought. The reform becomes the application of a peculiar Italian way to New Education, of which Lombardo Radice is specifically the author. This Italian way to New Education, while dialoguing with international suggestions, draws its roots from a different terrain, the one that goes from Vico to Croce and Gentile. The analysis of the Lombardo Radice’s didactics in this view allows us to understand similarities and differences between the Italian way to New Education and the international movement, shedding more light on the figure of Lombardo Radice as one of Italy’s leading educational theorists

Informazione di garanzia
Il contributo intende offrire un’analisi dello strumento istituzionalmente deputato ad informare la persona sottoposta alle indagini dello svolgimento di un complesso di attività dirette al potenziale esercizio dell’azione penale nei suoi confronti, onde consentire alla stessa l’esercizio del suo diritto di difesa nel corso del procedimento penale: l’informazione di garanzia disciplinata dall’art. 369 c.p.p.
L’indagine muove dallo studio dei c.d. antenati dell’informazione di garanzia, sorti in vigenza dell’abrogato codice Rocco, quali l’avviso di procedimento e la comunicazione giudiziaria, per poi affrontare l’istituto di cui all’art. 369 c.p.p. del vigente codice di procedura penale.
L’analisi dell’informazione di garanzia viene, peraltro, condotta senza trascurare il percorso evolutivo dell’art. 369 c.p.p., e la modifica dell’originario tenore letterale della disposizione, operata dalla l. 8 agosto 1995, n. 332 che ha spostato in avanti il momento in cui il pubblico ministero è tenuto all’invio dell’informativa, alimentando, peraltro, il dibattito sulla reale utilità dell’istituto in commento.
Il contributo conduce, dunque, un articolato esame dell’istituto: in particolare, costituiscono oggetto di un approfondito studio i profili concernenti i presupposti dell’informazione di garanzia, il suo contenuto, le modalità di invio, i destinatari della stessa e il regime sanzionatorio connesso alla sua eventuale violazione. L’analisi dei presupposti dell’informativa ex art. 369 c.p.p. investe, peraltro, anche la tematica dei c.d. equipollenti dell’informazione, nonché la questione dei tempi dell’inoltro dell’informativa allorquando debbono essere compiuti dal pubblico ministero i c.d. atti a sorpresa (sequestri e perquisizioni).
Infine un’attenzione particolare è dedicata al complesso rapporto tra l’attuale fisiologia dell’informazione di garanzia e i principi del giusto processo: siffatto confronto è condotto non solo alla luce dell’art. 111 Cost. e dell’art. 6 della CEDU, ma anche ponendo il menzionato istituto sotto la lente di ingrandimento della direttiva 2012/13/UE del Parlamento europeo e del Consiglio sul diritto all’informazione nei procedimenti penali che, peraltro, porrà al legislatore italiano non pochi problemi in sede di recepimento

Les sermons sur saint Antoine et le bon usage de la prédication comme "vertu"
Saint Anthony of Padua's activity as a preacher is reknown to have been one of the reasons for his fame of holiness.
After having focused on the hagiographical legends on the saint of Lisbon passages referring to preaching as a virtue or a gift of the Holy Grace, the author points out the importance of Iulianus de Speyer's works in the spread of this identification. Passing to sermons, the article passes through a series of ctexts written between about 1250 and 1350. Especially, the author tries to contextualize the sermons referring to saint Anthony's wisdom as preaching within the large and mostly unpublished homiletic production of sermon for the liturgical feast of the Portuguese saint and she seeks to shed light on the identification of recta et fructuosa praedicatio (right and fruitful preaching activity) with saint'Anthony's wisdom (sapientia) or science (scientia). Thus, the persistence of this type of message is revealed within a relatively broad time span -although it's testified only by a selected number of witnesses -, since the Eighties of the thirteenth century onwards. There is also evidence of cross-disciplinary problem, which seems to involve not only the preachers belonging to the Order of Friars Minor, but also those who were called to preach them from outside the Order.
Having examinated of the texts, the author proposes three possible reading keys to explain the appearance of preaching on the list of virtues in a more or less explicit way. It may have been originated by a phenomenon linked to the attempted assimilation of contemporary preachers with the model of holiness provided by saint Anthony or by an attempt to create a counterbalance to the increasingly defined vices of the tongue which were supposed to affect preachers' audience, or, again, it may be an indicator of a more general debate on praedicatio as a gift of Holy grace in opposition to those who believed it was the mere result of a studied technique

Sull’asse Bologna-Padova-Venezia: un’inaspettata relazione fra Pietro Lombardo e Marco Zoppo
The article sheds light on the relationship between the oculi on the pediment of the polyptych by Marco Zoppo at the Collegio di Spagna in Bologna, and those carved by Pietro Lombardo for the pendentives of the cupola of the presbytery of San Giobbe in Venice. After noting how unlikely it would be that these solutions might be linked to a single prototype that has now been lost, the author sets out the circumstances that would have made it possible for Lombardo, whose oculi are of later date than those of Zoppo, to have seen the Collegio’s polyptych. Other works by Lombardo demonstrate that, at a time when both artists were living in the Venice area, he maintained a certain amount of attention to what Zoppo released. Zoppo, for his part, without having any particular partiality for Lombardo’s production, was nevertheless regularly compared to the highest-level sculptural works of the day
