The essay focuses on the effects of an opposition to an order for payment brought before an incompetent judge. Particularly, the question rises – in the two cases examined – as a result of the restyling to the Italian judicial structure carried out by d.Lgs 7 september 2012, n. 155. Before the intervention of the lawmaker on this point, the abolition of some secondary seats of first instance courts and the merging of others, engendered doubts as to the choice of the court to be seised for such oppositions. However, the courts seised of the dispute declared themselves incompetent, thus choosing the most severe sanction of inadmissibility for the opposition in question: the Author, therefore, takes the opportunity to examine the jurisprudential and doctrinal views on this point, turning her attention also to the appeal system, which undoubtly has many features in common with opposition to an order for paymen
Artificial intelligence applied to the analysis of paintings: between false myths and new perspectives
The idea of using Artificial Intelligence for art diagnostics is nothing new. Until now, however, its application has been bent, almost exclusively, to the utopian certification of the authenticity of works of art, claiming to replace human sensitivity in the recognition of stylistic traits with automation. This methodological approach is flawed as it is unable to respond to the human variable with which each work of art was created. The use of Artificial Intelligence, however, is functional to the analytical investigation of diagnostic factors that, if read by the human eye, can give rise to unnecessary and misleading interpretations: in particular, a systemic and automatic reading of the results in False Colour, can return a true and complete reading of the pigments that make up the surface of a painting. This investigation methodology, devised by the author of the article and based on a system of three different algorithmic methods, was tested on approximately three hundred paintings, whose colour palette was also checked using traditional spectrographic techniques
Regulation 1234/2007 of the European Council of 22 October 2007 establishing the common organisation of agricultural markets and certain food products, together with Regulation 1151/2012 of the European Parliament and the Council of 21 November 2012 on the systems of agricultural and food products quality enabled extension of the protection of products using such protective instruments as Protected Names of Origin or Protected Geographical Indications. As is shown in the paper, apart from the similarity in the very concept of those instruments, in practice they frequently coexist in the same territory. Moreover, they are sometimes used to protect the same product (e.g. olive oil from the province of Jaén in Spain). This often leads to legal disputes between producers, mainly in Spain and Italy. The author suggests that in order to eliminate the problem, three conditions should be satisfied: the territory protected by protected names of origin should be within the territory
protected by geographical indications, the products protected by protected names of origin should be protected by geographical indications, and most importantly, a product should be first protected by geographical indications before it is included among products protected by the protected names of origin.
2011 - 2012Many studies have emphasized the deep relationship that links the motor coordination and some
skills crucial for academic performance such as writing, arithmetic, music, etc.. Some authors such
as Piagets (1952) and Montessori (1950), have claimed that the sensory-motor abilities was
functional to the development of thought and intelligence. The importance of the relationship
between the integration of sensory inputs and motor actions has given rise to large number of
researches that have demonstrated how it is a necessary function not only for good academic
performance but also for a proper development of the organizational thinking. To the ability of
sensory-motor integration is today recognized a central role in the integral formation of the subject
(Viviani, Stucchi 1992). The Italian National Guidelines for the curriculum of primary school of
2007 require the achievement of motor skills related to visual motor coordination as one of the
goals for skill development at the end of primary school, measurable through a different use of
evaluation tools.
Among the several motor assessment tests recognised by the international scientific community,
the VMI Developmental Test of Visual-Motor Integration (Beery & Buktenica, 2000),Bender
Gestalt Test, Tpv test, Abc Movement represents a valid instruments of assessing the motor
coordination skills and their constitutive elements. The aim of the research has highlighted the
importance of an use of motor evaluation assessment in the nursery and primary school that is
required to bring out potentialities and plurality of limits of each pupil, which are essential for
effective customized teaching planning of educational activities.
